Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name)
roof covering" is required to be on site at the time of final inspection.
Midroof & Final Roof inspections for ROOFS 6/12 PITCH & OVER: 3rd party inspection will be
required, the 3rd party inspection report AND THE ORIGINAL PERMIT CARD needs to be dropped
off to the Permit Desk at the City of Wheat Ridge. The report MUST BE SIGNED by the
Homeowner.

subject to the compliance with those documents, and all applicable statutes, ordinances, regulations, policies and procedures.
2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the original ermit fee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to the standard
requirements, fees and procedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief Building Official and is not guaranteed.

Residential Roofing Permit Application
This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received and due to the volume of requests, time to process
varies and is subject to change. YOU WILL BE CONTACTED WHEN YOUR
PERMIT IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE
AND TIME WINDOW TO COMPLETE THE TRANSACTION. You will be notified if
your contractor's license or insurance has expired, and you may update those
documents at the time you are issued your permit.
For all other requests:
Homeowners wishing to obtain a roofing permit must apply for the permit in person
at City Hall. Revisions to existing permits (for example, to add redecking) must be
completed in person at City Hall. All other non -roofing permits must be completed in
person at City Hall. The Building Division will be open from 7:30-10:30 a.m.,
Monday through Friday to process these types of requests.

If initialed by buyer, then the contract price is contingent upon insurance approval; and buyer is only
responsible for his/her deductible. When the insurance carrier agrees to pay the claim for damage to the property, then the
buyer agrees to allow Elk Construction to perform all repairs prescribed by the insurance company's adjuster report. By
reference, said adjuster's report and estimate becomes and here is part of the contract.
ACCEPTANCE OF PROPOSAL: The above prices, specifications and conditions are satisfactory and are hereby accepted.
You are authorized to do the work specified. This contract may be subject to approval by company owner. Payment will be
made upon completion or as outlined below. This is a legal binding contract when approved by your signature below. By
state law you have 72 hours to cancel and receive a full refund of deposit. If the property owner plans to pay for the roofing
services through an insurance claim, Elk Construction cannot pay, waive or rebate the homeowner's insurance deductible in
part or in whole. Elk Construction shall hold in trust any payment from the property owner until Elk construction has
delivered the roofing materials to the jobsite or has performed a majority of the roofing work on the property The
property owner may rescind a contract for services, the payment for which shall be made from the proceeds of a property
insurance claim, within 72 hours after receiving notice from their insurer that a claim is denied in whole or part. Al checks

