Dear Benjamin Management Group:
Qn May 30, 2006 Jefferson County Department of Fiealth and
Environment (JCDHE) received a report from Tom Koch, Koch
Environmental Health, Inc, regarding the above referenced property
where methamphetamine was reportedly manufactured.
JCDHE makes the following statements regarding this report:
2. The report and contains the following specific language as
required by 6 CCR 1014-3:
1. The report was prepared or reviewed by a person who states that
they are an industrial hygienist as defined in 24-30-1402 C.R.S.,
"1 do hereby certify that 1 conducted a preliminary
assessment of the subject property in accordance with
6 CCR 1014-3, § 4, and that I conducted post-
decontamination clearance sampling in accordance
with 6 CCR 1014-3, § 6. I further certify that the
property has been decontaminated in accordance with
the procedures set forth in 6 CCR 1014-3, § 5, and that
the cleanup standards established by 6 CCR 1014-3, §
7 have been met as evidenced by testing 1 conducted."

3. To obtain the immunity set forth in 25-18.5-101 CRS and CCR
1014-3 (Section 8.26) you must also file this report with the City of
Wheat Ridge Police Department and City of Wheat Ridge Building

On May 30, 2006 Jefferson Counry Department of Health and
Environment (JCDHE) received a report from Tom Koch, Kxh

SITE DESCRIPTION
The Site is a iwo-story, 3-bedroom residential sUudure with a crawlspace and an
altached garage in a residential part of Wheat Rid9e, Colorado. The house is
apprnximately 1900 squane feet and the garage is approximately 380 square
feet. There are single-famiy home propertiw under seQoafs ad" essrs an eiMte►

yard. The propedy is located in a suburban portion of Auxora. Colorado. No
othw structurQS were present on the property. Single family homes are preserit
surrouriding the properry•
BqCKGROUND
The single-family residence at 3375 Union Strset in Broorrf'ield, Cotorado was
identified by the Chvner as corisidered to be a potential dandestine
mefharnphetamine markFaduring laboratory. KEH contacted Mr. Chad Root with
the Cily of VVheat Ridge for infamation pertaining to the siie. Mr. Root verbally
reported to KEH that he nor ft Wheat Ridge Police caAd oonfinn ihet
methamphetamine wes produced or used at te site and that the site was emply
of oonlerNs upon his inspeetion of the property. KEH wes not able to obtain
arrast reports and assoaated doc:umentation related to this site prior to
formulating this workplan. The exact manuFacturing method was not known at
the time of devalopment of the cleanup worlcplan associated with this Site-
Clemxip of the reaidenm was to be oonducted per the requirements of the
Cofvradq pepartmerd of Public Health and Errvironment (CDPME) Regulations
Pertaining to the Cleanup of Methamphet8mine Laborahories (6 CCR 10743),
although KEH representatives were not preserlt during cJeanup- ResWts irom

A visual inspeccion of the Site conducted on January 10, 2006 indicated na
contents, fumiture, appliances, etc, within the residence or the garaga. Dark and
other colqred stains were observed on the carpeting thrarghout the fitst 8rtd
second floors of the struc:ture, akhough the origins of the stains could not be
vgr~'ied nor were samples collected of stained area& for ideritrfication. No
chemical or waste containers considered to be used during methamphetamine
"cooldng" operatians were abssrved ak the Site. No exterior areas of stained
soils or vegetation were observed on the exterior af Me premises. Based on
visual observation only, the heaviest visual staining was observed on the
carpeting in the living room and upper floor bedroom. The upper floor east room
and bathroom appeared under construction at the time of the evaluation or had
recenUy besn finished. "fhere were rio sinks, toilets, or associated plumbing in
the kitchen or batlirooms. Haat is provided via a hot water system with
baseboard heaters. There were no contents in the structure.

DECONTAMINATION
Decontamination at the Site was conducted by the (hwners selected cleanup
Contractor, RMCAT. RMCAT was provided a copy of the WORKPLAN FOR
CLANPESTINE DRUG LAB CLEANUP, for the Site dated January 17, 2006.
KEH representatives were not present during cleanup at the Site by RMCAT.
KEH was notified by RMCAT upon completion af decont8mination at the Site and
subsequent re-cleaning events.
POST-CLEANUP ASSESSMENT
Upon campletian of Gesnup and decontamination, KEH conducted a post-
clearxap evsluation and sampling at the Site nn March 28, 2006 and April 6,
2006. The post-Geanup assessment was conducted to determine that deanup
standards and workplan requirements have been met. Samples were collected in
accordance with sampling protocols preseMed in appendices A, B, and D(if
applicable) of 6 CqPHE CCR-1014-3.

