This handout is intended to be an all-inclusive guide for submitting commercial and
multi-family building permits. You will find permit process information, submittal
requirements, detailed checklists, example graphics and contact information.
When do vou need a permit?
A building permit is needed for almost any work performed
require submittal of a building permit:
• Painting
• CarpeUtile/linoleum removal & installation
• Minor fence repair/maintenance
• Landscaping
• Flatwork under 500 square feet
The following items do not
For everything else, you will need to submit a building permit for review by the Community
Development Department.
Buildina Contractor's License
You must be a licensed contractor in the City of Wheat Ridge to work on any commercial
project. If you have licenses in other cities, you must provide copies to the Building
Division. Copies of licenses from 3 other cities are required. If you do not have licenses in
other cities, you must provide a work history, including references. An insurance
certificate (with the City of Wheat Ridge listed as the certificate holder) is required for all
licenses. Before Submittal
There are some issues you should explore and preliminary questions you should ask
before you submit your permit. First, you should check the zoning on the subject property
to ensure that the intended use is allowed. A pre-application meeting with staff is
required prior to submittal of the building permit. This meeting will serve to discuss
potential issues and clarify development regulations. There is a$200 charge for this
meeting and a site plan and project narrative is required. Contact the Planning Division to
schedule the pre-application meeting.
You may want to ask specific questions such as "How many parking spaces will I need?"
or "What type of building materials can I use?" These type of questions will help you
design the site. You should verify if the property is located in a designated flood plain
area, as there will be added building requirements in conjunction with a flood plain permit.
Before submittal, it may be a good idea to talk with the districts which serve your property.
Of particular interest should be the water, sanitation and fire districts. This will minimize
the chance of unexpected fees for upgrades or redesigned plans after construction has
started.
Commercial & Multi-Family Building Permits
City of Wheat Ridge
The City has adopted the 2003 IBC. This Code will be used to review your building. In
addition to the IBC, the City has a Zoning Code which dictates development standards
(setbacks, required landscaping, etc.) and a Streetscape and Architectural Design
Manual which will dictate building design. All of these documents will be used to review
your submittal.
Submittal/review process
Once a building permit has been submitted, the Planning Division, Building Division,
Public Works Department and Fire District will review the planset in accordance with the
applicable codes. If major changes are needed, a letter will be written to the contractor
explaining exactly what needs to be corrected. Any minor changes may be identified on
the plan set in red-line format. Different construction jobs have different submittal
requirements. Expect the permit review process to initially take 4-6 weeks.
Tvpes of buildina permits
There are over-the-counter permits which do not require any detailed information, and
building permits with a site plan required. You may obtain a building permit application
online at: http://www.ci.wheatridqe.co.us/uploads/1/2736.pdf, or in the Community
Development Department at Wheat Ridge City Hall. Both sides of the permit must be
filled out completely. Please list all contractors on the building permit application.
Over-the-counter buildina permits
• Water heaters
• Re-roof
• Electrical service change
• Gutters / siding / soffit / fascia changes or alterations
• Furnaces
• A/C units
• Exterior irrigation systems
For an over-the-counter permit, you simply complete the building permit application and
submit to the Community Development Department. You do not need to submit anv plans
for over-the-counter permits. Over-the-counter permits are issued during a specific
timeframe throughout the day.
• Over-the-counter permits will be issued from 10:00 a.m. to 2:00 p.m. Monday
through Friday.
• If you drop off your over-the-counter permit before 10 a.m., it will be ready by noon
on the same day.
• if you drop off your over-the-counter permit after 2 p.m., it will be ready by 10 a.m.
the next day.
Buildina permit with site plan
With larger commercial projects, more detailed information is required. A site plan is
required for any building permit which is not an over-the-counter permit. The following
information is required at time of submittal:
• Completed building permit application listing all contractors and sub-contractors

