RE: Landscaping af 3035 Saulsbury
Deaz Mr. Holiand:
After a landscaping site check on June 11, 2004 I have the following comments:
1. The driveway leading to the detached garage on the reaz of the property does not conform to
what was shown on the plans, as the permit was approved by our building department "per
redlines". Please see the redlined comments on the first page of the building plans.
2. Per the Code of Laws Sea 26-502 (D)(1)(b) you are required to have no less than 25 percent
of your lot landscaped. It appeazs that you may be under this required minimum, due to the
fact that based on the site check it appeazs that none of the backyazd of the lot was
landscaped. Please verify that at least 25 percent of your lot is landscaped.
3. Per the Code of Laws Sec. 26-501 (D)(1) the first riventy-five (25) feet of driveway azea
from the existing edge of pavement into the site shal] be swfaced with concrete, asphalt,
brick pavers or similar materials. Based on the site check there was a significant gap
between the edge of pavement for Saulsbury Street and the beginning of the paved driveway
that was not paved.
Please take the necessary steps to bring the lot into conformance. A Certificate of Occupancy
cannot be issued until these corrections are made.
If you have questions please contact me at 303-235-2845
Sincerely;
Jeff Hirt

Subject: Wind bracing for a new home located at 3035 Saulsbury Street, Wheat Ridge, CO.
(Engineer's job reference Number 4072.)
Deaz Mr. Holland:
On May 13, 2003, [ received a facsimile copy of a Residential Plan Review Checklist
from the Inspection Services Division of the City of Wheat Ridge. There were three items
requested on this form.
The first two items requested the finish floor elevations be indicated on all sides of the
exterior elevation drawings. These elevations were not prepazed by this firm and must be
corrected by the person responsible for the azchitectural drawings. The elevations must be
indicated on the elevation drawings and resubmitted.
The third item requested the wind bracing type and location. Section 2320.113 of the
1997 Uniform Building Code requires the walls be braced to resist the forces imposed by the
wind. Item 2320.11.3.5 indicates this bracing requirement may be met by instal(ing'/z-inch thick
by 4 feet wide gypsum board over studs spaced not more than 24 inches on center. All interior
walls will meet this criterion. All section drawings indicate the studs will be spaced at 16 inches
on center, which exceeds the code requirement. The section drawings also indicate thick
drywall (gypsum board) will be installed on all surfaces.
Based upon the previous pazagraph and the elevation drawings you will be modifying. I
believe all of the requests of the CiTy of Wheat Ridge Inspection Services Division will be
satisfied.
Please feel free to contact me if you have any questions or concems.
Sincerely yours,
* ' 3170$ ' *

Deaz Mr. Holland:
Please be advised that at its meeting of June 10, 2002, City Council APPROVED your request for a two-lof
minor subdivision on Residential zoned land at 3114 Teller Street for the following reasons:
1. The minimum lot size requirements of ihe R-2 zoning district have been exceeded
2. All requirements of the City's Subdivision Regulations have been met.
With the following conditions:
1. A final drainage repod shall be approved by the Deparhnent of Eublic Works prior to
development of Lot 2.
2. Escrow is required in tieu of construction foc public imptovements along Saulsbury and Teller
Streets.
However, City Council DENIED your request for a 6-foot lot width variance from the 100-foot minimum lot
width requirement to allow for a two-family dwelling for the following reasons:
1. The property may be developed with a single-family residence without the need for a
variance.
2. The hardship is self-imposed through the desire to construct a twafamily dwelling instead of
a single-family home.
3. There aze no unique circumstances attributed to the property that would warrant approval of
the vaziance.
A recordable blackline photographic mylar must be submitted within 60 days of final action for recording of
the plat with Jefferson County.
Enclosed is a draft copy of the minutes stating the Council's decision. Please feel free to contact me at 303-
235-2846 ifyou have any questions.

