This is the first significant commercial development within the 38`' Avenue streetscape ixnprovement azea. A 25-foot high pole sign with a 5-foot setback from 38th Avenue is inconsistent with the objectives of the Streetscape and Architectural Design Manual and the intent of the City's investment in this corridor. The allowance for two wall signs on the building provides sufficient visibility for motorists and pedestrians. Allowance of a 25-foot high pole sign in this location would also contribute to visual clutter on 38th Avenue and would not compliment the building's azchitecture and materials. The applicant could construct a freestanding monument style sign 7 feet in height with a 5-foot setback without the need for a vaziance. Ryan Kring 18034 Pierce Road Greenland, IN Mr. Kring was sworn in by.Chair DRDA. He stated that good exposure through signage is very important in order to direct customers to the business. The sign requested is compafible with other Advance Auto Parts stores thronghout the country. He entered two additional options for signage into the record. Copies were provided for Board members. He stated the applicant was complying with city requirements regarding landscaping and building materials. Without the city's Siseetscape and Architectural Manua1 requirements, the building could have been set further back and had room for a larger sign without need for a variance. John Montoya 3755 Benton Street Mr. Montoya was sworn in by Chair DRDA. Mr. Montoya lives next door to the proposed building and spoke in favor of the application. He stated that the applicant's contractor had built a 6-foot fence for him and also paid for water the Montoya's allowed him to use. He stated that the signs would not bother him. Charles Durbin 3703 Ames Street Mr. Durbin was sworn in by Chair DRDA. He stated that he was not opposed to the business but spoke in opposition to the vaziance. He stated that the city has spent over three million dollazs to improve 38"' Avenue and the variance would not be compatible with other businesses in that area. The variance would also violate five sections of the sign code. He submitted two photos of Advanced Auto Parts store signs in Arvada. Ronald Peterson 4106 Yates Street Mr. Peterson was sworn in by Chair DRDA. He is the owner of the car wash adj acent to the proposed building. He stated that he was not opposed to the business but was opposed to the sign variance because the sign would practically block the view of his caz wash. Dear Mr. Brossman, The purpose of this amendment to the original approved drawings is to modify the detention pond as well as to incorporate landscape features consistent with the existing City of Wheat Ridge streetscape into the revised design. The location and capacity of the original pond has not changed with this modification. The design and modifications to date have included the following: The original approved design called for an earth berm to be constructed 1-foot high along the north and east sides of the proposed pond. The elevation of this berm was to be 5415.41 with a 10-foot wide weir opening at an elevation of 5414.41 for the control of the 100-year storm event. The 100-year storm weir openmg was to be constructed using the block wall in the original location and elevation of 5414.41. Mr. David Brossman January 24, 2006 Page 2 of 2 Amendment No. 2, dated January 24, 2006, proposes to omit the outer Keystone type block wall and re-establish the earth berm on the north and east sides of the detention pond. The reason for re-establishing the earth berm is to preserve the City's existing streetscape and to utilize the berm as the required 1-foot freeboard above the 100-year elevation. To accommodate the required storage volume, (3468 cubic feet - see final drainage report for required volume), the proposed block wall will be 3.7-feet tall. Calculations for the wall are provided under separate cover. The proposed curb and gutter along the south and west sides of the pond will also be used to detain water in the pond. The remaining detained volume wili be in the parking area of the site at 6-inches deep (maximum). Plan sheets C-2 and C-4 have been modified to reflect the new pond configuration and are being submitted as Addendum No. 4 in 24" X 36" and 11" X 17" format (two sets each) for your review. The volume calculations for the revised pond configuration are aiso being submitted on 8.5" x 11" sheets for insertion into the final drainage report. In order to receive fmal approval, a few additional documents need to be received. Please also refer to the attached redlined comments. Planning Division The Plamiing Division approves of the revised detenrion facility with the following comments and conditions: 1. The existing trees in the City's streetscape area cannot be removed during this process. If the existing shrubs aze to be removed, they must be replaced to match existing condiiions. 2. Please indicate the height of the berm. It appears that the berm is approximately 1 foot high, which is an acceptable dimension so as not to obstruct the view of the fence. 