• Four (4) full-sized (24" x 36") complete sets of plan:
licensed Architect or Engineer
• Proof of ownership (copy of a deed)
• Proof of utility availability
• Drainage report and plan
• Soils report
• Traffic Study
Tenant Finish/Chanqe of Use
If you wish to move into an existing commercial building, there are some items which
must be addressed. If you are proposing a different use than what was previously in the
building, you will need to check with a planner to discuss the allowed uses and parking
requirements for the property. When moving into a multi-tenant space, it is beneficial to
list the other tenants (by use) with a measure of their office space. All tenant finish work
will reauire a buildinq permit with a site plan. You should be aware that a business license
is required for every commercial endeavor in the City of Wheat Ridge.
What constitutes a complete plan set?
A complete set of plans shall include: title sheet, site plan, foundation plan, civil
construction plan, framing plan, mechanical plan, plumbing plan, electrical plan and an
architectural plan. Each plan shall be stamped by a licensed Architect or Enaineer and
drawn to scale. All new commercial building permits will require the submittal of a
drainage report, a grading plan, erosion control plan and a traffic study. A grading and fill
permit is required for every commercial and multi-family project. This permit is issued by
the Public Works Department. Failure to submit a complete set of plans will lengthen the
review process.
The information contained in the addendum illustrates the elements of a complete plan
set, and contains some useful guidelines. You may also want to view the Zoning Code
online for further guidance. The Zoning Code can be found at:

link named "municipal code". This will redirect you to Municode, which hosts the City of
Wheat Ridge Code of Laws. Then, click on "Chapter 26" for the Zoning Code.
Public Improvements
Where they do not exist, curb, gutter and sidewalk will be required foi
all street frontage(s). If it is deemed illogical to install thesE
improvements due to the surrounding conditions, an escrow shall be
submitted to the City in the amount of 100% of these improvements
When public improvements (curb, gutter and sidewalk) are installed, a right-of-way permit
from the Public Works Department will be required. The Public Works Department will
inspect the improvements during and after construction.
Callinq for inspections
The Building Inspection Line is 303.234.5933. You must call the inspection line to request
an inspection. If you call before 3 p.m., the inspection can be scheduled for the next
business day. Please remember to include the project address, your name, phone

number and building permit number in the message. Without this critical information,
your inspection may be delayed. If the work is not completed, you may be charged a re-
inspection fee.
You will need to call for inspections at different milestones during the construction phase.
The following inspections must occur before any concrete has been poured:
• Foundation (including footings/caissons, stemwall, reinforcing or monolithic,
weatherproof or French drain and water and sewer service lines)
• Concrete Slab Floor underground electrical, plumbing and heating
The following inspections should occur throughout the construction phase:
• Plumbinq/Electric/Mechanical (electric service, rough electric, rough plumbing, air
test gas piping and rough mechanical)
• Buildinq (framing, roofing, insulation and drywall screw)
• Final Inspections (electrical, plumbing, mechanical, frame/interior finish, right-of-
way and drainage, fire district, parking and landscaping)
All work must be complete and all inspections shall be passed by the building inspector to
receive a certificate of occupancy. The parking lot must be striped and the landscaping
must be installed. If the landscaping cannot be installed due to inclimate weather, a
landscape escrow must be submitted. The escrow will be in the amount of 125% of the
value of the landscaping (100% for the cost of the improvements and 25% for the
assurance to install). You must submit a contractor's bid with the landscape escrow. The
escrow will be held until the landscaping can be installed. Once installed and inspected,
the escrow will be returned in full.
Sometimes during the plan review phase, the plan reviewer will make red-lined
corrections on a planset or create a list of `to-do' items, and approve the building permit
with the condition that those items are addressed. All of these items must be
addressed prior to issuance of the certificate of occupancy.
It is the responsibility of the applicant to ensure that all property lines are located
during the construction phase, and that construction is consistent with the site
plan.

3. 501-10,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic yards, but
does not exceed 10,000 cubic yards, may be allowed by a permit issued by the City Engineer after review of
an application and supporting information. The following information shall be submitted with the required

4. Performance Standards: The following provisions shall apply to all Minor Grading, Excavation and Fill
Permits:
A. Rehabilitation: Within thirty (30) days after cessation of filling and/or excavation, rehabilitation for the
site shall have been completed in accordance with the approved plans. Rehabilitation shall consist of
leveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable
to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the terms "garbage, trash
or junk" as defined in the Wheat Ridge Code of Laws, Section 15-4."
In no case shall debris or contaminates identified or classified as hazardous waste by local, state or federal
agencies be used as fill in any fill azeas within the City of Wheat Ridge.
C. Excavation and/or fill azeas shall be graded to facilitate weed control until final grades aze set and site

