This letter explains the violations and outlines your options for bringing the property into compliance. The property at 9190 W. 44` Avenue is zoned Commercial -One (C -1). There are two issues with having these temporary storage containers: Per section 26 -625.13 of the zoning code, industrial shipping containers or temporary storage units are not allowable accessory structures in commercial zone districts. Temporary storage containers are allowed only on active construction sites, as set forth in Section 26- 614.E. An active construction project is any project associated with an active building permit issued through the City. As there are no active construction projects on the property, temporary storage containers are not allowed. With these violations, I can suggest the following options to correct the situation and provide storage that is in compliance with the code: 1. Remove the temporary storage container from the site. 2. Construct an addition to the existing primary structure in compliance with applicable development standards (e.g., setbacks, height, etc.) and building codes. 3. Construct an accessory building in compliance with the following development standards as set forth in section 26- 625.D: a. A maximum of one (1) accessory building is allowed on the property. If an accessory structure already exists, a second structure is not permitted. b. The required setbacks for accessory structures are five (5) feet from the side property lines and ten (10) feet from the rear property line. c. The maximum height is twelve (12) feet as measured from finished grade to the midpoint between the eaves and peak of the roof. d. The size of the structure may not exceed 500 square feet. e. The only exception is for structures less than 120 square feet which may have horizontal metal siding if the material has a wood grained appearance similar to horizontal clapboard. f. A one month temporary use permit for the structure may be applied for and approved administratively. No more than two extensions to the 30 day period may be approved. b.