3. Given the height of the MSE wall (approximately 4 feet), the entire detention area must be enclosed, as there will be pedeshian traffic azound all areas of the detention facility. The enclosure must consist of a fence structure to match the existing city streetscape improvements and the proposed improvements on Benton Street. If there is not sufficient space to accommodate both the fence and the plant materials, the fence may be constructed with no plant material on the south and east sides of the detention facility (see redlined plans). Additional item: Due to the height of the retaining walls proposed azound the detention facility, protective fencing will need to be placed. A detail of the fencing (including the specific type) will need to be subxnitted for review and approval. A statement of intent to match the existing streetscape fencing is acceptable. Whenever any portion thereof has been daznaged by fue, earthquake, wind, flood or by any other cause, to such an extent that the structural strength or stability thereof is materially less than it was before such catastrophe and is less than the nuniumm requuements of the Building Code for new bwldings of similar structure, pucpose or locauon. 5. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe tor purpose of whic6 it is being used. 10. Whenever the building or structure has been so damaged by fue, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to clrildren; (ii) a harbor for vagrants, rriminals or immoral persons; or as to (iri) enable persons to resort thereto for the piupose of committing unlawful or immoral acts. 13. Whenever a building or stcucture, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, fau1Ty consiruction or arrangement, inadequate light, air or sanitation facilities, or othenvise, is determined by the health officer to be unsanitary, unfit for human habitafion or in such a condirion that is likely to cause siclmess or disease. 16. Whenever any building or struchue, because of obsolescence, dilapidated condition, deterioration, clamage, inadequate exists, lack of sufficient fue-resisrive construction, faulty elech-ic wiring, gas connections or heating appazatus, or other cause, is deternilned by the fire mazshal to be a fire hazazd. 17. Whenever any building or s4ucture is in such a condirion as to constimte a public nuisance lmown to the common law or in equity jurisprudence. 18. Whenever any portion or a building or structure remains on a site after the demolirion or destruction of the building or structure or whenever any building or structure is abandoned for a period in excess of six montUs so as to constitute such building or poriion thereof an attracfive nuisance or hazard to the public. The 1997 Uniform Housing Codes states: SECTION 1001 - DEFINITIONS 1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit, guest room or suite or rooms, or the premises on which the same is located, in wluch there exisu any of the conditions referenced in tlils section to an extent tUat endangers the life, limb, health, properry, safety or welfaze of the public or the occupanu thereof, shall be deemed and hereby are declazed to be substandazd buildings. 1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandazd when they are when they are in sanitary. Inadequate sanitation shall include, but not be lunited to, the following: I. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house. 2. Lack of or improper water closets, lavatories, and bathtubs or showers per oumber or guesu in a hotel. 3. I,ack of or improper kitchen sink in a dwelling unit. 4. Lack of hot or cold iuuuing water to plumbing fixtures in a hotel 5. Lack of hot or cold ruuning water to plumbing fixtures in a dwelling unit or lodging house. 6. Iack of adequate heating facilities. 7. Lack of or improper operarion or required ventilating equipment. 8. Lack of minimum amounts ot natural light and ventilation require by this code. 9. Room and space dimensions less than requ'ued by tlus code. 10. Lack of requued elechical lighting. 11. Dampness of habitable rooms. 12. Infestation of insects, vemiln or rodenu as determined by the health officer. 13. General dilapidation or improper maintenance. 14. Lack of connection to requued sewage disposai system 15. Lack of adequate gazbage and rubbish storage and removal facilities as determined by the health officer. 10013 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or contain sauctural hazards. Structural hazazds shail include, but not be l'united to, the following: 1. Deteriorated or inadequate foundations. 2. Defective or deteriorated flooring or floor supports. 3. Flooring or floor supports of insufficient size to carry imposed loads with safety. 4. Members of walls, parhitions or other vertical supports that split, lean, list or buckle do to defecfive material or deteriorations. 5. Members of walls, paztitions or other vertical supports that are of insufficient size to cazry imposed loads with safety. 6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split or buckle due to defective material or deterioration 7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of iusufficient size to carry imposed lads with safety. 8. Fireplaces or chimneys that list, bulge o settle due to defecfive material or deteriorarion. 9. Fireplaces or chimneys that are of insufficient size or strength to carry unposed ]oads with safety. 1001.4 Nuisance. Buildings or portions thereof in wluch there exists any nuisance as defined in this code are deemed substandazd buildings. 10015 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code requirements in ellect at the time of insta0ation or electrical wiring not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.6 Hazardous Plumbing. Plumbing that was installed in violafion ot code requirements in effect at the time of installation or plumbing not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a sate manner shall be considered substandard. 