SAMPLING AND ANALYTICAL IIAE7HUDOLOGY
7he methamphetamine surFace &les were collected using Whatman 541
Ukrapure, hardened, ashiess, fibr'ous filter papers or sterile gauze pads saturated
with deionized water for preliminary samples end metharwl for post-cleanup
samples in ar.cordance with sampling protoc:ols presented in appandices A, B,
and D(if applicable) af 6 CDPHE CCR-1014-3. Sampling media was provided
by the selected laboratorY with field sample kits prepared by KEH.
Samples were collected irom distinct 100 square oen6meter (100 cmx) sample
areas of the floor arxi other working surtaces af tt►e residence. For any given
functional space ider►tified by KEH, at least 500 pn2 of surface was sampled,
unlass the area was assumed to be nont:ompliant. KEH sampled at least 1,000
cm2 of total surface ama for ihe Site.
Composite samples were collected from no more than five (5) areas per
cpmposite sample in each functional area• The composite materials consisted of
like media, matrices and /or substrates. Each area sampled as part of tfie
composite sample was collected from distinct 100 cmZ area.
ReSUlts for these samples are reported in average methamphetamine per 100
square centimeters (total methamphetamine detected in micrograms dividecf by
100 square centimeters).
Samples were collected from traffic areas, visibly stained areas, at or near water
or elactric sources and/ar other suspect areas where Gandes6ne drug
manuFacturing was suspected, or where pravious sample results yieldad
concerttrations in excess of 0.5 uglcm'. 5amples were collacted where
contamination may have migrated, such as adjaoent rooms or fundiorral spaces,
common areas, and ventilation systems.
The methamphetamine surtaces samples and blanks were sent with proper
chain-of-custody for anelysis to Analytical Chemistry, Inc. of Seattle, WA
(preliminary samples) and Datachem Laboratories of Salt Lake City, UT (post-
Geanup samples). Sample handting, labeling, preservation, documentation, and
ch8in of custody was conducted in a manner consistent with the requirements of
the analytical methods being used and based on laboratory necommendations.
Samples were analyzed by Analytical Chemistry, Inc, or Datachem Laboratories
via GC/MS in accordance with standard laboratory procadures for
methamphetamirie wipe sample analysis. Qualiry Corrtrol/Quality Assurance
(QA/QC) procedures in handling and laboratory QA/QG was conducted in
aCCOrdsnce with Appendix B of 6 CCR 1014-3.
Qrganic vapor air contaminants were not measured or assessed at the Site since
it had aired out for several weeks priw to sampling. Sampling for surtace or
airborne iodine or any other compounds typically associated with
methamphetamine production was not conducted at the Site; residue of such
contaminants was not observed or suspected subsequent to Geanup. There

were no noticeable organic vapor odors nor visible evidence of chemicaIs,
products, or containers present at the Site at the time of this evaluetlon.

RESULTS AND WSCUSSION
Results of inethamphetamine surtace samples collected after Geanup and re-
cleaning of identified areas or items indicated methamphetamine surFace
contamination below the CDPHE cleanup level of 0.5 ug1100cmz in each
functional space sampled. Final sampling oonducted using discrete sampling
methods and systemic wmposite sampling methods indicated all &urFaces
sampled were below the cleanup standard of 0.5 ug/100 cm' and the applicable
standard for systemic composite sart►pting. Visual inspection indicated no
evidence of chemiCats or containers typically associated with dandestine drug
manufacturing nor was any staining of surfaces observed during the final
inspedion(s).

