Since you are waiting on the property to be sold and closed, you should re-apply when that process is at a point when you are sufficiently sure that the property will be sold. City staff cannot keep the case open any longer based tentative information. The Community Development Department is committed to providing the highest level of customer service, which entails timely review of land use submittals. I explained to you, at the time that Ben was unable to release that portion of the land until they had a closing on the remaining portion, and my understanding of our conversation was that since I had made contact with you and explained to you what was going on, that you would hang on to the Mylar until you heard from me. If I had known that it only extended for 90 days, it would have been my utmost priority to continue to write letters and keep you posted on the progress, but I had no reason to believe that we were in jeopardy of having to begin this process all over again. Please appeal to the City to reconsider a continuance of this case so that when we close, most likely in November, on the remaining portion of the lot at 6417 W. 29th Ave., we can also close this lot line adjustment. Please find the attached memo to you dated December 31, 2007. At that time the case had been inactive for over 120 days. Cases are considered inactive and are typically closed after 90 days of no activity. Staff gave you and Mr. Davenport until January 31, 2008 to come in and sign the mylar so it could be recorded with the Jefferson County Clerk and Recorder, as the plat is in a recordable format. Your letter dated January 17, 2008 was received and an extension of the deadline to sign the mylar was extended another 90 days, as is typical when an extension is granted. The case has now been inactive for nearly 16 months and the extension expired nearly 6 months ago. Since the case has been outstanding for this amount of time the case has been officially closed by the City. Although the case has been closed it is not to say you are unable to re-apply for the lot line adjustment. To re-apply all documents required for a lot line adjustment and fees must be submitted with an application. If you do wish to re-apply for the lot line adjustment staff recommends waiting until a time when both parties involved are available complete the process. After submittal of the initial application, City staff generated several comments which were corrected by your surveyor, Dan Griggs. The final plant with all corrections was submitted in August 2007 and has been being held for the signatures of both you and Ben Davenport since that time. These signatures must be received before the final plat can be recorded at the County. To date, the land use application has been stagnant for a period of over one year. Typically, after a stagnant period of 90 days a land use application is withdrawn, and the process is abandoned. Since the application has been inactive for over one year and this being the second notice of inactivity, the City of Wheat Ridge considers the case closed as of October 8, 2008. The Lot Line Adjustment "process" has been stopped and the City fees have been forfeited as a result of the inactivity on this application. The mylar with final plat will be held for you at the City of Wheat Ridge Community Development Office and can be picked up at your convenience between the hours of 8am and 5pm, Monday through Friday. If you wish to pursue this request further, the City will require that a new application be filed with all other required documents and fees to be submitted. As you know, I am in the process of purchasing a portion of the lot located at 6417 W. 29th Ave. This portion of land is incorporated into the lot line adjustment and land use application referenced above. The current owner of 6417 W. 29th Avenue has the property listed for sale. They would prefer to close my portion of the lot simultaneously with the remaining property. The reason for this is that in order to get a partial release of the deed of trust, the holder of their note would have to be paid off completely for that portion of the land to be released. When the whole property is sold and closed, their lien holder would be paid off, the portion of the land incorporated in my land use application and lot line adjustment would be released and all documents, including the Mylar, could then be recorded. Another option might be for Ben Davenport and I to come to the City and sign the Mylar and have the title company hold the Mylar until the closing of 6417 W. 29tb Avenue, at which time the Mylar would be recorded. Please let me know as soon as possible as to how the City will handle this request. I do not want the case to be withdrawn and do not want to forfeit all fees and progress made thus far. The applicant is seeking the lot line adjustment so they will be able to construct a two car garage on the property. Will a neighborhood meeting need to be held prior to application submittal? A neighborhood meeting will not be required for a lot line adjustment. Planning comments: The parcel on which the action is being requested is zoned Residential Two, R -2. This district was established to provide high quality, safe, quiet and stable low to moderate - density residential neighborhoods, and to prohibit activities of any nature which are incompatible with the residential character. The property is a small lot with a two family dwelling unit on it. The surrounding lots are similar in nature with R -1 and R -2 zoning with single family dwelling units and a church to the west. Under the R -2 zone district regulations, a detached garage is allowed as an accessory building to the primary residence. The garage will need to comply with all R -2 zoning district regulations, such as setbacks, height, and maximum building coverage. A garage is permitted to be 15 feet in height, up to 1,000 sq ft per unit and must have side and rear setbacks of 10 feet and a front setback of 30 feet. It was established that the north property line is the rear property line, the south property line is the front, and the east and west property lines are the side property lines. If the garage would not meet any one of these zoning requirements a variance to that particular requirement would need to be requested as well. The property is accessed using a private drive off of W. 29 Ave. The property to the north also gains access via the private drive coming off of W. 29 Ave. The drive runs on the applicant's property along the eastern edge. An easement would need to be placed on the applicant's property in order to allow the property owner to the north to access his property from the drive. A private road maintenance agreement with all property owners who access their property from the private drive is also needed to address the general maintenance issues of the drive. An agreement has already been received and recorded at Jefferson County according to the applicant. The property owner to the north will need to be listed as a co- applicant for the lot line adjustment. They do not have to do not need to be involved in any part of the process other then expressing written consent of the conveyance of a portion of their land to the applicant. The first step in the lot line adjustment process began with the pre - application meeting on April 5, 2007. A lot line adjustment is an administrative review. This means the application will be reviewed and approved at an administrative level by the Community Development Director rather than having required public hearings before Planning Commission or City Council. The applicant must submit an application for a lot line adjustment along with all the required fees and documents associated with it to the Community Development Department. The Community Development and Public Works Departments, along with other appropriate outside agencies will review the application to identify any issues that should be addressed before the application is signed on. Changes required by any of the departments reviewing the application will need to be addressed and made by the applicant. The Community Development and Public Works directors will review the final plat and approve, approve with conditions, or deny the application. If the application is denied, the applicant may appeal the decision of denial or any of the conditions placed upon the application to the Planning Commission. An appeal must be submitted in writing to the Community Development Director within 10 days of the administrative decision. Public Works comments: Public Works was not present at the meeting.
