Dear Mr. Cutler,
On behalf of the Wheat Ridge Sanitation District (WRSD), Martin/Martin Inc., acting as the District Consulting Engineer,
offers the following in response to the site plan received March 3, 2020, concerning a proposed commercial structure
and 14 attached residential units separated into two buildings at the above referenced address. The Wheat Ridge
Sanitation District has no objections with the proposed development conditional on the items identified herein are fully
addressed. The following are general requirements for sanitary sewer service. Rules, Regulations and Standards of the
District must be complied with at all times. Applicant to directly coordinate with District for review of plans.
The subject lot is entirely within the service and boundary area of the Wheat Ridge Sanitation District. Treatment of
sewage generated within the Wheat Ridge Sanitation District is provided by Metro Wastewater Reclamation District.
Below are some initial comments based on the site plans received on March 3, 2020:
Utilities Site Plan
• A 25' easement (20' exclusive) with drive -able surface will be required to be dedicated to the District by
separate document. There cannot be any above ground structures within the easement boundary or other
utility within 10' outer edge of the sanitary mainline. A legal description and exhibit must be provided.
• Provide detail for any sanitary utility crossings and offset distances between other utilities and structures.
• Provide a profile design of the proposed sanitary mainline extension.
• Provide standard details for sanitary system such as: Wye connection, manholes, trench, asphalt section,
tracer wire, etc.
• Provide information on existing manholes upstream and downstream of proposed connection (rim & invert
d ista nce ).
• The sanitary line shall be 8" PVC and connection to sanitary mainline requires a manhole.
General
• Provide additional information as to the nature of the commercial retail development to better understand
service capabilities and requirements for pre-treatment such as grease interceptor.
• No further review of the plans will occur until deposit has been paid.
Existing District Sanitary Sewer Mainline(s)
Wheat Ridge Sanitation District has the following sanitary sewer mains in the vicinity of the proposed property:
• 12 -inch mainline running west to east, north of the referenced property within W. 38`h Avenue.
It appears the property may be serviced by gravity flow; however, the owner/developer is responsible for determining
horizontal locations and vertical depths of the existing sanitary sewer main(s) to verify if gravity flow is feasible or if a
private individual sewage ejector (lift station) is required. Each building and townhome unit must front the District's
mainline and have individual service. The issuance of a sewer tap permit by the District does not in any way guarantee
that the property can be served by gravity flow. No sump pump or perimeter/underdrains connections to District
facilities are allowed.

The District will also require submission from the water provider, water meter sizing for the proposed commercial and
residential buildings. Should the water meter sizing change in the future, the District must be notified immediately. The
basis of connection fee will be water meter sizing per Metro Wastewater standards.
Utility Locates
It is the developer's responsibility to provide the District, c/o Martin/Martin Inc., with an ASCE Utility Quality B utility
locate mapping stamped by a Colorado PE as required in Colorado Revised Statue Title 9 and ASCE 38 standards.
Depending on the design, an ASCE Quality Level A supplemental survey may be required which necessitates physical
contact and survey of the existing utility at crossings. All projects must meet Colorado Revised Statue Title 9 for proper
notification to the Notification Association by the Developer's professional engineer. It is also the owner's
responsibility to include electronic locators on all new underground facilities, including service lines up to the
structure or building being served. Submit details for tracer wire and associated test stations.
Sanitary Sewer Extension and Easement Agreement
A mainline extension requires an extension agreement, any necessary easements and easement agreements, District
approvals, deposits, and necessary insurance and bonding prior to beginning construction. Tap applications cannot be
accepted until conditional approval is made on the extension conditional approval requires acceptable as constructed
drawings and televising of the line. A sanitary sewer main extension agreement with appropriate bonding and deposit
is required prior to moving forward with construction. This agreement will be provided from the District's Attorney. A
25' easement (20' exclusive) with drive -able surface will be required to be dedicated to the District prior to
construction. An easement agreement will be provided from the District's Attorney. The owner/developer is
responsible for providing a vesting deed and title insurance commitment for the easement property prior to
coordination with the District's Attorney. The owner/developer is also responsible for providing a certified land
description and exhibit of easement to the District for review. An engineering review fee document will be provided
and is required to be deposited to the District prior to moving forward with reviews. All costs associated with
extensions are the responsibility of the owner/developer.
