If the City of Wheat Ridge exercises its right to perfonn work of any nature, including labor, materials and use of equipment either by force account or contract, the City shall have the absolute right to withdraw the escrow funds to complete said site improvements. The only precondition to the City's right to withdraw the escrow funds for this purpose shall be a letter from the Community Development Director, stating Chat the site improvements have not been completed or provided and that the compliance date of Apri130, 2007 has expired.
