July 6, 1994, A note was received from Deborah Lauhban, stating she brought in another set of plans. August 1, 1994, A phone message in the file from Zane Laubhan requesting more time to contact an engineer and an inspection ticket stating time was extended. (Until when and by Whom?) September 12, 1994, A letter was sent Certified Mail (P918-242-765) to Bennie Laubhan stating compliance to the June 28, 1994-letter had not been met and was told to repair or demolish the structure within 60 days. October 12, 1994, Received a three page notarized letter from Zane Laubhan explaining why he could not meet the previous dates and requested an extension until January 1, 1995 to complete these issues. November 28, 1994 Memo saying there would be a Building Code Advisory Board meeting on December 14, 1994 to hear an appeal of the notice to repair or demolish 4235 Xenon Street. December 14, 1994, Building Code Advisory Board meeting was held and a copy of the minutes is in the file, Mr. Laubhan stated (on pg.4) he should be able to get the required structural information within 60 days. A suggestion was made (on pg.4) to have Mr. Laubhan install a fence to avoid having the property become an attractive nuisance. A motion was made (on pg.6) that a 45-day extension from December 14, 1994 would be granted so Mr. Laubhan could get a letter from an engineer, if this was not received within the 45 days Mr. Laubhan could secure his own demolition permit and have 15 days to complete the process. February 15, 1995, There is a certified letter (P917-446-793) that was sent to Zane Laubhan stating the City was in the process again of soliciting bids for demolition. There is also a bid document dated February 17, 1995 that is not complete or signed? March 13, 1995, A memo was sent to Council requesting funds to demolish 4235 Xenon Street. March 15, 1995, A memo to Bob Middaugh, from Paul Edwards stating the results of the demolition bid opening held on March 9, 1995. Low bidder was Agritrack, Inc. and per an agenda item RFB 95-14 dated March 20, 1995 suggesting same be awarded the demolition contract. March 28, 1995 A letter was sent to Zane Laubhan stating during the March 20, 1995 Council meeting, Council decided it would like to offer Mr. Laubhan the opportunity to speak, and stated they would rehear the request on April 11, 1995. June 3, 1998 Permit issued to Executive Plumbing Services LLC for extensive plumbing remodel to meet code. There are no inspection tickets in the file showing any inspections have been done on the last three permits issued, but Bob Gasper told me he went out to the job site and talked with the owner in June 1998. It appears he is slowly working on the structure and according to Bob Gasper they are keeping in contact with our office. Bob only had three issues that needed to be addressed as of July17, 1998, 1. Install a front door on the structure or secure with plywood. 2. Keep the fence around the property in tact and keep gate shut and secure. 3. Weeds need to be mowed. Attached is a chronology of the events surrounding this structure. A permit for complete remodeling was issued in August 1997. Inasmuch as the new owner is making progress on the remodeling, with the issuance of new electric and plumbing permits, we are allowing construction to proceed. We aze keeping a close eye on the property due to the concems noted by Bob Gaspaz. February 24, 1997, A permit was issued to remodel a studio workshop, the permit was denied by zoning, then approved and issued by John Eckert per letter dated 2/26/97 from Jeff Cannon. The letter requested that Mr. Cannon be allowed to complete the job in three stages and he estimated it would take approximately six months to finish the construction. The applicant will be able to obtain the necessary engin- eering to obtain the required permits b. That all code violations will bo corrected. Sta£P Recommendations and Conclusions III Staf£ recommends that the Board visit the site prior to the meeting Staff concluded that the history of this structure indicates that the owner has been unable or unwilling to comply with standard building practices in obtaining the engineering or required building permits. Since you original letter of June 28th, I have, to best of my ability, attempted to resolve each issue you identified with respect to securing an appropriate building permit. I have consulted a number of professional engineers with the intent of reviewing and validating the plans originalty submitted, as they pertain to the structure at 4235 Xenon Street. This property was acquired by my grandfather, Bennie B. Laubhan, and in April of 1992, myself and my famity moved inro the house. The house itself was in extremely poor conditioa My grandfather's intentions at [his time was [o assist me in obtaining my own residence. The proper[y was occupied by an extensive amount of debris that was accumulated over an estimated for[y year period, and resulted in approximatety $3,000.00 in bump receipts to clean up. The owners of the house had rented it for the past 15 years. The primary issue at hand was to modify the house so that it could be reasonably and safely inhabited. The heat was supplied by two gas convection space heaters, one which was recessed into an interior wall and the other in the open space of the living room. The knotty pine panels that lined