three (3) horizontal to one (1) vertical slope, or such fill is less than three (3) fee± in depth and is not
intended to support permanent structures, and in addition, such fill or excavation does not obstruct or
othernrise adversely affect any drainage way. Shouid any of the above standards be exceeded, or a
drainage way be affected, a permit shall be required under the guidelines for No. 2. 2. 51-500 cubic yards: Dumping or excavation of earth materials not exceeding 500 cubic yards may
be allowed with a permit approved by the City Engineer. AII applications are to be submitted on the
appropriate completed application form and shail be accompanied by the appropriate fee and sketch
plan indicating the following information before the permit will be issued.
A. Location and dimensions of all property boundaries and structures on the site.
B. Location and extent of areas to be filled and/or excavated.
C. Location of existing and proposed drainage ways, irrigation ditches, etc., and
indication of how and where historic runoff will be maintained on and throughout the site.

3. 507-20,000 cubic yards: Operations in which earth material fill or excavation exceeds 500 cubic
yards but does not exceed 20,000 cubic yards may be aliowed by a permit issued by the City Engineer
after review of an application and supporting information. The following information shall be submitted
with the required application form:
A. A site pian, prepared and signed by a Colorado registzred , a scale
of no less than one inch to twenty feet (1 profassional engineer at
20) which illustrates the foilowing:
1. Location and dimensions of ail property boundaries and structures on the site.
2. Location and extent of areas to be filled and/or excavated.
3. Location of existing water,vays and drainage courses indicating any changes: (For
a site containing an established irrigation ditch, a letter of approval from the
appropriate ditch company shall be required).
4. Location of existing and proposed points of ingress.
5. Location and extent of existing vegetation, proposed changes in such vegetation and
methods of rehabilitation on site vegetation after earthwork operations are complete.
6. Erosion control plan.
7. Grading plan with existing (dashed lines) and proposed (solid lines) ground contours
with contour intervals of two feet and spot elevations.
8. At least two cross sections (east to west and north to south) through the sho~,ving
depth of fill and/or excavation. site
9. A drainage report my be required if site runoff characteristics are changed.
10. Relative elevations of adjacent properties and structures.
11. Statement or purpose of intended fill or excavation.
4. Pertormance Standards: The following provisions shail apply to all Minor Excavation and Fill
Permits:
A. Rehabilrtation: Within thirty (30) days after cessation of filling and/or excavation,
rehabilitation forthe site shall have been completed in accordance with the approved plans.
Rehabilitation shali consist of leveling, grading, landscaping, or any combination thereof to
minimize potential erosion and be acceptable to the City Engineer.
B. Debris: Debris andlor contaminants shail not be used except with the approval of the City
Engineer.

"garbage, trash, orjunk" as defined in the City of Wheat Ridge Code of Laws, Section 20-21."

The following letter is to inform you that you are currently in violation of Section 109 of the
Uniform Building Code, which states, "No bui[ding or structure shall be used or occupied, and no change
in the existing occupancy classification of a building or structure or portion thereofsha[1 be made until
tl:e Building Officia[ has issued a certifzcate of occupancy therefor as provided herein. "
Your contractor was notified by me during the final electrical inspection that it would be all right
for you to move your equipment into the new building and set up, but that occupancy would not be permitted
until all outstanding issues were resolved and approved. Due to apparent mis-communication between your
contractor and yourself you are illegally occupying the above referenced address.
The only remaining outstanding issue is the storm sewer connection to 44' Avenue. This should
complete the drainage requirements so your engineer can certify the site for drainage improvements and the
Wheat Ridge Public Works Department can review and approve the engineer's letter.
Please be aware that if these outstanding issues are not resolved and approved by 3:00 n.m., Fridav,
Sentember 10, 1999, the City will be forced to require that use of the building be discontinued and the
structure be vacated until all outstanding issues are completed and approved. Failure to discontinue use and
vacate the structure could result in utility services being disconnected for the structure.

We have reviwed the plans for this building for conformance with the 1991 Unifrom Fire Code
and have the following comments.
l. Site:
The address wili need to be posted on a temporary basis and permanently affixed to the
building in a murimum of 4 inch numbers on a contrasting background
UFC 91 10301(a). Amended
2. All-weather fire dept. access roadway, minimum of 20 feet of unobstructed width, capable
of supporting the unposed loads of 52,000 lb. Fire apparatus need to be provided to
within 150 feet of all portions of the building prior to above grade construction.

3. The proposed access roadway is a dead-end in excess of 150 feet and will need to be
provided approved provisions for the turning azound of fire apparatus..

This letter is to inform you that the final drainage report, and
the grading/erosion control plan for the above referenced project
have been reviewed and approved for construction. Please be
aware of the following items regarding the construction of the
project:
1. The proposed drainage facilities shall be constructed and
approved by the City of Wheat Ridge prior to issuance of the
Certificate of Occupancy.
2. Erosion control for the project shall be placed in conformance
with the approved drainage/erosion control plan and shall be
maintained as needed during the course of construction.
3. All drainage improvements shall be constructed in conformance
with the approved drainage report and plan.
4. It will be the responsibility of the contractor for the
project to repair any damage to the existing public

In my last conversation with planning personnel, I got the impression that standards for
set backs in commercial zones that are not zone districts allowing residential uses would
not be enforced between 9207 West 44th Avenue and other commercially zoned
properties.
Ourproperty at 9201 West 44th Avenue is zoned commercial, but we purchased it
because the zoning regulations allow residential uses for treatment centers which are a
part of our business. The building is a converted residential shucture built in 1927. Not
enforcing set backs for "residential uses" will do irreparable harm to the use and value of
our building.
Please review any site plans for 9207 West 44th Avenue with us prior to any official

approval in hopes we can avert conflict or lawsuits with the City and the owne X.
