The foundation is poured in place concrete. The exterior walls are frame with wood siding. There is a concern about the hole in the corner of the house. The hole is about 4 foot x 4 foot, removing the 3-2x4 corner post and the 2x4 wall studs each side for about 4 feet. The corner is supported by the existing diagonal wall sheathing. The corner of the house and the roof above the opening are supported by the diagonal wall sheathing and interior partitions and is not subject to collapse. For repair shore up the roof from the inside and tear out the corner and rebuild with 2x4 at 16 wall studs with 3-2x4 corner studs. Sheath the corner with '-�" OSB. Reinstall lap siding. The facility is home to a hair salon. The purpose of the limited inspection was to identify and sample potentially hazardous friable and non - friable ACM that has recently been impacted by a car impact and a subsequent fire and/or may be impacted by renovation activities to repair damaged materials. Bulk -samples were collected of the following suspect asbestos containing materials, all of which are none -detect for asbestos. Only the materials that were impacted by the car impact and/or fire were tested as part of this inspection. • The knockdown textured plaster ceiling in the rear laundry room • The knockdown textured plaster walls and ceilings in the center room on the west side of the building • The hand -troweled textured plaster ceiling in the main entry room (main front entrance) • The knockdown textured plaster walls and ceilings in the northwest corner room • The brown insulation in the ceiling cavity throughout • The white window glaze if the west side exterior window • The brown roof shingles 2.0 Scope of Work The scope of the limited inspection and bulk -sampling was limited to specific areas and materials of the salon listed above. The remaining areas and materials within the building, garage or any out -building on the property were not included in the scope of the inspection. The limited asbestos inspection did not constitute a full building inspection and does not fulfill the asbestos inspection requirements for structures that are to be demolished. 3.0 Site Description The building is a single -level, single-family residence converted for commercial use. 4.0 Certifications The limited asbestos inspection and bulk -sampling was conducted by Mr. Steve Shurtliff with DS. DS is a Colorado Department of Public Health and Environment (CDPHE) certified Asbestos Consulting Firm, Registration No. 14912. Mr. Shurtliff is a CDPHE certified Building Inspector; having certification number 15413 (see Appendix Afor certifrcates). 5.0 Inspection, Sampling & Analytical Procedures 5.1 Inspection Procedures The limited asbestos inspection was conducted by an Environmental Protection Agency (EPA) and CDPHE certified Building Inspector. The inspection procedures included identifying and sampling suspect ACM within the pre -defined areas, submitting samples to an accredited laboratory for analysis, classifying the materials and assessing their condition, and compiling a final report detailing the inspection and the analytical results of the bulk -samples. 5.2 Sampling Procedures Statistically random bulk -samples representative of the suspect ACM of each homogeneous area were collected according to the guidelines published as EPA Final Rule: Title 11 of the Toxic Substances Control Act (TSCA), 15 USC, Sections 2641 through 2654 and in compliance with 40 CFR, Part 763 and CDPHE Regulation Number 8, Part B - Asbestos (Reg. 8). DS has collected the appropriate number of bulk -samples to meet all regulatory requirements for the classification and quantity of each homogeneous area. Some minor destructive sampling was conducted; however, walls, columns and perimeter pipe chases were not broken into in order to locate and quantify suspect ACM. It should be noted that additional ACM might be located in these and other inaccessible areas. 5.3 Analytical Procedures All asbestos bulk -samples were analyzed by a National Voluntary Laboratory Accreditation Program (NVLAP) accredited laboratory via Polarized Light Microscopy (PLM) for asbestos content (see Appendix B for laboratory report). The percentage of asbestos within each individual bulk -sample can vary depending on sample location, homogeneity of the material, and the type of application. Any sample reporting a "TRACE" amount of asbestos must be considered positive for asbestos greater than 1% unless it is re -analyzed utilizing the point -count method and verified to be less than or equal to 1%. Materials containing less than or equal to 1% asbestos are not regulated by CDPHE Regulation 8, Part B - Asbestos. However, all demolition/abatement activities should be performed following the applicable Occupational Safety and Health Administration (OSHA) regulations. This would include, but not limited to, the appropriate asbestos training for the type of material being removed/disturbed as well as having a properly trained supervisor onsite, using wet removal methods, wearing adequate personal protective equipment (NEPA-filtered particulate respirators), medical surveillance of workers, personal -exposure air monitoring, area air monitoring in occupied buildings, etc. There may also be landfill disposal requirements for these materials, depending on the facility. DS recommends that all demolition/renovation areas involving any amount of asbestos be subjected to visual inspections and a final clearance air testing by a CDPHE-certified Air Monitoring Specialist (AMS) after the work has been completed, but before any containments are dismantled and the area is reoccupied. 