Flow Study Participation Sub -Total:
The owner/developer is required to participate in the District flow study completed in June 2017. Costs for
participation in the flow study are based on the proposed number of single-family residential equivalents (SFREs) for
the development and will be provided in the engineering review fee document. From the site plan provided March 3,
2020, it appears that 14 SFREs are proposed. Please notify the District if these values are not correct. The developer
will be required to provide definition of proposed generated flows from the anticipated development(s) to allow an
understanding of downstream sanitary mainline capacity. If it is determined that downstream mainlines will need to be
upsized due to the development, upsizing costs will be the responsibility of the owner/developer.
A flow study is required for the development to verify that contributed sanitary flow will not cause down stream
mainlines to exceed their allowable capacity. Participation in the District's flow study is available at the following cost:
14 SFRE X $35.80/SFRE = $501.20
An additional $600.00 fee is charged to analyze the proposed development flows.
Fee for participation in flow study is based on number of units, but the values used in the flow study will be based on
actual flows the sewer could potentially see based on water meter size. Please be aware that connection fees will be
based on water meter size per metro wastewater.
The total fee of $10,000.00 is inclusive of the above flow study $1,101.20 and initial deposit anticipated for plan
review, mainline extension agreement, sanitary sewer easement agreement and exhibit review, coordination with
contractor, tap fee documents, and coordination with Metro Wastewater. Additional funds may be required for
construction observations.

The money from the initial deposit discussed will be used towards the steps listed above. If any credit is left over after
the construction, it will be refunded accordingly. If the funds are exhausted during the review or construction process,
additional monies will be required prior to continuing.
Costs
All costs involved are to be deposited in advance—engineering, reviews, design, legal, construction, observation and
inspections — are the responsibility of the Owner/Developer at the then current rate fee structure. Please be aware of
the following: 1. Deposit must be made prior to reviews and further coordination. 2. Extension agreement with
required title, bonding, etc. and easement agreement(s) with required legal, exhibits, title, etc. prior to plan
acceptance and construction. 3. Application for tap fees and development fees can only be made upon completion of
construction with conditional acceptance of the mainline extension per extension agreement. 4. All connection and
outstanding fees are due prior to connection.
A water provider letter verifying water meter sizing for all units/buildings will be required prior to tap application
completion. Full addresses of each sanitary service are also required. A tap application is available online and must be
submitted to the District for review. No tap fees will be accepted until conditional approval is received for the mainline
extension including such items as "as -constructed drawings," final televising of the mainline(s), compaction tests, and
air testing. If credits for SFRE's are being requested for existing units(s)/buildings, the Developer must provide existing
addresses, meter size, and if applicable, abandon the sanitary tap at the mainline (District observation and fee is
required) prior to final new connection acceptance. A minimum 72 -hour notice prior to construction is required
following District receipt of all fees. These fee amounts can be paid directly to the District Office prior to connection,
payable to Wheat Ridge Sanitation District, which also collects Metro Wastewater's "connection fees".

I have completed my sixth review for the request for approval of a Site Plan, seventh review of
the Final Plat, and 8a' review of cost estimates for the property located at 6230 W. 38a' Avenue,
the signed copies of which were received on January 16 & 24, 2020. This Memo is to inform you
that the plat was previously approved on January 7, 2020, all cost estimates have been approved,
and all civil engineering documents for this development have been reviewed and are hereby
approved for construction by the Department of Public Works.
