3. If this pemit expires, a new pemit may be acquired for a fee of one-half the amount normally required, provided no

be paid for a new pesmit. -

5. Contractor shall notify the Building inspector twenty-four (24) hours in advance for all inspections and shall receive

I have completed the fust review of the above referenced documents received on January 31, 2006 and have the
following comments:
This letter is to inform you that the Grading/Drainage Plan for the above referenced development have been
reviewed and aze hereby approved for conslruction with the following stipulation:
• Evidence of Ownership/Written Approval Required
The proposed 2' concrete drainage pan and associated asphalt abutting said pan lie outside of the
boundazies of the subject properry. Therefore, evidence of ownership for the tract or written approval
from the current owner of the {ract shall be required prior to the commencement of conshuction in this
azea.
Please be aware of the following items regarding the construction of the project:
1. Grading and Erosion Control
The erosion control for the project shall be in place prior to the commencement of any grading activities,
and maintained as needed during the course of coustrac6on. Please be advised that addifional erosion
control measures may be required if deemed necessary by the City Inspector.
2. Drainage Certification Required Prior to C.O.
Upon completion of the grading and any site drainage facilities, the Engineer-of-Record Mr. Kenneth S.
Boyd, P.E., shall provide to the Ciry of Wheat Ridge a written, signed and sealed Drainage Certification
Letter stating that the grading and drainage facilities were completed per the approved civil conslruction
documents, and that the site has been accurately surveyed to confirm that the grading and the construction
of all drainage facilities was completed and shall function in accordance with these documents. Per
Secflon 26-412-H of the Municipal Code of Laws, the Drainage Certificafion Letter shall be submitted
along with a copy of As-Built Plans for the site prior to issuance of the Certificate of Occupancy:

area. Also, the contractor will be responsible for maintaining 38b Avenue and Reed Street on a regulaz

4. Construction within the Public Right-of-Way
It will be the responsibility of the developer/owner, to provide the necessary testing, as applicable for the
scope of this project, for sub-grade compaction and other related material tests for any improvements to
be constructed within the public Right-of-Way.

Right-of-Way Construction Permit(s)/Licensing
Prior to conshvction of any improvements lying within the public right-of-way, the necessary Right-of-

Right-of-Way Construction Pernuts are issued only after approval of all required technical documents,
including but not limited to, the Final Drainage Report & Plan, Final Plat, Final Development Plan,
Traffic Impact Study, Storm Sewer Plans, Street Construcrion Plans, Crrading & Erosion Control Plan,
and easement or ROW dedications. A detailed description of the work to be completed within the Right-
of-Way and a Traffic Control Plan shall be submitted for review and approval prior to the issuance of the
ROW ConshuctionPercnit(s).
6. 2-Year Warranty Period for Pnblic Improvements
Per the Gity of Wheat Ridge Pemut Testing and Inspection Requirements, the Contractor shall wanant all
work performed within the public right-of-way for a period of two (2) years, commencing upon
completion of all public improvements and final acceptance by the City Inspebtor. Prior to the expirarion
of said 2-year Warranty Period, if the City Inspector deems that the constructed public improvements aze
in such condition as to require repairs or replacement, the Contractor shall complete such repair work
upon request per the City of Wheat Ridge Pernvt Testing and Inspecrion Requirements.
7. Application for Grading/Fill Permit
Prior to the commencement of any onsite grading, an Application for Grading/Landfill Permit, along with
the fees due will need to be submitted for review and approval.