KEH representatives are qualified Certified Industnal Hygienists and Industnal
Hygienists as defined in section 24-30-1402, Colorado Revised Statutes wifh
experience in conduc6ng methamphetamine assessments. All wwk is conducted

Purpose
The purpose of this workplan is to descnbe deanu0 and/ar removal operations of a potential
clandestine drug (i.e. methamphetamine produaion) lab for Benjamin Managemern Group
(BMG, the Owner) at 3375 Union Street in Wheat Ridge, Coloredo (the Site). T'his woilcplan was
preparetl for the Owner by Thomas D. Koch. CIH representing Koch Environmental HeaRh, Inc.
(KEH). The interd of this workpian and the procedures described is to condud Geanup and post-
cleanup sampling of the interior af the Site under controlled conditions subsequent to
identification of the Site of a dandesline methamphetamine laboratory. The exad
ItlanufaCturing methbd was not known at the time of development of thi5 Geenup WOrKpian.
Cleanup of the residence must be caWuded per the requiremeMs of the Colorado Department
of PuWic Meatth and EnvironmeM (CDPHE) Regulations Pertalning to !!re C/eanup of
Methem►ahetamkte Labor&twfes (B CCR 10143). The Site was ideMified by the Owner as
considered to be a potential clandestine methamphetamine manufacturing laboratory. KEH
coMaded Mr. Cha1 Root with the City of VYheffi Ridge Tor infortnation pertaining to the site. Mr.

dOCUm0nt8tion felated to this site prior to formulating this woricplan. Resutts from wlpe sampling
effoRS during a preliminary assessment conduc[ed by KEH indicated Surtace methamphetamine
concentrations in various locatipns of the SRe in excess oi the CCD and State of Colorado
Department of Public Heatth and Environmerit (CDPME) allowable timit of inethamphetamine of
0.5 micrograms methamphetamine/100 square centimeters (ugH00 cml).
The Site is a two-story, 3-bedroom residential structure wkh a crawlspace and an attadtitied
garage in a residentisl part of Wheat Ridge, Colorado. The hbuse is approXimately 1900 square
feet and the garage is approximately 380 square feet. There are single-family home pmperties
under separate addresses on eitfier side of the property, wi[h an open space park across the
street to the east. A visual inspedion of ine Site conduded on January 10, 2008 indicated no
contents, fumiture, appliances, etc. within the residence or the parage. DaAc and other colored
stains were observed on the carpeting throughout the first arid setond flbors of ihe struc[ura,
atthough the origins of the stains could not ba verified nor were sampies collected of steined
areas for identification, No chemical or waste containers considered to Ae used during
methamphetamine 'cooking' operatipns wcve observed at the Ske. No exterior afeas of stained
soils or vegetation were observed on the exterior of the premises. Based on visual opservation
only, the heaviest visual staining was observed on the carpetiag in the living room and upper
floor bedroom. 7he upper floor east room and 6athroom appeared under construction at the
time of the evaluation or had reCently been finis118d. There were no sinks, toilets, or associsted
plumbing in the kRchen or bathrooms. Heat is provided via a hot water system with paseboard
heaters. There were no coMents in the strudure.
Preliminary wipe sample results were conduded using camposite sampling methods only. Any
surface not sampled is sssumed non-compliant with respea to surface methamphetamina
concentrations pef 6 CCR 10143.

packaged in polyethylene disposal bags or a lined dumpster for delivery to a IendFill. Remove all
insulation and contents in the crewlspace. Clean the eMire exterior surfaces W the water heater
boiler, and basepoarcl heaters. All suAaces within the interior of the residenca, inGuding the
garage and crawlspace, must be HEPA-vacuumed and wet-wiped with an appropriate water-
based sotvent (e.g. Simple Green, detergerrt wash, etc.) or other appropriate solvent sukable for
Geaning methamphetamine laboratories and a55ociated chemicals. This may inGude the use oi
alcohoi, methanpl, or other suitable solvent tor removal of oily stains on some surfeces. Clean
the textured ceiling material throughout the svucture; ihis teuture material was sampled 6y a
CDPMExertided Asbestos Inspector and fnund to aontafn no asbesios. Remove plumbing to
the poirri of being "roughed in". Floor drains leading to the public sanitary sewer system should
be flushed wfth Gean water. (Note; The local waterlreatmeM facility must be notified and
informed of these activities prior to 8ushing wfth waterJ