the living room were charred behind the heater and along the flue pipe. The natural gas lines were comprised of a mixhue of galvanized, brass and copper lines and fittings. There was a constant lingering mercap[an odor wi[hin [he house. The floors in the bathroom and kitchen were all but completely rotted due to constant water saturation. The water lines were a myriad of repairs and configura[ions, and were extensively occluded with mineral deposits. The waste water stream for the kitchen sink was in[errupted just below the floor and allowed to flow in[o the crawl space. Subsequently, I would later discover that the galvanized 1.5 inch kitchen drain line was completely occluded with a positive slope of a 1/4 inch per foo[ for eight feet. The three inch cast sewer line, at its juncture under the foundation, exited with a positive slope and was partially fragmented. One of three water samples yielded coliform organisms, and as such [ suspect the water line was perforated. The rafters and stringers were comprised of spliced 2 x 4's. The house consisted of five obvious construction phases. The roof consisted of seven layers of shingles, with the last layer being applied to facilitate sale of the house prior co my grandfather's acquisition. Anticipating extensive construction and remodeling, [ obtained a Homeowner Construction License from the City of Wheat Ridge in the spring of 1992. My father and I began developing plans for the remodel, whi(e we proceeded to gut the interior of the house. It was my earnest desire and concern to render the house compliant with the National Electric Code and the Unifortn Mechanical Code, and Building Code. I also took into consideretion the context of the National Fire Code and some NFPA guidelines. Initially the remodel would have only entailed approximately 30°/a of the structure. However, as we proceeded with our interior work, the bulk of the structure was not at all sound. At this point, we devised differen[ constcuction plans which my father proceeded to draw, while I calculated the appropriate load bearing configurations. I also spent a considerable amount of time calculating appropriate gas line configurations for the specific BTU demands, while my father determined the electrical configurations. BUILDING CODE ADVISORY BOARD MEETING December 14, 1994 The meeting was called to order at 7:40 P.M. on Wednesday, December 28, 1994. In attendance were the following members of the board: William Smith, Paul Recen Kenneth Adams, Richard Ondrusek, Ross Westover and Sam Martin. Also in attendance were staff inembers John Eckert, Bob Gaspar and the appellant Zane Laubhan. Before the formal meeting began, Mr. Ondrusek tendered his resignation as chairman of the Board, citing ill health as his reason. He was thanked by Mr. Eckert, the Chief Building Inspector and the other Board members for his many years of service on the Board. He asked that he still be able to attend the meetings as a citizen vitally interested in the Board's business, as his health perntits. In Mr. Ondrusek's absence it was necessary for the Board to appoint a new chairman. Mr. Adams nominated Ross Westover for the position, and the motion was seconded by Mr. Smith. Mr. Westover asked that the position be temporary, as he felt that Mr. Santangelo had done such a good job at the last meeting he would like a vote by the full board. Mr. Adams withdrew his nomimation and rephrased the nomination to be pro tem. The motion was seconded and approved unanimously. Mr. Westover then opened the meeting stating the address of Mr. Laubhan's address is 3034 Lowell Blvd., Denver, 80204. The date of the legal notice sent is September 12, 1994 which was sent to all board members. He also read the Staff Report which too was sent to all the Board members. Mr. Laubhan requests of the Building Code Advisory Board that the City's request to demolish the building located at 4235 Xenon Street be set aside to allow Mr. Laubhan time to obtain his permit. Each board member received a copy of the criteria needed to issue a permit to Mr. Laubhan. Mr. Westover then read the letter from John Eckert to Mr. Laubhan dated June 28, 1994 which detailed the things to be done to obtain a building permit. These are: 1. Two sets of plans stamped by a licensed engineer 2. 'I4ao plot plant. 3. A copy of the deed. 4. An improvement survey. 5. A stamped letter from a licensed engineer notifying us that all concealed work completed meets design require- ments and City Building Codes - 1991 UBC, UPC, UMC, and 1993 NEC. -Z- During the last year 4 stop work orders were issued, in August 1994 all utilities were disconnected, a condemnation notice a condemnation notice was sent and Mr. Laubhan's appeal letter received. The Board of Appeals must find that all of the following can be achieved within a reasonable time period: the applicant will be able to obtain the required permits and all code violations will be corrected. Mr. Martin wanted to know why the building was in the present condition and why something wasn't done some time ago. John Eckert answered that he had no authority until he became Chief Building Official. The only record available was a photograph taken in November 1993 and a memo from Glen Gidley Director of Planning to Jack Prose saying to take care of the matter. Mr. Westover stated that he visited the site on