Please be aware of the following items regarding the construction of the project:
Subdivision Improvement Agreement
Prior to the issuance of any Building or Right -of -Way Construction Permits or the
commencement of any construction activities, a Subdivision Improvement
Agreement (SIA) shall be executed by the project owner/developer. The project
owner/developer will need to contact the Dept. of Community Development at
303.235.2846 to obtain a copy of the SIA template. Please note that an approved
engineer's itemized cost estimate for the public improvements will be included in
the SIA (refer to #2 below). SIAs are recorded at the Jefferson County Clerk &
Recorder's Office with the Final Plat.
Public Improvements & Performance Guarantee:
An Irrevocable Letter of Credit (ILOC) in the amount of $35,625.00 reflecting the
total amount of the approved cost estimate plus 25% (125% of the total estimatel
shall be submitted by the owner/developer for review and approval prior to
issuance of any Building, Site Work, or ROW Construction Permits. The ILOC
shall remain in force for the entire duration of the project, and the City reserves
the right to request the ILOC be renewed if deemed necessary. A photocopy of
the approved itemized cost estimate and form of the ILOC will be attached to the
SIA and recorded at the Jefferson County Clerk & Recorder's Office.
3. Construction Control Plan:
A Construction Control Plan (CCP) shall be required prior to issuance of Sitework
and ROW Permits. The Construction Control Plan is a modified set of
construction plans used in the field to facilitate recordation of key as -built

elevations and dimensions. The CCP shall be developed by the design engineer
and architect and shall be submitted to the City for review and final approval.
Instructions for development of the CCP are included with this letter.
4. Post Entitlement/Pre-Construction Meeting:
Prior to commencement of any construction activities the contractor shall attend a
post entitlement/pre-construction meeting to be scheduled by the City of Wheat
Ridge Community Development Department at 303.235.2846.
5. Right -of -Way Construction Permit(s)/Licensing:
a. ROW Permits. Prior to any construction within the public right-of-way
(ROW), the necessary Right -of -Way Construction Permit(s) and
respective licensing will need to be submitted for processing by the City.
Right -of -Way Construction Permits are issued by the City only after
approval of all required technical documents, including but not limited to,
the Final Drainage Report & Plan, Final Plat, Final Development Plan,
Traffic Impact Study, Storm Sewer Plans, Street Construction Plans,
Grading & Erosion Control Plan, Traffic Control Plan (if applicable),
Construction Control Plan and easement or ROW dedications.
b. Licensing. All work within the public Right -of -Way shall only be
performed by a municipally -licensed contractor that may be obtained
through the Engineering Division (303.235.2861).
6. 2 -Year Warranty Period and Guarantee for Public Improvements:
Upon completion of all public improvements and Final Acceptance has been
granted by the City Inspector, the original Irrevocable Letter of Credit shall be
surrendered. At that time a 2 -year warranty period for the completed and
approved public improvements shall commence. If at any time during said 2 -year
Warranty Period the City Inspector deems that the constructed public
improvements are in such condition as to require repairs or replacement, the
Developer shall complete such work upon request. Upon commencement of the 2 -
year Warranty Period, a 2°d Letter of Credit in the amount of 25% of the original
itemized engineer's cost estimate shall be submitted to the City of Wheat Ridge
and be dated as to expire on the 2 -year anniversary of the Warranty Period
commencement date. The City shall retain said Letter of Credit for the entire 2 -
year Warranty Period. Upon completion of the 2 -year Warranty Period, the 2°d
Letter of Credit shall be surrendered by the City of Wheat Ridge.
7. Site Work Permit:
Prior to construction of any private infrastructure on the site, a Sitework Permit
will need to be obtained from the City Building Department. Payment of the City
use tax is required at the time of application for the Sitework Permit. Sitework
Permits are issued by the City only after approval of all required technical
documents, including but not limited to, the Final Drainage Report, Final Plat,
Final Development Plan, Traffic Impact Study (if applicable), Construction Plans,
and Construction Control Plan.