Upon completion of cleanup adivities, KEH wiU condud ppst-deanup sampling of the interior of
the S{te. Methamphetamine surface wipe samples wfll be collected using Whatman 541
Uttrapure, harclened, ashless, Tibrpus flRer papers or 4' X 4' sterile gauze pads saturated wfth
methonol in accordance with laboratory-recommended proceduras.
Samples will bE COIIeCtCd from di5tina one hundred square cefltim0ter (100 CRI2) 58mple aYBas
of the floors, walls, slutls, sinks, showers, iumiture personal-belonging suAaces, and floor dreins
in the work aress. In some cases, up to five sampling locations will be sampled using the same
sample filter resutting in a composite sample area. Resulfs for mese samples will be reported in
average micrograms of inethamphetamine per 100 squam centimeters (total methamphetamine
detected in micrograms divided by the number of 100 square cm areas sampled). Samples wi11
be colleaed from trafflc areas, at or near water or electric sources, anq other areas where
clandestine drug manufacluMng was suspected. At least one disaete or composite sample will
be colleded In eaCh affected room at the Site.
The methamphetamine surlaces samples will be sent with proper chain-of-custody for analysis to
a laboratory qualified to pertorm methamphetamine anatysis under standard tumarountl time
(TA1).
No rooms or sampled matenals showing surface concentrations in excess of 0.5 ug/100 cm' Tor
discrete samples or the equivalent for Composite samples Will be Consideted fd for occupaacy or
releasetl to the Owner's Representative_ Should any woiic area sampied, induding individual or
wmposite samples, reveal surface concentrations in excess of CDPHE standards, that work