6.0 Homogeneous Areas A Homogeneous Area (HA) includes materials that are uniform in appearance, color, texture and date of application. The asbestos content of the bulk -samples collected within a homogeneous area can be applied to the entire homogenous area if they conform to the above characteristics and the regulated minimum sample quantities of each type of material are collected and analyzed. El 6.1 Material Friability A material can either be friable or non friable. A friable material is one that, when dry, can be pulverized, or reduced to powder by hand pressure, a non -friable material cannot. A non -friable material may become friable if its condition had deteriorated or has been impacted by forces that have rendered it friable. 6.2 Material Classifications Sampled materials are divided into one of the following three categories: • Surfacing Material: sprayed or troweled onto structural building members • Thermal System Insulation (TSI): any type of pipe, boiler, tank, or duct insulation • Miscellaneous Material: all other materials not classified in the above two categories 6.3 Material Conditions Sampled materials are placed into one of the three following categories of conditions: • Good: none to very little visible damage or deterioration • Damaged: the surface is crumbling, blistered, water -stained, gouged, marred or otherwise abraded over less than one-tenth of the surface if the damage is evenly distributed, or one-quarter if the damage is localized • Significantly Damaged: the surface is crumbling, blistered, water -stained, gouged, marred or otherwise abraded over greater than one-tenth of the surface if the damage is evenly distributed, or one-quarter if the damage is localized 6.4 Sample Quantities DS collected at least the minimum number of samples from each homogeneous area necessary to meet all regulatory requirements for the quantity of material to be disturbed. The quantities listed in this report are approximate and on-site verification of the exact quantity of each material is required. Please reference the attached field report and photographs. The house is a ranch circa 1946. The foundation is poured in place concrete. The foundation is on footings. The exterior walls are frame with wood siding. The roof is stick framed. There is a concern about fire damage on the inside and outside of the house. An automobile burned on the west side of the building engulfing the building in fire also. The automobile did not impact the building. The fire went up the outside of the building and caught the attic on fire also. The interior fire damage is confined to the west bedroom. The rest of the attic suffered smoke damage. The 2x4 rafters are charred to 1/16" depth in the attic and are still serviceable. The rafter tails and roof sheathing are damaged from the fascia up the roof about 3 feet. For repair remove 4 feet of roof sheathing and the fascia board on the west side. Sister the rafters with 8 foot 2x4's. Replace the 2x4 fascia. Install 4x8 sheets of ;,�" roof sheathing. Install underlayment and 4 foot strip of new asphalt shingles to match existing. Scrape or sandblast the char off the siding and soffit and prime with kills before painting. I had been told that smoking of marijuana and tobacco was prohibited inside the business. I was part of a team that waited outside while an undercover police officer entered the 3 Kings Dab Supply. I had counted nine cars parked in the front (north) parking lot when I had driven passed. I heard Det. Kendall advised that the undercover officer inside the business had observed smoking violations. We were asked to respond to the business by Det. Kendall. I parked on the W 44th Ave sidewalk because the parking lot was completely ful of cars. I saw that there was a film crew outside the business with a large TV camera and a boom microphone. As I walked up to the front door I was approached by a member of the film crew and I was asked if they would be allowed to follow me inside. I advised the film crew that there may be an occupancy issue inside the business and I asked them if they would remain outside. I walked into the front door (4th officer in) and I was met with an overwhelming odor of marijuana and a wall of smoke. I walked throughl,the first room and I noted that it was occupied by four or five peoplx,,e. I walked into the sea�ond room and I noted that it was occupied by about,10 people. In the second room i'noted that many of the occupants were sitting around a "bar" that was covered in drug paraphernalia and gas torches. I walked to the right and I noted that there were five people in a small room with a TV mounted on the wall. I went back outside and the undercover officer advised me that he had observed several people smoking inside the business. The officer advised me that he saw a white female with green hair smoking, a white male with a shaved head and a black shirt smoking, and an older male smoking. While I was outside I noted that the other officers and several patrons walked outside into the north parking lot. I later learned that the officers had been asked to leave the businesses by the owner. I walked back up to the front door and I