Dear Mr. Seamons, I have completed the first review of the above referenced documents received on September 17, 2010, and I have the following comments: Final Drainage Report: 1. The submitted "Technical Memorandum" for the drainage was fine for use in obtaining the Special Use Permit as it allowed the applicant to gain approval for the SUP without having to spend a lot of money up -front for technical civil engineering. However, now that the SUP has been approved the civil engineering information needed to properly construct this project is required. Please submit a Final Drainage Report & Plan containing all of the elements required for a "Major New Development" under the Multi - Family /Commercial category in the attached City of Wheat Ridge Site Drainage Requirements. 2. Please be sure the Report/Plan includes the following: a. The Final Drainage Report/Plan must conform to the outline found in Section VII. Final Drainage Report (Outline and Required Information Guideline) of the Site Drainage Requirements (no other format will be approved). b. The calculations for the offsite runoff from 4e Avenue must be addressed as a result of the required connection of the monolithic curb, gutter, and sidewalk across the subject property frontage to the existing improvements on 44 Avenue, as the added flow may affect the design of the (reverse) sidewalk chase to be located at the sump on Xenon Street. c. While it is understood that the typical above - ground detention facility w /outlet works is not proposed for this project, the developed runoff volume must still be calculated and addressed. If permeable pavement or porous pavers are to be used, adequate underground detention volume (in the form of an infiltration basin) must be provided to handle the developed runoff. The net void space can be calculated for the area under the proposed porous surface by utilizing the highest groundwater surface elevation obtained by borings taken while the adjacent ditches are flowing full d. The soil percolation rate and employment of the overflow retention basin (again taking into account the highest groundwater elevation) should be discussed. This info will support statements made that the design will function as proposed and that the overflow retention pond will fully drain within the 40 hours as required in the Site Drainage Requirements (thus minimizing the creation of a mosquito habitat and the threat of West Nile Virus). e. The boring and percolation rate data collected in the area of the proposed porous pavement shall be included in the Report Appendix. f Information pertaining to the type of pervious material shall be included in the Appendix: www.ci.wheatridgexo.us Public Works Engineering September 28, 2010 Page 2 i. The pervious pavement typical section and mix design with applicable specs and installation instructions (APWA may have these available). ii. If porous brick pavers are to be utilized, a typical section accompanied by the manufacturer's specs and installation instructions are to be included in the Appendix. g. You may wish to include a statement, either in the Report, on the Construction Plans, or both, that the construction of the offsite public improvements north of the subject property along the west side of Xenon Street will be made under a separate contract negotiated between the property owner's contractor and the City. 3. Please provide a P.E. seal and signature on both the Final Drainage Report & Plan. Civil Construction Plans: General Comments 1. While it is acknowledged that the boring information provided in the Technical Memorandum shows the local groundwater elevation to be around 12 feet below surface grade, the borings apparently were done in March when the ditch was shut off. Public Works recommends new borings be taken (now) while the ditch is flowing full to ensure the groundwater elevation does not increase substantially from May through September, the months when the ditch is flowing. Plus, Boring P -1, which lies within the area of proposed porous pavement, was only taken to a depth of 5 feet; the bottom of the overflow retention basin as proposed is more than 4 feet below existing grade. 2. Need to include a plan & profile at 25' stations for the proposed improvements along Xenon Street, from the south property line to the match point of the PCR at 44'" Avenue. To go along with the Plan & Profile: a. Need to either include cross -slope grades from crown and elevations at the easterly edge of asphalt at the corresponding Plan view stations, OR b. Provide to -scale cross - sections at the corresponding 25' station intervals extending from the property line on the west side to the east edge of asphalt of Xenon. The cross - sections should run from 50' south of the south property line northward to the existing PCR at 44 Avenue. 