DESCRIPTION
Materials sampling and testing for public unprovements shall be performed by an independent
materials testing company at the expense of the developer, and/or utility district. Unless
otherwise designated, all referenced specifications, standarns or policies shall be the latest
edition as revised or updated by approved supplements published and issued prior to the date of
the building perxnit.
REQUII2EMENTS
All materials sampling and testing shall be performed by certified, experienced and qualified
materials testing tecluucians who work under the supervision of a registered professional
engineer in the Sta#e of Colorado. All materials sampling and testing equipment shall be
serviceable and have current calibrated certifications.
Soil classifications and moisture-density curves sha11 be provided to the Department of Public
Works inspector prior to in-place density testing. Materials testing technicians shall furnish
copies of failed test results to the inspector as promptly as the results become available. On a
weekly basis when testing is being performed, the developer shall fiunish the inspector with
copies of a11 test resuits taken during the prior week and a cover letter, signed by the supervising
registered professional engineer, which smmnazizes the results and discusses any failed tests or
inconsistencies.
The City materials testing requirements are provided in Table 720-1. All testing procedures of
verification and central lab requirements shall be as specified in the Frequency Guide Schedule
of the Colorado Department of Transportation Field Materials Manual. One test is required for
any $action of the specified frequency. The reference to Section 203.07 in the table is from the
Colorado Depattrnent of Transportafion Standard Specifications for Road and Bridge
Construction.

Dear Mr. Martin,
I have completed the first review of the above referenced documents received on January 31, 2006 and have the
following comments:
This letter is to inform you that the Grading/Drainage Plan for the above referenced development have been
reviewed and are hereby approved for construction with the following stipulation:
• Evidence of Ownership/Written Approval Required
The proposed 2' concrete drainage pan and associated asphalt abutting said pan lie outside of the
boundaries of the subject property. Therefore, evidence of ownership for the tract or written approval
from the current owner of the tract shall be required prior to the commencement of construction in this
area.
Please be awaze of the following items regarding the construction of the project:
1. Grading and Erosion Control
The erosion control for the project shall be in place prior to the commencement of any grading activities,
and maintained as needed during the course of construction. Please be advised that additional erosion
control measures may be required if deemed necessary by the City Inspector.
2. Drainage Certification Required Prior to C.O.
Upon completion of the grading and any site drainage facilities, the Engineer-of-Record Mr. Kenneth S.
Boyd, P.E., shall provide to the City of Wheat Ridge a written, signed and sealed Drainage Certification
Letter stating that the grading and drainage facilities were completed per the approved civil construction
documents, and that the site hasbeen accurately surveyed to confirm that the grading and the construction
of all drainage facilities was completed and shall function in accordance with these documents. Per
Section 26-412-H of the Municipal Code of Laws, the Drainage Certification Letter shall be submitted
along with a copy of As-Built Plans for the site prior to issuance of the Certificate of Occupancy.
3. Public Improvement Restoration/Debris Traclzing
It will be the responsibiliTy of the of the contractor for the project to repair any damage to the existing
public improvements along 38b Avenue and Reed Street as a result of related construction traffic in the
area. Also, the contractor will be responsible for maintaining 38"' Avenue and Reed Street on a regular
basis such that it remains free of construction debris and tracking from construction traffic accessing the
site.
4. Construction within the Public Right-of-Way
It will be the responsibility of the developer/owner, to provide the necessary testing, as applicable for the
scope of this project, for sub-grade compaction and other related material tests for any improvements to
be constructed within the public Right-of-Way.
(SEE ATTACHED MATERIAL SAMPLING & TESTING REQUIREMENTS)
Right-of-Way Construction Permit(s)/Licensing
Prior to construction of any improvements lying within the public right-of-way, the necessary Right-of-
Way Construction Permit(s) and respective licensing will need to be submitted for processing by the City.
Right-of-Way Construction Permits are issued only after approval of all required technical documents,
including but not limited to, the Final Drainage Report & Plan, Final Plat, Final Development Plan,
Traffic Impact Study, Storm Sewer Plans, Street Conshucrion Plans, Grading & Erosion Control Plan,
and easement or ROW dedications. A detailed description of the work to be completed within the Right-
of-Way and a Traffic Control Plan shall be submitted for review and approval prior to the issuance of the
ROW Conshvction Permit(s).
6. 2-Year Warranty Period for Public Improvements
Per the City of Wheat Ridge Permit Testing and Inspection Requirements, the Coniractor shall warrant all
work performed within the public right-of-way for a period of two (2) years, commencing upon
completion of all public improvements and final acceptance by the City Inspector. Prior to the expiration
of said 2-year Warranty Period, if the City Inspector deems that the constructed public improvements are
in such condition as to require repairs or replacement, the Contractor shall complete such repair work
upon request per the City of Wheat Ridge Permit Testing and Inspection Requirements.
7. Application for Grading/Fill Permit
Prior to the commencement of any onsite grading, an Application for Grading/Landfill Permit, along with
the fees due will need to be submitted for review and approval.

