Thanks for this information. I have completed my research at the City and can report as
follows:
The Code requires the memorandum to be recorded, but does not require an owner name.
However, the owner at the time of the designation was Joy Williams, and her name does
appear on the recorded memorandum (attached). The memorandum lists the property
address as 11460 W. 44th Avenue, and this is in fact the correct address of the parcel upon
which the barn is located. At some time subsequent, it appears that a subdivision occurred,
creating the 11480 address, but you will note Ms. Williams April 8, 1998 consent letter lists
the barn's address as 11460.
I conclude that the City fully complied with Code 26-914. Please let me know if you have
further questions.

n1� THIS MEMORANDUM OF ACTION is made and executed by the City of Wheat
J Ridge, (the "City") with respect to the following facts:
RECITALS
A. On July 27, 1998, the Wheat Ridge City Council adopted Ordinance No. 1127,
Series 1998 entitled An Ordinance Designating the Joy Williams Barn, Located
at 11460 West 44' Avenue, as an Historic Landmark in the City of Wheat
Ridge; and
B. Ordinance 1127was adopted in accordance with Article VI of Chapter 26 of the
Wheat Ridge Code of Laws; and
C. Article VI, Section 26-613 of the Code of Laws requires the City to record with
the Jefferson County Clerk and Recorder a Memorandum of Action within 15
days of City Council designation of an historic landmark.
NOW, THEREFORE, in accordance with Article VI, Historic Preservation, of the
Wheat Ridge Code of Laws, the City hereby sets forth the following:
1. The Joy Williams Barn, (the "Barn") located at 11460 West 44' Avenue, has
been designated as an Historic Landmark by the City of Wheat Ridge;
2. The legal description of the property which underlies the Barn and is affected by
the historic landmark designation is attached hereto as Exhibit A:
3. The Barn and the property described on Exhibit A attached hereto are subject to
Article VI, Chapter 26 of the Wheat Ridge Code of Laws pertaining to historic landmark
requirements;
4. The provisions in Article VI, Chapter 26 provide, among other things, that with
regard to properties which have historic designation, there are certain limitations on
development, certain maintenance obligations, and certain penalties for violations of or failure
of compliance with the Article;
5. This Memorandum is made solely for purposes of confirming the matters stated
herein for recording purposes. This Memorandum does not in any manner alter, amend,
enlarge or reduce the respective rights, privileges, liabilities or obligations of any person.

The Notice and Order, attached hereto as Exhibit B, detailed eight (8) separate
violations of the Uniform Code for the Abatement of Dangerous Buildings, adopted by the City
and applicable to the Property pursuant to Section 5-80 of the Wheat Ridge Code of Laws
("Code"). Each condition upon the Property in violation of the Code, including the uniform codes
adopted by reference therein, constitutes a nuisance pursuant to Code Section 15-4. The
damage done to the House by the Tree is simply too severe to be reversed. The House is
structurally unsound and dangerous beyond repair.
The Notice and Order further directed the Responsible Parties to cure the eight (8)
violations by- (1) securing the House from entry of unwanted persons, and (2) taking all
necessary action to remove the Tree and demolish the House. After the Notice and Order were
served, Mr. Huss called the City of Wheat Ridge Community Services Unit and informed City
staff that the Responsible Parties had no plans to abate the dangerous conditions set forth in
the notice because the Property was in foreclosure, As of the date of this Affidavit, the real
estate records of Jefferson County, Colorado, available through the Jefferson County
Assessor's website, reflect that the Responsible Parties remain the record owners of the
Property.
As of the date of this Affidavit, the Responsible Parties have failed to abate the
dangerous nuisance conditions, as directed by the Notice and Order, The Property today exists
as it appears in Exhibit A. Having determined that it is unable to obtain compliance through the
Responsible Parties, the City applies to this Court for an Abatement Order authorizing the City
to enter the Property and abate the nuisances, pursuant to Section 15-8 of the Wheat Ridge
Municipal Code,
Therefore, for the reasons stated herein, the City of Wheat Ridge requests
Abatement Order authorizing the City to enter the Property and remove the Tree, demolish t

This matter comes on for hearing upon the application of the City of Wheat Ridge for a nuisance
abatement order with respect to the following real property within the City:

On 07/05/2010 at approximately 1300 while on routine patrol I observed the
following code violations located at 11480 W 44th Ave:
- tall grass and weeds exceeding 12 inches in height located on the entire

the property for compliance. Upon arrival I observed the following violations:
- a portion of the tall grass and weeds had been cut to less than 12 inches in
height located on the north side of the property.
- tall grass and weeds exceeding 12 inches in height located on the west and east
sides of the driveway on the property.
- trash and junk located on the north side of the property.
- the north fence was in disrepair on the property.
- the fallen tree had not been removed and the structure had not been repaired
from the July 18, 2009 storm.
The property did not appear to be in compliance. I took digital photos of the
violations on the property. I issued an Administrative Citation # A-1005 (2nd) to
S1 Tim Huss and S2 Richard Sparlin for 15-24 Littering and 24-51, Weed Control. I
issued a Notice of Violation for 15-15 Unlawful Acts. I mailed the citation and

and live loads, is more than one and one half times the working stress or stresses
allowed in the Building Code for new buildings of similar structure, purpose or
location.

(4) Whenever any portion thereof has been damaged by fire, earthquake, wind, flood
or by any other cause, to such an extent that the structural strength or stability thereof
is materially less than it was before such catastrophe and is less than the minimum
requirements of the Building Code for new buildings of similar structure, purpose or
location.
(5) Whenever any portion or member or appurtenance thereof is likely to fail, or to
become detached or dislodged, or to collapse and thereby injure persons or damage
property
(8) Whenever the building or structure, or any portion thereof, because of (i)
dilapidation, deterioration, or decay; (ii) faulty construction; (iii) the removal,
movement or instability of any portion of the ground necessary for the purpose of
supporting such building; (iv) the deterioration, decay or inadequacy of its foundation;
(v) any other cause, is likely to partially or completely collapse.
(11)Whenever the building or structure, exclusive of the foundation, shows 33 percent
or more damage or deterioration of its supporting member or members, or 50 percent
damage or deterioration of its nonsupporting members, enclosing or outside walls or
coverings.
(13) Whenever any building or structure has been constructed, exists or is maintained
in violation of any specific requirement or prohibition applicable to such building or
structure provided by the building regulations of this jurisdiction, as specified in the
Building Code or Housing Code, or of any law or ordinance of this state or
jurisdiction relating to the condition, location or structure of buildings.
(14) Whenever any building or structure which, whether or not erected in accordance
with all applicable laws and ordinances, has in any nonsupporting part, member or
portion less than 50 percent, or in any supporting part, member or portion less than 66
percent of the (i) strength, (ii) fire- resisting qualities or characteristics, or (iii)
weather - resisting qualities or characteristics required by law in the case of a newly
constructed building of like area, height and occupancy in the same location.
(17) Whenever any building or structure is in such a condition as to constitute apublic
nuisance known to the common law or in equity jurisprudence
The ordered repairs are:
1. Take the necessary action to immediately secure the structure from entry of
unwanted persons
2. Submit all necessary documents, obtain all necessary permits and perform all