attempted to enter the business to attempt to identify the patrons that had been smoking. The door was locked and A4 Shelton Howard, one of the business owners, told me that he had locked the door and he was not allowing anyone in the business. I looked into the business and I still could see many= patrons inside while the front door was locked. Sgt. J. Pickett requested that I cite Shelton Howard a summons for 9-25(a) Smoking Prohibited because other patrols had been cited for smoking inside the business. I issued Shelton Howard summons #M36677 for Smoking Prohibited. W1 Robert Corry was standing next to Howard Shelton. I asked Robert Corry of he was the second business owner. Howard Shelton told me that Robert Corry was his attorney. While standing outside in the parking lot Robert Corry addressed me and stated that the business was private and that we were not allowed to enter a private business. I advised Robert Corry that there was an "OPEN" sign on the front of the business. Robert Corry told me that the business is only open to people who had purchased a membership. I asked Robert Corry how I would obtain a membership, if interested, if I was prohibited from entering the business. The undercover officer had walked into the business and had bee shown around without a membership. I MUM Narrative - Supplemental 2 Attachments: Municipal Summons #M-35346 (Hammock) Municipal Summons #M-35348 (Benages) On November 4, 2014 at around 1630 hours I, Officer Talon Darling 10-3 with the Wheat Ridge Police Department, while on special assignment with the C.A.T. Team was riding with Officer Taggart when we arrived at the Three Kings Dab Supply located at 12390 W 44th Ave. We arrived at the Three Kings Dab Supply in an ongoing investigation based on multiple complaints of an over occupying of the business in addition to concerns that marijuana was illegally being smoked inside the business and there being parking issues associated with the business. This operation was being run by Detective Kendall. Detective Jungclaus was also involved in an undercover capacity and prior to my arrival was inside the business checking on the occupancy and marijuana smoking issues. Sgt. Pickett, Officer Lovan, officer Brooks were also on scene. Upon my arrival Officer Brooks, Officer Lova n and Sgt. Pickett had already entered the business. As I walked through the parking lot of the business I observed what appeared to a film crew filming in the parking lot. As I approached the front door of the business I saw that there was a,clearly illuminated TFOpenf' sign near the front door. As I entered the business I saw that there was a glass display case to the left of the entrance hallway with a three to four people standing around the display case to include Detective Jungclaus. To the right of the main entrance hallway there was a small room with an additional display case that did not have anyone inside of the room. As I continued into the business I saw a large bar table with approximately ten people sitting around it to the left of the first major room. In an ash tray on the table I saw a burning marijuana blunt and joint which no one at the table claimed ownership to. I did not see anyone actively smoking marijuana while inside the business, but I was able to tell that marijuana had very recently been smoked inside the business between the strong odor of burnt marijuana and the extremely visible and thick smoke in the rooms of the business that I had been in. I spoke with Officer Levan who informed me that he did see one of the males at the large bar table actively smoking marijuana when he entered the business. officer Lovan pointed out to me Steven Hammock as the male that he witnessed smoking marijuana when he entered the business. I contacted Steven and explained to him the situation. I asked Steven for his identification which he provided me with. While speaking with Steven the decision was made to move all individuals who were going to be cited outside of the business. Once outside of the business the doors to the business were locked with multiple people still inside. I had dispatch clear Steven for wants and warrants. Steven was found to be clear. I then issued Steven with a municipal summons for 16-131 (c) Possession of Marijuana- (Openly and Publicly Consumed) and 9-25 (a) Smoking Prohibited. Steven was allowed to leave, but he did stay in the parking lot for a short time. I did not see anyone actively smoking marijuana while inside the business, but I was able to tell that marijuana had very recently been smoked inside the business between the strong odor of burnt marijuana and the extremely visible and thick smoke in the rooms of the business that I had been in. I spoke with Officer Levan who informed me that he did see one of the males at the large bar table actively smoking marijuana when he entered the business. officer Lovan pointed out to me Steven Hammock as the male that he witnessed smoking marijuana when he entered the business. I contacted Steven and explained to him the situation. I asked Steven for his identification which he provided me with. While speaking with Steven the decision was made to move all individuals who were going to be cited outside of the business. Once outside of the business the doors to the business were locked with multiple people still inside. I had dispatch clear Steven for wants and warrants. Steven was found to be