MATERIALS AND TESTING REQUIREMENTS
FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
DESCRIPTION
Materials sampling and testing for public improvements shall be performed by an independent
materials testing company at the expense of the developer, and/or utility district. Unless
otherwise designated, all referenced specifications, standards or policies shall be the latest
edition as revised or updated by approved supplements published and issued prior to the date of
the building permit.
REQUIREMENTS
All materials sampling and testing shall be performed by certified, experienced and qualified
materials testing technicians who work under the supervision of a registered professional
engineer in the State of Colorado. All materials sampling and testing equipment shall be
serviceable and have current calibrated certifications.
Soil classifications and moisture-density curves shall be provided to the Department of Public
Works inspector prior to in-place density testing. Materials testing technicians shall furnish
copies of failed test results to the inspector as promptly as the results become available. On a
weekly basis when testing is being performed, the developer shall furnish the inspector with
copies of all test results taken during the prior week and a cover letter, signed by the supervising
registered professional engineer, which suminarizes the results and discusses any failed tests or
inconsistencies.
The City materials testing requirements are provided in Table 720-1. All testing procedwes of
verification and central lab requirements shall be as specified in the Frequency Guide Schedule
of the Colorado Department of Transportation Field Materials Manual. One test is required for
any fraction of the specified frequency. The reference to Section 203.07 in the table is from the
Colorado Department of Transportation Standard Specifications for Road and Bridge
Construction.

All pernrits shall be applied for through the Public Works Department. An approved permit is effective for a
period of one (1) yeaz from date of issue and may be renewed. Al1 fees shall be in accordance with those fees
established by the Uniform Building Code or other applicable City adopted Resolutions or Ordinances.
Note: All public improvements, when constructed, shall be maintained (by the respective individual(s) and/or
company responsible for the construction of that public and/or private improvement in the respecdve
development) on a daily basis, ar as needed, such that they are free af mud and other construciion debris
tracking from the site. Failure to comply with this requirement will result in the enforcement of Article 77,
Specified Nuisances, Section I5-16 (4) of the City of WheatRidge Code ofLaws.
MINOR GRADING. EXCAVATION, AND FILL PERMITS
1. 1-50 Cubic Yards: No permit is required for dumping or excavation of earth materials, which do not exceed
50 cubic yazds, provided, however, that any fill deposited is on natural terrain of less than three (3) horizontal
to one (1) vertical slope, or such fill is less than tluee (3) feet in depth and is not intended to support
permanent structures, and in addition, such fill or excavation does not obstruct or otherwise adversely affect
any drainageway. Should any of the above standards be exceeded, or a drainage way be affected, a permit
shall be required under the guidelines for No. 2.
2. 51-500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 cubic yazds may be
allowed With a permit approved by the City Engineer. All applications aze to be submitted on the appropriate
completed application form and shall be accompanied by the appropriate fee and sketch plan indicating the
following information before the pernut will be issued.
A. Locarion and dimensions of all property boundaries and structures on the site.
B. Location and extent of areas to be filled and/or excavated.
C. Location of existing and proposed drainageways, irrigation ditches, etc., and indication of how and where
historic run-off will be maintained on and through The site.
D. Cross-section azea to be filled and/or excavated indicating original slope, new slope and depth of fill.
E. Statement that indicates the proposed use or purpose for said fill or excavation.
F. Relative elevafion of adjacent properties.
G. Erosion control plan showing placement of control devices such as hay bales, etc.
3. 501-10,000 Cubic Yards: Operarions in which earth material fill or excavation exceeds 500 cubic yazds, but
does not exceed 10,000 cubic yazds, may be allowed by a pemut issued by the City Engineer after review of
an application and supporting information. The following information shall be submitted with the required
application form:
A. A site plan, prepared and signed by a Colorado registered professional engineer, at a scale of no less than
1 inch to twenTy feet (120) which illustrates the following:
B. Location and dimensions of all property boundaries and structures on the site.
C. Location and extent of azeas to be filled and/or excavated.
D. Location of existing waterways and drainage courses indicating any changes. (for a site containing an
established irrigation ditch, a letter of approval from the appropriate ditch company sball be required).
E. Location of existing and proposed points of ingress.
F. Location and extent of existing vegetation, proposed cbanges in such vegetation and methods of
rehabilitation on site vegetation after earthwork operations aze complete.
G. Erosion control plan.
H. Grading plan with eatisting (dashed lines) and proposed (solid lines) ground contours with contour
intervals of 2 feet and spot elevations.

