At its meeting of December 1, 2005, the Planning Commission APPROVED Case No. WA-05-19,
a request for approval of a lot size variance for an existing two-family dwelling in the R-2 zone
district for property located at 8605 West 32nd Place for the following reasons:
1. The hardship has not been created by any person having interest in the property.
2. The two-family dwelling currently exists and the reduced property size should have no
impact on the surrounding neighborhood.
Planning Commission also APPROVED Case No. `LLA-05-03, a request for approval of a lot line
adjustment plat for properties located at 8605 West 32nd Place and 3295 Cody Court, for the
following reasons:
1. All requirements of the Subdivision Regulations have been met.
2. The land to be transferred is not being used by the owners of Lot 1 and is a logical
extension of Lot 2.
Enclosed is a draft copy of the minutes stating the Commission's decision. A blackline
photographic mylar of the plat needs to be submitted for recording with Jefferson County within
90 days of final action. Enclosed are Jefferson County's recordation requirements. The fees for
recording with Jefferson County are $11 per page. Please submit payment along with the mylar.

7. PUBLIC HEARING
Chair McMILLIN announced that Cases No. LLA-05-03 and WA-05-19 would be heard
concurrently.
A. Case No. LLA-05-03: An application filed by Gino and Michelle Quintana for
approval of a lot line adjustment at the properties located at 3295 Cody Street and 8605
West 32nd Place.
B. Case No. WA-05-19: An application filed by Gino and Michelle Quintana for approval
of a variance to minimum lot size for an existing duplex on property zoned Residential
Two and located at 8605 West 32"d Place.
These two cases were presented by Travis Crane. He entered all pertinent documents into the
record and advised the Commission there was jurisdiction to hear the case. He reviewed the
staff report and digital presentation.
In response to a question from Commissioner BRINKMAN, Travis Crane explained that denial
of the variance request would not affect a two-family dwelling on lot 1.

The applicants, Gino and Michelle Quintana, were sworn in by Chair McMILLIN. In response
to a question from Commissioner WESLEY, Mr. Quintana explained that the uneven notch of
land on the property line would allow an existing fenced garden to remain. Mrs. Quintana
stated that she and her husband plan to maintain that portion of the property.

The property owner, Denise Colburn, was sworn in by Chair McMILLIN. In response to a
question from Commissioner McMILLIN, Ms. Colburn stated that she has no plans to equalize
the size of the two lots. She also noted that there is a cement culvert running between the two
properties.
In response to concerns expressed by Commissioner BRINKMAN, Travis Crane stated that the
uneven property line would not cause any future problems in that these types of situations exist
in many parts of Wheat Ridge.
Alan White stated that there were no other individuals signed up to speak regarding these two
cases.
Commissioner WESLEY stated that he would vote in favor of the applications. He did not
believe the city should hold anyone hostage about quirks along property lines. He commented

that the applicant is attempting to utilize the property as a garden area and keep it in the same
condition as the property at 8605 West 32nd Place. Further, if the property owners wanted to
change the configuration in the future they would have to come back to the city for approval.
It was moved by Commissioner STEWART and seconded by Commissioner BRINKMAN
to approve Case No. WA-05-19, a request for approval of a lot size variance for an
existing two-family dwelling in the R-2 zone district for property located at 8605 West
32nd Place for the following reasons:
1. The hardship has not been created by any person having interest in the property.
2. The two-family dwelling currently exists and the reduced property size should
have no impact on the surrounding neighborhood.
The motion passed 8-0.
It was moved by Commissioner STEWART and seconded by Commissioner WESLEY to
approve Case No. LLA-05-03, a request for approval of a lot line adjustment plat for
properties located at 8605 West 32°d Place and 3295 Cody Court, for the following
reasons:
1. All requirements of the Subdivision Regulations have been met.
2. The land to be transferred is not being used by the owners of Lot 1 and is a logical
extension of Lot 2.
The motion passed 8-0.
C. Case No. Z6A-05-04: An ordinance amending Chapter 26 of the Wheat Ridge Code
of Laws pertaining to references to the Streetscape and Architectural Design Manual.
This case was presented by Alan White. He advised the Commission that proper public notice
had taken place for this case. He reviewed the staff report and explained that the proposed
amendment would simply provide cross references between the commercial zone district
regulations and the Streetscape and Architectural Design guidelines. These changes would
lessen confusion for applicants.
Comu issioner WESLEY suggested adding language to the ordinance to reflect that the
regulations may be changed from time to time.
It was moved by Commissioner WESLEY and seconded by Commissioner STEWART
that Case No. ZOA-05-04, proposed amendments to various sections of Chapter 26 of the
Wheat Ridge Code of Laws referencing the Streetscape and Architectural Design Manual,
be forwarded to City Council with a recommendation of approval for the following
reasons:
1. The City of wheat Ridge has adopted legislation pertaining to the development
standards for the commercial zone districts;