3. Please submit an itemized cost estimate for the public improvements along Xenon Street for review and approval. Be sure to divide the cost estimate into two parts: a. The portion to be paid by the property owner AND b. The portion for the "offsite items" to be paid by the City 4. Please keep in mind that the As -Built plans which must accompany the Drainage Certification Letter required prior to the issuance of the Certificate of Occupancy at the conclusion of this project shall be on the Current City Datum per the Municipal Code of Laws. (In light of this requirement, at this time you may wish to adjust the current contours & elevation information upward by 3.03 feet to be on NAVD88). 5. A copy of the written approval required for all proposed offsite work shall be provided to the City of Wheat Ridge prior to issuance of the Building Permit 6. A Right -of -Way Construction Permit from CDOT may be necessary to complete the proposed ditch work lying within the CDOT ROW. 7. All civil documents and construction plan sheets must be signed and sealed prior to approval. Sheet C 1 (Cover Sheet): 1. All projects started on or after January 1, 2008 must be on the Current City Datum, which utilizes NAVD88 as the vertical datum. Need to add a Note #6 regarding the construction of the offsite public improvements along Xenon Street stating, "ITEMS LYING WITHIN THE AREA IDENTIFIED HEREIN AS "OFFSITE WORK" ARE TO BE COMPLETED UNDER SEPARATE CONTRACT WITH CITY OF WHEAT RIDGE." Sheet C2 (Utility Plan) 1. The City standard for new sidewalk is a 6" vertical curb with a 5 -foot wide monolithic sidewalk. If your client wishes to save some money he can reduce the proposed 6' wide walk down to the standard 5 -foot wide. Please identify the section as being "7.5' monolithic curbwalk, Type C- D02 ". 2. Please differentiate between the portions of catch and spill gutter within the site. Need also to include a 10 -foot long area of transition between the two different gutter types. 3. Need to construct a (minimum) 1 -foot wide concrete strip between the standard (impervious) pavement and the porous pavement/paver area. This will not only delineate the two but it will also provide an abutment needed during construction for each material type. The depth of the concrete strip must be as deep as the infiltration basin material (minimum of 12 "). 4. Modify the text for the permeable pavement identifier (remove the reference to Note 7 and replace with something like "see detail and typical section on Sheet C7)." Also, remove Note 7 on this sheet (the material must be specified and the specs /details necessary to properly construct shall be on these plans and discussed in the Final Drainage Report prior to approval of these documents. 5. Revise the manhole on the SE corner of 44 Avenue & Xenon Street to reflect that it is in fact an irrigation manhole and not a storm MH as currently shown. 6. It appears the proposed retention pond bottom elevation may be too low. Public Works recommends that new borings be done during this time (while the ditches are flowing) to establish the high groundwater elevation. The high groundwater elevation must be established to support the design prior to approval by the City. 7. For the "OFFSITE WORK" items for the sidewalk connection north of the subject property: a. Clearly identify the "OFFSITE WORK" items (might use a "bubble" as shown). b. Identify the fire hydrant as "FIRE HYDRANT TO BE RELOCATED (BY OTHERS)." c. Show the handrail, and identify the backside footer (if applicable) for the sidewalk. d. Provide a minimum 5' transition from the existing sidewalk to the proposed 5 -foot wide sidewalk. e. Show a 6' wide ADA ramp with 6' wings and 3' by -pass walk as indicated on the plan. f. Show the asphalt patching. 8. Identify the Swadley and Slough irrigation ditches. Sheet C3 Grading, Drainage, & EC Plan): 1. Add silt fencing along Xenon Street. 2. Need to place 12" straw wattles along both sides of the ditch (top) prior to commencement of construction. 3. The lower the grade across the area of pervious pavement the better it will function. PW recommends a maximum of 2% cross slope. 4. Please add the silt fencing along the northeast portion of the site and along the westerly side of the "OFFSITE WORK" as shown. 5. Please include the following Notes: a. Prior to commencement ofHERCP construction work: i. Sheet C4 (Irrigation Plan & Profile): 1. The proposed design does not leave sufficient room between the top of the HERCP and the bottom of the proposed porous pavement/pavers. There needs to be a minimum of 6" between them to allow not only for construction error, but also to allow for a minimum thickness of subgrade (gravel) material which is required to construct the porous surface. 2. If the northerly side of the parking lot were to be raised a bit (about 6" or so) it could be used to flatten out the grade across it and actually help the porous surface function better - less than 2% seems to be ideal for porous pavement functionality (the flatter the better). Sheet C5 (Site Detail Sheet): 1. Need to include a typical section for the pervious pavement or permeable brick pavers. Please include the manufacturer's specs and instructions as needed to properly construct. 