ADDITIONAL PROVISIONS- Unless otherwise specified herein, the following additional provisions are expressly incorporated into this contract
1 All material is guaranteed to be as specified. All work is to be completed in a workmanlike manner according to standard practices. Any alterations or additions, verbal or written, to
the specifications above involving extra costs will be charged above the estimate. All pictures and loose objects should be secured prior to roof installation. Owner agrees to carry his
own property owner and content insurance, and agrees not to hall the company liable for, any act of God, Rain or Wind Stones, Lightning, or other events out of our control. The
company is not responsible for any damages to hidden or concealed water, gas, electrical, etc., utility lines, internal structure of the building, sagging, or movement of internal
substructure during or after roof is installed. The company will have no responsibility for curing any structural deficiencies in the property that are in existence prior to the
commencement of the work. (Le. decking, rafters, etc.) Roof deck replacement not included will only be added if required and with homeowners approval at $1.25/sq.ft (approx.
$3914'x8' sheet)
2 Contractors Right To Cancel Owner understands that final approval of this contract rests with Contractor and Contractors installation and estimation departments. In the event this
contract is not approved by Contractor, any payment made hereunder shall be refunded to Owner and this contract shall be null and void and of no effect Contractors
commencement of work as scheduled or Contractor's signature herein shall constitute approval of this contract by Contractor.
3 Contract, Plans, Specifications, Permits and Fees. The work described in this contract shall be done according to the plans and the pan specifications (if any) except in the case of
conflict when the provisions of this contract shall have control over both the plans and the plan specifications. All required building permits will be paid for by owner and obtained by
Contractor. All other charges, taxes, assessments, fees etc., of any kind whatsoever, required by any government body, telephone or utility company or the like shall be paid for by
Owner.
4 Installation. Contractor has the right to subcontract any pad of, or all of, the work herein.
5 Change Orders. Should Owner, construction lender, or any government body or inspector require any modification to the work covered under this contract, any cost incurred by
Contractor shall be added to the contract price as extra work and Owner agrees to pay Contractor his normal selling price for such extra work. All extra work as well as any other
modifications to the original contact shall be specified and approved by both parties in a written change order. All change orders shall become a part of this contrail and shall be
incorporated herein.
6 Owners Responsibility. Insurance etc. Owner is responsible for the following: (1) to see that all necessary water, electrical power, access to premises, and toilet facilities are provided
on the premises. (2) to provide a storage area on the premises for equipment and materials. (3) to relocate and protect any Rem that prevents Contractor from having free access to
the work areas such as but not limited to TV or radio antennas, vehicles, tools or garden equipment. In the event that Owner fails to relocate such items, Contractor may relocate
these items as required but in no way is Contractor responsible for damage to these items during their relocation and during the performance of the work. (4) to obtain permission
from the owner(s) of adjacent property(los) that Contractor must use to gain access to the work areas. Owner agrees to be responsible and to hold Contractor harmless and accept
any risks resulting from the use of adjacent property(ies) by Contractor. (5) to correct any existing defects which are recognized during the course of the work. Contractor shall have
no liability for corectng any existing defects such as, but not limited to, dry rot, structural defects, or code violations. (6) to maintain property insurance with Fire, Course of
Construction, all Physical Loss with Vandalism and Malicious Mischief clauses attached, in a sum at least equal to the contract price, prior to and during performance of this contract.
If the project is destroyed or damaged by an accident, disaster or calamity, or by theft or vandalism, any work or materials supplied by Contractor in re-roofing or restoring the project
shall be paid for by Owner as extra work.
7 Delay. Contractor shall not be held responsible for any damage occasioned by delays resulting from: work done by Owners subcontractors, extra work, acts of owner or owners
agent including failure of owner to make timely progress payments or payments for extra work, shortages of material and/or labor, bad weather, fire, strike, war, governmental
regulations, or any other contingencies unforeseen by Contractor or beyond Contractors reasonable control.
8 Surplus Materials and Salvage. Any surplus materials left over after this contract has been completed are the property of Contractor and will be removed by same. No credit is due
Owner on returns for any surplus materials because this contract is based upon a complete job. All salvage resulting from work under this contract is the property of Contractor.
9 Cleanup & Advertising. Upon completion, and after removing all debris and surplus materials, wherever possible, Contractor will leave premises in a neat broom dean condition. Any
debris consisting of dust, dirt, asphalt, or small bits of materials that settle into attics, garage areas, or any other area being worked over with open beam ceilings or no attic, is
unavoidable and Contractor shall not be responsible for this cleanup. Contractor recommends that Owner lay out drop cloths to protect such areas wherever owner discovers debris
infiltration. Owner hereby grants to Contractor the right to display signs and advertise at the job site for the period of time starting at the date of signing of this contract and continuing
uninterrupted until fourteen (14) days past the date the job is completed and payment in full has been made. Owner grants Contractor the right to publish the project street address on
a'references' list which may be given to prospective customers.
10 Concealed damage & dry rot. Contractor will inform Owner of any dry rot or other sub-roof deterioration which is concealed and is discovered during the course of the work.
Contractor is not responsible to repair any such discovered deterioration and any work done by Contractor to remedy such discovered deterioration will only be done as extra work in
a written change order.
11 Termites, Pests & Hazardous Substances. Owner understands that Contractor is not qualified or licensed as an inspector or abatement contractor for Hazardous Materials (as defined
by the government), or for Pests (including Termites). Should any such hazardous substances or Pest be suspected to be present on the premises, it is the Owners' responsibility to
arrange and pay for inspecton and abatement Contractor cannot certify or warrant your building as being free of hazardous substances or pests.
12 Right to Stop Work and to Withhold Payment on Labor and Materials. If any payment is not made to Contractor as per this contract Contractor shall have the right to stop work and
keep the job idle until all past due progress payments are received. Contractor is further excused by Owner from paying any material, equipment and/or labor suppliers or any
subcontractors (hereinafter collectively railed 'suppliers'), during the period that Owner is in arrears in making payments to Contractor for bills received during that same period. If
these same 'suppliers' make demand upon Owner for payment, Owner may make such payment on behalf of Contractor and Contractor shall reimburse Owner for this amount at
such time that Owner becomes current with Contractor for all past due payments. Owner is responsible to verify the true amounts owed by Contractor to these same'suppliers', prior
to making payment on behalf of Contractor. Owner shall not be entitled, under any circumstances, to collect as reimbursement from Contractor any amount greater than that exact
amount actually and truly owed by Contractor to these same 'suppliers", for work done or materials supplied on Owners job.
13 Legal Fees. In the event litigation or arbitration arises out of this contract prevailing party(ies) are entitled to all legal, arbitration, and attorney fees. The court or arbitrator shall not be
bound to award fees based on any set, fee schedule but shall if it so chooses, award the true amount of all costs, expenses and attorney fees paid or incurred.
14 Arbitration of Disputes. Any controversy or claim arising out of or relating to this proposallcontract or the breach thereof, shall be settled by arbitration in accordance with the
applicable Construction Industry Arbitration Rules of the American Arbitration Association which are in effect at the time the demand for arbitration is filed. A judgement upon the award
rendered by the arbitrators) may be entered in any court having jurisdiction thereof. Any arbitration award shall be subject to correction and/or vacation for the reasons stated in the
law. The arbitrator shall award reasonable attorneys fees and expenses to the prevailing party. After being given due notice, should any party fail to appear at or participate in the
arbitration proceedings, the arbitrator shall make an award based upon the evidence presented by the party(ies) who do (does) appear and participate. Notwithstanding Contractors
right to arbitrate, Contractor does not waive any of its lien rights.
NOTICE: By initialing in the space below you are agreeing to have any dispute arising out of the matters included in the 'arbitration of disputes provision decided by neutral
arbitration as provided by law and you are giving up any rights you might possess to have the dispute litigated in a court or jury trial. By initialing in the space below you are giving up
your judicial rights to discovery and appeal, unless those rights are specifically, included in the 'arbitration of disputes' provision. If you refuse to submit to arbitration after agreeing to
this provision, you may be compelled to arbitrate under the authority of the applicable laws. Your agreement to this arbitration provision is voluntary.
We have read and understand the foregoing and agree to submit disputes arising out of the matters included in the'arbitraWn of disputes' provision to neutral arbitration.