SUBJECT: DTI Trucking Paving Permit - Civil Documents, 4h Review
I received the 4`h submittal of the Final Drainage Report and Grading & Erosion Control Plan for
the above referenced Building Permit on October 16, 2008 for the property located at 8955 W.
44`h Avenue, and I have the following comments:
The Engineer-of-Record will need to be made awaze of the following items regarding the construction of
the project:
1. Grading and Erosion Control
The erosion control for the project shall be in place prior to the commencement of any grading
activities, and maintained as needed during the course of construction. Please be advised that
additional erosion control measures may be required if deemed necessary by the City Inspector.
2. NPDES/CDPS Permit
The area of proposed area of disturbance for this construction project is greater than one acre and
therefore requires an NPDES Permit for construction activities. The NPDES permit for
construction activities is issued by the State through the Colorado Discharge Permit System
(CDPS), and may be obtained by contacting the Colorado Department of Public Health &
Environment, Water Quality Control Division at 303.6923500 and asking for the public
assistance person for the Permits Unit. A copy of the CDPS Permit must be submitted to the
Department of Public Warks prior to issuance of any Grading/Fill or Building Permits.
3. Application for Grading/Fill Permit
Prior to the commencement of any onsite grading, an Application for a Minor Grading/Fill
Permit, along with the fees due will need to be submitted for review and approval.
4. Public Improvemeut Restoration/Debris Tracking
It will be the responsibility of the of the contractor for the project to repair any damage to the
existing public improvements along 44`" Avenue as a result of related construction traffic in the
area. Also, the contractor will be responsible for maintaining 44t° Avenue on a regular basis such
that it remains free of conshvction debris and tracking from construction traffic accessing the site.
Right-of-Way Construction Permit(s), Licensing, and Bonding
Prior to any construction within the public right-of-way, the necessary Right-of-Way
Construction Permit(s) and respective licensing will need to be submitted for processing by the
City. Right-of-Way Construction Permits are issued only after approval of all required technical
documents, including but not limited to, the Final Drainage Report & Plan, Final Plat, Final
Development Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction Plans, Grading

& Erosion Control Plan, Traffic Control Plan, and easement or ROW dedications. In addition, if
the cost of the proposed public improvements exceeds $10,000, additional warranty bonding shall
be required.
6. 2-Year Warranty Period for Public Improvements
The contractor shall warrant all work performed within the public Right-of-Way for a period of
two (2) years, commencing upon completion of all constructed public improvements and Final
Acceptance by the City Inspector. Prior to the expiration of said 2-year Warranty Period, if the
City Inspector at any time deems that the constructed public improvements aze in such condition
as to require replacement or repairs, the contractor shall complete such repair work upon request
per the City of Wheat Ridge Permit Testing and Inspection Requirements.
7. Stormwater Maintenance Agreement and O& M Plan Required
All post-construction Best Management Practices (BMP's) for water quality must be
maintained and inspected by the property owner(s) per Section 20-34 of the City of
Wheat Ridge Municipal Code of Laws. For the stormwater quality facilities including,
but not limited to, above-ground or underground detention facilities, porous landscape
detention areas, porous pavement, centrifuge type devices such as a Rinker
Stormcepterg), or for hydrodynamic separation systems such as a Contech Vortechsg, a
Stormwater Maintenance Agreement accompanied by an Operations and Maintenance (O
& M) Schedule/Log will be required prior to issuance of the Certificate of Occupancy.
The O& M Schedule/Log must be kept current and will be inspected on a regular basis
by City staff to ensure compliance with CiTy of Wheat Ridge requirements.
8. Drainage CeMification Required Prior to C.O.
Upon completion of the drainage improvements, the Engineer-of-Record Mr. Henry Hollender,
P.E., shall provide to the City of Wheat Ridge a written, signed and sealed Drainage Certification
Letter stating that the site grading was completed per the approved Grading & Erosion Control
and Drainage Plans, all drainage facilities were constructed and shall function as defined in the
approved Final Drainage Report/Plan, and that the site has been accurately surveyed to confirm
that the grading and the construction of all drainage facilities was completed in accordance with
these documents. The Drainage Certification Letter shall be submitted to the City for review and
approval, and shall be accompanied with As-Built Plans for all constructed drainage facilities
prior to issuance of a Certificate of Occupancy (or Certificate of Completion).
Two (2) copies of the "As-BuilY" Plans shall be submitted as follows:
a. 1 copy is to be on fu(1-size 24" X 36 " bond paper, signed and sealed, and
b. 1 copy is to be on electronic media (DVD or CD-ROM) and shall be in AutoCAD 2000-
2007 dwg format only.
9. Materials Testing for Construction within the Public Right-of-Way
It will be the responsibility of the developer/owner, to provide the necessary testing, as applicable
for the scope of this project, for sub-grade compaction and other related material tests for any
improvements to be constructed within the public Right-of-Way.