clear. I then issued Steven with a municipal summons for 16-131 (c) Possession of Marijuana- (Openly and Publicly Consumed) and 9-25 (a) Smoking Prohibited. Steven was allowed to leave, but he did stay in the parking lot for a short time. We were briefed by Detective Kendall regarding the Three Kings Dab Supply located at 12390 W 44th Ave. Detective Kendall informed me that the police department had received numerous complaints regarding smoking of cigarettes and marijuana inside and around the business. There were also complaints of over population and parking issues. Detective Kendall informed me they were allowed 6 cars in the parking lot and 12 people were allowed in the business at a time for fire code and 25 people total. Detective Kendall informed me she was sending in an undercover (UC) officer in the business just prior to our arrival. I staged in the area along with Officer Brooks in a marked police vehicle. Detective Kendall aired that the UC said there were people smoking inside the business and there were numerous people inside= once told to enter the business by Detective Kendall we arrived to a chaotic scene. As we pulled into the parking lot I noticed at leaat,,,,,12 vehicles in the paved portion of the parking lot. on the west side of the building was a gravel dirt area that had several more cars. As we exited our vehicle I saw approximately 10 people standing outside the business along with what appeared to be a profession TV crew. I observed a large microphone on a pole and a large professional looking camera. I was immediately approached by a male I know to be Bryant Bonet. I know Bryant from previous contacts and know him to be the owner. I told him we were here to respond to complaints of smoking and over occupancy. Bryant told me to talk to a male that was standing next to him that he identified as "our lawyer," I informed him that I would talk to him in a minute and approached the business. As I approached I could see numerous people in the windows as well as what appeared to be a heavy smoke cloud inside. I noticed to the right of the front door in the window was a green illuminated neon sign that said "OPEN." These letter were approximately 4-611 high. I noticed directly underneath were the business hours of the business that said 12pm to "at most 10pm" for today. As I was approaching the business the lawyer, later determined to be Robert Corry, was shouting at me that I could not enter the business as it was a private club. I informed him that due to being a retail business that was open to the public, and showed indications of that, that we would be going inside to check on the violations. I opened the unlocked door and immediately upon entering I could smell the strong odor or cigarette and marijuana smoke. The clouds of smoke inside the business were so heavy it was difficult to see. I was coughing and having difficulty breathing normally. Looking around I could see numerous items of paraphernalia including pipes, large torches (some attached to propane bottles) and numerous lighters. There were glass cases of new pipes for sale that were clean and organized. In the first room I entered I observed at least 15 -20 people in the room. I walked back a little further to a small room to the west of the main room where I saw approximately 5-6 more people. In the main room I immediately noticed a male wearing a black hat with a yellow logo on it. The male was actively smoking an unknown object and I saw him blow a large billow of smoke out of his mouth. I saw him immediately put away what he was smoking. I pointed this male out to Officer Darling who contacted the male. At this point officers inside and contacted and detained numerous people for smoking. Bryant was following me around shouting that I needed to leave and had no right to be in his business. Bryant continued to shout that it was a private business that I could not stay. At this point we decided to move everyone that was received a summons outside to communicate better due to the noise and the smoke. As we were walking out Robert Corry told somebody to "lock the door on our way out so they can't get back in." Once outside I issued a summons to Bryant as the owner of the business for allowing smoking inside his property. I talked to Bryant for several minutes and explained to him why we were here. I told him about the complaints. I explained to him about the occupancy issues and the parking issues. Bryant told me they are currently working with the city to allow for 36 people and many more cars. I told him that until that is finalized those rules are not in effect and explained to him how they (the owners) have been warned numerous times about this and the smoki.ng violations. Bryant told me "yeah I know - your j 3t (j 04 ng your job." I noticed that during the entirety of us being on the property about 6-12 people were video recording us on cell phones as well as the professional photographers. Several people tried to interview me regarding what happened. I would inform that that I could not tell them facts of the case and after they continued to ask I began to ignore them. I stood by while other officers issued summons and Sgt Pickett spoke to Robert and the owners. A male approached me and said he was with the film crew and worked for CNB O from New Jersey, He informed me they were here for the one year anniversary of the passing of Amendment 64 and seeing