SUBJECT: 9910 W. 44' Avenue — Dwelling Unit Conformity
The purpose of this memo is to inform the determination of the conformity of dwelling
units related to the property at 9910 W. 44a' Avenue.
The property at 9910 W. 44a' Avenue is zoned Commercial -One (C-1). This district is
established to provide for areas with a wide range of commercial land uses which include office,
general business, and retail sales and service establishments. This district is supported by the
community and/or entire region. The Zoning and Development Code ("the code") permits
"residential uses in existence on 3/11/97" as a permitted use in the C-1 zone district, so long as
no additional dwelling units are created.
According to the Jefferson County Assessor's Property Record for this address (Exhibit 1), the
original single-family structure on the property was built in 1952. A building permit for an
addition was submitted in 1982 (Exhibit 2) to connect the existing single-family house to the
detached garage in the rear yard. A Certificate of Occupancy (CO) for the "room addition" was
issued the same year.
In 2006, an electrical permit was issued for this property dividing the electrical service for two
units (Exhibit 3). The code prevents additional dwelling units from being created, however it
appears that the Zoning Division was not included in the review of this permit. The Building
Division issued a building permit and thus created a vested right (see Sec. 26-121.0. This means
9910 W. 44a' Avenue may have a maximum of two dwelling units on the property. However, per
our records, no further building permits were applied for and/or issued to convert the single-
family home into a duplex nor do we have a CO for a change to a duplex.
The property was recently put on the market as for -sale and being advertised as a duplex with the
front unit operating as a short-term rental (STR) (Exhibit 4). The front unit is described as a two
bedroom/two bathroom unit, while the rear unit is described as one bedroom/one bathroom unit.
The VRBO description for the front unit further elaborates that the second bathroom was
completed in February 2020, and, given the first review was left in September 2017, this
property has been operating as a duplex at least since then (Exhibit 5).
As mentioned earlier, the City has no records of 9910 W. 44' Avenue being remodeled and
administered a CO for a duplex. All permits related to the structure after the 2006 electrical
permit have been to update the roof. The most recent permit associated with this address is from
2017, also a roofing permit. Therefore, a number of updates were made to this structure without
permits.
Jefferson County Assessor's record recognizes this property as a single-family home with three
bedrooms/one bathroom and an attached garage (Exhibit 1). In addition, while the real estate
listing shows the units labelled as "A" and `B" in the pictures (Exhibit 4), there are no official
address change records associated with this address.
The second back dwelling unit is legally nonconforming. For the second unit to continue to
exist, the following conditions must be met:
1. All work that was done to convert the entire structure into a duplex must be permitted and
inspected in order to have a CO issued for the second unit. This is critical to ensure that
life, safety issues are addressed. There is an ability to have the second unit by virtue of
the City's action of approving the electrical permit, but the second unit is not legal until
this step is completed. Any interested party may contact the Building Division to
schedule a courtesy inspection as a potential first step.
2. An address request must be submitted to officially provide an address for the second unit.
Furthermore, although STRs are not currently permitted within the City, we are in the process of
updating the code. City Council is scheduled to review an ordinance on February 22, 2021 that
would allow, license, and regulate short term rentals. If approved, the ordinance would go into
effect later in the year currently proposed to be May 1, 2021.
Please note: If the residential uses are converted to commercial uses (which is permitted by the
zoning), they cannot be returned to residential uses under the zoning. Any conversion would
require permits.

Perfect location to access Colorado outdoor recreation in the mountains or to enjoy City Amenities in Denver. 5
minutes from 1-70 with easy access on/off 1-70; 15 minutes to downtown Denver. 15 minutes to Golden and Olde
Towne Arvada, 30 minutes from Boulder. Few blocks from home is Restaurant/Bar which has live music on weekends
during spring, summer, fall; located 2 miles from new downtown Wheat Ridge on 38th which has restaurants, shops;
15 minutes from the "Highlands" & "North Highlands", another great area for restaurants/shops; walking/biking path
along creek just few blocks south of our home. Appx 20 min to Anschutz Medical Campus for our guests who work in
health care industry
We have owned this home since 1995, having spent number of years living in our home, "The Shop". Home is
approximately 1000sf (2b2b), each bedroom has 1 queen bed.
We have many wonderful happy memories living in our home, which we fondly nicknamed "The Shop"". Our "pet"
squirrel "Peanut" lives in the tree "condo" in our back patio, enjoys snacks, such as pecans, peanuts, etc. In spring the
"flickers" return, taking possession of the "condo", nesting, hatching and raisingyoung "flickers".
We are sharing our home with guests who want a cozy home, with easy access to all Colorado has to offer.....

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection
prior to installation of ANY roof coverings and is require on the entire roof when spaced
or board sheathing with ANY gap exceeding k/2 -inch exists. Asphalt shingles are required to
be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is
required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturera€ms installation
instructions, whichever is more stringent. In order to pass a final inspection of
elastomeric or similar type roof coverings, a letter of inspection and approval from the
manufacturer's technical representative stating that "the application of the roof at
(project address) has been applied in accordance with the installation instruction for