15 Our standard payment terms are as follows if not specified above: A. 33% upon acceptance of contract, 33% upon completion of prep work or delivery of material, final payment due
upon completion. B. 50% of upon delivery of materials, 50% upon completion. Make all checks payable to Elk Construction.
16 Homeowner is responsible for Homeowners Association approval of roofing products and colors.
17 Homeowner acknowledges Elk Construction as a General Contractor and as such will be entitled to 10% overhead and 10% profit R approved by insurance company as part of the
claim.
18 Past due accounts are defined when all work has been completed by Elk Construction as defined by this contract (f applicable) insurance claire has been completed by release of
final check and 30 days have passed, earn interest at 10% per annum (per month) and in addition if Elk Construction is required to tum the matter to an attorney for collection, the
homeowner also agrees to pay all costs incurred including reasonable attorney fees.
19 Should defauh be made in payments of this contrail Elk Construction reserves the right to place a mechanic's lien on the contract property.
20 Our standard workmanship warranty for roofing is (10) years and (1) year for all other work and is transferable. Warranty applies to complete installation of new composition roofs with
at least a 4/12 pitch. Any roofs under 4112 pitch are warranted for a period of one year from date of installation. Warranty covers 100% of material and labor for the first year after
installation. In years 2-10 there will be a fifty dollar deductible for any repairs.
21 The company is not responsible for any leaks or water damage below the roof line including excessive wind, ice or hail during the warranty period.
22 If this contract is cancelled by the customer after three (3) days of execution, the customer agrees to pay the company 20% of the contract price as liquidated damages, not as
penalty, but as fair compensation for services to that point
23 Should defau8s be made in payment of this contract a mechanic's lien will be placed upon the property.
24 The company will not be held responsible for sight scratching or denting of gutters, oil droplets in the driveway, cracks in concrete or molding or stucco, deteriorated solar panels,
evaporative coolers and existing skylights or any interior damage such as falling dust and debris, cracked plaster, sheetrock or nails pops as a result of re-roofing.
25 The company is not responsible for any damages to hidden or concealed water, gas, electrical, etc., utility lines, internal structure of the building, sagging, or movement of internal
substructure during or after roof is installed.
26 If material has to be reordered or restocked because of a cancellation by the customer, there will be a restocking fee equal to twenty percent (20%) of the centrad price.

The meeting was called to order by Chair BLAIR at 7:30 p.m. in the Council
Chambers of the Municipal Building, 7500 West 290' Avenue, Wheat Ridge,
Colorado.