December 13, and made some notes. The notes are that there seems to have been a willful disregard of the requirements to obtain a building permit since this has gone on more than a year; and from casual observation at the structure, serious structural problems do not seem apparent. But there can be no comments as to utilities and hidden work. Mr. Westover then stated that he felt a reasonable amount of time to complete the project would be 4 to 6 months using full time workers. With one or 2 part time workers he could see it would take another year's work even with diligence. He voiced the opinion that the work was deliberately done to avoid code requirements and inspections, foundations would have to be checked and also the utilities and certified by an engineer as per the letter. Mr. Westover then asked for comments. John Eckert stated that the only request of the Board was to have Mr. Laubhan get the engineering and the permit. The Building Code allows an indefinite time to complete the project as long as it is not abandoned for a period of more than 6 months. He stated his concern was that the structure was well under way without having any qualified information on the structure that in the near future it may shift, change, settle etc. which cause hazard to life and limb. He stated that the only way to assure that the house is structurally sound is to get an engineering firm out there to do the testing. The City does not have the equipment to do the required testing. Mr. Westover asked Mr. Laubhan if in the beginning there was any attempt to prepare drawings for this. Mr. Laubhan replied that there was. His grandfather tried to help him get a house, he had someone look at the house prior to buying it and that person said it was structurally sound. But it was soon apparent that it was not. It had been built over five separate generations, there is no history of it. When he first bought it he -3- went into the bathroom and the floor was collapsed. It was all wet he didn't feel there would be much in fixing that up. The further it went it became apparent that the whole house was held up because residual parts of the other house - there was addition upon addition upon addition. The sewer piping was disconnected under the floor and the roof buckled because all the 2 x 4's were spliced. He took pictures of everything. Mr. Westover suggested that in remodeling work, generally you must prepare plans showing the existing, all of the utilities and the work that is meant to tie into this and the new work that goes beyond this. He stated that his background is in architecture and had been involved in extensive remodeling work where one must tie into existing work. He stated that he felt if that had been done in the beginning there probably wouldn't be the need for this condemnation procedure. In walking through the building Mr. Westover stated he didn't see any real problems, but acknowledged it would take investigation to certify what is being requested by the City. Mr. Laubhan concurred and Mr. Westover stated that if the requirements are not complied with post haste, then he said he saw no alternative but to tear it down. Mr. Laubhan agreed and stated that he did not mean any disregard to John's original letter but had hoped to have more things to present to him. He had someone who trying to help him locate a firnl to do the testing. He also has spoken to a hydrologist at School of Mines. He stated that his time is limited since he has the care of his grandmother since his grandfather died they have just discovered that the house on Lowell Blvd. has an asbestos problem. He stated his background and education and employment made him aware of the codes, so he couldn't plead ignorance. He then enumerated the problems encountered in the house at 4235 Xenon. There were no black gas pipes in the house, five layers of shingles with a new layer being put on just before the sale of the house to his grandfather. He brought some plans they had had done. They found the house had no foundation under it and things just seemed to keep going on. He tried to repair the sewer line and found it was all cracked going out. He stated they kept drawing plans and changing them. He got the ILC was done in 1993. To do a full survey in that area is almost impossible since there is nothing to go off. In that area is where there were farms and they were just divided up with no surveys. Mr. Westover asked what is the City's position now on obtaining the required documents for the building permit saying this is a reasonable time to still obtain a permit. John Eckert said the City' s opinion it is not our intention to deprive any citizen of property. He really doesn't want to demolish -4- the house. Even if Mr. Laubhan hadn't appealed, the meeting would still have been held anyway. As to a reasonable time period, Mr. Laubhan is going to have to give some input. His concern is very simple. The framing is probably stable and standardized but being an inspector in the field, there are items on foundation problems that were observed and related to Mr. Laubhan and were ignored. It is at the point that he as an inspector can no longer certify the foundation. At that point if you have a poor foundation, no matter how good the structure is, it isn't going to stay put. Again there are other factors in a foundation - percolation