2. Please include the following standard City of Wheat Ridge details: a. C -D02 VCG.SW (vertical curb with 5' monolithic sidewalk) b. C -1309 VCG.SW.FOOT (sidewalk with backside footer) c. C- D10VCG.SW.FOOTC (sidewalk with backside footer connection) d. C -D09 VCG.SW.FOOTCP (sidewalk with backside footer connector plate) e. U -AOI CURB.CHASE (be sure to include all 2 pages of the curb chase detail) f S -E01 HMA (typical asphalt paving/patching detail) 3. Dear Mr. Seamons, I have completed the second review of the above referenced documents received on November 29, 2010, and I have the following comments: Final Drainage Report (Discussion) L Under Section 3.2 Proposed On -site Sub - basins, please include the areas for Sub -basin R -N. 2. Under Section 3.3 Existing Off -site Sub - basins, please include the areas for Sub - basins OS -S, OS- N, and OS -SW. 3. Under Section 3.4 Detention Requirements, please include the following: a. Describe the proposed underground infiltration basin section and how the required detention volume will be provided using this type of facility, i.e., by calculating the residual void space of the rock (primarily in the 8 "rock sub -base course) beneath the pavers. b. Since this system does not utilize the usual above - ground detention pond /outlet works, please include a discussion of the outflow and how the release rate was calculated. For example, in reality is the outflow Q equal to the percolation rate as measured by Kumar & Associates multiplied times the total (bottom) surface area of the permeable pavers and retention pond? c. Include a statement that the maintenance requirements for the proposed infiltration basin/permeable paver system will be detailed in a separate Operations & Maintenance Manual to be created by you prior to issuance of the Certificate of Occupancy (please refer to item #6 under the Notes below). d. Add the letters "ed" to the end of the 6 ° i word in the second paragraph so that it reads, "...62% of the needed capacity..." 4. Please provide a P.E. seal and signature on both the Final Drainage Report for approval. Final Drainage Report (Appendix): L The calculations for the proposed irrigation pipe assume a circular conduit is to be used. Please note the following: a. The calculations should be modified to reflect the true design which proposes using a horizontal elliptical pipe. The calculations provided also assume the pipe is flowing full, which means the ditch must flow at 29" in depth to achieve the capacity shown. If not, the flows in the irrigation channel will back up because of course the capacity has not been met. b. To minimize the possibility of flows being backed up in the channel, i.e., in the event the ditch does not actually flow at a depth of 29 ", you might consider using an arch pipe instead of the HERCP (more capacity at a lower water depth). Plus an arch pipe could lower the top N1 ww.ci.WheatHdge.co.us Public Works Engineering December 8, 2010 Page 2 of pipe a couple of inches, which in turn could help you achieve the minimum allowable cover between the curb & gutter of the parking lot (see Sheet C4, Comment #1 below). You might check the local suppliers for the availability of arch pipe if you decide to go this route. Regarding the Detention Volume by the Modified FAA Method worksheet: a. Using the modified FAA method is fine to use for this project. However, the inflow rate used on this sheet currently shown as 2.21cfs needs to be changed to 3.3efs, which equals the sum total of the Q's for the three onsite sub - basins A, B, & R -N (0.2 + 2.6 + 0.5 = 3.3cfs) as found on the Runoff calculation sheet. b. Also, the allowable peak outflow rate should be based on the percolation rate rather than using 0.53cfs which I assume was taken from the UDFCD standard release rate per developed acre. This number really only works for releases from the site for standard above - ground detention facilities & outlet works (which actually discharges offsite). Given the percolation rate it seems obvious this system will not be releasing much if any offsite, but will instead be percolating into the ground at the actual measured rate (please refer to comment 2b under the Discussion section above). The Pond Cuics Pond Sizing volume may be changing depending on the new geometry of the pond. The northerly wall of the pond needs to move to the south to provide adequate room to construct the structure entirely within the bounds of the subject property (must take into account the wall footer plus provide a 6" buffer from the exterior construction limit to the property line). The 6" buffer will ensure that in the event the contractor doesn't construct the wall in perfect alignment it still has a good chance of lying completely within the subject property (and avoid encroachment /legal issues with the adjacent land). Final Drainage Plan: 1. Need to include the following items on this Plan: a. Delineate the areas of permeable pavers and HMA pavement (just as shown on the Utility Plan). b. Include the following Notes: i. THE CONTRACTOR SHALL CALL THE DEPARTMENT OF PUBLIC WORKS AT 303.235.2861 FOR AN INSPECTION 48 HOURS PRIOR TO PLACEMENT OF THE ROCK WITHIN THE INFILTRATION BASIN (PERMEABLE PAVER) AREA. ii. Remove all erosion control & grading items and their related Notes and add them to a separate sheet named "Grading & Erosion Control Plan ". All of the info was much easier to see on the 1 " =10' scale you previously used, and now that the erosion control items for the "Offsite" work along Xenon Street will also need to be shown it would certainly make it all much easier to see at the larger scale on a separate sheet. (And include a copy of the Final Drainage Plan in the back of the construction plan set). 