This request for an administrative Special Use meets all applicable conditions as required by Section 26-114 of the City of Wheat Ridge Code of Laws. 2. There will be no detrimental effect on health, safety, welfare, or convenience to the public in the area. 3. There will be no impact on the light, air, or water to adjacent property owners. 4. There has been a history of compliance of the property with the provisions of the Zoning and Development Code. 5. The special use will not create or contribute to blight in the neighborhood and will not over burden the capacities of the existing streets, parks, schools, and other public facilities and services. 6. There were no comments or objections received during the required posting period. 7. The proposed special use will continue the use of an existing business that has not received any complaints. With the following conditions: 1. The property shall be utilized in accordance with the existing operation set forth in the approval of Case Number SUP-08-04 and the Site Plan (Exhibit 3). 2. All outside dog runs shall be surrounded by a six foot solid fence so that the interior of the outside dog run is not visible from public streets or adjacent properties. 3. There shall be no overnight boarding of any of the dogs. 4. There shall be no selling of any animals on the premises. 5. Business hours shall be between 7:00 a.m. and 7:00 p.m. Monday through Saturday. 6. Multiple documented complaints about barking dogs shall be grounds for invoking the enforcement procedures of Section 26-114(F) of the Wheat Ridge Code of Laws. 7. REQUEST Case number SUP-08-04 is an application filed by Michael Tilly and Patricia Christiansen for approval of a special use permit to allow to continue the use of an existing dog day care facility to accommodate new owners of the business on property zoned Agricultural Two (A-2) and located at 4322 Xenon Street. The application is being filed by the property owner. Dog day care facilities are considered kennels relative to the table of allowed uses in Section 26-204. In the A-2 district, kennels require a special use permit. A special use permit was granted for the subject property in 2004 (Case No. SUP-04-05) with the condition that the permit is for the applicant and could not be inherited (Exhibit 1, City Council Approval). With this, the new applicant must obtain a new special use permit to allow sale of the business and operation. Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without a public hearing, provided the following conditions have been met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and supports the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. H. CASE ANALYSIS Existing conditions The property is 50,275 square feet, or 1.15 acres (Exhibit 2, Consolidation Plat). It contains multiple structures affiliated with the dog day care facility and a residential structure (Exhibit3 Site Plan). All were in existence at the time of approval of the original special use permit. There is also a fenced in dog run area to the east of the structures used for the business. This area was constructed after approval of the special use permit and meets all applicable regulations per Section 26-204 for dog run areas. A paved parking area adjacent to the building is utilized for the business currently in accordance with the approved site plan from the original land use case. Case history Case number SUP-04-05 approved the use of the property as a dog day care facility in 2004 by City Council. The case was approved with the following conditions: 1. The property shall be utilized in accordance with the Letter of Request/Operational Description and the Site Plan. 2. All outside dog runs shall be surrounded by a six foot solid fence so that the interior of the outside dog run is not visible from public streets or adjacent properties. 3. There shall be no overnight boarding of any of the dogs. 4. There shall be no selling of any animals on the premises. 5. Business hours shall be between 7:00 a.m. and 7:00 p.m. Monday through Saturday. 6. Multiple documented complaints about barking dogs shall be grounds for invoking the enforcement procedures of Section 26-114(F) of the Wheat Ridge Code of Laws. Case No. SUP-08-04/Christiansen 2 7. The applicants shall file a consolidation plat for the properties located at 4322 Xenon and 4330 Xenon with the Community Development Department within one month of approval of the Special Use Permit. 8. The grant of use shall be a personal grant to the applicant and may not be inherited. As there is a new applicant requesting to continue the existing use of the property as a dog day care facility, a new special use permit must be obtained. It is also noteworthy that per Section 26-214 (A-2 district standards) this use must have a minimum lot area of 1 acre. Condition number 7 above states that the applicant had to file a consolidation plat after the approval of the special use. This was placed as a condition because the previous lot was just under one acre, and acquiring the adjacent property and consolidating it created a lot over one acre to meet this standard. The applicants did file this plat to create the current lot per case number MS-05-01 (See Exhibit 2). Analysis The new applicants do not propose any changes to the existing operation. This includes compliance with all conditions placed on the original special use permit including hours of operation, no overnight boarding, and the location and characteristics of the outside dog run area. No physical changes are proposed to any structures or the parking area. The applicants have agreed that they intend to comply with all of the original conditions of the special use permit. Staff researched the property and whether any complaints have been filed during the operation of the business since the original special use permit in 2004. Based on the open code violations files and an email from the Community Services Unit Supervisor (Exhibit 4,,Response from Community Services), there have been no complaints filed for this property. At the neighborhood meeting held on June 4, 2008 for this case, those in attendance expressed they have no complaints about the operation of the business (Exhibit 51 Neighborhood Meeting Notes). III. SPECIAL USE PERMIT CRITERIA Staff has the following criteria to evaluate special use permit requests and shall determine that the majority of the "criteria for review" listed in Section 26-114.13 of the City Code have been met. Staff provides the following review and analysis of the special use criteria: 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The proposed special use should not affect the health, welfare, safety, or convenience of any person working or residing in the area. No complaints have been filed against the business relating to this criterion during its operation and no changes are proposed as part of this application. Staff finds this criterion has been met. 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. The issuance of the original special use permit resulted in improvements to the property from the prior condition, which was as a relatively unmaintained lot. Approval of the special use permit with no changes in the operation will allow this to continue. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. The special use will not create adverse impacts greater than what is existing on the property. Given that this is the continuance of an existing condition, and not a new condition proposed staff has concluded this criterion has been met. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The use will not create undue traffic congestion or hazards. All parking and loading areas are currently existing on the property. Staff finds this criterion has been met. 5. The properly is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The applicant is proposing to utilize the existing buildings with no additions or any new buildings. The proposed dog day care facility will not vary from any of the original site characteristics that were approved as part of the original special use permit. The use will conform to all development standards in the A-2 district for nonresidential uses, including standards for the dog run area. Staff finds this criterion has been met. 6. The special use will not over burden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. Parks, schools and other public facilities will not be negatively impacted. There will be no or minimal increases to traffic on the streets that will be generated by this use as this is an existing use to be continued. Other utility agencies are already serving the property. Staff finds this criterion has been met. 7. There is a history of compliance by the applicant and/or property owner with Code requirements and prior conditions, if any, regarding the subject property. The applicant and the property have no history of code violations. Staff finds this criterion has been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. The Architectural and Site Design Manual applies to all new construction except single and two family residential and those existing structures undergoing major additions. This building will not see any additions or other improvements as a result of this request. Staff finds this criterion is not applicable. IV. NEIGHBORHOOD METING Prior to submittal of an application for a special use, the applicant shall be required to hold a neighborhood meeting in accordance with the requirements set in City Code, Section 26-109A. Approximately 6 individuals were present (excluding city staff and the prior and new applicants) (Exhibit 6, Neighborhood Meeting Sign Up Sheet). V. AGENCY REFERRAL Affected service agencies were contacted regarding the ability to serve the property. Their specific referral responses follow. City of Wheat Ridge Building Division: The Building Division may require a life and safety inspection for the change of business ownership, as is common practice. Additionally, the new applicants must obtain a kennel license to operate through the police department. This license would be applied for after approval of the special use permit. VI. STAFF RECOMMENDATIONS/FINDINGS OF FACT Having found the application for Case No. SUP 08-04/Christiansen, a Special Use Permit to allow the continuance of an existing dog day care facility to accommodate new owners of the business, to be complete and in compliance with the majority of the applicable review criteria, therefore, staff recommends APPROVAL of the special use request. No objections were filed in response to the required posting and adjacent property notification. Staff recommends APPROVAL for the following findings of fact 1. Many of those interested were declined because the current owners did not feel they would run the business to their satisfaction and be good neighbors. • The current owners foresee an overlap of about 3 months with the new owners. • The question of why dogs bark more at some dog day care facilities than others was addressed: L Dogs bark more when there are transparent (e.g., chain liuk) fences, With this, they can see each other and what's going on around them, especially if they are confined- AThen one barks, all of them start to bark. 2_ Unsupervised dogs bark more than those who have constant interaction and supenasion with employees of the facility. Other kennels in the area may not provide Case No. SUP-08-04/Christiansen 10 constant supervision the way this business does. State law for these businesses requires a level of supervision, but many kennels meet the requirement by having someone nearby that comes out to the dog nm area when there are issues. • Those in attendance are primarily residents of the block. Those that spoke up stated they have never heard any barking from this facility, including the neighbor directly to the north who is the closest to the outside dog ran area. • The new owners propose to rim the operation exactly how it currently runs - including no overnight boarding and the same business hours. All conditions from the original SUP approval in 2004 will be adhered to. • One neighbor spoke up about the overgrown weeds on a portion of the subject lot (the north area of the lot). This indicadual would like to see this area cleaned up- • There are not any veterinary technicians on staff with the new ownership, whereas there is with the current owners of the business. One of the new owners however is looking into getting certified. • The new owners are proposing to live and work in the facility (the house) currently housing the business. • The house to the north on the subject property (separate structure) is currently being rented out and this will continue with the new ownership. This facility received approval of a special use permit for the use in 2004. One of the conditions of approval for the special use stated "the grant of the use shall be a personal grant to the applicant and may not be inherited". As a new applicant is requesting to utilize the property for the dog day care facility, a new special use permit application is required. For details on the special use permit procedure, please find the attached handout. Below are the conditions from the original approval in 2004. 1. The property shall be utilized in accordance with the Letter of Request/Operational Description and the Site Plan. 2. All outside dog runs shall be surrounded by a six foot solid fence so that the interior of the outside dog run is not visible from public streets or adjacent properties. 3. There shall be no overnight boarding of any of the dogs. 4. There shall be no selling of any animals on the premises. 5. Business hours shall be between 7:00 a.m. and 7:00 p.m. Monday through Saturday. 6. Multiple documented complaints about barking dogs shall be grounds for invoking the enforcement procedures of Section 26-114(F) of the Wheat Ridge Code of Laws. 7. The applicants shall file a consolidation plat for the properties located at 4322 Xenon and 4330 Xenon with the Community Development Department within one month of approval of the Special Use Permit. 8. The grant of use shall be a personal grant to the applicant and may not be inherited. Next Steps: 1. A written record of this meeting and the discussion will be produced and made part of the public record. Factors discussed will be considered in evaluating the application. 2. After this meeting, the applicant may apply for the special use permit with the Community Development Department. 3. Once we have received a complete application we will forward the information on to any necessary referral agencies (building dept, police dept, etc.) for comment. 4. The department will initiate a ten day public notice period where a sign will be placed on the property, and letters will be sent out to adjacent property owners notifying them of the request. 5. If any legitimate written objections are received during this ten day period, the application may be forwarded to city council for a public hearing and decision. If there are no legitimate written objections received during this ten day period, the application may be approved administratively.