how marijuana business's were working. Once all summons were issued I left the property. Note that I have a department issued PVD (Personal Video Device) in which this incident was recorded on. I did not start the video until about 5 minutes after I was on scene. This was due to policy regarding filming of undercover officers. Once the officer was clear of the area I began recording. The police department was acting upon numerous complaints against the business. I was assigned as the supervisor of the operation. In the briefing we learned that the occupancy of the property was 12 persons in the structure and 25 people total to include the back yard. Detective Jungolaus acting in an undercover capacity went into the business. Detective Kendall advised via radio that Detective Jungolaus had seen numerous violations and had advised that there were a number of people inside the business. The initial response called for 2 officers to respond initially and then 2 more to assist if there were several violations. As the supervisor, I would not respond unless requested due to complaints or other issues. Due to the number of people reported at the business the entire CAT team responded. Note: Officer Darling was working with CATT on this date. I was the last of the uniformed officers to arrive at the business. I parked my marked police motorcycle in the drive of the business. I noted that there were 9 cars parked in the front parking lot and 5 cars and a tour bus parked in the back lot (see attached photo of the back lot.) The back lot is gravel. On the front of the business was an illuminated (green) "open" sign. Below the open, sign was an hours of operation sign. The hours of operation for Tuesday stated 1112pm to almost 10". See attached photo. I entered the business where I noted that the building had in excess of about 20 people. In the front room there was a glass display case. There were 4 or more people in this area. Beyond the front room was a room that had a raised table/bar. There were approximately 10 people sitting around the bar. On the bar were numerous smoking devices including pipes and marijuana cigarettes. The entire building was filled with smoke and the smell of burnt marijuana. A man approached me and stated that he wanted to talk to me and that he was the lawyer of the business. I asked him to wait as I walked out to the deck of the business. outside in the back there was a table right next to the back door. At this table were a male and female. The male, later identified as Brandon Shaw was smoking a marijuana cigarette, From my 8 years as a narcotics detective I recognized the smell as that of marijuana. I then checked the area beyond the table. The lawyer continued to follow me and try to get my attention. In the back yard area there was a station set up that looked like it was a glass blowing tutorial. There were 6-8 people sitting in this area. I informed the male that he needed to go inside with me to receive a ticket for smoking marijuana. The male said he was not smoking marijuana and pointed to the cigarette that the female was holding and said that he was smoking a cigarette. I informed the two that both of them were next to a door of a business and would be receiving tickets. I asked the two to go inside with me. Inside the business the owner, later identified as Howard Shelton stated that the police was scaring his clients and asked if we could move the issuing of summons outside. Due to trying to accommodate Shelton and to get out of the marijuana filled room, I instructed officers to move people outside that were going to receive tickets. Once outside I asked Officer Darling to issue tickets to Shaw and Upton. Shaw stated that Upton was hearing impaired and wanted an interpreter. Shaw also asked for a supervisor to respond. I called dispatch and requested both an interpreter and a commander. I spoke with the lawyer later identified as Robert Corry. Corry asked me how the police can force their way into a private establishment. I explained to Corry that the business was a public business. I pointed out the illuminated "open" sign and the store hour sign. I explained that we had numerous complaints and we were following up on the complaints, Corry asked me if it were normal to use 5 police officers for such an operation. Shelton had told me that there were 36 people on the property. I explained to Corry that 5 officers dealing with 36 people was reasonable. Corry continued to want to debate the matter. I explained to Corry that I would not debate it with him. I referred Corry to the court for arguments. While dealing with the issuing of tickets I observed a car arrive in the parking lot. In the car was a male later identified as Ernesto Benages. Benages was smoking a cigarette. Benages exited the car and walked through the group standing outside and toward the front door. Benages got near the front door and was contacted by Officer Darling and myself. I asked Benages to put out his cigarette and explained to him that it was illegal to smoke within 15 feet of the entrance of a business. Benages put the cigarette out with his fingers, buts continued to the front door where there was a large ash bin located immediately adjacent to the front door. Benages put the cigarette but in the ash bin. During the entire operation there was a film crew on the property. The crew filmed the entire encounter. One of the crew later