MATERIALS AND TESTING REQUIREMENTS
FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
DESCRIPTION
Materials sampling and testing for public improvements shali be performed by an
independent materials testing company at the expense of the developer, and/or utility
district. Unless otherwise designated, all referenced specifications, standards or policies
shall be the latest edition as revised or updated by approved supplements published and
issued prior to the date of the building permit.
REQUIREMENTS
All materials sampiing and testing shall be performed by certified, experienced and
qualified materials testing technicians who work under the supervision of a registered
professional engineer in the State of Colorado. All materials sampling and testing
equipment shall be serviceable and have current calibrated certifications.
Soil classifications and moisture-density curves shall be provided to the Department of
Public Works inspector prior to in-place density testing. Materials testing technicians
shall furnish copies of failed test results to the inspector as promptly as the results
become available. On a weekly basis when testing is being performed, the developer
shall furnish the inspector with copies of all test results taken during the prior week and a
cover letter, signed by the supervising registered professional engineer, which
suminarizes the results and discusses any failed tests or inconsistencies.
The City materials testing requirements are provided in Table 720-1. All testing
procedures of verification and central lab requirements shall be as specified in the
Frequency Guide Schedule of the Colorado Department of Transportation Field Materials
Manual. One test is required for any fraction of the specified frequency. The reference
to Section 203.07 in the table is from the Colorado Department of Transportation
Standard Specifications for Road and Bridge Construction.

