HomeMy WebLinkAbout07/01/1993 SPECIAL CITY COUNCIL MEETING MINUTES CITY OF WHEAT RIDGE, COLORADO JULY 1, 1993 8 00 A.M The City Council Meeting was called to order by the Mayor at 8 00 a m Councilmembers present Don Eafanti, Phil Edwards, Vance Edwards, Tony FIasco, Ron Selstad, and Kent Davis Also present City Clerk, wanda Sang, City Administrator Robert Middaugh, City Attorney, Kathryn Schroeder, City Treasurer, Jim Malone, staff, and interested citizens Item to be discussed is the replacement of the vacated Council seat in District IV There was a question as tv this meeting being a continuation of the June 28th meeting To alleviate the situation, Mr FIasco withdrew his second on Phil Edwards Motion to vote on candidates in alphabetical order Motion was made by Mr FIasco to follow the normal procedure when any members of boards or commissions are elected, the Councilperson from District involved make nominations of persons to be voted on until someone is selected, seconded by Phil Edwards Motion by Mr Selstad to amend by having a preliminary ballot submitted to the r:ity Clerk with the names of the Councilmember's top three candidates, thus, narrowing down the candijates by this method, seconded by Vance Edwards Mrs Brougham objected to voting no against someone and encouraged Council to vote favorably on the amendment Mr FIasco will be voting no on the amendment, this is no different than the boards and commissions selections Phil Edwards will be voting no on the amendment, according to the Charter, the only procedure allowed is the one for boards and commissions and this woulj be the easiest way to proceed Mr Davis will be voting no Motion to amend failed 3-4 with Vance Edwards, Mr Selstad and Mrs Brougham voting yes Original Motion carries 4-3 with Mr Selstad, Vance Edwards and Mrs Brougham voting no SPECIAL cITY COUNCIL MEETING MINUTES Page -2- Motion by Phil Edwards to appoint Dennis Hall to fill the vacancy of Mr Shanley in District IV, seconded by hr FIasco Motion to amend by Mr Selstad to substitute the name of Don Lancaster, seconded by Elise Brougham Mr FIasco will be voting no on the amendment, the Council in the past have said when on boards and commissions that the person in the District is the one that has to work the most closely with it and the opinion is respected Phil Edwards will be voting no on the amendment, request Council respect his Motion according to past procedures of appointments in districts Vance Edwards will be voting for amendment, questioned the reasons for following the process for boards & commissions when Councilmembers have voted against recommendations from other districts whenever there was a vacancy Mrs Brougham felt that this is a legislative body and this process should not be compared with boards and commissions Mr Selstad stated that this is the first time for this type of process and are now setting a precedent for the future Motion to amend failed 3-4 with Mr Selstad, Vance Edwards, and Mrs Brougham voting yes Motion to amend by Vance Edwards to substitute the name Geoffery WOdell, seconded by Mrs Brougham Mr FIasco and Phil Edwards will be voting no for the same reasons previously stated Motion to amend failed 3-4 with Vance Edwards, Mrs Brougham, and Mr Selstad voting yes Mr Davis called for the question, seconded by Mr FIasco, with a vote of 4-3, Mr Selstad, Mrs Brougham, and Vance Edwards voting no, failed due to less than two-thirds majority vote Vance Edwards read from the Council Rules of Order & Procedure, Table of Rules Relating to Motions, Previous Question (Recall the Question), Debatable - No, Amendable - No, Comments - Two-thirds majority This Motion does not have two-thirds majority Mayor Winger verified that this is what the rules say SPECIAL r:ITY COUNCIL MEETING MINUTES Page -3- hotion to amend by Vance Edwards to substitute the name Mary Madison, seconded by Mrs Brougham Mr FIasco and Phil Edwards will be voting no for reasons previously stated Mr Selstad felt that there seems to be a trend and a certain level of decision making before the fact on a certain person Motion to amend failed 3-4 with Mr Selstad, Mrs Brougham, and Vance Edwards voting yes Motion to amend by Mrs Brougham to substitute the name Frank Busnardo, Motion failej for lack of second Motion to amend by Mr Selstad to substitute the name of Rocco Gioso, seconded by Vance Edwards Mr FIasco and Mr Edwards will be voting no for reasons previously stated Motion to amend failed 3-4 with Mr Selstad, Mrs Brougham, and Vance Edwards voting yes Mrs Brougham stated she felt Dennis Hall was the least qualified of all the candidates, finds it absolutely amazing that someone who wants to run for Council does not know what the biggest issue was and has no opinion at this time, which was the widening of 38th Avenue, has lived here only a short time and Council should give credit to long time citizens who have been active in other organizations, it appears he will be selected Mr Selstad noted that he felt there may be a possible conflict with Mr Hall being on the Jeffco District Attorney's staff and there are questions that either have been or certainly should be referred to the Jeffco D A regarding the Election Law violations in this City, the robust attendance at the meetings certainly indicates probably the reason for Mr Hall's nomination, let the vote fall where it will Vance Edwards will not be voting for Mr Hall, was not aware of anything on which he had an opinion, does not find that acceptable, if running for office must take a position especially with the information that is available, everyone did not have the opportunity to go thru council, this decision was made well in advance Also, wanted to apologize to Mrs Brougham, she wanted to make the Motion for Ms Madison Original Motion carried 4-3, with Mr Selstad, Vance Edwards, and Mrs Brougham voting no SPECIAL CITY COUNCIL MEETING MINUTES Page -4- Motion by Vance Edwards to adjourn the meeting, seconded by Mrs Brougham, carried 7-0 Meeting adjourned at 8 25 a m _,:::1" ctLic_7L Wanda Sang, C'iti:slerk APPROVED BY CITY COUNCIL ON JULY 12, 1993 BY A VOTE OF 5 TO 0 ~ (-~~~ Ron Selstad, Council President