(Case No. MS-02-01)
Ifem 2 was introduced by Mr. DTuliio; summary and background was read by the Clerk.
A/bert Nol/and, applicant, was swom in by the Mayor and asked for approval of his
application. He explained that his lot frontage is 5 ft less than the 100 ft re.guirement, whieh
is why he is asking for.the variance. Mary Austin, Pianner for the City of Wheat Ridge, was swom in by the Mayor and
presented the staff report and entered exhibits into the record.
The following speakers were sworn in by the Mayor and spoke in opposition to fhe
variance:
Nancy Cupples, 3130 Teller Street
Belle Haley, 3140 Teller Street
Trecy Rubey, 3075 Saulsbury Street
Eileen Wi-seman, 3135 Saulsbury Street, did not receive notice of the hearings. .
Sharon Heinien, 3145 Saulsbury Street, cortcemed about the trash on the empty lot.
Their comments were that the integrity of the neighborhood needs to be maintained. They
have no problem witfi a single family home, but oppose the variance for a two-family
structure.
Motion by Mr. DiTullio that Case No. MS-02-01, a request for approval of a 2-lot minor
subdivision in a R-2 Zone District at 3114 Teller Street, be approved for the following

CITY COUNCIL MINUTES
CITY OF WHEAT RIDGE, COLORADO
7500 West 29t' Avenue, Wheat Ridge
June 10. 2002
The Regular City Council Meeting was called to order by Mayor Cerveny at 7:00 p.m.
Councilmembers present: Jerry DiTullio, Vance Edwards, Dean Gokey, Ralph Mancinelli,
David Schneider, Odarka Figlus, Lena Rotola, and Harry Hanley. Also present: City
Clerk, Wanda Sang; City Manager, Randy Young; City Attorney, Gerald Dahl; Director of
Planning, Alan White; Director of Public Works, Bob Goebel; staff; and interested citizens.
APPROVAL OF MINUTES OF May 13, 2002
Motion by Mr. DiTuilio for the approval of the Minutes of May 13, 2002; seconded by Mr.
Gokey; carried 8-0.
Mayor Cerveny announced that there are no fireworks allowed in Wheat Ridge.
CITIZENS' RIGHT TO SPEAK
There was no one present to speak.
PUBLIC HEARINGS AND ORDINANCES ON SECOND READING
Item 1. Council Bill 15-2002 - An Ordinance providing for the approval of
amendments to Article I, Article III, and Article IV, of Chapter 26 of the Code
of Laws of the City of Wheat Ridge, Colorado
(Case No. ZOA-02-03)
Council Bill 15-2002 was introduced on second reading by Mr. DiTullio, who also read the
title. Clerk read summary and background and assigned Ordinance No. 1251.
Planning Director, Alan White, presented the staff report.
CITY COUNCIL MINUTES: June 10, 2002 Page - 2-
Motion by Mr. DiTullio for the approval of Council Bill 15-2002 (Ordinance 1251) , Case
No. ZOA-02-03, and that it take effect immediately upon adoption; seconded by Mr.
Schneider; carried 8-0.
Item 2. Application by Albert Hofland for approval of a 2-lot minor subdivision plat
with dedication and a lot width variance for the purpose of building a two-
family structure on property located at 3114 Teller Street, zoned Residential-
Two (R-2).
(Case No. MS-02-01)
Item 2 was introduced by Mr. DiTullio; summary and background was read by the Clerk.
A/bert Holland, applicant, was sworn in by the Mayor and asked for approval of his
application. He explained that his lot frontage is 5 ft less than the 100 ft requirement, which
is why he is asking for the variance.
Mary Austin, Planner for the City of Wheat Ridge, was sworn in by the Mayor and
presented the staff report and entered exhibits into the record.
The following speakers were sworn in by the Mayor and spoke in opposition to the
variance:
Nancy Cupp/es, 3130 Teller Street
Belle Ha/ey, 3140 Teiler Street
Tracy Rubey, 3075 Saulsbury Street
Eileen Wiseman, 3135 Saulsbury Street, did not receive notice of the hearings.
Sharon Heinien, 3145 Saulsbury Street, concemed about the trash on the empty lot.
Their comments were that the integrity of the neighborhood needs to be maintained. They
have no problem with a single family home, but oppose the variance for a two-family
structure.
Motion by Mr. DiTullio that Case No. MS-02-01, a request for approval of a 2-lot minor
subdivision in a R-2 Zone District at 3114 Teller Street, be approved for the following
reasons:
1. The minimum lot size requirements of the R-2 zoning district have been exceeded.
2. All requirements of the City's Subdivision Regulations have been met.
CITY COUNCIL MINUTES: June 10, 2002 Page - 3-
With the following conditions:
1. A final drainage report shall be approved by the Department of Public Works prior to
development of Lot 2.
2. Public improvements of curb, gutter and sidewalk shall be constructed along Saulsbury
Street.
3. Escrow is required in lieu of construction for public improvements along Teller Street;
seconded by Mr. Edwards.
Motion by Mr. Edwards for an amendment that condition 2. be stricken and 3. be modified
to require escrow along and Teller and Saulsbury Streets; seconded by Ms. Figlus; carried
8-0.
Original Motion as amended carried 8-0
Motion by Mr. DiTullio that the request for a 6' lot width variance from the 100' minimum lot
width requirement for a two-family dwelling be denied for the following reasons:
1. The property may be developed with a single family residence without the need for a
variance.
2. The hardship is self-imposed through the desire to construct a two-family dwelling
instead of a single family home.
3. There are no unique circumstances attributed to the property that would warrant approval
of the variance;
seconded by Mr. Edwards; carried 7-1 with Mr. Hanley voting no. Mr. Hanley does not feei
this is logical, since it is zoned for R-2.
Item 3. Public Hearing on 2002 Local Law Enforcement Block Grant.
Item 3 was introduced by Mr. Edwards, who also read the summary and background.
Motion by Mr. Edwards to accept the 2002 Local Law Enforcement Block Grant. I authorize
the City Manager to execute all documents necessary for the acceptance of the award. I
further move that upon receipt of the funds during the fiscal year 2002, they be placed in the
general fund. I further move that the 10% match amount of $1,901 be appropriated from the
general fund, be authorized and occur. I further move that the City of Wheat Ride fiscal year
2002 Budget be amended accordingly with an additional authorized expenditure of
$19,006 at Acct. No. 01-201-700-750; seconded by Mr. DiTullio; carried 8-0.