of the soil, stability of the soil, the type of water table - all these things are very critical on how you build a foundation. If Mr. Laubhan can get the foundation study that has been requested and get it stamped, we would have no problems in issuing a permit. His lot is large enough, the plans have been reviewed and are reasonable and fairly concise. But, no matter how solid the house is if the foundation isn't there, the rest of the work is for naught. If Mr. Laubhan gets an engineering report saying the foundation isn't sufficient, it would be ludicrous for us to allow Mr. Laubhan to continue to sink money into this project without rectifying the original problem. Mr. Eckert then suggested that Mr. Laubhan be asked for a reasonable time period. Mr. Laubhan explained some of the things that had been done on the property. Mr. Westover asked Mr. Laubhan had consulted a structural engineer familiar enough with foundations to analyze and maybe suggest underpinning for the foundation if it is not major. But if John says it is major, there is little that can be done, and to certify his results perhaps would satisfy John. Mr. Westover also stated that whoever he does approach, must be a registered engineer whose expertise is in structural foundations. Mr. Laubhan stated that that is what he is attempting to do, and Mr. Westover then stated that the question John has is how long is it going to take to get this certification. Mr. Laubhan stated that he should be able to get this information within 60 days. John stated that he sees little hazard as the building now stands to the people around. There is no fire hazard because the gas and electricity have been disconnected. There may be a small hazard to the children in the neighborhood who might get curious and go wandering. Mr. Westover then suggested that Mr. Laubhan get an engineer's certification in this time since the building permit could go on for some time and perhaps a fence should be erected around the structure. -5- John Eckert stated that up until last summer the situation was pretty well monitored because the Laubhan's were living in the house. The condemnation procedure as such is not hard and fast, asked Mr. westover. John answered no. Mr. Westover then said that the burden is then on Mr. Laubhan to obtain the report. If nothing is done, the demolition process would be undertaken. He continued saying that a security fence should be erected around the site if the construction is to be prolonged. Mr. Smith asked how we got to this point. Was there ever a building permit pulled for the construction. John replied no, but an application was received after several stop work orders were placed. But because we had no engineering on the foundation the permit was denied. Mr. Smith asked if there was a permit when the house was originally built and John replied that that was pre-City. The house is 40 or more years old. Mr. Laubhan stated that originally it was a shack. He found much debris when he started to break out the foundation. That area of Wheat Ridge stated John is a very old farming community area. Most of the house in there are approximately 40 years old or older. At that time there were no building standards and no records kept. Mr. Laubhan passed around pictures he took as he was doing renovation. John said that in the area of Mr. Laubhan's house, being on the geographical edge of the City, does not get routinely patrolled, but one of the neighbors took out a permit to for an addition and that brought us into the neighborhood. There was further discussion regarding the different things found as Mr. Laubhan did renovation on the house, and discussion regarding the inspection of that house by an indpendent inspector saying that the house was structurally sound. Mr. Laubhan stated that the has dump receipts to the tune of $5,000. All that was done was to dump garbage at the back of the lot. John stated that he would be more than glad to go along with the Board's decision as far as time. The project has been so protracted now that if the property could be salvaged, all latitude should be granted Mr. Laubhan. But if the property is not going to -6- be renovated, we need to address that as well. Mr. Adams questioned if Mr. Laubhan had any of the necessary documents. Only the deed and improvement location certificate have been submitted, and some plans that have to be redone. Mr. Westover stated that it appeared that the first step ought to be securing of the engineer's report. John Eckert then said that is what this meeting is keying on. Everything else - the field inspection and plan review, but it is impossible to see through concrete. A standard for all construction is that the foundation be engineered. Mr. Westover suggested Mr. Laubhan contact a soils engineer. They are familiar with soil but they can also recommend what type of foundation to be used for the various conditions. Mr. Smith said he was going to make a recommendation of soil engineers who are local that Mr. Laubhan could contact. Mr.Laubhan stated that he has consulted with a hydrologist. Mr. Smith said there are very many engineers, but he would be glad to recommend maybe three or four who could help Mr. Laubhan down the right path. They will do investigations and testing and can give you a letter with the information the City is looking for. Mr. Westover then