Building Official of Wheat Ridge, Colorado, has found the building located on the above
described rea] property to be a Dangerous Building within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the Uniform Code
for the Abatement of Dangerous Buildings, sections in bold are the sections that this
property is in violation of.
SECTION 301- GENERAL
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or the Housing Code. Where terms are
not defined, they shall have [heir ordinary accepted meanings within [he context wi[h which [hey are used.
Webster's Thtrd new lnternational Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary accepted meanings. Words used in the singular masculine gender
include [he feminine and the feminine the maswline.
BUILDING CODE is the lnternational Code Council, as adopted by this jurisdiction
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Sectiou 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the In[ernational Conference of building
Officials, as adopted by this jurisdiction.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the In[ernational Code Council, as adop[ed by this jurisdiction.
SECTION 302 - DANGEROUS BUILDING
For the purpose of this code, any building or sVUCture which has any or all of the condi[ions or defects
hereinafter described shall be deemed ro be a dangeraus building, provided [hat such conditions or defects
exist to the extent that the life, health, property or safety of the public or its ocwpants are endangered.
1. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or
size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exi[ is so
warped, worn. Loose, rom or otherwise unsafe as to no[ provide safe and adequate means of exit in
case of fire or panic.
3. Whenever the sUess in any materials, member or portion [hereof, due to all dead and life loads, is
more than one and one half [imes the working stress or stresses allowed in the Building Code for
new buildings of similar s[tucture, purpose or location.
4. Whenever any portion thereof has been damaged by tire, earthquake, wind, flood or by any
other cause, to such an extent that the structural strength or stability thereof is materially
less than it was beFore such catastrophe and is less than the minimum requirements of the
Building Code for new buildings of similar structure, purpose or location.
5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become
detached or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the
exterior [hereof is not of sufficient strength or stability, or is not so anchored, a[tached oc fastened
in place so as ro be capable of resis[ing a wind pressure of one half of tha[ specified in the building
Code for new buildings of similar structure, purpose or location without exceeding the working
stressed permitted in the Building Code for such buildings.
7. Whenever any portion [hereof has wracked, warped, buckled or settled to such an extent that walls
or other structural portions have materially less resistance to winds or eaz[hquakes [han is required
in the case of similaz new construction.
8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of
any portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to
partially or completely collapse.
9. Whenever, for any reason, the bui►ding or structure, or any portion thereof, is manifesdy
unsafe for purpose of which it is being used.
10. Whenever the exterior walls or other ver[ical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does no[ fall inside the middle on
[hird ofthe base.
11. Whenever the building or sVUCture, exclusive of the founda[ion, shows 33 percent or more damage
or deterioration of its supporting member or members, or 50 percen[ damage or deterioration of i[s
non-suppor[ing members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so.damaged by fire, wind, earthquake or flood,
or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to
children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable
persons to resort thereto for the purpose of committing unlawful or immoral acts.
13. Whenever any building or stncture has been constructed, ezists or is maintained in
violation of any specific requirement or prohibiGon applicable to such building or structure
provided by the building regulations of this jurisdiction, as speci6ed in the Building Code or
Housing Code, or of any law or ordinance of this state or jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any building or sVUC[ure which, whe[her or no[ erected in accordance wi[h a all
applicable laws and ordinances, has in any non-suppor[ing par[, member or por[ion less than 50
percent, or in any sopporting part, member or portion less the 66 percent or the (i) strength, (ii)
fire-resisting qualities or chazacteristics, or (iii) weatheo-resisting qualities or chazacteristics
required by law in the case of a newly cons[ruc[ed building of like area, height and occupancy in
the same location.
15. Whenever a building or structure, used or intended to be used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay, damage, faulty construction or
arrangemeny inadequate light, air or sanifation facilities, or otherwise, is determined by the
health of£icer to be unsanitary, unfit for human habitation or in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition,
deterioration, damage, inadequate exists, lack of sufticient fre-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or other cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a wndition as to constitute a public nuisance
known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains on a site after the demolition or
destruction of the building or structure or whenever any building or svucture is abandoned for a
period in excess of six months so as to cons[itute such building or portion thereof an a[tractive
nuisance or hazard to the public.
The 1997 Uniform Housing Codes states
SECTION 1001- DEFINITIONS
1001.1 General. Any building or portion thereof tha[ is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or pottion thereof, including any dwelling uni[,
guest room or suite or rooms, or the premises on which the same is loca[ed, in which there exists any of the
conditions referenced in this section [o an extent that endangers the life, limb, health, property, safety or
welfare of the public or the ocwpants thereof, shall be deemed and hereby are declazed to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they aze
when [hey are in sanitary. Inadequate sanitation shall indude, but no[ be limited to, the following:
1. Lack of or improper water doset, lava[ory, bathtub or shower in a dwelling unit or lodging house.
2. Lack of or improper water closets, lava[ories, and bathtubs or showers per number or guests in a
hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of ho[ or cold running wa[er to plumbing fixtures in a hotel
5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventila[ing equipment.
8. Lack of minimum amounts of namral light and ventilation require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
11. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate gatbage and rubbish srorage and removal facilities as determined by the health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they aze or
contain structural hazazds. SVUCtural hazazds shall include, but not be limited ro, the following:
1. De[eriorated or inadequate foundations.
2. Defective or deteriorated t]ooring or t7oor supports.
3. Flooring or tloor supports of insufficient size to carry imposed loads with safety.
4. Members oF walls, partitions or other vertical supports that split, lean, list or buckle do to
defective material or deteriorations.
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag,
split or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are
of insufScient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge o settle due ro defec[ive material or deterioration.