8. Drainage Certification/ As -Built Plans or updated CCP:
Please note the following items required prior to the issuance of the first
Certificate of Occupancv for the subdivision:
a. Drainage Certification: Upon completion of the drainage improvements,
the Engineer -of -Record shall provide to the City of Wheat Ridge a written,
signed and sealed Drainage Certification Letter (DCL) stating that the
overall site grading was completed per the approved Grading and
Drainage Plans, all drainage facilities were constructed per the approved
construction plans and shall function as defined in the approved Final
Drainage Report/Plan, and that the site has been accurately surveyed to
confirm that the grading and construction of all drainage facilities was
completed in accordance with these documents. The DCL shall be
submitted to the City for review and approval, and shall be accompanied
with As -Built Plans on the Current City Datum for all constructed
drainage facilities prior to issuance of the first Certificate of
Occupancy.
b. As -Built Plans/Updated CCP: The following items shall be included in
an As -Built Plan or on an updated CCP on the Current City Datum prior to
Final Acceptance by the City:
i. Storm Sewer (this info referenced in DCL)
1. Detention/WQ pond volume (sufficient spot elevations for
engineer to calculate the provided volume)
2. Detention/WQ pond Outlet Structure elevations.
3. Manholes (both rim and invert elevations)
4. Drop inlets (both grate and invert elevations)
5. Concrete channels
ii. Lighting, within Public ROW only
1. Streetlight locations.
2. Pedestrian light locations.
3. Pull Box locations.
4. Electric meter location(s)
Two (2) copies of the "As -Built" Plans are to be submitted as follows:
i. One (1) file in AutoCAD 2015 DWG or older format, AND
ii. One (1) file in PDF format (of the signed & sealed sheets).
9. Public Improvement Restoration/Debris Tracking:
It will be the responsibility of the contractor for the project to repair any damage to the
existing public improvements along Ames Street or W. 38,' Avenue as a direct result of
related construction traffic. Also, the contractor will be responsible for maintaining all
affected roadways on a regular basis such that they remain free of construction debris and
tracking from construction traffic accessing the site.
10. Materials Testing for any Construction within the Public Right -of -Way:
It will be the responsibility of the developer/owner, to provide the necessary testing, as applicable
for the scope of this project, for sub -grade compaction and other related material tests for any
improvements to be constructed within the public Right -of -Way.

MATERIALS AND TESTING REQUIREMENTS
FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
DESCRIPTION
Materials sampling and testing for public improvements shall be performed by an
independent materials testing company at the expense of the developer, and/or
utility district. Unless otherwise designated, all referenced specifications, standards
or policies shall be the latest edition as revised or updated by approved supplements
published and issued prior to the date of the building permit.
REQUIREMENTS
All materials sampling and testing shall be performed by certified, experienced and
qualified materials testing technicians who work under the supervision of a
registered professional engineer in the State of Colorado. All materials sampling
and testing equipment shall be serviceable and have current calibrated
certifications.
Soil classifications and moisture -density curves shall be provided to the
Department of Public Works inspector prior to in-place density testing. Materials
testing technicians shall furnish copies of failed test results to the inspector as
promptly as the results become available. On a weekly basis when testing is being
performed, the developer shall furnish the inspector with copies of all test results
taken during the prior week and a cover letter, signed by the supervising registered
professional engineer, which summarizes the results and discusses any failed tests
or inconsistencies.
The City materials testing requirements are provided in Table 720-1. All testing
procedures of verification and central lab requirements shall be as specified in the
Frequency Guide Schedule of the Colorado Department of Transportation Field
Materials Manual. One test is required for any fraction of the specified frequency.
The reference to Section 203.07 in the table is from the Colorado Department of
Transportation Standard Specifications for Road and Bridge Construction.