10019 Hazardous MecLanical. Mechanical equipment that was installed in violauon of code requirements in effect at the time of installation or mechanical equipment not installed in accordance with generally accepted construcfion practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe mauuer shall be considered substandard. 1001.8 Faulty Weat6er ProtecGons. Buildings or portions thereof shall be wnsidered substandard when they have faulty weather protections, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineftecHve waterproofing or eaterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weatLer protecfion for exterior wall coverings, including lack of paint, or weathering due to laek of paint or other approved protective covering. 4. Broken, rotted, split or buckled exterior wall coverings or roof coverings. 1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combusrible waste, or vegetation that, in the opinion of the chief of ffie fire deparhnent, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fue or explosion arising from any cause shall be considered substandard. 1001.10 Faulty Materials of Construction. The use of materials of constructioq except those that are specifically allowed or approved by this code and the Building Code, and that have been adequately maintained in good and safe conditions, shall cause a building to be substandard. 1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials or conditions on a premises constitutes fire, health or safety hazards that s6a11 be abated in accordance with t6e procedures specified in Chapter 11 of this code. 1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with adequate exit facilities confomvng to the provisions of ttris code, buildings or portions thereof whose exit facilities were installed in viola6on of code requiremenu in effect at the time of their construcfion or whose exit facilities have not been increased in number or width in relations to any increase in occupant load due to altentions, additions or change in use or occupancy subsequent to the time of construction shall be considered substandard. Notwithstanding compliance with code requirements in effect at the time of theu construction, buildings or portions thereof shall be considered substandard when the building official fmds that an unsafe condifion exists tUrough an improper location of exiu, a lack of an adequate number or width of eacits, or when other condirions exist that are dangerous to human life. 100113 Inadequate Ftire-Protection or Fire-Fighfing Equipment. Buildings or portions there of sttall be considered substandazd when they aze not provided with the fire-resisrive construction or fue- extinguishing systems or equipment requ'ued by this code, except those buildings or portions thereof that conformed with all applicable laws at the time of theu conshuction and whose fire-resistive integrity and fire-extinguishing systems or equipment has been adequately maintained and improved in relation to any increase in occupant load, aiteration or addition, or any cLange in occupancy. . 1001.14 Improper Occupancy. Al] buildings or portions thereof occupied for living, sleeping, cooking or dining purposes that were not designed or intended to be used for such occupancies shall be considered substandard. The following is a list of items that shall be fixed to meet code: 1. Inside of the house was not inspected and other code violations may need to be addressed. 2. Broken windows need to be fixed. 3. All hazardous wiring needs to be repair by licensed Electrician. 4. Electrical Service riser has no drip loop. 5. Front entry deck is unsafe. 6. Concrete step in front of the building is unsafe. 7. Anti siphon hose bib is installed upside down. ORDER 1. The City of Wheat Ridge Building Official has determined the building referenced above to be a Dangerous Building. The owners aze ordered to pull a building permit to fix the deficient items. If such items are not fixed by June 1, 2005, the Building Department will post 5400 W. 38`h Ave. in Wheat Ridge CO. 80033 as a Dangerous Building. Pwsuant to Code future tenants shall not be permitted to occupy this units until all issues are brought up to code and are inspected by the City of Wheat Ridge Building Department. This is therefore required in order to protect life, health and safety of the public. If the structure has not been brought to code or demolished by June 1, 2005. Section 801 in the Uniform Code for the Abatement of Dangerous Buildings states, " 801.1 Procedure. When any work of repair or demolition is to be done pursuant Section 701.3, Item 3, of this code, the building official shall issue an order thereof to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director. Plans and specifications therefore may be prepared by said director, or the d'uector may employ such architectural and engineering assistance on a contract basis as deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standazd public works contractual procedures shall be followed." Secrion 801.2 states, "801.2 Costs. The cost of such work shall be paid from the repair and demolition fund, and may be made a special assessment against the property involved, or may be made a personal obligarion of the properiy owner, whichever the legislative body of this jurisdiction shall determine is appropriate."
