This letter outlines prescriptive requirements, and if fulfilled, the added dead load of the proposed PV system will not overstress the existing structure and the flush mount modules will not add additional wind loads to the roof framing. A change to the Code of Laws in 2001 made dog kennels a special use in the A-2 zone district. This property existed as a dog kennel prior to the Code change in 2001, making the kennel a legal non- conforming use. A non-conforming use may continue as long as no expansion or enlargement is proposed. If any expansion or enlargement of the non-conforming use occurs, a special use permit wiil be required. It has been determined by staff that since the dog runs have existed in the rear yard (west side of the property) prior to the Code change in 2001, the individual dog runs may be constructed. Therefore, a special use permit is not needed for this proposal. If the dog runs are ever expanded or enlarged, a special use permit will be required. You will be required to maintain a 25-foot buffer along the entire northern property line. There shall be no kennels or dog runs within this 25-foot buffer. It was indicated that you are interested in constructing a detached garage on this property. You must obtain a building permit for this garage. DATE: 08/11 /03 SUBJECT: Fence Dispute- 42nd Ave & Xenon St. Cindy: Following our fieid visit to the two properties along west side of Xenon St, just north of @ . 42nd Ave., I offer the following per my observations: 1. The new wood fence is ciearly being eroded due to the grading actions of the property owner to the north. It is apparent that the soil along the fence line has been removed to a depth of 1-2 feet below existing grades, and as a result the foundations of several wooden fence line posts have been eroded Several sections of the fence are beginning to lean. This issue does not appear to be a matter for City involvement. 2. As far as drainage is concerned, the southern property owner expressed that drainage from the northern property was flowing beneath the new fence. This does not appear to be possible since the northern property owner has created a soil berm near the fenceline, effectively blocking runoff from his property from reaching the fence. In several areas, the northern property owner has removed soil per item 1 above. This condition would divert stormwater runoff away from the wood fence. Following conversations with the northern property owner, the purpose of the soil berming is to keep flood waters out of his property, and not to divert same towards the fence line. It appears that so far, less than 50 CY of soil has been disturbed within the northern property. 3.
