COLORADO Department of Public Health b Environment To: ACI Services From: The Colorado Department of Public Health and Environment, Air Pollution Control Division ("Division") Date: August 10, 2020 Re: Dispenser Canopy — 6875 West 38th Ave, Wheat Ridge, CO. The structure described as a canopy over gas dispensers at the above address was demolished without the required state demolition notice. Before a state demolition notice is issued, Indoor Environment Program staff review the application to ensure that the structure was inspected by a Colorado -certified Asbestos Building Inspector and all friable asbestos -containing material or material that could be rendered friable (in an amount greater than the state trigger level) has been removed. This review did not occur for the above property. Post demolition, an inspection of the site was conducted by a Colorado -certified Asbestos Building Inspector. The inspector was required to note any remaining construction debris and to sample any remaining suspect asbestos -containing material. The inspector reported that they inspected another structure on the site, but did not list any materials left behind from the canopy. Mr. Keith Allis, President of ACI Services the company listed as the demolition contractor, stated that the canopy was removed during the removal of the fuel system. He also stated that the canopy was all metal material. Since a comprehensive asbestos building inspection was not conducted prior to the demolition of the canopy and building materials had already been removed from the site prior to the inspection, it is impossible to determine if asbestos -containing materials had been present in this structure. This letter is issued strictly for the prior demolition of the canopy, any additional demolition on the site is required to comply with state and local regulations. Because the requirement for notification under Colorado Regulation No. 8, Part B, was not met, the Division cannot issue a state Demolition Notice. Natural disasters, such as falling objects, cyclones, hurricanes, tornadoes, or other winds or gusts exceeding Force 7 on the Beaufort scale, earthquakes, lightning, hail or fire; 2. Misuse, abuse, falling objects, tools, foot traffic, or equipment or sign installation; 3. Clogged drains or lack of adequate drainage that does not promptly and readily remove water from the roof; 4. Ponding water (as defined by the National Roofing Contractors Association); 5. Settlement, cracking, warping, expansion, contraction, deflection or other movement of the building structure; 6. Improper installation of Product; 7. Failure to maintain Product as required under the Commercial Roof Systems Specification Manual; 8. Mold and other damage caused by water entering building; and 9. Any other damage not attributable to a manufacturing defect of the Product. This Limited Warranty does not cover damages caused by leaks. This Limited Warranty covers to material only and does not include installation or labor costs of any kind. (completed) • Install the seven recovery well DPE system. • Conduct remediation system start-up and submit an implementation report. • Operate and maintain the system for 48 months conducting monthly system check visits. • Implement the approved monitoring plan as follows: sample wells MW-1 through MW-24 for the two quarters prior to CAP implementation. Monitoring wells MW- 1 through MW-5, MW-8 through MW-14, MW-19, MW-21, MW-23, and MW-24 will be sampled for 16 quarters of system operation and four quarters after system shut down. Sample MW-6, MW-7, MW-13, MW-15, and MW-16 annually during operation of the system and for four (4) quarters after system shut down. • Submit Monitor Remediation Reports (MRR) on a quarterly basis. The EFS submitted with this CAP for costs to complete remediation through closure has been approved for $616,908. The effective date of this EFS is October 31, 2007.