4. PerFormance Standards: The following provisions shall apply to all Minor Grading, Excavation and Fill

A. Rehabilitation: Within tturry (30) days after cessation of filling and/or excavation, rehabilitation for the
site shall have been completed in accoxdance with the approved plans. Rehabilitation shall oonsist of
leveling, grading, landscaping ar any combination thereof to minimize potential erosion and be acceptable
to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City Engineer.
"Far the purpose of this Section, the term debris shall have the same meaning as the terms "gazbage, hash
or junk" as defined in the Wheat Ridge Code of Laws, Section 15-4."
In no case shall debris or contaminates identified or classified as hazazdous waste by local, state or federal
agencies be used as fill in Any fill areas within the City of Wheat Ridge.

A building permit was submitted for the property located at 7015 W. 38th Ave. (building pemlit #
060029). The property contains a building which was previously used as a dental clinic. The
applicant wishes to re-use the building as a dental clinic, with some minor modifications to the
interior of the building and the property.
One of the changes to the property is the addition of a small parking area on the north end of the
property (see site plan). The applicant is proposing access from an existing drive aisle which runs
east-west and connects to Reed Street.
The drive aisle is a privately owned tract of land; however, the ownership is ambiguous (see attached
APN map). After research by the applicant and City staff, it was made cleaz that the Jefferson
County Assessor's office did not have a record of ownership ior this tract, only that the tract was
privately owned.
As a result, City staff has approved the building permit and allowed the access from Reed Street.
Staff has indicated to the applicant that there is a possibility that the rightful property owner of the
tract may come forwazd and disallow the access from Reed Street.

The following requirements are made under the 2003 Interimational Fire
Code adopted by the Fire Board of the Wheat ridge Fire Protection District
and the City Councii of the City of Wheat Ridge, Colorado.
FIRE ALARM
1. Graphic maps shall be updated to new changes.
2. The fire alarrri shall remain in service during all phases of
construction.
3. If the alarm is out of service for any time period a fire watch shall be
initiated and logged every hour.
4. With the addition of the above units the battery calculations shall be
adjusted and extra power planned for the system.
5. All devices shall be numbered and addressable.
6. A rough in inspection sha11 be scheduled with the Fire District as well
as the' City building inspector.
7. A complete test of the entire system shall be performed prior to
calling for a final inspection.
8. All means of egress shall remain clear during all phases of
construction.
9. All Fire Lanes shall remain clear of all construction vehicles and
" supplies.
lO.Any changes to the approved plans shall be submitted to the Fire
IL District for approval.
11. Signs shall be attached to every exit door stating "THIS DOOR TO
REMAIN UNLOCKED VVHILE T'HE BUILDING IS OCCUPIED."
12.The address of the tenant finish shall be readable from the siseet of
addressing.

1. Fire Lanes shall be established along the sides of the building. These
lanes shall be denoted with red marking paint and/or signage stating
"FIRE LANE NO Pt1RKING".
2. All egress ways shall be maintained during all phases of construction.
3. Several Fire violations were noted on a previous inspection. These
violations and others that are noted during the rough-in inspection or
final will be addressed as they arise.
4. Signs sfiall be on the exit doors stating "THESE DOORS TO
REMEIIN LJNLOCKED WHII,E THE BiJII.,DING IS OCCUPIED."
5. Changes to approved plans shall be submitted to the Fire District for
approval.
6. A building permit shall be obtained from the City of Wheat Ridge
and be posted onsite with the Fire Permit during construction.
7. The Fire District shall be given 24 hour notice during normal
business hours for any required inspections.