identified as Wally Griffith of CNBC out of New Jersey. Griffith advised that they were there at 3 Kings filming the one year anniversary of the legalization of marijuana. Griffith asked if the police would be willing to speak with him. I referred Griffith to the departments PIO. Commander Cooney responded to my request for a Commander. Once on scene he was asked all the same questions that I had answered. Commander Cooney, not being part of the operation looked to me to again answer why we were there. Dispatch was unable to locate a certified translator for Upton. Shaw approached me and complained on how long it was taking to get an interpreter. One of the complainants had informed me that AJ Hashman advertises events at 3 Kings on his Facebook site. Cin the Facebook site there were 3 videos of the contacts. The first shows some of the contact with Benages. The second one shows people continuing to smoke marijuana inside the business as we cited people outside. The third starts about the time I ask all officers to go outside with the people that they are going to ticket. It also shows Corry advising Shelton to lock the door as we leave. There is then a commentary by 11AJ Hashman" who we identified as James Ashkar through a computer check. The video ends with the commentary. I had officer Brooks record the Facebook video's and place them into evidence. I was assigned to the contact team that was going to go to the business if violations were found. The detective that was monitoring the undercover officer advised over the radio that there was no parking at the business so the undercover officer had to park at the gas station adjacent to Three Kings. Once the undercover officer entered the business he notified the detective monitoring that there was active smoking inside. A few moments later the detective monitoring advised for us to go ahead and go to the business. Officer Lovan and I then went to 12390 W 44th Ave. I parked the marked patrol vehicle on the west side of the parking lot (in the driveway). I noticed that there was a large amount of people standing outside of the business and there was what appeared to be a camera crew outside as well. Officer Lovan and I walked passed the people outside and entered the building. walking towards the front door I noticed that there was a neon "Open" sign illuminated in the west window on the front porch. As soon as I opened the door I could see a large amount of smoke and there was a large amount of people inside the building. I was able to recognize the smoke as being that of burnt marijuana. Once through the entryway I noticed a large bar type area where there were approximately 8-10 people sitting around it. There was a door to the back patio through the furthest south room. I checked the furthest south room and found there to be a couple people. I saw several people on the back patio, but did not go to the back patio. I went back to the main room where the bar area was and we were in the process of starting to identify people who were smoking inside the business. I contacted a male later identified as Wade Boushele. Wade had a clear glass pipe commonly used to smoke marijuana right in front of him and right next, to his hand. I asked Wade if he had an ID and he provided me with a Colorado ID card. Officers were then instructed that if they were going to write tickets to write them outside. I asked Wade if he would come outside with me and he agreed. I began to write Wade a ticket and he began to explain to me that he has a medical marijuana license and he comes here to medicate. I explained to Wade that the business license for the business is for a retail shop and it is unlawful to smoke marijuana inside the premise. Wade went on to tell me that it is a private club and he was allowed and I suggested that he go to court. I completed the summons and explained it to Wade. Wade signed the summons and did not have any questions. Wade told me that he was going to take the bus home and he then left. Sergeant Pickett then advised me to write another male a summons. Sergeant Pickett pointed a male out to me who was later identified as Brandon Shaw. Sergeant Pickett told me that he saw Brandon smoking a joint by the door. Brandon provided me with a Kansas ID and I began the summons. I asked Brandon if there was a local address for him and he told me to use the Kansas address on his ID and he didn't want to answer any other questions. I completed the municipal summons and issued it to Brandon. Brandon was provided with his copy and did not have any further questions. Sergeant Pickett also advised that Brandon's girlfriend, later identified as Amanda Upton, was observed smoking a cigarette by the door on the back deck. Sergeant Pickett asked me to issue Amanda a summons for the smoking violation. Amanda provided an ID out of Kansas and Brandon advised that she was hearing impaired and requested an interpreter. Sergeant Pickett was advised that an interpreter, was requested and began working on providing one. I noticed that Brandon was communicating with Amanda via sign language and asked if he could just explain to her what was going on and he again requested an interpreter. I completed what I could of the summons and began to wait for the interpreter. other officers had completed what enforcement efforts they had and the only thing preventing us from leaving the business was waiting for the interpreter.
