Why do you need a building permit? 2. What are your setback requirements? 3. What are the building requirements for this type of structure? In response to the first question, during the 1989 Uniform Building Code (U.B.C.) adoption cycle, City Council deleted ARicle 301(b)(I): ^ S' 4cce5sorv Buildines from the building code. This action required buitding permits for one-story accessory buildings smaller than 120 squaze feet. During the subsequent code adoptions, this deletion has been upheid by Council and has remained deleted from the adopted codes. Any accessory building, including a shed now requires a building permit. In response to the second question, setback and buiiding separation requirements can sometimes be confusing. Setbacks in the Zoning Ordinance and building sepazation requirements in the U.B.C. serve different purposes and apply to different circumstances. Zoning setbacks aze established to ensure adequate light and air circulation between buildings. Building separations in the U.B.C. are established primarily for fire safety. The setbacks established in ihe Zoning Ordinance always apply. The building code requires different construction depending upon the distance a building is from the property line. The Zoning Ordinance requires a five (5) foot setback in most zone districts for accessory structures (sheds). No special construction is required because this setback is more than three (3) feet as required in the building code. If the setback were 0 feet for accessory structures under the zoning, a shed could be constructed at three (3) feet from the property line without special construction , or could be closer with the appropriate fire wall construction. The Zoning Ordinance will determine the allowed setback in most cases. _ ,rj RECVCLED PAPER F I In response to the third question, any structure that is constructed under the U.B.C., whether a permit is required or not, is still required to conform to the adopted standazds.
