TERMS AND CONDITIONS I/We the owners of the premises described below, hereinafter referred to or understood as "Owner/Buyer," offer to contract with Precision Siding & Construction Co., Inc. hereinafter referred to as "PSC" to furnish and deliver and arrange for installation of all materials necessary to improve the premises according to the specifications attached hereto. I. This agreement is subject to final approval by PSC and is the entire agreement of the parties and no other terms will be recognized. 2. Any supplemental payment from the buyer's insurance company is due to PSC including Contractor's Overhead and Profit. 4. Labor Warranty does not cover damage caused by natural disasters: lightning, gale force wind, hurricane, tornado, hailstorm, and impact of foreign objects or other damages due to settlement, distortion, improper ventilation of the building envelope, or failure of the roof deck, walls, or foundation of a building. PSC shall be held harmless and free from all liability and legal action relating to any presence of Mold at the subject property regardless of the legal theory upon which any such claim rests. 5. PSC is not responsible to provide any materials or to perform any work other than what is described above. 6. 1.5% monthly will be added in daily increments to the balance of any and all unpaid portion of contract, commencing upon completion date reception of remaining insurance proceeds. 7. PSC will perform all work according to local building codes and specifications. 8. If this contract is canceled by the buyer later than three (3) days from signing, the buyer shall pay to PSC, an amount equivalent to thirty percent (30%) of Approved Replacement Cost Value, as liquidation damages, and PSC agrees to accept such as reasonable and just compensation for said cancellation and Consequential loss of profits. 9. Contract may be rescinded within 72 hours after the property owner receives written notice that the Insurance claim has been denied. 10. Buyer shall provide all electricity necessary to complete the above scope of work. 11. PSC shall not be liable for any structural movement, settling, cracks in drywall, driveways or dents in gutters created during normal construction procedures. 12. Before any warranty, written or otherwise, is to be considered valid, the Contract must be paid in full. In the event of a problem, due to Workmanship, PSC must be notified in writing within 10 business days of discovery of said problem. PSC must be allowed to inspect and correct the problem before anyone else, and will not be held responsible for any problems arising from long-term exposure to water. 13. Each trade represented will be payable in full at completion of said trade. 14. If customer fails to pay for services performed by PSC then the Customer is responsible to pay all legal Costs and Fees acquired by PSC in pursuing payment. 15. Final payment shall not be held up while waiting for city or county inspection. 16. PSC reserves the right to reject work at any time.