4. Please provide a P.E. seal and signature on both the Final Drainage Plan for approval. Civil Construction Plans: General Comments 1. Include the Final Drainage Plan sheet in the back of the Final Construction Plans. 2. Please sign & seal all revised construction plan sheets for approval. 3. Please submit a revised itemized cost estimate for the OFFSITE WORK items for review and approval. Sheet Cl (Cover Sheet 1. As previously requested, please identify the sidewalk section along Xenon Street as being "7.5' monolithic curb, gutter, and sidewalk, per City detail C -D02 VCG.SW (See Sheet C6) ". 2. Relocate the arrow identifying the sidewalk width from the previous 6' wide location to the current 5' width, and modify the detail referral to read "See detail C -D02 VCG.SW on Sheet C6 ". 3. The 3' wide by -pass sidewalk behind the proposed driveway must be fully located within the existing City Right -of -Way, or the property owner shall dedicate a permanent sidewalk easement to the City for maintenance purposes. 4. Need to provide adequate dimensions to properly construct the retention pond. PW recommends that a detail be added to the plans so that an enlarged scale may be used. 5. The pond has a wall along the northerly side now identified as needing to be designed by a structural engineer. In light of this, the pond will need to move southerly to provide adequate room to construct the wall footer. A minimum 6" buffer from the property line should also be included in the design. 6. Please note the following pertaining to the " OFFSITE WORK" items north of the subject property: a. Need to add one 8' stick of 34" X 53" HERCP and FES extending the pipe to the west. b. The inlet needs to be modified and identified as being "MODIFIED WHEAT RIDGE STANDARD INLET W /CHASE ". This additional pipe may also necessitate a modification of the existing storm culvert coming from the east side of Xenon St. c. Modify the proposed riprap below the chase to match in with the additional pipe length. d. Remove the note pertaining to the handrail (the handrail will no longer be needed with the pipe extension). e. Identify the bubble items as being, " OFFSITE WORK" to be paid for by the City (See Note #7). These remedies include, but are not limited to: (a) The refusal to issue any building permit or certificate of occupancy; (b) The revocation of any building permit previously issued under which construction directly related to such building permit has not commenced, except a building permit previously issued to a third party, (c) A demand that the security given for the completion of the Public Improvements be paid or honored, or (d) Any other remedy available at law or in equity. Unless necessary to protect the immediate health, safety and welfare of the City or to protect the City's interest with regard to security given for the completion of the Public Improvements, the City shall provide the Developer thirty (30) days written notice of its intent to take any action under this paragraph. The Developer may cure the breach described in the notice during said thirty -day period. 5. Public Improvements All storm sewer lines, drainage structures, paved streets, curb, gutter and sidewalk, and necessary appurtenances as shown on the associated construction documents (the "Public Improvements" or "Improvements ") as approved by the Director of Public Works or designee of the City, shall be installed and completed at the expense of the Developer within the time frames set forth on Exhibit B. The Public Improvements required by this Agreement and shown on the construction documents approved by the Director of Public Works, hereinafter "Director ", the time frames for construction of the Improvements and the itemized costs of these Improvements are set forth on Exhibit B attached hereto and incorporated herein. All Public Improvements covered by this Agreement shall be made in accordance with the construction documents drawn according to regulations and construction standards for such improvement and approved by the Director. It is understood by the Parties that the description of the Public Improvements may be general in nature, and that reasonable modifications of the scope, nature, costs, and similar aspects of the Public Improvements may be necessary to secure final approval of the Public Improvements. The quantities and locations for the Public Improvements are based on information that was available at the time of approval of the construction documents by the Director. 