The following is the officia] set of Boazd of Adjustment minutes for the public
hearing of August 26, 2004. A set of these minutes is retained both in the office
of the City Clerk and in the Community Development Department of the Ciry of
VJheat Ridge.

No one indicated a desire to speak at this time.
4. PUBLIC HEARING
A. Case No. WA-04-04: An application filed by Manuel and Heidi Marfil
~ for approval of a 3-foot front yazd setback variance from the 30-foot &ont
yazd setback requirement resuldng in a 27-foot froni yard setback for
property zoned Residential-One A and located at 2900 Webster Street.
1'he case was presented by Jeff Hirt. He advised the Board there was jurisdiction
to hear the case. He entered all pertinent documents into the record which were
accepted by Chair BLAIR. He reviewed the staff report and digital presentation
and explained that, due to the fact this request is for a 10% or less variance, this
request could have becn appmved administratively. However, since two relevant

letters of objection were received, the code requires the case to come before the
Boazd of Adjustment. Staff recommended approval of the variance for reasons
outlined in the staff report.

Mrs. Marfi1, the applicant, was sworn in by Chair BLAIR. She stated that the
existing single caz garage will not accommodate their vehicle (a pickup truck with
extended cab) because the fueplace chimney juu into the garage and the garage is
too small. They wish to add an attached gazage which would allow room to pazk
their vehicle and leave room for her husband to exit the vehicle and enter the
house without having to go outside in the elemenu. Her husband is totally blind
and has fallen on the ice wtule walking outside from the vehicle into the house.
The gazage would eluninate the necessity of pazking their extended cab pickup
truck in the driveway. She stated that pazking the truck in the driveway presents a
greater hindrance to the neighbor's view of the pazk than would the proposed
garage (as this pertains to one of the letters of objection).

Mr. Mentgen, builder for the applicant, was swom in by Chair BLAIR. He
submitted photographs into the record for the Board's review. He stated that
several options were reviewed for the proposed gazage. The garage could not be
extended towazd the back because of an existing swimming pool and a side-load
garage would not provide sufficient huning radius for the truck. The most
desirable location for the garage necessitates the need for a 3-foot variance.
In response to a question from Boazd Member ABBOTT, Mr. Mengten explained
that inierior access is planned from the new garage into the old garage which will
be renovated into a laundry and mud room. He also explained that once the
garage is built, the entire house and garage would be finished with traditional
stucco.
In response to a question from Boazd Member MOLNAR, Mr. Mentgen stated
that no consideration has been given to removing the above-ground swimming
pool in order to make room for the garage.
In response to a question from Board Member HOWARD, Mr. Mentgen stated
that he has planned to build a three-caz garage in order to allow sufficient room
for Mr. Marfil to have a clear path into the house and allow storage space for lawn
equipment, etc. There would also be space for a second car.
Chair BLAIR asked when staff became awaze of the applicanYs plans to build a
three-car garage. Mr. Hirt stated he was not aware of those plans until this

meeting; however, there is sufficient room to build a 3-caz gazage within the
required side yazd setbacks.
In response to questions from Boazd Member ABBOTT, Mr. Mentgen and the
applicant stated that they would be willing to leave the third bay of the gazage
within the 30-foot setback.
Chair BLAIR asked if there were any present who wished to address the Board.

Ms. Croom was swom in by Chair BLAIR. She lives next door to the applicant.
She stated that the three-foot variance would block her view to the pazk. She also
objected to plans for a three-caz gazage and the stucco finish.
Boazd Member ABBOT"f asked Ms. Croom if she would still object if the third
bay is built within the setback requirement. Ms. Croom replied that it would
make no difference in her objection.
Boazd Member BELL suggested that the truck being pazked in the MarfiPs
driveway presents a greater obstruction to Ms. Croom's view than a three-foot
variance would present. Ms. Croom replied that the truck isn't always pazked
there.
Suzanne Wilson

Ms. Wilson was swom in by Chair BLAIR. She expressed her objection to the
application. She stated her belief that the addition of the garage and the stucco
finish will diminish property values in the neighborhood of brick homes.
Jeff Hirt submitted photographs from the applicant which depict other homes in
the unmediate neighborhood (on Webster and Vance). Some of these homes have
finishes other than brick.
Board Member ABBOTT clarified that the applicant has the legal right to build a
three-caz garage and apply a stucco finish. The Boazd's only authority is to
determine whether or not to allow the three-foot variance.