raised the question about the time frame for completion of this project. He also stated that he feels everything hinges on the engineering report. That is what should be done immediately, and that he felt that 60 days was too long a time and suggested 45 days which would be the end of January. If the report is favorable, then a building permit could be issued and on the other hand if not favorable condemnation proceedings would have to be started. John Eckert stated that the Board has to look down the road to when the Laubhan's sell and others living in that house 10 to 20 years from now. Mr. Smith then made a motion that an extension of 45 days from this date of December 14, 1994, be granted Mr. Laubhan to obtain a stamped letter from a licensed engineer explaining that all concealed work completed to date meets the design requirements and the City of Wheat Ridge building codes. If not presented at that point, 45 days, the City shall do their work to demolish the side and charge the owners. If a letter is present and the requirements of the June 28th letter from the City of Wheat Ridge are met, the permit shall be issued and construction will continue in accordance with the City of Wheat Ridge building codes. The motion was seconded and Mr. Westover asked for further discussion. There was none. John Eckert urged Mr. Laubhan to make any comments or if he had anything to discuss to do so at this time. Mr. Laubhan asked if the engineers report should be bad, could he arrange for the demolition. -7- An amendment to the motion was made to include if after 45 days a letter is not presented to the City explaining the concealed work by a licensed engineer, Mr. Laubhan can secure his own demolition and the time period is to be 15 days. At the end of the 15 days, demolition has not been started and completed, the City will take charge of the demolition and charge the owners. Mr. Westover then seconded the motion. Mr. Recen asked what the pertinent dates would be. Mr. Smith figured that it would be January 28, 1995. Mr. Westover then asked for a vote on the motion as presented and amended. The vote was unanimous in favor of the motion. There was some general discussion among board members and staff regarding the adoption of the Housing Code and how, and who would enforce it. Mr. Westover then asked if there was any further business to be discussed. There was one more case, and the appellant was asked to present his case to the Board after a short recess. Mr. Westover asked if this was to be official business, John replied it was if it pleased the board. Mr. Westover reconvened the Building Code Advisory Board at 8:40 P.M. to hear an item to be introduced by John Eckert. The case to be heard was an appeal by Emilio Tippesmana. Mr. Tippesmana reroofed a house at 3155 Vance Street. The job incurred some difficulty in the process and John was called out to do an inspection prior to the compeltion of the job. The owner of the property requested a letter, which is in front of you at the present time. Mr. Tippesmana has conflict and disagreement with Item 2 which states 113 tab shingles were used but the breaks in the shingles were not lined up giving the roof an unprofessional look." John acknowledged he stated and voiced that opinion, backed up by the Residential Asphalt Roofing Manual. The method of applying the roof according to the Manual is what is classified the 4" lap, which means each consecutive course will lap 4" over from the previous course so that the breaks in the shingles are 4" over going up the roof. There is the first starter course, the second course will be 4" over, the third course 8" over and the fourth course will be lined up with the first course because the shingle is 12" wide. The code also states that using this alignment that no offset shall be smaller than 411. On September 13, 1994 during this inspection, I saw a variation in this lapping method to where they were not uniform. This is all that I stated that it gave it an unprofessional look. Mr. Tippesmana contests that statement and asks the Board to respond. John said he stated an opinion to the homeowner in letter form. At -8- this time, he said he stands behind that opinion. Mr. Tippesmana said his reason for appearing before the board was because the homeowner was taking him to court based on John's letter. He said he could prove that John was wrong. He showed board members a drawing he said John had made for him earlier that day. He proceeded to say how many years he had been in the roofing business and made a drawing on the board to show the way shingles should be installed, and that John was completely wrong. John rebutted Mr. Tippesmana's contentions citing the UBC and the Asphalt Roofing Manufacturers Association application guide as his guide in determining proper application. Mr. Tippesmana also took exception to Item 3 in the letter of September 13 which stated "The drip edge was bent and not tight with the roof." John stated that he did not have photos, but he did find that the drip edge was as stated in that letter. At the time John was out there the drip edges were pulled away, the shingles on the valleys were suspended. Mr. Tippesmana may have gone back and corrected these problems, but the inspection was done on September 13, 1994 in the middle of the job. Mr. Tippesmana again restated his position.