I. CASE ANALYSIS
The applicants (owners) are requesting approval of a lot line adjustment and a lot size
variance (Exhibit 1, Letter of Request).
The properties are currently zoned R-2, and each lot contains an existing structure. The
applicants wish to transfer land from one property to the other. The R-2 zone district
allows either single-family or two-family structures, depending on lot size. The properties
together are currently 20,908 square feet in size.
Typically, a lot line adjustment between two lots is reviewed administratively. In this
case, one of the lots currently does not meet minimum lot size standards for a two-family
dwelling in the R-2 zone district. The transfer of land will make this lot even more non-
conforming. This increase in non-conforming status cannot be approved administratively.
Therefore, Planning Commission must review each request, and will be the final
reviewing authority.
Existing Conditions
Each lot contains an existing structure. Lot 1 (8605 W. 32' Pl.) contains a duplex.
Currently, lot 1 is 12,121.75 square feet in size, approximately 378 square feet short of
the required lot size for a duplex in the R-2 zone district. The structure was built in 1962,
prior to the City's incorporation. Therefore, there are no building permits on file which
would show if the structure was originally constructed as a duplex.
Lot 2 (3295 Cody Ct.) contains an existing single family structure. Lot 2 is approximately
9,000 square feet in size prior to the property transfer (Exhibit 2, Dudley Acres
Subdivision Plat).
Each existing structure will remain. The transfer of property will not have any effect on
the minimum required setbacks or maximum lot coverage for either property. Lot 1 (8605
W. 32nd Pl.) is a somewhat typical cul-de-sac lot, with a small appendage which extends
back to Cody Court, directly north of lot 2 (3295 Cody Ct.). The land has been
maintained by the owners of lot 2, and it is logical that the land is transferred to lot 2.
II. LOT LINE ADJUSTMENT PLAT
The plat will transfer approximately 2,500 square feet of land from the property at 8605
W. 32nd Place to the property at 3295 Cody Ct (Exhibit 3, Plat). The land to be transferred
is located just north of lot 2 (3295 Cody St.) The R-2 zone district requires minimum lot
size of 9,000 square feet for a single-family structure, and a minimum lot size of 12,500
square feet for a duplex. After the property transfer, lot 1 (8605 W. 32nd pl.) will contain
9,621.75 square feet. This decrease in square footage of an already non-conforming lot
necessitates the lot size variance. Lot 2 (3295 Cody Ct.) will contain 11,287.17 square
feet, well above the minimum lot size for a single family structure.
The property transfer is a logical addition to lot 2. It would be impractical for the owner
of lot 1 to either utilize or maintain this portion of land.

