Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection
prior to installation of ANY roof coverings and is require on the entire roof when spaced
or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are
required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and
water shield is required. Eave and rake metal is required. A ladder extending 3 feet above
the roof eave and secured in place is required to be provided for all roof inspections.
Roof ventilation is required to comply with applicable codes and/or manufacturer
installation instructions, whichever is more stringent. In order to pass a final inspection
of elastomeric or similar type roof coverings, a letter of inspection and approval from the
manufacturer technical representative stating that "the application of the roof at (project
address) has been applied in accordance with the installation instruction for (roof
material brand name) roof covering" is required to be on site at -the time of final
inspection.

Residential Roofing Permit Application
This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received. YOU WILL BE CONTACTED WHEN YOUR PERMIT
IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE AND TIME
WINDOW TO COMPLETE THE TRANSACTION. You will be notified if your
contractor's license or insurance has expired, and you may update those
documents at the time you are issued your permit. Permits are currently being
processed within 5 business days, subject to change based on volume.
For all other requests:
Homeowners wishing to obtain a roofing permit must apply for the permit in person
at City Hall. Revisions to existing permits (for example, to add redecking) must be
completed in person at City Hall. All other non -roofing permits must be completed in
person at City Hall. The Building Division will be open from 7:30-10:30 a.m.,
Monday through Friday to process these types of requests.

Roof Replacement Contractor Agreement
This Agreement is of loth day of July 2017 by and between DARBY ENTERPRISES, INC.
Here after called the contractor and Mary Newell between after called the Owner
WITNESSSETH that the Contractor and the Owner for the conditions name agree as follows
Scope of Work ATTACHED EXIBIT "A"
The Contractor shall furnish all material and perform of the work on the property at:

The Owner shall pay the Contractor for material and labor under the sum of:

Property Owner is X is not intending to make payment from the proceeds
of property and casualty insurance policy.
SB38 COLORADO LAW- You have the right to rescind this contract and obtain a full refund of any
deposit within 72 hours after entering into the Contract. If you plan to use the proceed of a property and
casualty insurance policy to pay for the roofing work, you may rescind this contract within 72 hours after
you received written notice from the Property and Casualty insurer that your claim has been denied in
whole or in part. However, Darby Enterprises, Inc. is entitled to retain payments or deposits to
compensate Darby Enterprises, Inc for roofing work actually performed in a workmanlike manner
consistent with standard roofing industry practices. Darby Enterprises, Inc cannot pay, waive, rebate, or
promise to pay, waive or rebate all or part of any insurance deductible applicable to the insurance claim
for payment for roofing work on your property.
Progress Payments:
If applicable Darby Enterprises, Inc. agrees to hold in trust any payment from
Owner/Agent for materials or roofing services.
PAYMENT SCHEDULE: Payment is due in full upon final inspection of any/all Local. City
or State Bldg Departments,
If payment fails to be made Owner/Responsible Party agrees to pay all legal fees associated with the
collection or recovery of money. Including but not limited to interest, collection cost, suit, attorney's fees,
and accrued interest.
CHANGE ORDERS — Additional Work not included in "Exhibit A": Any extra work which is requested
of required due to the condition of the building or building code changes shall be performed only after a
written change order.
INSURANCE — Contractor shall provide and carry during the entire term of Contract its own insurance,
including general liability insurance {bodily injury and property damage} worker's compensation &
automobile insurance. Contractor agrees to maintain workman's compensation insurance and public
liability insurance in the amount of $1,000,000.00 in full force throughout the term of Contract. The

INDEMNIFICATION — To the fullest extent permitted by law, Contractor agrees to save indemnify and
keep harmless Owner and all persons claiming by through or in connection with Owner or its interest in
the property, including without limitation, and lender having taken a security interest in all or part of the
property, from any and all demands, liabilities, judgments, actions, costs, or claims of whatsoever nature
or variety in connection with the subject matter of the present Construction Contract. These
indemnifications shall not apply to excusable delays, including but not limited to labor, strikes, weather,
fire, unavoidable casualties, or any other causes beyond the reasonable control of the contractor.
OTHER — Owner agrees to protect the contractor by paying all monies owed for which work was
completed. Owner /Agent will protect contractor from liens, judgments, or actions not related to
Contractors work, materials, or actions. Any claims or representative, at which the Owner/Agent will pay
all expenses including but not limited to Attorney Fees to correct or indemnify for Contractor
Warranties and limitation on liability: Contractor grants the customer a five-year warranty on
workmanship. In the event of a claim of defective workmanship, the notice of the warranty claim must be
submitted in writing and must describe the claim in sufficient detail to determine the nature of the
problem(s), and must be signed by the customer. Removal of the roofing system lifts a great weight from
the building. This causes uplift in the building, sometimes resulting in interior cracking of walls, ceilings,
and floors. Such cracking may disappear upon roof replacement; however, uplift is unavoidable.
Therefore, contractor shall not be liable should interior cracks occur. Any re -roofing requires removal of
the membrane protecting the building from rainwater. Contractor shall use best efforts to cover the roof if
rain occurs during re -roofing. However, if rain occurs during re -roofing, rain infusion and even mold
infestation are inevitable. Therefore, should mold occur, contractor shall not be liable. Should fire,
casualty, vandalism, storm(s) resulting in whole, or partial destruction of the building should occur during
the work due it shall not be deemed the fault of the contractor, customer shall look solely to the
homeowner's insurance for recourse for any damage, and contractor shall not be liable. Contractor is not a
dealer in roofing materials, and does not warrant materials supplied or installed. The shingle
manufacture, Certainteed is offering a lifetime warranty on Shingles installed. It is agreed
that shingles and tiles shall vary in color and texture from time to time, and that sure variation does not
constitute a default under this agreement.

2. This. pen -nit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
