This agreement made this 19th day of March, 2008 by and between the City of
Wheat Ridge and Enoch SandovaL Escrow in the ainount Five Hundred Dollars
($500.00) is being held until all outstanding site improvements are completed at
6090 W. 44th Avenue
In the event that parking lot sh•iping detailed per the attachment required by Wheat
Ridge and as shown on the approved building plans are not installed by April 30, 2007,
the City of Wheat Ridge or its designee shall have the right to enter upon said property to
construct and/or install such improveinents or do other such work to accomplish that
purpose as may be necessary, provided that the City of Wheat Ridge shall first give
notice in wiiting to the contractor, developer or owner of its intent to do so.
If the City of Wheat Ridge exercises its right to perfonn work of any nature, including
labor, materials and use of equipment either by force account or contract, the City shall
have the absolute right to withdraw the escrow funds to complete said site
improvements. The only precondition to the City's right to withdraw the escrow funds
for this purpose shall be a letter from the Community Development Director, stating Chat
the site improvements have not been completed or provided and that the compliance
date of Apri130, 2007 has expired.

and the following notes, corrections and clarifications are hereby attached to and indicated on the

The Oil Inspection Section (OIS) has reviewed the "Subsurface investigation" report for
the referenc:ed site dated June 13, 2000.
Based solely upon the information submitted, which shows that contamination levels
are below staFe cleanup levels, the OIS does not require any further investigation or
remedial action at this time. If conditions change, the 015 reserves the right to
determine i1' any additional actions are necessary. This no further action (NFA) letter is
in reference to the 8000, 4000 and 2000-gailon gasoline tanks that were removed on
April4, 1996.
The OIS cannot release you from any liability that may be associated with any
contamina4ion at or from this site.