NOTICE
The property owner, and all current occupants, are hereby noUfied that the undersigned
Building Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be a Dangerous Building within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 ediuon, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used far dwelling purposes and is in violation of the Uniform Code
for the Abatement of Dangerous Buildings, sections in bold are the sections that this
property is in violation of.
SECTION 301- GENERAL
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter ot as specified in the Building Code or the Housing Code. Where terms are
not defined, they shall have their ordinary accepted meanings within the context with which they are used.
We6ster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinazy accepted meanings. Words used in the singular masculine gender
include the feminine and the feminine the masculine.
BUILDING CODE is the International Code Council, as adopted by this jurisdiction.
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Section 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the In[ernational Conference of building
Officials, as adopYed by this jurisdiction.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 In[ernational Property
Maintenance Code promulgated by the International Code Council, as adopted by this jurisdiction.
SECTION 302 - DANGEROUS BUILDING
For the purpose of this code, any building or structure which has any or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent that the life, health, property or safety of the public or its occupants are endangered.
I. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or
size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in
case of fire or panic.
3. Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is
more than one and one half times the working sVess or stresses allowed in the Building Code for
new buildings of similar sVUCture, purpose or location.
4. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other
cause, to such an extent chat the structural strength or stability thereof is materially less than it was
before such catastrophe and is less than the minimum requirements of the Building Code for new
buildings of similar structure, purpose or location.
5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collxpse and thereby injure persons or damage proper[y. 6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the
exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened
in place so as to be capable of resisting a wind pressure of one half of that specified in the building
Code for new buildings of similar structure, purpose or location without exceeding the working
shessed permitted in the Building Code for such buildings.
7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls
or other structural portions have materially less resistance to winds or earthquakes than is required
in the case of similaz new construction.
8. Whenever the building or svucture, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of any
portion of the gound necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to paztially or
completely collapse.
9. Whenever, for any reason, the building orshucture, or any portion thereof, is manifestly unsafe
for purpose of which it is being used.
10. Whenever the exterior walls or o[her vertical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does not fall inside the middle on
third of the base.
11. Whenever the building or s[ructure, exclusive of the foundation, shows 33 percent or more damage
or deterioration of its supporting member or members, or 50 percent damage or deterioration of its
non-supporting members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has
become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a
harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort therero for
the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any specific requirement or prohibition applicable to such building or structure
provided by the building regulations of this jurisdiction, as specified in the Building Code or
Housing Code, or of any law or ordinance of this state or jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any building or structure which, whether or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting pazt, member. or portion less the 66 percent or the (i) strength, (ii)
ffre-resisting qualities or characYeristics, or (iii) weather-resisting qualiUes or characteristics
required by law in the case of a newly conshucted building of like area, heigh[ and occupancy in
the same location.
15. Whenever a building or structure, used or intended to be used for dwelling purposes, because of
inadequate maintenance, dilapidation, decay, damage, faulty construc[ion or arrangemen[,
inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be
unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or
disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration,
damage, inadequate exists, lack of sufficient fire-resistive consVuction, faulty elecVic wiring, gas
connections or hea[ing apparatus, or other cause, is determined by the fire marshal to be a fire
hazard.
17. Whenever any building or sVucture is in such a condition as to constitu[e a public nuisance known
to the commonlaw or in equity jurisprudence.
18. Whenever any portion or a building or s[ructure remains on a site after the demolition or
destruction of the building or sVucture or whenever any building or structure is abandoned for a
period in excess of six months so as to constitu[e such building or portion thereof an attractive
nuisance or hazard ro[he public.
The 1997 Uniform Housing Codes states;
