1, This permit -was issued based on the information provided in the permit application and accompanying Flans and specifications and is
subject to the compliance with those documents, and all applicable statutes, ordinances, regulations, policies and procedures.
2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the original permit tee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to the standard
requirements, fees androcedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief Budding Official and is not guaranteed.
4, No work of any manner shall be performed that shall results in a change of the natural flow of water without prior and specific approval.
5, The permit holder shall notify the Building and Inspection Services Division in accordance with established policy of all required
inspections and shall not proceed or conceal work without written approval of such work from the Building and Inspection Services
Division.

Case No. SUP-03-02 is an application by Michael Woodward requesting approval of an
administrative special use pernut to allow a vehicle sales lot on Gl zoned properiy located at 12301
West 44"' Avenue.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirements for a public hearing,
provided the following conditions aze met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Deparhnent has notified adjacent property owners by
letter notice and the site has been posted for at least ten (10) days,
3. No written objections have been received in such ten-day period;
4. The Community Development Director concludes that the criteria for approval, as set
forth below, aze substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerarions to ensure
compliance with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and may or may not be inherited; and
/or,
3. Whether the SUP is granted only for a defined period, after which time the specia7 use
shall expire unless renewed subject to all of the requirements of this section
AGENCY REFERRALS
The following are comments from responding ciYy deparhnents and outside agencies.
Arvada Fire Protection Dishicf wi11 requiie an access aisle not less than 20' in width from West 44h
Avenue to the building. A tum-around will not be required. The building does not have to be
sprinkled. The garage portion of the structure can only be used for detailing of vehicles. No storage
of flammable liquids or oils is allowed.
Colorado Department of Transportation has no comments.
Valley Water District currently serves the property with a 3/<" tap on a 16" water main in 44`h
Avenue. Additiona] fire hydrants wil] not be required.
Xcel Energy can serve the proper[y with an existing gas line in 44`h Avenue. Existing elech-ic
service lines are on the south side of 44`h Avenue.
Ciry of Wheat Ridge Public Works Department reviewed the site plan and has no comments.
City of Wheat Ridge economic development has noted that the property is located in an urban
renewal area, which calls for a lazge commercial project. The SUP is inconsistent with the long-
range goal, however the proposal is probably the best use for the property until redevelopment
occurs.
SPECIAL USE PERMIT CRITERIA
Before an administrative specia] use is approved, the applicant shall show and the Communiry
Development Director shall find that the proposed special use:
1. Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood of the proposed
use.
The property in quesiion has historically been utilized for vehicle sales. No substantial changes
are proposed to the site, except for upgrades to the parking lot and the replacement of dead
landscaping in two existing planting azeas.
2. Will not create or contribute to blight in the neighborhood by virtue of physical or
operational characteristics of the proposed plan.
The property has been vacant for several years and is in an unmaintained condition. The
establishment of a viable commercial use should be a benefit to the neighborhood and will not
contribute to blight.
3. Will uot adversely affect the adequate light and air, nor cause significant air, water
or noise pollution.
The site conditions are not changing, therefore, there should be no unpact on light, air, or water
to adjacent properties. The property is bounded on the north by a muu-storage facility with I-70
beyond. The 3-70 off-ramps abut the property on the east. In light of the proximity to I-70, there
should be no concem for increased noise pollurion.
4. Will not result in undue traffic congestion or trafC►c hazards, or unsaFe parking,
loading, service of internal traffic conflicts to the detriment of persons whether on
or off the site.
No changes aze proposed to the existing access to W. 44`h Avenue and the applicant will provide
adequate employee and customer parking on-site. Emergency vehicle access has been evaluated
by the Arvada Fire Protection District who is requiring a 20' wide access aisle from 441h Avenue
to the building.
5. Will be appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with
the character of the surrounding areas and neighborhood, especially with adjaceat
properties.
Adjacent properties are commercial in nature and will experience minimal impact from the
proposed special use. The applicant is upgrading the facility in regards to aesthetics of the
building, striping of the parking lot and installation of new ]andscape materials.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and
other public facilities and services.
All responding utility agencies are able to serve the properiy. There will be no impact to parks
or schools as no new residences are proposed.
History of compliance by the applicant with Code requirements and prior
conditions, if any, regarding the subject property.
A search of the City's code enforcement records has shown that there was a sign code violation
waming notice issued to the property owners in 1999. The violation was abated in a reasonable
time period (approximately one month).
8. Ability of the applicant or any permitted-in-interest to continuously meet the
conditions of the proposed permit.
If conditions of an approved special use are violated, the permit can be revoked. If the permit is
revoked, then the car sales use must cease. It is in the applicanYs best interest to follow the
terms and conditions of any approval received form the city.
9. Other factors relevant to the specitic application.
There aze no other relevant factors.
This request for an administrative special use meets all applicable conditions as required by Section
26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in
opposition to this request from the adjacent property owners.