I. INTRODUCTION
A. Site Location
DTI is located on the north side of West 44m Avenue in Wheat Ridge, just west of
Clear Creek at 8955 West 44th Avenue in Wheat Ridge, Jefferson County, Colorado.
(See Location Map in the Appendix.) DTI is bordered on the north by West 44I'
Avenue, to the east by commercial property, to the west by Cleaz Creek, and south
' by West 46m Avenue. One residential properly abuts the site in the northeast corner.
Open space is located across West 44th Avenue south of the property. Residential
development exists across West 46ffi Avenue, north of the property.
B. Site Description
Currently, there are tluee commercial buildings on the lot. The southem portion of
the site is paved and most of the rest of the site is gravel surfaced. The lot generally
drains to the east-northeast on a 1% to 3% slope, sheet flowing into Cleaz Creek.
The area north of the buildings drains north into a drainage system that exists in
West 46~' Avenue. This area will not be disturbed and, therefore, there will be no
impact to this sub-basin. A portion of a landscape strip along the southern border of
the site adjacent to West 40 Avenue drains into a shallow swale that drains d'uectly
into Clear Creek. The area south of that drains to West 44" Avenue. Most of the
area of the commercial property to the west that is adjacent to the lot drains into a
drainage system that drains into the West 46th Avenue drainage system. The rest of
this area drains to West 44'" Avenue. The lot is being used commercially.
C. Proposed Project Description
Approicimately 61,226 square feet of new asphalt pavement is proposed in the area
south and east of the existing building. Most of this area has existing deteriorating
asphalt pavement. The existing access to West 44"' Avenue and the lot to the west
will be maintained. Gated access to the green space east of the site will also be
maintained. The paving will be done at or below grade to avoid filling in the
floodplain. A water quality pond will be constructed in the northeast corner of the
site as part of this project.
D. Flood Hazazd and Drainage Studies Relevant to Site
The 100-year flood plain, as depicted in the Apri12007 Flood Hazard Delineation
Study (FHAD) for Cleaz Creek prepared by ICON Engineering Inc. and adopted by
the City of Wheat Ridge is shown on the drainage plan included in the reaz pocket of
this report. This flood plain includes most of the area being paved and all of the
buildings, although an Elevation Certification prepazed by R. E. Pod, PLS (see
appendiY) indicates that the main building is outside the 100-year flood plain.
H. ffi5TORIC DRAINAGE SYSTEM
A. Major Basin
Clear Creek is the major channel and is located just east of the east boundary line.
The major basin is urban development with mixed uses and topography.
B. Sub-Basin and Site Drainage
There are 4 historic sub-basins on the site
Sub-basin H-1 covers the majority of the site and it drains in sheet flow across the
east property line into Clear Creek It is 1.62 acres in uea and consists of 0.86 acre
of pavement, 0.06 acre of roof, 0.68 acre of gravel, and 0.02 acre of
landscaping/grass. Using UDFCD recommended assumptions from of 100%
imperviousness for pavement, 90% imperoiousness for roofs, and 40% impervious
for gravel, the total percent impervious ofthe sub-basin is 73%. The 5-yeaz and 100-
year flows generated by this sub-basin are 2.92 cfs and 6.78 cfs respectively. This
flow does not leave the site at a point, but rather is spread along the entire east
property line.
Sub-basin H-2 is located in the northeast wrner of the site. It is 034 acre in area and
is the only portion of the site that flows onto adjacent residential property. The sub-
basin has 0.02 acre roof, 0.01 acre pavement, and 031 acre gravel, which computes
to 45% imperviousness. The 5-year and 100-year flows generated by this sub-basin
are 0.40 cfs and 1.18 cfs respectively. This flow also does not leave the site at a
point, but rather is spread along the entire portion of the property line that abuts the
residential property.
Sub-basin H-3 is located in the northern portion of the site. It is 0.58 acre in area and
sheet flows to the drainage system along West 45"' Place to the north. The sub-basin
has 0.11 acre roof, 0.02 acre pavement, and 0.45 acre gravel, which computes to 52%
imperviousness. The 5-yeaz and 100-year flows generated by this sub-basin are 0.77
cfs and 2.13 cfs respectively. This flow also does not leave the site at a point, but
rather is spread along the north property line.
Sub-basin H-4 is located in the western portion of the site. It is 0.24 acre in azea and
flows off site along the western boundary of the property to a drop inlet located in
the northeast corner of the building on the adjacent property. The sub-basin has 0.12
acre roof and 0.12 acre pavement, which computes to 95% imperviousness. The 5-
yeaz and 100-year flows generated by this sub-basin are 0.41 cfs and 1.14 cfs
respectively. This flow leaves the site at several locations along ihe west properry
line.
The one design basin considered on this project consists of the azea that drains to
Cleaz Creek and covers most of the site. The &inge areas north of the eicisting
buildings and along the West 44"' Avenue Right-of-Way are not included in this
basin as they are not proposed to be disturbed by this project. No offsite drainage
flows onto the lot.
IIL PROPOSED (DEVELOPED) DRAINAGE SYSTEM
A. Criteria
The total area of the property is 2.86 acres. Most of the site (2.23 acres), designated
as Basin A on the drainage plan, is desigued drain into a water qualiry pond that will
be constructed in the eastern portion of the site. The remainder of the site will
remain undisturbed and drain directly into the gutters of the adjacent streets.
Due to the proximity of the site to Clear Creek, flood attenuation detention of the site
will not be compulsory per the City of Wheat Ridge site drainage requirements.
Only water quality needs to be addressed. Water quality volume will be calculated
using UDFCD procedures to size the pond. The pond will be designed to provide a
maximum depth of less than P so that infiltration and evaporation will minimize the
amount time standing water will be present.
B. Runoff
Basin A will sheet flow to an asphalt curb that will be constructed along the east
property line at a 1% slope to direct stormwater into the water quality pond. The
curb will be constructed primarily by excavating from the top of curb down to the
gutter to avoid filling in the flood plain. This curb will flow into a gravel swale that
will flow into the pond. The pond will be excavated to maintain a 4' wide top to
prevent erosion of the slopes and keep stormwater away from the adjacent residential
property. The 5-year and 100-year flows into the pond are 5.62 cfs and 11.78 cfs
respectively.
This flow will leave the site through the concrete entrance constructed in front of the
gated access, which will be designed as the spillway for the pond. The historic flow,,
that drain from the site to the pond in sheet flow will be increased (from 2.92 cfs and
6.78 cfs to 5.62 cfs and 11.78 cfs respectively for the 5-yeaz and 100-yeaz flows) and
concentrated to leave the site through the spillway.
The UDFCD spreadsheets used to calculate these flows are provided in the appendix.
C. Pond Design
Using a 24-hour drain time, the Water Quality Capture Volume for the 2.23 acres
draining into the pond is 0.067 acre-feet or 2919 cubic feet computed as follows:
From Figure EDP-2, using a 24-hour drain time and a 90% imperviousness ratio, the
Water Quality Capture Volume (WQCV) is 036 watershed inches. Using that figure
in the design volume equation:
Design volume =(WQCV/12) x area =(036/12) x 2.23 = 0.067 acre-feet
= 2919 cubic feet
The pond will be graded to achieve this volume in 0.73' of depth. The bottom of the
pond will be set at elevation 5332. A 20' long wncrete emergency spillway will be
constnacted on the west side of the pond. This spillway will also serve as an access
point to the site. The elevation of tlus spillway will be set at 5332.73 to limit the
maximum depth of the pond to 0.73'. An additional minimum of 1' of freeboard will
be provided on either end by constructing the top of the pond at an elevation of at
least 5333.73. A 4:1 slope will be used to transition between the spillway elevation
and the top elevation.
Sis percolation tests were taken in the vicinity of the proposed pond. The resulting
average percolation rate is 43.9 min/in. At this rate the 0.73' maximum depth would
percolate into the soil in less than 6.5 hours.
Using the weir equation, the 100-year storm would flow over the spil(way at a depth
of 031' computed as follows:
H=(Q/CL)"3 =(11.78/3.4 x 20)v3 = 03 P
The velocity of water flowing over the spillway would be:
11.78cfs/(21.24ft x 031ft) = 1.79 cfs
This velocity will not cause erosion downstream from the spillway. A Stormwater
Maintenance Agreement accompanied by a long term maintenance schedule will be
executed with the City prior to completion of the project.

