This permit was issued in accordance with the provisions set forth in your application and is subject to the laws of the
State of Colorado and to the Zoning Regulations and Building Codes of Wheat Ridge, Colorado or any other applicable
ordinances of the City.
This permit shall expire 180 days from the issue date. Requests for an extension must be received prior to expiration
date. An extension may be granted at the discretion of the Building Official.
If this permit expires, a new permit may be acquired for a fee of one-half the amount normally required, provided no
changes have been or will be made in the original plans and specifications and any suspension or abandonment has not
exceeded one (1) year. If changes have been or if suspension or abandonment exceeds one (1) year, full fees shall
be paid for a new permit.
No work of any manner shall be done that will change the natural flow of water causing a drainage problem.
Contractor shall notify the Building Inspector twenty-four (24) hours in advance for all inspections and shall receive
written approval on inspection card before proceeding with successive phases of the job

Please be advised that at its meeting of March 27, 2008, the Board of Adjustment APPROVED
your requests for approval of (1) a 3 foot variance to the 4 foot maximum fence height
requirement within a minimum 30 foot front yard setback; and (2) a 1-foot variance to the 4-foot
maximum foot variance to the 6-foot maximum fence height requirement behind the front setback
line resulting in a 7-foot fence on property zoned Commercial One and Agricultural-Two and
located at 4315 Van Gordon Street for the following reasons:
1. The requests will not alter the character of the neighborhood.
2. The requests would not be detrimental to public welfare.
3. The variances, with conditions, would result in the addition having a minimal impact on
the surrounding properties
4. The requests are consistent with the existing conditions on the property.
5. Security in this type of location is a legitimate concern; therefore, the visual screening
provided by a 7-foot fence is logical.
With the following conditions:
1. The fence must be screened with slats, mesh or other similaz material that is durable.
2. The color of the screening materials shall be non-intrusive in color and reflect the
character of parks and open space.
Enclosed is a copy of the Certificate of Resolution, as well as a draft copy of the minutes, stating
the Board's decision which became effective the date of the meeting, March 27, 2008. This

WHEREAS, Board of Adjustment Application Case Number WA-08-01 is an appeal to this
Board from the decision of an administrative officer and in recognition that there were no
protests registered against it; and
WHEREAS, the property has been posted the fifteen days required by law; and
WHEREAS, Yhe relief applied for MAY be a'anted without substantially impairing the intent
and purpose of the regulations governing the City of Wheat Ridge.

B. Case No. WA-O8-Ol: An application filed by the City of Wheat Ridge
~ Parks and Recreation Department for approval of (1) a 3 foot variance to
the 4 foot maximum fence height requirement within a minimum 30 foot
front yard setback; and (2) a 1-foot variance to the 4-foot maximum foot
variance to the 6-foot maximum fence height requirement behind the front
setback line resulting in a 7-foot fence on property zonedCommercial One
and Agricultural-Two and located at 4315 Van Gordon Street.
This case was presented by Adam Tietz. He entered all pertinent documents into
the record and advised the Board there was jurisdiction to hear the case. He
reviewed the staff report and digital presentation. The subject property is
currently undeveloped and will remain'in this manner. The area would be used
for storage of landscape and plantmaterials integral to the operation of the Parks
Department. Staff recommended approval with conditions as outlined in the staff
report.
In response to a'question from Board Member ABBOTT, Mr. Tietz explained that
the seven feet is being requested in order to be consistent with the other seven
foot sections on the property. Board Member ABBOTT commented that seven
feet would provide more security.
Board Member HOVLAND asked if the variance would stay with the land if it
should,ever change ownership. Mr. Tietz explained that the fence would stay
unless tlie Board placed a condition on the variance.
In response to a question from Board Member BUCKNAM, Mr. Tietz explained
that, for the intended use, the code requires that landscape materials be screened
from adjacent properties which can be accomplished with a screened fence.
Board Member BELL suggested that pine-beetle-kill lumber fencing with pickets
for security be used, which would be much more attractive than chain link with
screening strips. The wood fencing could be added to the existing chain link
fence. She also suggested installing landscaping in front of the fence.
In response to a question from Board Member HOWARD, Mr. Tietz stated that
the subject property is not in the floodplain. The reason the city purchased this

piece oFproperty is that the property where landscaping storage previously took
place has recently been included in the floodplain.