SECTION 1001- DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion thereof, including any dwelling uni[,
guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the
conditions referenced in this section to an extent that endangers the life, limb, health, proper[y, safety or
welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary. Inadequate sanitation shall include, but not be limited to, the following:
1. Lack of or improper water closet, lava[ory, bathtub or shower in a dwelling unit or lodging house.
2. Lack of or improper water closets, lavaTOries, and bathtubs or showers per number or guests in a
ho[el.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a hotei
5. Lack of hot or cold running water to plumbing fixtures in a dwelling uni[ or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating equipment.
8. Lack of minimum amoun[s of natural light and ventilation require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required elec[rical lighting. ll. Dampness of habitable rooms.
12. Infes[ation of insects, vermin or rodents as determined by the health ofFicer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal facilities as determined by [he health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain s[ructural hazards. Structural hazazds shall include, but not be limi[ed to, the following:
1. Deteriorated or inadequate foundations.
2. Defec[ive or deteriorated flooring or floor supports 3. Flooring or floor supports of insufficient size to carry imposed loads with safety.
4. Members of walls, partitions or other vertical supports thaf split, lean, list or buckle do to defec[ive
material or deteriorations. -
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposed loads with safety. 6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members tha[ sag, split
or buckle due ro defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof suppor[s, or other horizontal members that are of
insufficient size to carry imposed lads with safety. S. Fireplaces or chimneys that list, bulge o settle due to defective material or deterioration.
9. Fireplaces or chimneys that are of insufficien[ size or strength to carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which tbere exists any nuisance as defined in this code
are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code
requirements in effect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction pracrices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect
at the time of iastallation or plumbing not installed in accordance with generally accepted
construction pracHces in areas where no codes were in effect or that has not been maintained in good
condition or that is not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was instaRed in violation of code
requirements in effect at the time of installation or mechanical equipment not installed in accordance
with generally accepted construction practices in areas where no codes were in effect or that has not
been maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or
vegetation that, in the opinion of the chief of the fue department, is in such a condition as to cause a fire or
explosion or provide a ready fue] to augment the spread and intensity of fire or explosion arising from any
cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of construction, except those tha[ are
specifically allowed or approved by [his code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be subs[andard. - 100111 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic
matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similaz materials
or conditions on a premises constitutes fire, health or safety hazards that shall be abated in accordance with
the procedures specified in Chapter 11 of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with
adequate exit facilities conforming to the provisions of this code, buildings or portions thereof whose exit
facilities were installed in violation of code requirements in effect at the time of their construction or whose
exit facilities have not been increased in number or width in relations to any increase in occupant load due
to alterations, additions or change in use or occupancy subsequent to the time of construcrion shall be
considered substandard.
Notwithstanding compliance with code requirements in effect at the time of their consh'uction,
buildings or portions thereof shall be considered substandard when the building official finds Ihat an unsafe
condition exists through an improper location of exits, a lack of an adequate number or width of exits, or
when other conditions exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered substandard when they are not provided with the fire-resistive construcrion or fire-
extinguishing systems or equipment required by this code, except those buildings or portions thereof that
conformed with all applicable laws at the time of their construction and whose fire-resistive integity and
fire-extinguishing systems or equipment has been adequately maintained and improved in relation to any
increase in occupant load, alteration or addition, or any change in occupancy.
100114 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or
dining purposes that were not designed or intended to be used for such occupancies shall be considered
substandard.
The following is a list of items that shall be fixed to meet code:
1. Section 602.2 Residential occupancies in the International
Property Maintenance Code states, Dwellings shall be provided
with heating facilities capable of maintaining a room
temperature of 68 degrees F(20 degrees C.) in all habitable
rooms, bathrooms and toilet rooms based on the winter outdoor
design temperatare.

