You stated that you installed the fence several years ago and that it is on your property. Your neighbor has planted vines along the side of the fence that faces his properly. As the vines have grown, they have become heavier and are causing the wood fence to lean toward the neighbor's side of the properry. Your homeowners insurance policy provides coverage for "accidental direct physical loss to property". Because this situation is not "direct physical damage", but rather, damage that is occurring over a period ot time, we are unable to provide coverage. Consideration was given to the possibility of the fence coilapsing from the weight of the vines. Your policy provides the foilowing coverage: "SUPPLEMENTARY COVERAGES-SECTION 1 We provide the following Supplementary Coverages. These coverages are subject to all terms of this policy, except where modified by the Supplementary Coverage. 1. Collapse. We cover risk of direct physical loss to covered property involving collapse of a building or any part of a building caused only by one or more of the following: a. Perils Insured Against in Coverage B. These perils apply to covered building(s) and personal property and personal property for loss insured by this Supplementary Coverage; b. hidden decay; c. hidden insect or vermin damage; d. weight of people, animals, equipment or contents; e. weight of rain or snow which collects on a roof; or f. use of defective material or methods in construction, reconstruction, renovation or remodeling if the collapse occurs during the course of the construction, renovation or remodeling. Loss to an awning, fence, patio, pavement, swimming pool, underground pipe, flue, drain, cesspool, septic tank, foundation, retaining wall, bulkhead, pier, whart, dock, outdoor equipment or a structure that is not a building is not included under items b,c,d,e and f unless the loss is a direct result of the collapse of a building. Collapse does not include settling, cracking, shrinking, bulging or expansion. This coverage does not increase the limit applying to the damaged covered property." Because of the policy requirement that collapse to a fence must be a result of collapse of a building, we are unable to find coverage under the "Collapse" portion of the Supplementary Coverages. As a result, are unable to provide coverage for this loss. If you have any questions or other information which may cause us to reconsider our position, please contact me at 303-792-0740, ext 52533.