The Wheat Ridge Sanitation District Engineer has reviewed your variance request dated
March 27, 2006 to disconnect your service line inside your property line. The District
grants a variance from the Rules and Regulations by disconnecting your service line at
your property line during demolition of the condemned house on your property. The
service line shall be mechanically plugged and encased in concrete at the point of
disconnection. An inspection of the service line shall be conducted by the District
inspector, Mark Bruns - 303-912-3776. Prior to inspection the fee shall be paid at the
District office and notification of inspection time shall be made with Mark Bruns at least
24 hours prior.
Upon redevelopment of the subject property, the District will require the service line to
be reconnected at the main in 38`hAvenue at the location of your existing service
penetration into the main line.
All sewer construction shall be in accordance with the Wheat Ridge Sanitation District's
Rules and Regulations.

NOTICE
The property owner, and all current occupants, aze hereby notified that the undersigned
Building Official of Wheat Ridge; Colorado, has found the building located on the above
described real property to be a Dangerous Buiiding within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the Uniform Code
for the Abatement of Dangerous Buildings, sections in bold aze the sections that this
property is in violation of.
SECTION 301- GENERAL
For ihe purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either ttus chapter or as specified in the Building Code or the Aousing Code. Where terms aze
not deSned, they shall haue their ordinary accepted meanings within the confext with which they aze used.
Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary accepted meanings. Words used in the singular masculine gender
include the feminine and the femivine the masculine.
BUII.DING CODE is the International Code Council, as adopted by this jurisdiction.
DANGEROUS BUILDING is any building or shucture deemed to be dangerous under the provisions of
Secfion 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the Internarional Conference of building
Officials, as adopted by this jurisdicrion.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the International Code Council, as adopted by ttris jurisdiction.
SECTION 302 - DANGEROUS BUILDING
For the purpose of this code, any building or structure which has any or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent ffiat the life, health, properry or safety of the public or its occupants aze endangered.
1. Whenever any door, aisle, passageway, stairway or other means of esit is not of sufficient
width or size or is not so arranged as to provide safe and adequate means of exit in case of
fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of
exit in case of Tire or panic.
3. Whenever the stress in any materials, member or portion thereaf, due to all dead and life
loads, is more than one and oue half times the working stress or stresses allowed in the
Building Code for new buildings of similar structure, purpose or location.
4. Whenever any portion thereof has been damaged by Tire, earthquake, wind, flood or by any
other cause, to such an estent that the structural strength or stability thereof is materially
less than it was before such catastrophe and is less than the minimum requirements of the
Building Code for new buildings of similar structdre, purpose or location.
5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become
detached or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a 6uilding, or any member, appurtenance or ornamentation on the
eaterior thereof is not oF sufficient strength or stability, or is not so anchored, attached or
fastened in place so as to be capable of resisting a wind pressure of one half of that specified
in the building Code for new buildings of similar structure, purpose or location without
exceeding the working stressed permitted in the Building Code for such buildings.
7. Whenever any portion thereof has wraeked, warped, buckled or settled to such an eztent
that walls or other structural portions have materially less resistance to winds or
earthquakes than is required in the case of similar new construction.
8. R'henever the building or structure, or any portion thereoF, because of (i) dilapidation,
deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of
any portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to
partially or completely collapse.
9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly
unsafe for purpose of which it is being used.
10. Whenever the exterior wa11s or other vertical shuctural members list, lean or buckle to such an
eactent that a plumb line passing through the center of gaviTy does not fall inside the middle on
tbird of the base.
11. Whenever the building or sh-ucture, exclusive of the foundation, shows 33 percent or more damage
or deteriorarion of its supporting member or members, or 50 percent damage or deteriorarion of its
non-supporting members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so damaged by fire, wind, earthquake or llood,
or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to
children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable
persons to resort thereto for the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any specific requirement or prohibition applicable to snch building or structure
provided by the building regulations of this jurisdiction, as specified in the Building Code or
Housing Code, or of any law or ordinance of this state ar jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any buIlding or shvcture which, whether or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (ii)
fire-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics
required by law in the case of a newly constructed building of like azea, height and occupancy in
the same locarion.