IV. CONLUSIONS
A. Impact of Ixnprovements
The proposed project at DTI's facility will add impervious area to the drainage
basin, but due to its proxunity to Cleaz Creek it is better to allow the increase
flow to enter the creek undetained rather than detain it until upstream peak flows
reach the site. However, a water quality pond will be incorporated into the
project to improve the quality of the stormwater that leaves the site into Clear
Creek Maximum water that can accumulate in this water quality pond will
percolate into the soil in less than 6.5 hours.
B. Flood Hazazd
Most of the proposed construction at this site is in the 100-year floodplain for
Clear Creek. The project provides for paving at or below existing grades so as
not to impact the floodplain. No structures are proposed to be constructed as
part of this project.

The City of
Wheat Ridge
This letter is in regards to the upcoming expiration of a Temporary Building Permit that was issued
for 8935 W. 44`h Avenue for a period of one yeaz. The expiration date of the temporary building
permit is October 24, 2003.
Pursuant to Section 26-115(3)(a) "The Board of Adjustment is empowered to hold a public hearing
to decide upon requests for temporary buildings or signs. The board may approve a temporary
permit for no longer than one (i) yeaz per application." Also, pursuant to Section 26-115(3)(b)
"Only one (1) such permit may be approved per year for a particu]az site. No renewals of one-year
permits or new permits for substantially the same building or sign shall be allowed."
Mike Mueller on behalf of TruGreen Landcaze submitted a separate application, for three temporary
office trailers for 8935 W. 44`h Avenue. The application was heazd before the Boazd of Adjustment
on October 23, 2003, and was denied. Therefore, the trailer that was placed on the site a year ago,
and the trailer that has been illegally placed on the site within the last week must be removed.
Failure to remove the temporary trailers by October 31, 2003, will result in further code action
being taken.

This letter is in regards to the upcoming expiration of a Temporary Building Permit that was issued
for 8935 W. 44`h Avenue for a period of one yeaz. The expiration date of the temporary building
permit is October 24, 2003.
Pwsuant to Section 26-115(3)(a) "The Boazd of Adjustment is empowered to hold a public hearing
to decide upon requests for temporary buildings or signs. The boazd may approve a temporary
permit for no longer than one (1) year per application." Also, pursuant to Section 26-115(3)(b)
"Only one (1) such permit may be approved per year for a particulaz site. No renewals of one-year
permits or new permits for substantially the same building or sign shall be allowed."
Mike Mueller on behalf of TruGreen Landcare submitted a separate application, for three temporary
office trailers for 8935 W. 44`h Avenue. The application was heazd before the Boazd ofAdjustment
on October 23, 2003, and was denied. Therefore, the trailer that was placed on the site a yeaz ago,
and the trailer that has been illegally placed on the site within the last week must be removed.
Failure to remove the temporazy trailers by October 31, 2003, will result in further code action
being taken.