Agency Referral
All responding agencies have indicated that they can serve the property, and the applicant
will bear the cost of upgrading any service to the property. Because each property has an
existing structure, perimeter utility easements are not being required.
III. VARIANCE CRITERIA
Staff has the following comments regarding the criteria used to evaluate a variance request:
1. Can the property in question yield a reasonable return in use, service or income if
permitted to be used only under the conditions allowed by regulation for the district
in which it is located?
If the request is denied, each property may still receive a reasonable return in use. The
properties may continue to be used as they have been historically; however the property
transfer cannot be approved.
2. If the variance were granted, would it alter the essential character of the locality?
If the request were granted, the character of the locality would not be altered. The duplex
on lot 1 exists today. The transfer of land from one property to the other should have no
effect on the surrounding area.
3. Does the particular physical surrounding, shape or topographical condition of the
specific property involved result in a particular and unique hardship (upon the
owner) as distinguished from a mere inconvenience if the strict letter of the
regulations were carried out?
One of the lots does have a unique shape. Lot 1 (8605 W. 32 ad Pl.) is located on a cul-de-
sac bulb. The current configuration of lot 1 is the main reason for the property transfer.
The owners of lot 1 do not use the small strip of land being transferred to lot 2. Lot 1
currently does not meet the minimum lot size for a two-family dwelling in the R-2 zone
district.
4. Has the alleged difficulty or hardship been created by any person presently having
an interest in the property?
A person who has interest in the property has not caused the hardship. The structure on
lot 1 was constructed prior to incorporation of the City of Wheat Ridge, and it is
unknown if the structure was constructed in a conforming manner. The two-family
dwelling is non-conforming under today's standards, as it applies to minimum lot size.
5. Would the granting of the variance be detrimental to the public welfare or injurious
to other property or improvements in the neighborhood in which the property is
located, by, among other things, impairing the adequate supply of light and air to
adjacent property, substantially increasing the congestion in public streets or
increasing the danger of fire or endangering the public safety, or substantially
diminishing or impairing property values within the neighborhood?
The request would not be detrimental to the public welfare. The adequate supply of light
and air would not be compromised as a result of the, request. The request would not

increase congestion in the streets, nor increase the danger of fire. The request would most
likely not have an effect on property values in the neighborhood.
6. If criteria 1 through 5 are found, then, would the granting of the variance result in a
benefit or contribution to the neighborhood or the community, as distinguished
from an individual benefit on the part of the applicant, or would granting of the
variance result in a reasonable accommodation of a person with disabilities?
The request would not result a benefit or contribution to the neighborhood, only the
property owner. The request would not result in a reasonable accommodation of a person
with disabilities.
IV. STAFF CONCLUSION & RECOMMENDED MOTION (S):
Each request will require a separate motion

Staff concludes that the variance criteria are supportive of the request. Therefore staff
recommends APPROVAL of the variance request.

I have completed my second review of the lot line adjustment plat for the addresses located at 3295
Cody Street and 8605 W. 32°d Place, and I have the following comments:
1. Plat Review:
A. Under the Planning Commission certification, please correct the spelling of the word
"Commission".
Please make the following correction prior to the next submittal. A hearing before the Planning
Commission has been scheduled for Thursday, December 1St at 7 p.m. Sixteen full-sized copies
and one 11x17 copy will be required by Wednesday, November 23`d. Public hearing signs will be
created by City staff to be posted on the properties by the applicants. These signs must be posted on
each property by Thursday, November 17t , and must remain in place until the night of the
hearing.
The applicants must be in attendance at the public hearing. Upon approval of the lot line adjustment
plat, a mylar copy must be produced, signed and notarized in indelible ink by the applicants. The
signed mylar, along with a check for $11.00 for recordation must be submitted to the Community
Development Department.

I have completed my initial review of the lot line adjustment plat for the addresses located at 3295
Cody street and 8605 W. 32°d Place, and I have the following comments:
General:
A. Please include copies of the deeds for each property.
B. I have included all comments received during the referral period. If you have
questions regarding any of these comments, please contact the agency which
generated the comment.
C. I have included a red-lined copy of the plat with all corresponding comments for
clarification and your review.
2. Plat Review:
A. Under the Owner's Certificate, please correct the spelling of the word "commission"
in the Notary's certification.
B. Please add a Planning Commission certification which reads: Approved this
day of by the Wheat Ridge Planning Commission.

D. Please correct the label for the existing utility easement of the north side of lots 1

applicants. A mineral rights certification form (included) must be completed and returned to the