15. Whenever a bui(ding or structure, used or intended to be used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay, damage, faulty construction or
arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the
health officer to be unsanitary, unfit for human habitation ar in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition,
deterioration, damage, inadequate esists, lack oF sufflcient fire-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or other cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance
known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or shucture remains on a site after the demolition or
destruction of the building or shucture or whenever any building or structure is abandoned for a
period in excess of six months so as to constitute such building or portion thereof an attracuve
nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001-DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any buIlcling or portion thereof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same,is located, in which there exists any of the
condirions referenced in this section to an extent that endangers the life, limb, health, properry, safeTy or
welfaze of the public or the occupants thereof, shall be deemed and hereby aze declazed to be substandazd
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they aze in sanitary. Inadequate sanitation shall include, but not be limited to, the following:
1. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging
house.
2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a
hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack uf hot or cold runni2g water to plumbing fvctures in a dwelling unit or lodging hause.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating equipment.
8. Lack of minimuxn amounts of natural light and ventilation require by flris code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
11. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal facIlities as determined by the health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandazd when they aze or
contain structural hazards: Structural hazazds shall include, but not be limited to; the following:
L Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insufficient size to carry imposed loads with safety.
4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to
defective material or deteriorations.
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposedloads with safety.
6. Members of ceiliugs, roofs, ceiling and roof supports, or other horizontal members that sag,
split or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are
of insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge o settle due to defective material or deterioration.
9. Fireplaces or chimueys that are of insufficient size or strength to carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this
code are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code
requirements in eTfect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbiug that was installed in violation of code requirements in effect
at the time of installation or plumbing not installed in accordance with generally accepted
construction practices in areas where no codes were in effect or that has not been maintained in good
condition or that is not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of installation or mecLanical equipment not installed in accordance
with generally accepted construction practices in areas where no codes were in effect or tLat has not
been maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2: Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or tloors,
including broken windows or doors.
3. Defective or lack of weather protection for eateriar wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible
waste, or vegetation that, in ttie opinion of the chief of the Sre department, is in such a condition as to
cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fre or
explosion arising From any cause shall be considered substaudard.
1001.10 Faulty Materials of Construction. The use of materials oF construction, except those that are
speci5cally allowed or approved by this code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead
organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and
similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided
with adequate exit facilities conForming to the provisions of this code, buildings or portions thereof
whose exit facili&es were installed in violalion of code requirements in effect at the time of their
construction or wbose exit facilities have not been increased in number or width in relations to any
increase in occupant load d-ae to alterations, additions or ehange :n use or occupancy subsequent to
the time of construction shall be considered substandard.
Notwithstanding compliance with code requirements in effect aY the time of their
construction, buildings or portions thereof shall be considered substandard when the building of£icial
finds that an unsafe condition exists through an improper location of ezits, a lack of an adequate
number or width of exits, or when other conditions exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered substandazd when they aze not provided with the Sre-resistive conshvction or fire-
extinguishing systems or equipment required by tlils code, except those buildings or por[ions thereof that
conformed with all applicable laws at the time of their construction and whose fire-resistive integriry and
fire-exringuishing systems or equipment has been adequately maintained and impmved in relation to any
increase in occupant load, alterauon or addition, or any change in occupancy.
1001.14Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking
or dining purposes that were not designed or intended to be used for such occupancies shall be
considered substandard.
The following is a list of items that shall be fixed to meet code:
1.
The siding shall be repaired.
2.
Broken windows shall be fixed.
3.
Openings to the building shall be covered.
4.
The roof shall be fixed or replaced.
5.
Vents shall be installed with jackets properly.
6.
Siding is falling off.
7.
Electrical wiring shall be fixed to code 2002 NEC.
8.
Structural elements shall be fixed.
9.