Therefore, Case No. SUP 03-02 is hereby APPROVED with the following conditions:
1. The special use shall be a grant of use to run in perpetuity with the property, unless it is
included as part of an overall redevelopment plan of aggregated, adjacent properties.
2. The use of the property shall remain in compliance with the submitted application
materials and site development plan.
3. Hours of operation shall be 9 a.m. to 7 p.m., Monday ihrough Friday, and 9 a.m. to 6 p.m.
on Saturday and Sunday.
4. Vehicle sales shall be limited to cars, trucks and motorcycles. No RV, boat, trailer or
personal watercraft sales shall occw.
5. Freestanding signage on the property will be limited to the existing freestanding sign.

On June 17, the Community Development Director approved a request for an administrative special
use permit for a vehicle sales lot at 12301 West 44`h Avenue. Attached for the building permit file is
a copy of the staff fmdin¢s and an approved site plan. Required site modifications include parking
lot striping and installarion of landscaping in two ex ting islands. The improvements must be
completed prior to issuance of a certificate of cbmpl~tion and opening of the business. The owner
was also informed that permits would be needed for:installation of a sign face change and wall
signage.

Case No. SUP-03-01 is an application by Michael Woodwazd requesting approval of an
administrative specia] use permit to allow a vehicie sales lot on C-1 zoned property located at 12301
West 44`h Avenue.
Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide
upon applications for administrative special use approval, without requirements for a public hearing,
provided the following conditions are met:
1. A completed application package has been submitted and fee paid.
2. The Community Development Department has notified adjacent property owners by
letter notice and the site has been posted for at least ten (10) days,
3. No written objections have been received in such ten-lay period;
4. The Community Development Director concludes that the criteria for approval, as set
forth below, aze substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval,
which may include physical design, operational, and maintenance considerations to ensure
compliance with the criteria for review.
The Community Development Director shall also decide the following:
1. Whether the SUP runs with the land in perpetuity; or,
2. Whether the SUP is personal to the applicant and may or may not be inherited; and
/or,
3. Whether the SUP is granted only for a defined period, after which time the special use
shall expire unless renewed subject to ali of the requirements of this section
AGENCY REFERRALS
The following aze comments from responding city deparlments and outside agencies.
Arvada Fire Protection District will require an access aisle not less than 20' in width from West 440'
Avenue to the building. _A tum-azound will not be requued. The building does not have to be
sprinkled. The garage portion of the structure can only be used for detailing of vehicles. No storage
of flammable liquids or oils is allowed.
Colorado Deparhnent of Transportation has no comments.
Valley Water District currently serves the property with a'/a" tap on a 16" water main in 44`b
Avenue. Additional fire hydrants will not be required.
Xcel Energy can serve the property with an existing gas line in 44`h Avenue. Existing electric
service lines aze on the south side of 44`h Avenue.
City of Wheat Ridge Public Works Department reviewed the site plan and has no comments.
City of Wheat Ridge economic development has noted that the property is located in an urban
renewal area, which calls for a large commercial project. The SUP is inconsistent with the long-
range goal, however the proposal is probably the best use for the property until redevelopment
occurs.
SPECIAL USE PERMIT CRITERIA
Before an administrative special use is approved, the applicant shall show and the Community
Development Director shall find that the proposed special use:
Will not have a detrimental effect upon the general health, welfare, safety and
convenience of persons residing or working in the neighborhood of the proposed
use.
The property in question has historically been utilized for vehicle sales. No substantial changes
aze proposed to the site, except for upgrades to the parking lot and the replacement of dead
landscaping in two existing planting areas.
2. Will not create or contribute to blight in the neighborhood by virtue of physical or
operational characteristics of the proposed plan.
The property has been vacant for several years and is in an unmaintained condition. The
establishment of a viable commercial use should be a benefit to the neighborhood and wiil not
contribute to blight.
3. Will not adversely affect the adequate light and air, nor cause significant air, water
or noise pollution.
The site conditions are not changing, therefore, there should be no impact on light, air, or water
to adjacent properties. The property is bounded on the north by a mini-storage faciliry with I-70
beyond. The I-70 off-ramps abut the property on the east. In light of the proximity to I-70, there
should be no concern for increased noise pollution.
4. Will inot result in undue trafSc congestion or traftic 6azards, or unsafe parking,
loading, service of internal traffic conflicts to the detriment of persons whether on
or off the site.
No changes are proposed to the existing access to W. 44`h Avenue and the applicant will provide
adequate employee and customer parking on-site. Emergency vehicle access has been evaluated
by the Arvada Fire Protection District who is requiring a 20' wide access aisle from 44`h Avenue
to the building.
5. Will be appropriately designed, including setbacks, heights, parking, bulk,
buffering, screening and landscaping, so as to be in harmony and compatible with
the character of the surrounding areas and neighborhood, especially with adjacent
properties.
Adjacent properties aze commerciai in nature and will experience minimal impact from the
proposed special use. The applicant is upgrading the facility in regards to aesthetics of the
building, striping of the parking lot and installation of new landscape materials.