Margaret Paget, Open Space Coordinator of the City of Wheat Ridge, was sworn
in by Chair BLAIR.
Board Member LINKER commented that consideration should be given to
maintenance that would be required by wood fencing.
In response to questions from Board Member BUCKNAM, Ms. Paget stated that
the size of mulch piles, gravel, etc. would vary according to supply. Trees would
be temporarily stored until such time as they could be planted.
In response to a question from Board Member BELL about materials blowing
around during windstorms, Ms. Paget replied that some materials are covered
with tarps and the fence screening would help contain some material.
Board Member LINKER commented that appearance was more important than
security considering the types of materials that will be stored on the property.
Board Member BELL asked Ms. Paget if she would be open to changing the type
of screening fQr the fenee. Ms. Paget stated that she wanted to do things
economically, but would be willing to entertain different types of screening. The
fence would have to be fireproof so it wouldn't catch fire when the ditch is
burned.
Board Member BELL commented that she did not believe the type of screening
proposed fits with attempts to improve the aesthetic appeal of the city.
There was no one from the public to speak. Chair BLAIR closed the public
hearing.
Upon a motion by Board Member PAGE and second by Board Member
HOVLAND, the following resolution was stated.
Whereas, the applicant was denied permission by an administrative officer;
and
Whereas, Board of Adjustment Application Case No. WA-08-01, is an appeal

Board Member BELL offered a friendly amendment that the preferred screening
material be the use of pine-beetle-kill wood pickets that would provide security
and would be environmentally sensitive by finding a re-use for something that has
become a;bigproblem for our state.
The amendment was not accepted by Board Member PAGE.
Board,Member ABBOTT offered a friendly amendment to add the following
reason: Securiry in this type of location is a legitimate concern, therefore the
visual screenzng provided by a 7 foot fence is logical.
The amendment was accepted by the Board Members PAGE and
HOVLAND.

DEMOLITION APPROVAL NOTICE
This approval notice is granted subject to Colorado Air Quality Control Commission
Regulation No. 8, Part B, adopted December 16, 2003, and effective March 2, 2005, the
Colorado Air Pollution Prevention and Control Act C.R.S. (25-7-101 and 25-7-501 et seq).
This notice signifies that the structure was inspected for asbestos and CFCs and the
demolition contractor has properly notified the Colorado Department of Public Health and
Environment pursuant to Regulation No. 8, Part B.
As a contractor, you may be subject to other demolition licenses and permits, depending on
the requirements of the county and municipality in which the wark is being performed. The
Colorado Department of Public Health and Environment, Air Pollution Control Division,
strongly suggests that you check with county and municipal authorities in arder to determine
any other local building/permitting requirements that must be met.
THE ORIGINAL PERMIT MUST BE POSTED ON SITE AT ALL TIMES.

January 3, 2001. It was found that the greenhouse at the SW corner ofthe street are in use. The
greenhouses have numerous electrical concerns.
Also there appeats to have been radiant heat installed within the greenhouses. Do you know if any
permits were obtained?
I have enclosed a copy of the letter and fire inspection for your file.

The Arvada Fire Protection District responded to a reported gas leak at 4315 Van Gordon Street
on Januaty 3, 2001. At the time of this incident, Sre suppression crew noted that several fire code
discrepancies were present.
On January 19, 2001, I conducted an on-site inspection ofthe facility and noted code concerns
involving exits, portable fire extinguisher's, electrical wiring and heating appliances. A fire
inspection survey report is attached for your review.
We aze presently scheduling a follow-up fire inspection for Mazch 1, 2001. If this time frame is
not workable, or if you have any questions, need additional information, please feel free to give
me a call.