6. Protection Developer, at its expense, shall continuously maintain adequate protection of all Improvements from damage and shall protect the City's property from injury and loss arising in connection with this Agreement. Developer shall make good any such damage, injury or loss except such as may be caused directly by authorized agents or employees of the City. Developer shall adequately protect adjacent property and shall provide and maintain all passageways, guard fences, lights and other facilities for protection required by public authority or local conditions. PUBLIC IMPROVEMENT AGREEMENT 04/03 Developer shall be responsible for damage to any public and private property on and adjacent to the site of Developer's Improvements caused by negligent or willful acts of Developer, its agents or subcontractors. When any direct or indirect damage or injury is done to public or private property by or on account of any act, omission, neglect or misconduct in the construction of Improvements, or in consequence of the non - execution thereof on his part, such damaged property shall be restored by Developer at its own expense to a condition similar or equal to that existing before such damage or injury. Developer shall at all times take necessary precautions to ensure the protection of the public. Developer shall furnish, erect and maintain, at its own expense, all necessary barricades, suitable and sufficient red lights, construction signs, provide a sufficient number of watchmen, and take all necessary precautions for the protection of the work and safety of the public through or around his construction operations as Developer and the Director shall deem reasonably necessary. 9. Related Costs - Public Improvements The Developer shall provide all necessary engineering designs, surveys, field surveys, testing and incidental services related to the construction of the Public Improvements at its sole cost and expense. If applicable, a final drainage letter certified accurate by a professional engineer registered in the State of Colorado shall also be submitted at the request of the Director. 10. Improvements to be the Property of the City All Public Improvements for roads, concrete curb and gutters, public storm sewers and public drainage improvements accepted by the City shall be the property of the City following acceptance by the City, as provided above. 11. Performance Guarantee In order to secure the construction and installation of the Public Improvements the Developer shall, prior to issuance of the building permit, furnish the City, at the Developer's expense, with the Performance Guarantee described herein. The Performance Guarantee provided by the Developer shall be either a cash bond or an irrevocable letter of credit in which the City is designated as beneficiary, in the amount of one hundred twenty -five percent (125 %) of the estimated costs of the Public Improvements to be constructed and installed as set forth in Exhibit B to secure the performance and completion of the Public Improvements as required by Section 26 -110, of the Wheat Ridge Code of Laws. A cash bond or an irrevocable letter of credit shall be supplied to the City within thirty (30) days of the execution of this Agreement in the amount and form approved by the City. Failure of the Developer to provide a cash bond or an irrevocable letter of credit to the City in the manner provided herein shall negate the City's approval of this Agreement. Letters of credit shall be subject to the review and approval of the City Attorney. The Developer shall not start any construction of any public or private improvement on the Property including, but not limited to, staking, earth work, overlot grading or the erection of any structure, temporary or otherwise, until the City has received and approved the cash bond or irrevocable letter of credit. PUBLIC IMPROVEMENT AGREEMENT 04/03 The estimated costs of the Public Improvements shall be a figure mutually agreed upon by the Developer and the Director, as set forth in Exhibit B attached hereto. If, however, they are unable to agree, the Director's estimate shall govern after giving consideration to information provided by the Developer including, but not limited to, construction contracts and engineering estimates. The purpose of the cost estimate is solely to determine the amount of security. At the discretion of the Public Works Director, the City may draw on the cash bond or letter of credit to complete the Public Improvements called for in this Agreement or hold such funds as security for performance of this Agreement as the City deems appropriate. Upon completion of such improvements, conditions, and requirements set forth in this Agreement, any unused monies may be returned to the Developer. 