The property in question is zoned Commercial One (C -1). The Wheat Ridge Municipal code
allows for minor auto service, repair and maintenance shops in the C -I district. Minor auto service
must meet the following definition (Sec 26 -123 of the Wheat Ridge Zoning Code): "Auto detail
shops, tune -up shops, upholstery shops, radiator shops, lubrications service, sound system shops,
and alignment services." Please note that tire recapping, body work and painting, engine repair,
and transmission repair are NOT allowed.
Under the C -1 zone district, auto sales are a special use and thus a Special Use Permit (SUP) is
required in order for an auto sales use to operate legally. The prior business at the property, MVP
Auto, did not have an SUP and so the auto sales use was a nonconforming use. MVP Auto closed
their business license with the City on August 18, 2010. Because the site has been vacant for less
than 12 months, the nonconforming use of auto sales may be continued at the site with an SUP.