Pumper 2: U/A crew from pumper 2 taiked with the tenant in unit 12. She informed us that she had smelled a strong
gas odor early in the morning and again after tunch, thats when she called
A.F.P.D. The RP said she thought the oder was coming from the green houses to the South. Pumper 2 crew then
investigated the green houses at 4315 Van Gorden St and found natural gas odors coming from two different areas.
We found that the leaks were coming from a furnace and a boiler. Public Service on scene repaired the leak on the
furnace and shut the gas off to the boiler. The ovmer of the green house said he will have everything checked and
repaired. The address at 4315 Van Gordon dces not come up in the Cad as business.

The following fire code discrepancies were noted as a result of our Sre uispection of this date.
Exits:
1. Exit signs need to be placed on or above eacit doors and eacit routes.
Portable Fire Extinguisher's
1. One Sre extinguisher was located in the break mom The fire extinguisher was last inspected
June of 1997. The e3Ringuisher needs to be mspected by a fire extinguishers service company
and hung up in an accessible location.
2. Portable &re extinguisher's were not noted within the greenhouse areas. Fire extinguisher's
need to be installed at the exit doors and located in such a manner that the maximum travel
distance does not exceed 75 feet. Fire extinguisher's wil need to be a 4-A rated, 10 ih. ABC
dry chemical unit, fully charged with current inspection tag, mounted not less than three feet
nor more than five feet from the floor to the top of the mounting bracket.
Electrical:
Numerous electrical discrepancies were noted within the facility. Electrical repairs will need to be
cocnpleted by a State of Colorado ficensed electrician. Permits will need to be obtained from the
City of Wheat Ridge Building Department. The following list is not intended to not every
electrical discrepancy that was observed within the buildings, but to serve as a guide to the
concerns of the Fire Marshal's Office.

The main electrical disconnect is obstructed by storage. A m;o;rnum of a three foot cleaz space
needs to be provided and maintained.
2. The main service conduit on the north side of the building is falling and needs to be secured.
3. Circuit breaker panels aze missing the front covers.
4. Circuit breakers need to be identified as to the azea or equipment served.
5. Receptacles aze missing cover plates.
6. Covers missing from junction boxes.
7. Rumning splices were noted in electrical wiring.
8. Improper wiring to receptacles. VJ'uing is subject to damage. Receptacle is not within a
junction box, or cover plate on receptacles.
9. Lighting hung over plant beds appears to be improper.
10. Improper wiring running through doorway to the boiler room
11. Flexible power cords spliced.
12. Improper wiring along north wall by telephone.
13. Unused wiring needs to be properly abandoned..
14. Extension cords in use in place of permanent wiring.
Heating Appliances
1. The odor of natural gas was detected in the bofler room.
2. Boilers have State of Colorado inspection number and current copies of the boiler inspectaons
should be at the site.

Storage is placed next to building. In the event of a weed or exterior Sre, storage could
allow fue extension into the building.
2. Grass and weeds need to be kept cut to eliminate fire damage to the structure from an
exterior weed fire.

1. I was unable to locate the gas meter for the building. If this information could be provided on
the follow up inspection

On July 19, 2002 I visited your address with and at the request of the Arvada Fire Protection
District to re-inspect the above referenced properry. We found multiple violations still in
existence from a previous inspection and notice and order issued in Mazch 2001. Below is a
partial list of violations still existing at this address,
~ Electrical panel covers missing
~ Improper electrical cord splices and extension cords
~ Improper electrical connections at operating equipment, i.e. pumps, eachaust fans, unit
heaters.
~ Improperly installed gas heaters.
Improperly labeled and maintained exits within facility.
Inoperable derelict vehicles.
Although there has been some improvement in the properry, there are still significant safety and
fire hazazd issues that still need to be repaired or removed. The last time Mr. Wilson and I spoke
he requested an extension until after growing season to complete the repairs, I granted this
extension due to the unprovements that had been completed up to that point.
Due to no further improvements being made in the yeaz since our last inspection and serious fire
and life safety violations still existing the City must requue the following,
1. Have a registered electrical and mechanical contractor acquire permit and commence
work to repair, replace or remove violations no later than Au¢ust 5, 2002.
2. All violations must be abated, inspected and approved no later than Seotember 27.
2002.
Failure to meet these date will result in further enforcement action being taken and gas and
electric services being disconnected to the above referenced address until all violations have been
abated, inspected and approved. Should you have any comments regazding these issues please