12. Indemnification The Developer shall indemnify and hold harmless the City and its officers, employees, agents or servants from any and all suits, actions, and claims of every nature and description caused by, arising from or on account of this Agreement any act or omission of the Developer, or of any other person or entity for whose act or omission the Developer is liable, with respect to the Public Improvements; and the Developer shall pay any and all judgments rendered against the City as a result of any suit, action, or claim, together with all reasonable expenses and attorney's fees and costs incurred by the City in defending any such suit, action or claim. The Developer shall pay all property taxes on the Property dedicated to the City, if any, and shall indemnify and hold harmless the City for any property tax liability. 13. Waiver of Defects In executing this Agreement, the Developer waives all objections it may have concerning defects, if any, in the formalities whereby it is executed, or concerning the power of the City to impose conditions on the Developer as set forth herein, and concerning the procedure, substance, and form of the ordinances or resolutions adopting this Agreement. 14. Third Party Beneficiaries There are and shall be no third party beneficiaries to this Agreement. 15. Modifications This instrument embodies the whole agreement of the Parties. There are no promises, terms, conditions, or obligations other than those contained herein; and this Agreement shall supersede all previous communications, representations, or agreements, either verbal or written, between the parties. There shall be no modification of this Agreement except in writing, executed with the same formalities as this instrument. Subject to the conditions precedent herein, this Agreement may be enforced in any court of competent jurisdiction. 16. Release of Liability It is expressly understood that the City cannot be legally bound by the representations of any of its agents or their designees PUBLIC IMPROVEMENT AGREEMENT 04/03 except in accordance with the City of Wheat Ridge Code of Ordinances and the laws of the State of Colorado. 17. Captions The captions to this Agreement are inserted only for the purpose of convenient reference and in no way define, limit, or prescribe the scope or intent of this Agreement or any part thereof. 18. Binding Effect This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors, and assigns as the case may be. 19. No Waiver No waiver of any of the provisions of this Agreement shall be deemed or constitute a waiver of any other provisions herein, nor shall such waiver constitute a continuing waiver unless otherwise expressly provided, nor shall the waiver of any default hereunder be deemed a waiver of any subsequent default hereunder. 20. Invalid Provision If any provision of this Agreement shall be determined to be void by any court of competent jurisdiction, then such determination shall not affect any other provision hereof; all of the other provisions shall remain in full force and effect. It is the intention of the Parties that if any provision of this Agreement is capable of two constructions, one of which would render the provision void, and the other which would render the provision valid, then the provision shall have the meaning which renders it valid. 21. Governing Law The laws of the State of Colorado shall govern the validity, performance and enforcement of this Agreement. Should either party institute legal suit or action for enforcement of any obligation contained herein, venue of such suit or action shall be in Jefferson County, Colorado. 22. Attorneys Fees Should this Agreement become the subject of litigation to resolve a claim of default of performance or payment by the Developer and a court of competent jurisdiction finds in favor of the City, the Developer shall pay the City's attorney's fees and court costs. 23. Notice All notices required under this Agreement shall be in writing and shall be hand delivered or sent by registered or certified mail, return receipt requested, postage prepaid, to the addresses of the parties herein set forth. All notices so given shall be considered effective seventy -two (72) hours after deposit in the United States mail with the proper address as set forth below. Either party by notice so given may change the address to which future notices shall be sent. Recording of Agreement This Agreement shall be recorded in the real estate records of Jefferson County and shall be a covenant running with the Property in order to put prospective purchasers or other interested parties on notice as to the terms and provisions hereof. 27. Title and Authority The Developer, RMJL Investments, LLC , expressly warrants and represents to the City that it is the record owner of the property constituting the Property and further represents and warrants, together with the undersigned individual(s) that the undersigned individual(s) has or have full power and authority to enter into this Subdivision Improvement Agreement.