Ms. Eckerds was swom in by Chair BLAIR. She commented that her
neighborhood consists of brick homes. Some homeowners are updating their
homes with stucco finish which she believed improved and updatcd the
neighborhood.

Suzanne Wilson retumed fo the podium to say there is no comparison between
their neighborhood and Green Mountain. She also commented that changing a
brick house to a stucco house is a big waste.
Chair BLAIR commented that the house directly east of the applicant has a stucco
finish.
Boazd Member ABBOTT inquired about the depth of the garage. Mr. Mentgen
stated the garage depth is planned to be approximately 21.7 feet. The common
depth for garages on new homes is 24 feet. He commented that lazger gazages aze
required to accommodate larger vehicles that are populaz today.
Boazd Member HOVLAND reminded those present that the Boazd's Authority
extends to the front yazd setback variance only and not the finish of the house, etc.
Boazd Member ABBOTT asked if the garage addition could be extended into the
existing garage to eliminate the need for a variance. Mr. Mentgen stated that
every engineering calcularion failed with this scenario because it would
necessitate removal of a structural wall. He also stated that he studied every
possibility to avoid the necessiTy of asking for a variance. ^

In response to a question from Board Member HOVLAND, Mr. Mentgen stated
that it is necessary to have at least five feet beriveen the garage and swimming
pool for excavation purposes. Boazd Member HOVLAND commented that it
seemed the inconvenience has been caused by the swimming pool.
Boazd Member ABBOTT suggested that the swimming pool could be moved.
Meredith Reckert commented that the builder is attempting to provide the closest
path to the indoor garage enhance for Mr. Marfil.
Board Member BELL commented that she did not believe three feet would
constitute a major barrier to the neighbor's view adjacent to West 29'" Avenue.
There would still be a 27-foot setback to the street on one side. The side yard
would still tiave a] 0-foot setback. Further, one of the major issues in the request
is to accommodate a person with a disability. For these reasons, she stated her
support for the application.
Upon s motion by Board Member BELL snd second by Board Member
ABBOTT the followiag resolution was stated:

Board Member ABBOTT offered a friendly amendment to add a condition
that the third bay to the north not be allowed the 3-foot variance. This
condition was accepted by Board Member BELL.
In Tesponse to a question from Chair BLAIR, Boazd Member BELL explained
that, while driving through tlvs neighborhood, she observed that it is noi an
entirely brick neighborhood. There is brick, a combination of materials, wood or
clapboazd and stucco finishes.
The motion passed 4-2 with Board Member HOVLAND and MOLNAR
voting no aod Board Members ECHELMEYER and DRDA absent.
Chair BLAIR advised the applicants that their request for variance was denied.
Mrs. Marfi1 asked if a side-loading gazage could be bwlt as long as it is within
required setbacks. She was advised that this would be permissible.

Chair BLAIR closed the public hearing portion of the meeting.
(Chair BLAIR declazed a brief recess at 8:45 p.m. The meeting was reconvened at 8:55
p.m.)
6. OLD BUSINESS
Jeff Hirt responded to a question raised at the last Boazd meeting regazding a
variance ganted in 1982 per Case No. WA-82-37 to build a carport. Upon
investigation, it was found that a subsequent variance had been granted in per
Case No. WA-84-31 to allow the carport to be enclosed and converted to a
garage. It was determined that staff fallowed the appropriate steps in allowing
the garage to be in its current state.
7. NEW BUSINESS
. A9oroval of Minutes - It was moved by Board Member HOWARD and
seconded by Board Member HOVLAND to approve t6e minutes of July
22, 2004 as presented. The motion passed unanimousiy.
. Board Member HOWARD referred to the northwest comer of 46lb and
Hazlan. He expressed concern ihat there is less than the 1 S00-foot separation
between car lots at this location. Meredith Reckert stated that, following
proper procedures of holding neighborhood meetings and posting, an
administrative decision was made to allow less than the 1500-foot separation
via a special use pennit.

Review was done on the additions to 2900 Webster with the assumption that a'/a" =1' scale was
used on the site plan submitted. The site plan noted a 1/8" = 1' scale, however measurements taken
indicate that this was not the scale used for this site plan.
Taldng measurements using the'/a" = 1' scale on the site plan submitted, the additions meet all
applicable zoning requirements. These measurements aze noted in red on the site plan.
Also, in order for this permit to be valid the driveway must be paved 25 feet in from Webster Street.