ORDER
The City of Wheat Ridge Building Official has deternuned the building referenced above
to be a Dangerous Building and to constitute a health hazard if not fixed. The owners are
ordered to pull a building permit to fix the deficient items. If such items are not fixed by
March 24, 2005, the Buiiding Department will post 7015 W. 38th Street Wheat Ridge
CO 80033 as a Dangerous Building. All existing tenants may stay in the building as long
as a permit is pulled to fix all issues. When that tenant moves out of the rental unit, the
unit shall not be leased out until all items are brought to code. Pursuant to Code future
tenants shall not be permitted to occupy these units until all issues are brought up to code
and are inspected by the City of Wheat Ridge Building Department. This is therefore
required in order to protect life, health and safety of the public.
The property owner and all future occupants are hereby ORDERED TO CEASE
AND DESIST occupancy and use of the above described building. The Building
Official shall cause the property to be posted with the attached Notice after March
24, 2005 and shall take action to remove all future occupants from the building.
RENIEDIAL ACTION
1. The property owner must apply for and obtain a City of Wheat Ridge building permit
to conect the following deficiencies.

APPEAL OF THIS NOTICE AND ORDER
Any person having recard tifle or other legal interest in the above described premises may

To
PROPERTY OWNER AND ALL CURRENT OCCUPANTS
Pursuant to the 1997 Edition and the Uniform Code for the Abatement of Dangerous
Buildings, the 1997 Uniform Housing Code and the 2003 International Property
Maintenance Code, the foliowing property is in violation. According to County Records
you are the property owner of the described property in violation.
NOTICE
The property owner, and all current occupants, are hereby notified that the undersigned
Buiiding Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be a Dangerous Building within the meaning of Section 302 of
the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted
by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the Uniform Code
for the Abatement of Dangerous Buildings, sections in bold are the sections that this
property is in violation of.
SECTION 301- GENERAL
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or the Housing Code. Where terms are
not defined, they shall have their ordinary accepted meanings within the context with which they aze used.
Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary aceepted meanings. Words used in the singular masculine gender
include the feminine and the feminine the masculine.
BUILDING CODE is the International Code Council, as adopted by this jurisdic[ion.
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Section 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the Intemational Conference of building
Officials, as adopted by this jurisdiction.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the Intemational Code Council, as adopted by this jurisdiction.
SECTION 302 - DANGEROUS BUILDING
For the purpose of this code, any building or sWCture which has any or all of the conditions or defec[s
hereinafrer described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent that the life, health, property or safety of [he public or its occupants are endangered.
1. Whenever any door, aisle, passageway, stairway or other means of exi[ is not of sufficient wid[h or
size or is not so attanged as to provide safe and adequate means of exit in case of fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in
case of fire or panic.
3. Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is
more than one and one half times the working stress or stresses allowed in the Building Code for
new buildings of similar structure, purpose or location.
4. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any o[her
cause, to such an extent that the shuctural strength or stability thereof is materially less than it was
before such catastrophe and is less [han the minimum reqairements of the Building Code for new
buildings of similaz structure, purpose or location.
5. Whenever any portion or member or appuRenance [hereof is likely [o fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the
exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened
in place so as to be capable of resisting a wind pressure of one half of tha[ specified in the building
Code for new buildings of similaz sttucture, purpose or location without exceeding the working
stressed permitted in the Building Code for such buildings.
7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls
or other structural portions have materially less resistance to winds or earthquakes than is required
in the case of similar new construction.
8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (ii)faulty construc6on; (iii) the removal, movement or instability of any
portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or
completely collapse.
9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe
for purpose of which it is being used.
10. Whenever the exterior walls or other vertical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does not fall inside the middle on
third of the base.
ll. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage
or deterioration of its supporting member or members, or 50 percent damage or deterioration of its
non-supporting members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has
become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a
harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort therero for
the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any speciGc requirement or prohibition applicable to such building or structure
provided by the building regulations of this jurisdiction, as specified in the Building Code or
Housing Code, or of any law or ordinance of this state or jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any building or structure which, whe[her or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting pazt, member or portion less the 66 percent or the (i) strength, (ii)
fire-resisting qualities or chazacteristics, or (iii) weatheo-resisting qualities or characteristics
required by law in the case of a newly constructed building of like area, height and occupancy in
[he same location.
15. Whenever a building or shucture, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construc[ion or arrangement,
inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be
unsanitary, unfit for human habitation or in such a condition [hat is likely to cause sickness or
disease.
16. Whenever any building or structure, because of obsolescence, dilapida[ed condition, deterioration,
damage, inadequate exists, lack of suf£icient fire-resistive constraction, faulty electric wiring, gas
connections or heating appazaws, or other cause, is determined by the fire marshal to be a fue
hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains on a site aRer the demoli[ion or
destruction of the building or structure or whenever any building or structure is abandoned for a
period in excess of six months so as to constitute such building or portion thereof an attractive
nuisance or hazard to the public.
The 1997 Uniform Housing Codes states;
SECTION 1001- DEFIIVITIONS
1001.1 GeneraL Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the
condi[ions referenced in this section to an extent that endangers the life, limb, health, property, safety or
welfare of the public or the occupants thereof, shall be deemed and hereby are declazed to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary. Inadequate sanitation shall include, but no[ be limited to, [he following:
1. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house.
2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a
hoteL
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventitating equipment.
8. Lack of minimkim amoun[s of na[ural light and ventila[ion require by this code.
9. Room and space dimensions less than required by [his code. 10. Lack of required electricai ligh[ing. 11. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the health officer. 13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate gazbage and rubbish storage and removal facilities as determined by [he health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain s[ructural hazards. S[ructural hazards shall include, but not be limited to, the following:
1. Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insufficient size to carry imposed loads with safety.
4. Members of walls, par[itions or other vertical supports that split, lean, lis[ or buckle do [o defective
material or deteriora[ions.
5. Members of walls, pazfitions or o[her vertical supports that aze of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split
or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of
insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge o settle due to defective material or deterioration.
9. Fireplaces or chimneys that are of insufficient size or svength to carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code
are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code
requiremeuts in effect at the time of installation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violatiou of code requirements in effect
at the time of installation or plumbing uot installed in accordance with generally accepted
construction practices in areas where no codes were iu effect or that has not been maintained in good
condition or that is not being used in a safe manner shall be considered substandard.
1001.7 Aazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of instaRation or mechanical equipment not installed in accordance
with generally accepted construction practices in areas where no codes were in effect or that has not
been maintained in good condition or that is not being used in a safe manner shall be coasidered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plastec
2. Deteriorated or ineffective waterproo£ng or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or
vegetation that, in the opinion of the chief of the fire depaztment, is in such a condition as to cause a fire or
explosion or provide a ready fuel to augmen[ the spread and intensity of fire or explosion arising from any
cause shall be considered substandard.
1001.10 Faulty Materials oF Construction. The use of ma[erials of cons[ruction, except those that are
specifically allowed or approved by this code and the Building Code, and that have been adequa[ely
maintained in good and safe conditions, shall cause a building ro be subs[andard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic
matter, debris, gazbage, offal, rat harborages, stagnant water, combustible materials, and similaz materials
or conditions on a premises constitutes fire, health or safety hazazds that shall be abated in accordance with
the procedures specified in Chapter 11 of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with
adequate exit facilities conforming to the provisions of this code, buildings or portions thereof whose exit
facilities were installed in violation of code requirements in effect at the time of their construction or whose
exit facilities have not been increased in number or width in relations to any increase in occupant load due
to alterations, additions or change in use or occupancy subsequent to the time of construction shall be
considered substandard.
Notwithstanding compliance with code requirements in effect at the time of their construction,
buildings or portions thereof shall be considered substandard when the building official finds that an unsafe
condition exists through an improper location of exits, a lack of an adequate number or width of exits, or
when other conditions exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered substandard when they are not provided with the fse-resistive construction or fire-
extinguishing systems or equipment required by this code, except those buildings or portions thereof that
conformed with all applicable laws at the time of their construction and whose fire-resistive integity and
£re-extinguishing systems or equipment has been adequately maintained and improved in relation to any
increase in occupant load, alteration or addition, or any change in occupancy.
1001.14 Improper Occupancy. All buildings or por6ons thereof occupied for living, sleeping, cooking or
dining putposes that were not designed or intended to be used for such occupancies shall be considered
substandazd.
The following is a list of items that shall be fixed to meet code:
1. Section 602.2 Residential occupancies in the International
Property Maintenance Code states, Dwellings shail be provided
with heating facilities capable of maintaining a room
temperature of 68 degrees F(20 degrees C.) in ali habitable
rooms, bathrooms and toilet rooms based on the winter outdoor
design temperature.