Therefore, the City is requiring that escrow be taken for the estimated cost of the public improvements
not to be constructed along the Teller Street frontage, and an Irrevocable Letter of Credit for the public
improvements (please see note 2 below) that shall be constructed along Saulsbury Street frontage. Twc
(2) signed and stamped sets of the Final Drainage Report and Plan, Grading and Erosion Control Plan,

vertical curb and gutter & sidewalk section, standard driveway) have been provided for implementation
into the requested plan.

Upon acceptance of this estimate, an Irrevocable Letter of Credit reflecting total costs of the approved
cost estimate plus 25% will need to be submitted by the owner/developer for review and approval. A
cost estimate for the Teller Street improvements (not to be constructed at this time) will need to be
submitted for review and approval. Upon approval of the estimate, a Development Covenant will be
executed and an escrow check in the amount of the engineer's estimate plus 25% shall be submitted.

Dear Mr. Holland:
Please be advised that at its meeting of June 10, 2002, City Council APPROVED your request for a two-lof
minor subdiyision on Residential zoned land at 3114 Teller Street for the following reasons:
1: The minimum lot size requirements of the R-2 zoning district have been exceeded
2. All requuements of the City's Subdivision Regulations have been met.
With the following conditions:
1. A final drainage report shall be approved by the Department of Public Works prior to
development of Lot 2.
2. Escrow is required in lieu of construction for public improvements along Saulsbury and Teller
Streets.
However, City Council DEDIIED your request for a 6-foot lot width variance &om the 100-foot minimum lot
width requirement to allow for a two-family dwelling for the following reasons:
1. The property may be developed with a single-facnily residence without the need for a
variance.
Enclosed is a draft copy ofthe minutes stating the CounciPs decision. Pleasefeel free to contact me at 303-
235-2846 if you have any questions.
