This letter is intended to clarify the permitted usage of property within the City of Wheat Ridge located
at 10590 W. 44`h Avenue. You were inquiring whether you could conduct itinerant produce sales on
the property this summer.
The property was rezoned from Agricultural-One to Planned Commercial Development by the Wheat
Ridge City Council on February 26, 2001. Pursuant to a note on the recorded preliminazy and final
development plan, "construction shall be developed in a single phase and shall start by late fall of 2003
and shall be completed in the spring of 2004. The garden center is currently in operation and wiD be
permitted to continue until the site development commences according to the development schedule."
It was City Council's intent that temporary garden sales could occur through the 2003 season. Any use
of the property after that needs to be in a permanent structure with approved site improvements. For
this reason, no itinerant sales are allowed by the property owner or lessee.

SUBJECT: Sign Permit Application for 10590 West 44" Ave.
DATE: June 21, 2000
The application and site plan for a sign permit has been reviewed for compliance with the City's
Code of Laws. Based on that review, I have the following comments:
d 1. The signs along 44' Ave aze considered freestanding signs. Only one freestanding sign is
allowed per street frontage. The masimum permitted height is 6 feet. Each freestanding sign
is limited to 32 square feet in size. The leading edge of the sign must be set back a minimum
of 10 feet from the property line.
✓ 2. The area and total height for each sign needs to be noted on the site plan.
~ 3. A sight triangle needs to be maintained on the comer of 44`h Ave and Moore St. This is
measured from the intersecting point of the lot lines for a distance of 25' along Moore St.
and a distance of 55' along 44`h Ave. Obstructions, including any signs, within this site
triangle are limited to 42" in height [Section 26-30 (I) (2)]. Without a scale on the drawing it
is difficult to determine whether the sight triangle is impacted.
-'~4. The banners that aze attached to the fencing are considered wall signs. Wall signs are only
permitted on those sides fronting a public street (44`h Ave. & Moore St.). Allowable area for
the wall signs is limited to 2 square feet per linear wall foot. Pursuant to the sign code, if a
banner is affixed to a fence, size shall be the same as if it were attached to the neazest
adjacent building wall having street frontage. This means that the allowable wall sign area is
based on the tent and is limited to 80 square feet fronting W 44" Ave. and 80 square feet
fronting Moore St.
/ 5. The "open" sign can be considered an informational sign if limited to 4 square feet in area.
An informational sign does not require a sign permit and does not count toward allowable
sign azea. The current "open" sign at 15 squaze feet does not qualify as an informational sign
and will count towazd allowable wall sign azea on the street frontage it faces.
/ 6. The banner on the east side of the fence as shown on the site plan does not reflect what is
actually attached to the fence. The banners must be relocated to a side of the fence facing
street frontage (44"' Ave. or Moore St.). If the 2nd banner is to be used, size must be indicated
on the site plan and together they may not exceed 80 square feet.