6. Will not overburden the capacities of the existing streets, utilities, parks, schools and
other public facilities and services.
All responding utility agencies are able to serve the property. There will be no impact to pazks
or schools as no new residences aze proposed.
History of compliance by the applicant with Code requirements and prior
conditions, if any, regarding the subject property.
A search of the City's code enforcement records has shown that there was a sign code violation
warning notice issued to the property owners in 1999. The violation was abated in a reasonable
time period (approximately one month).
8. Ability of the applicant or any permitted-in-interest to continuously meet the
conditions of the proposed permit
If conditions of an approved special use are violated, the pernut can be revoked. If the pernut is
revoked, then the caz sales use must cease. It is in the applicanYs best interest to follow the
terms and conditions of any approval received form the city.
9. Other factors relevant to the specific application.
There aze no other relevant factors.
This request for an administrative special use meets all applicable conditions as required by Section
26-114 of the City of Wheat Ridge Code of Laws. Staff has not received written comments in
opposition to this request from the adjacent property owners.
Therefore, Case No. SUP-03-01 is hereby APPROVED with the following conditions:
1. The special use shail be a grant of use to run in perpetuity with the property, unless it is
included as part of an overall redevelopment plan of aggregated, adjacent properties.
2. The use of the property shall remain in compliance with the submitted application
materials and site development plan.
3. Hours of operation shall be 9 a.m. to 7 p.m., Monday through Friday, and 9 a.m. to 6 p.m.
on Saturday and Sunday.
4. Vehicle sales shall be limited to cazs, trucks and motorcycles. No RV, boat, trailer or
personal watercraft sales shall occur.
5. Freestanding signage on the property will be limited to the existing freestanding sign.

(2) For all curb cuts, the vertical curve from the traveled way into the access shall be the flattest curve
that can be obtained. To prevent the center or overhang drag of a vehicle, with some allowance for vehicle
load and bounce, crest vertical curves should not exceed a four inch hump in a 10-foot chord and sag
vertical curves should not exceed a four inch depression in a 10-foot chord. For any access that is not a
curb cut, including streets and private access using curb returns, the first 20 feet beyond the closest
highway lane, including speed change lanes or the distance to the side drain, whichever is greater, shall
slope down and away from the highway at a two percent grade to ensure proper drainage control.
Exceptions may be made where steep topography, such as a mountain, makes this requirement very
difficult to fulfill. The approved design must protect the highway from drainage flows. Valley gutters are not
recommended. Where super elevations are present due to horizontal curves, drainage adjustments may
be necessary at Department approval.
(3) Within the right-of-way, maximum grades shall be limited to ten percent for low volume feid and
residential access. All other accesses shall be limited to a maximum of eight percent grade. Lesser grades
may be required for drainage control purposes. Use of the right-of-way for access purposes should not
preclude future roadway use of the public rights-of-way. The length of the access within the right-of-way
should be minimized. Any access horizontal or vertical curve should be minimized within the right-of-way
so as not to interfere with the future use, widening, reconstruction, or realignment of the highway within the
right-of-way.
(4) The horizontal axis of an access to the highway shall be at a right angle to the centerline of the
highway and extend a minimum of 40 feet from the edge of the roadway or to the right-of-way line,
whichever is greater. An angle between 90 and 60 degrees may be acceptabie only if significant physicai
constraints require a skew angle less than 90 degrees and is approved by the issuing authority and the
Department based upon site specific conditions. When horizontal curves are present, the issuing authority
or Department may require a different access approach angle to improve entering sight distance.
(5) Access specifications shali ensure that the access is designed and constructed in a manner that will
encourage proper use by the motorist. Access limited to right turns may be requested to have a positive
barrier such as a non-traversable median to prevent unauthorized tums either on the roadway or using the
access. Channelized driveway isiands may be required for turn restricted driveways when the driveway
volume is predicted to exceed 100 DHV, no restrictive center median is in place or programmed to be
constructed or it is likely that there will be frequent violations of the turn restrictions. Channelized driveway
islands are nortnaily not required when the driveway volume is lower and it is unlikely that there will be
frequent violations of the tum restrictions.
(6) An access that has a gate across it shall be designed so that the longest vehicle using it can clear the
roadway when the gate is ciosed. If significant topographical features make this requirement infeasible,
providing a wide shoulder for temporary standing while the gate is operated may be permitted or required.
(7) The access shali be designed to facilitate the movement of vehicies from the highway to prevent the
queuing of vehicles on the roadway. An access shall not be approved for parking areas that require backing
maneuvers within state highway rights-of-way. All off-street parking areas must include on-site maneuvering
areas and aisles to permit user vehicles to enter and exit the site in forward drive without hesitation other
than as directed by official traffic control devices. The issuing authoriry may request the review of the
parking lot layout and provide those terms and conditions and those design requirements necessary to
ensure the safe use of the access.