Need steps for the back door.
10
. Side Deck has fallen off.
11. Need to have numing water and power for sanitation per
building code at ali faucets and sinks.
12. All faulty weather protection shall be fixed.
13. All Plumbing sha11 meet 2003 IPC and IRC.
14. Roof is leaking in several locations and sha11 be fixed.
15. Bedrooms shall be supplied with one egess window per
bedroom.
16. All bedrooms sha11 be supplied with smoke detectors that are
hardwired in per 2003 IRC.
17. All bedrooms shall be supplied with Arcfault circuit breakers.
18. All rotten wood shall be replaced.
19. Stairs shall meet code if the go to habitable space.
20. Lack of heat in bed room. .
21. No more than three unrelated people per residence.
22. Sewage shall not dump onto yard.
23. All windows sha11 be fixed to meet code.
24. All rotten flooring and deeking shall be replaced.
25. Bathrooms shall be fixed to meet code and bathroom floors are
saturated with water plumbing not to code.
26. Need smoke detectors per 2003 IRC in each bed rooms and
living space.
27. All baze wiring shall be covered with approved ouflets and
lights per 2002 nec.
28. Lack of headroom height on stairs and door ways.
29. Ceiling falling in at locations.
30. Back porch framing is rotten and needs to be replaced.
31. Steps not to code.
32. Shed in the back of the property shall be removed since it has
collapsed and could continue to fa11 in on occupants.
33. Dangerous over head electrical shall be removed.
34. Holes ui ceilings sha11 be fixed.
35. Shower faucets shall be fixed to meet plumbing code.
36. Handrails needed on stairway.
37. Window by stairway sha11 be tempered.
38. Fix pla ster on wa11s.
39. Cooking appliances shall be installed per manufactures
installation criteria not just sitting on the floor.
40. Kitchen sinks needs to be fixed and operating.
41. Perxnits shall be pulled for all work done to this residence.
42. The basement is a fire hazard with excessive storage next to the
furnace.
ORDER
1. The City of Wheat Ridge Building Official has determined the building
referenced above to be a Dangerous Building. The Building Department will
post the building as a Dangerous Building due to the amount of life safety issues.
Pursuant to Code all occupants shall be required to vacate the property with 14
days of this Notice December 29, 2005. This is therefore required in order to
protect life, health and safety of the public.
II. The owners aze ordered to pull a building permit to fix the deficient items. The
Building Department will post the building as a Dangerous Building due to the
amount of life safety issues. Pursuant to Code a11 occupants shall be required to
vacate the properry. This is therefore required in order to protect life, health and
safety of the public.
III. If the shucture has not been brought to code or demolished by January 15, 2005.
Section 801 in the Uniform Code for the Abatement of Dangerous Buildings
states, "801.1 Procedure. When any work of repair or demolition is to be done
pursuant Section 7013, Item 3, of this code, the building official sha11 issue an
order thereof to the director of public works and the work shall be accomplished
by personnel of this jurisdiction or by private contract under the direction of said
director. Plans and specifications therefore may be prepared by said director, or
the director may employ such azchitectural and engineering assistance on a
coniract basis as deemed reasonably necessazy. If any part of the work is to be
accomplished by private contract, standard public works contractual procedures
shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall
be paid from the repair and demolition fund, and may.be made a special
assessment against the property involved, or may be made a personal obligation
of the property owner, whichever the legislative body of this jurisdiction shall
determine is appropriate."
The property owner and all occupants are hereby ORDERED TO CEASE AND
DESIST occupancy and use of the above described building. The Building Official
shall cause the property to be posted with the attached Notice and shall take action
to remove all future occupants from the building until the building is brought up tc
code.
REMEDIAL ACTION
1. The property owner must apply for and obtain a City of Wheat Ridge building permit
to conect any deficiencies.
IV.. All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person hauing record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Building Code
Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of a11 rights to an administrative hearing and
determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.