9. Fireplaces or chimneys that are of insufficient size or strength to cazry imposed loads with safety.
1001A Nuisance. Buildings or portions thereof in which there exists any nuisance as de6ned in this
code are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code
requirements in effect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Aazardous Plumbing. Plumbing that was installed in violation of code requirements in effect
at the time of installation or plumbing not installed in accordance with generally accepted
construction practices in areas where no codes were in effect or that has not been maintained in good
condition or that is not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was ins[alled in violation of code
requirements in effect at the time of installation or mechanical equipment no[ installed in accordance with
generally accepted construction practices in azeas where no codes were in effect or [hat has not been
maintained in good condition or tha[ is not being used in a safe manner shall be considered substandazd.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, appazatus, equipment, combustible waste, or
vegetation [hat, in the opinion of the chief of [he fire department, is in such a condition as to cause a fire or
explosion or provide a ready fuel ro augment the spread and intensity of fire or explosion arising from any
cause shall be considered substandard.
100110 Faulty Materials of Construction. The use of materials of construction, except those that are
specifically allowed or approved by this code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
100111 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic
matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials
or conditions on a premises constitutes fire, health or safety hazards [ha[ shall be aba[ed in accordance with
the procedures specified in Chapter 11 of this code.
100112 Inadequate Fxits. Except for those buildings or portions thereof that have been provided with
adequate exit facllities conforming ro the provisions of this code, buildings or portions thereof whose exit
facilities were installed in violation of code requirements in effect at the time of their construction or whose
exit facilities have not been increased in number or width in rela[ions to any increase in occupant load due
to alterations, additions or change in use or occupancy subsequent [o the time of cons[ruc[ion shall be
considered substandard.
Notwithstanding compliance with code requirements in effect at the time of their conswction,
buildings or portions thereof shall be considered substandard when the building official finds that an unsafe
condition exists through an improper location of exits, a lack of an adequate number or width of exits, or
when other conditions exist that aze dangerous ro human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered subs[andard when they are not provided with [he fire-resistive conshuction or fire-
extinguishing systems or equipment required by this code, except those buildings or portions thereof that
conformed with all applicable laws at the time of their construction and whose fire-resistive integity and
fire-extinguishing systems or equipment has been adequately maintained and improved in relation to any
increase in occupant load, alteration or addition, or any change in ocwpancy.
1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or
dining purposes [hat were no[ designed or intended ro be used for such occupancies shall be considered
substandazd.
The following is a list of items that shall be fixed to meet code:
1. The siding shall be repaired.
2. Broken windows shall be fixed.
3. Openings to the building shall be covered.
4. The roof shall be fixed or replaced.
5. Vents shall be installed with jackets properly.
6. Siding is falling off.
7. Electrical wiring shall be fixed to code 2002 NEC.
8. Structural elements shall be fixed.
9. Need steps for the back door.
10. Need to have running water and power for sanitation per
building code.
11. All faulty weather protection shall be fixed.
12. Note: The City needs to inspect the inside to determine if there
are other life safety issues. These items listed may not be the
only items that need to be fixed.
ORDER
I. The City of Wheat Ridge Building Official has determined the building
referenced above to be a Dangerous Building. The owners aze ordered to pull a
building permit to fix the deficient items. The Building Department will post the
building as a Dangerous Building due to the amount of life safety issues.
Pursuant to Code all occupants shall be required to vacate the property. This is
therefore required in order to protect life, health and safety of the public.
II. If the structure has not been brought to code or demolished by December 9, 2005.
Section 801 in the Uniform Code for the Abatement of Dangerous Buildings
states, "801.1 Procedure. When any work of repair or demolition is to be done
pursuant Section 701.3, Item 3, of this code, the building official shall issue an
order thereof to the director of public works and the work shall be accomplished
by personnel of this jurisdiction or by private contract under the direction of said
director. Plans and specifications therefore may be prepared by said director, or
the director may employ such azchitectura] and engineering assistance on a
contract basis as deemed reasonably necessary. If any part of the work is to be
accomplished by private contract, standazd public works contractual procedures
shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall
be paid from the repair and demolition fund, and may be made a special
assessment against the property involved, or may be made a personal obligation
of the property owner, whichever the legislative body of this jurisdiction shall
deternune is appropriate."
The property owner and all occupants are hereby ORDERED TO CEASE AND
DESIST occupancy and use of the above described building. The Building Official
shall cause the property to be posted with the attached Notice and shall take action
to remove all future occupants from the building until the building is brought up to
code.
REMEDIAL ACTION
The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct any deficiencies.
III. All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Building Code
Advisory Board ar known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an administrative hearing and
deternunation of this matter. FILING OF AN APPEAL SHALL NOT STAY TFIE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.

Colorado and to the Zoning Regulations and Building Codes of Wheat Ridge, Colorado orany other applicable ordinances of
the City.
(2) This permit shall expire if (A) the work authorized is not commenced within sixty (60) days from issue date or (B) the building
authorized is suspended or abandoned for a period of 180 days.
(3) If this permit expires, a new permil may be acquired for a fee of one-half the amount normally required, provided no changes
have been orwill be made in the original plans and specifications and anysuspension orabandonment has notexceeded one
(1) year. If changes have been or if suspension or abandonment exceeds one (1) year, full fees shall be paid for a new permit.
(4) No work of any manner shall be done that will change the natural flow of water causing a drainage problem. (5) Contractor shall noti(y the Building Inspector twenty-(our (24) hours in advance for all inspections and shall.receive written
approval on inspection card before proceeding with successive phases of the job. (6) The issuance of a permit or Ihe approval of drawings and speciications shall not be construed to be a permit for, nor an
approval of, any violation of the provisions of lhe building codes or any other ordinance, law, rule or regulation. All plan review
