Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. There is presently only on street parking available to the public, and as part of an upcoming landscaping project PRPD would like to incorporate pull in pazking into the overall landscape design. Please see the enclosed simple site plan of what PRPD would like the City of Wheat Ridge to consider. The benefits to this pull in parking are obvious. PRPD residents and park users conducting business at PRPD headquarters would be able to park their vehicles out of a traffic azea. They would certainly feel safer, and traffic on Xenon St. would not be impeded by parked cars. In conversation with yourself and other City of Wheat Ridge staff, I have been advised to write this letter to explore this possibility. The District is replacing two antiquated and dilapidated buildings with a single modern building. Following the zoning review with the Wheat Ridge Pianning DepaRment, and the selection of a contractor following bid reviews, the District leamed of the City's plan to impose a use tax with respect to the new building along with other fees. The Wheat Ridge Planning Department has advised the district of $11,116.05 in fees and use taaces. The fee poRion of this charge, $6,021.05, covers plan inspections and reviews, and appears to the District to be reasonable and appropriate. The remaining charge, $5,095.00, is a`use tax,' imposed by one govemment, the City, on another government, the District. The District asks that City of Wheat Ridge erempt the District's new building from the City's use tax. The Municipal Code is confusing to us: The Use Tax Ordinance states that "Every person who builds......., including all exempt institutions or private construction job sites, who purchase lumber etc...... used for construction thereon.... shall pay a use tax..." This appears to be quite broad, and would clearly impose a use tax on the Prospect Maintenance Building if it were not owned by a government. The Use Tax Ordinance distinguishes beriveen taxpayers and "governments" and "taxing jurisdictions." Its exemptions are very narrow, and even charities are "taspayers." However, the "Building Materials and Supplies" provision, at Sec. 22-68, appears to apply only to materials and supplies owned by "exempt instihxtions or private construction job sites," which would appear to exclude governments. Moreover, this suggests that materials and supplies at public (governmental) construction job sites are not intended to be subject to the Use Tax. Prospect Recreation & Park District, is a governmental entity and a taxing jurisdiction established under Title 32, Colorado Revised Statutes. Its construction site is clearly a public construction job site. We note that the City did choose to exempt the new Head Start facility, located just a few doors down 42"d Avenue, from the City's Use Tax. The District requests the same consideration. Response: The 50-amp 3-phase circuit is intended to be used in the future for an arc welder. The District currently does not own an arc welder, but is looking to acquire one in the future. 3. If this circuit is to be used for electric arc hot work, a switch or circuit breaker shall be provided so that fixed electrical welders and control equipment can be disconnected from the supply circuit. The disconnect shall be installed in accordance with the National Electrical Code. IFC 03 2606.4. Response: The recommended switch/circuit breaker will be incorporated into the plans so that when an arc welder is acquired, its instaliation/use will meet the code. 4. We would request that a main electrical exterior disconnect be provided on the exterior of the building. Response: An exterior main disconnect has been provided. 5. The occupanf will need to verify that su(ficient electrical receptacles have been provided as extension cords or multiple adapters are not permitted, Flexible cords shall not pass through walls, ceilings or doonvays. The District is replacing two antiquated and dilapidated buildings with a single modern building. Following the zoning review with the Wheat Ridge Planning Department, and the selection of a contractor following bid reviews, the District learned of the City's plan to impose a use tax with respect to the new building along with other fees. The Wheat Ridge Planning Department has advised the district of $11,116.05 in fees and use taxes. The fee portion of this charge, $6,021.05, covers plan inspections and reviews, and appears to the District to be reasonable and appropriate. The remaining charge, $5,095.00, is a`use tax,' imposed by one government, the City, on another government, the District. The District asks that City of Wheat Ridge exempt the DistricPs new bui[ding from the City's use taz. The Municipal Code is confusing to us: The Use TaY Ordinance states that "Every person who builds......., including all exempt institutions or private construction job sites, who purchase lumber etc...... used for conshuction thereon.... shal] pay a use tax..." This appears to be quite broad, and would cleazly impose a use tax on the Prospect Maintenance Building if it were not owned by a government. The Use Tax Ordinance distinguishes between taxpayers and "govemments" and "taxing jurisdictions." Its exemptions aze very narrow, and even chazities are "taxpayers." However, the "Building Materials and Supplies" provision, at Sec. 22-68, appeazs to apply only to materials and supplies owned by "exempt institutions or private construction job sites," which would appear to exclude governments. Moreover, this suggests that materials and supplies at public (governmental) construction job sites are not intended to be subject to the Use Tax. Prospect Recreation & Park District, is a governmental entity and a taxing jurisdiction established under Title 32, Colorado Revised Statutes. Its construction site is clearly a public construction job site. The address is currently located on a free-standing sign at the entrance drive. The four digit street number "41 98" will be installed on the building by the Owner. Sheet A2.01, Detail 3 will be modified to show the address number. Item No. 2 - Exits: 1. Acknowledge. A sign will be provided. 2. Because of the size (less than 1,000 sfl of the building, it is only required to have one exit (occupancy less than 30 based on office occupancy of 1 person/100 sf -1997 UBC Table 10-A). Item No. 3- Emergency Lighting: 1. Please clarify. Emergency Lighting: The UBC does not require exit signs for buildings that are required to have only one exit (1997 UBC 1003.2.8.2, exception #2 and 1997 UFC 1212.2, exception #2). This building requires only one exit. We reviewed UFC 97 1211.1., which refers to UBC 97. The UBC requires emergency power for egress illumination when the occupant load exceeds100. The occupant load of this building is less than 100. (1997 UBC 1003.2.9.2). The path of egress is lit when the building is occupied by the light fixtures that are provided. We find no other requirements that these fixtures be provided with emergency power. We can leave the middle corridor fixture un- switched so that it is on at all times if that is the intent of the comment. Item No. 4 - Electrical: 1. This has been verified with the Occupant. 2.
