Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection
prior to installation of ANY roof coverings and is require on the entire roof when spaced
or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are
required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and
water shield is required. Eave and rake metal is required. A ladder extending 3 feet above
the roof eave and secured in place is required to be provided for all roof inspections.
Roof ventilation is required to comply with applicable codes and/or manufacturer
installation instructions, whichever is more stringent. In order to pass a final inspection
of elastomeric or similar type roof coverings, a letter of inspection and approval from the
manufacturer technical representative stating that "the application of the roof at (project
address) has been applied in accordance with the installation instruction for (roof
material brand name) roof covering" is required to be on site at the time of final
inspection.
Roof inspections for ROOFS OVER 6/12 PITCH: 3rd party inspection will be required, the 3rd
party inspection report will be collected at final roof inspection performed by City of
Wheat Ridge. If report is not available the final inspection will not be completed.

Janelle Facinelli /FRFWCP, LLC /3185 Xenon Street
In September of 2010, the Building Division discovered that a remodel of a structure at
4752 Dudley Street, owned by FRFWCP, LLC, had been performed and completed
without the required permit or inspections. A courtesy notice was provided and an after -
the -fact permit was obtained and signed for by Ms. Janelle Facinelli. Ms. Facinelli was
advised of permitting requirements and warned against future violations.
On February 28, 2011, the Building Division received an application for permit from
Hamm's Interiors containing information that a remodel of the structure at 3185 Xenon
Street had occurred without permit. An investigation performed on March 8, 2011,
revealed that the structure had been remodeled at some time prior to that date without the
required permit(s). A Stop Work Order was posted on the structure along with a door
hanger advising immediate contact with the Building Division. A call was received from
Janelle Facinelli, identifying herself as the Project Manager for FRFWCP, LLC, the firm
which owned and remodeled the structure prior to its' sale to Aron and Sandra Sage on
March 4, 2011. Ms. Facinelli requested an on -site meeting to discuss the actions
necessary to rectify the situation. A meeting was arranged for 3:00 p.m. on March 9,
2011, at the structure.
On the same day of the meeting with Ms. Facinelli, March 9, 2011, Mr. Gale Bernhardt,
who resides at 4725 Reed Street, visited the Building Division at approximately 2:00 p.m.
to present the Division with a letter concerning his property and request assistance. His
letter stated that he and his wife had purchased the property in September of 2010 from
FRFWCP, LLC, and had been told that FRFWCP, LLC was working with the Building
Division to rectify "failed inspection report" issues. His letter stated that he had not had
any contact with the sellers since the purchase of the structure. At the time the Mr.
Bernhardt presented his letter, no permit or inspections had been obtained for work
performed at the structure.
At the March 9, 2011, meeting with Ms. Facinelli and Ms. Sage at 3185 Xenon Street,
Ms. Facinelli contended that she was not the person of responsibility for the project,
stating that she only did what her superiors told her. When asked if there were other
properties with similar violations within the City of Wheat Ridge of which the Building
Division should be aware, Ms. Facinelli stated that there were not. It was Ms. Facinelli
who had signed for the permit at 4752 Dudley Street and, based on statements from the
owner of 4725 Reed Street, it was Ms. Facinelli that was the contact person and work
coordinator for the remodel of that structure. Based on this information and these facts,
Ms. Facinelli was issued a summons to Municipal Court by Officer Phil Schroeder of the
Community Services Unit at the request of Chief Building Official John Schumacher.
A list of violations existing at 3185 Xenon Street was presented to Ms. Facinelli, which
included the requirements to obtain a permit for the work and include the name of the
contractors or firms that performed work on the structure. Ms. Facinelli contended that
Hamm's Interiors and Exteriors, whose City of Wheat Ridge contractor's license was, at
the time of application, expired, had performed all of the work on the project. In
discussions with Eric Hamm, he revealed that he was out of state and had never
performed work at or even been to that address. During the course of working with Mr.
Eric Hamm, owner of Hamm's Interiors and Exteriors, the Building Division discovered
that Mr. Hamm had submitted falsified liability insurance certificates to the City, and
therefore the issuance of permits for 3185 Xenon Street based on that permit application
was withheld pending provision of a different licensed general contractor. An application
for permit with a different licensed general contractor was submitted for the work at 3185
Xenon on May 10, 2011.
As a part of the attempt to submit for a permit for work at 3185 Xenon Street, Ms.
Facinelli's electrical contractor, Absolute Power, visited the Building Division on May 9,
2011, and provided a list of projects performed on FRFWCP, LLC owned properties. It
was found that two of the properties on that list, 3715 Lewis Street and 10895 W. 39"'
Avenue, both of which are still owned by FRFWCP, LLC, were remodeled without
permits. These projects were conducted under the direction and guidance of Ms.
Facinelli. This was confirmed by Jeremy Paddock, of Paddock Construction, who is
listed as the general contractor on the permit applications submitted for these two
properties. Mr. Paddock stated to Building Division staff that Ms. Facinelli was the
coordinator of the project and that she indicated to him that she had obtained the required
permits, which later proved to be untrue.
Ms. Facinelli has been the principal agent for FRFWCP, LLC, owners of at least five
properties within the City of Wheat Ridge that have been found to have been remodeled
or renovated without the permits and inspections required, and in each instance buyers,
occupants and contractors have indicated that Ms. Facinelli was their principal point of
contact and direction. Ms. Facinelli was granted leniency by the Building Division in the
first instance of violation in September of 2010 and made aware of the requirements for
permitting and inspection as they relate to remodeling and renovation. She has been
found to have repeated the same offenses a minimum of four additional times since that
time, each time having been identified by contractors and owners as the principal point of
contact and direction and the individual that directly orchestrated the projects. Ms.
Facinelli's violations of ordinance and building codes is repetitive and deliberate and it is
respectfully requested that the maximum penalties and fines be imposed upon Ms.
Facinelli.

2. Install a hammer arrestor on the dishwasher supply line.
3. Provide code compliant air gap on the dishwasher drain line.
4. Caulk and seal all plumbing fixtures
5. Install gas shut off valve and drip leg for water heater in code compliant locations.
6. Install hard -wired smoke alarms in bedrooms, hallways outside of bedrooms and on each level
of home. Also install hard -wired carbon monoxide detector within 15 feet of doorway to each
bedroom.

You're welcome. As I stated in our conversation yesterday, my main objective is to
insure that all work is performed by your firm is permitted, inspected and compliant and
that no more incidents of this nature occur in the future. I appreciate your efforts to
rectify these issues.
I have formulated and attached the correction lists for each of the three properties. We
are conducting the plan reviews this morning for all three of the permit applications and
the permits should be available for pick up after 12:00 p.m. today. Although I have
provided the lists, work should not be conducted until the permits have been obtained.

2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must
be made in writing and received prior to the date of expiration. An extension of no more than 180 days made be granted
at the discretion of the Chief Building Official and may be subject to a fee equal to one- half of the original permit fee.
