SUBJECT: Landscape Escrow 5831 W. 29`h Ave.
Attached is a copy of an escrow agreement for the property located at 5831 W 29°i St.. The
escrow is for landscape area improvements that could not be instalied prior to the issuance of a
Certificate of Occupancy.
The landscaping in the front yard will also be required to be completed and is estimated at
$500.00. A check for $500.00 is attached, and shall be held until October 31, 2004 or until the
deficient landscaping has been successfully installed.

Landscape Escrow Apreement
This agreement made this 14 day of Auqust , 20 08 by and between
the City of Wheat Ridge and Jack Daus (owners). Escrow in the amount of five
hundred dollars and zero cents ($500.00) is being held until all landscaping
improvements are completed at:
5831 W 29th Ave.
In the event that landscaping improvements required by Wheat Ridge Code of
Laws, Section 26-502 and/or as agreed to by the property owner is not installed
by October 31, 2007, the City of Wheat Ridge or its designee shall have the right
to enter upon said property to construct and/or install such improvements or do
other such work to accomplish that purpose as may be necessary, provided that
the City of Wheat Ridge shall first give notice in writing to the property owner of
its intent to do so.
If the City of Wheat Ridge exercises its right to perform work of any nature,
including labor, materials and use of equipment either by force account or
contract, the City shall have the absolute right to withdraw the escrow funds to
complete said landscape and drainage improvements. The only precondition to
the City's right to withdraw the escrow funds for this purpose shall be a letter
from the Community Development Director, stating that the landscape and
drainage improvements have not been completed or provided and that the
compliance date of October 31, 2008 has expired.

TERMS AND CONDITIONS
As applicant for a building permit in the City of Wheat Ridge, I do hereby agree to the ierms and
conditions set forth below for the issuance of a Certificate of Occupancy in connection with this
building permit. The issuance of a Certificate of Occupancy requires:
1) The completion of all required landscaping and related site improvements. Inspections
are performed by the Planning and Zoning Division.
The completion of site drainage/grading requirements per the approved site grading
plan and/or final drainage report and plan, if such report and plan is applicable. For all
residential and nonresidential projects with an approved final drainage report and plan, a
letter of certification is required from the civil engineer of record. Inspection are per(ormed
by the Public Works Department.
3) The completion and acceptance by the City of Wheat Ridge o( all required public
improvements, or a uevelopment Govenant or cash escrow may be required in lieu of
construction, as determined by the Public Works Department. The Public Works
Department performs public improvements inspections.
4) The completion and approval of a Certificate ot Occupancy Application form and final
inspections. Inspections are performed by the Building Division.
All the above items must be completed and approved by Planning and Zoning, Building and
Public Works before a Certificate of Occupancy is issued. Final Inspection by the Building
Division does not constitute authorization of a Certificate of Occupancy nor permission for
occupancy. Occupancy of the structure is not permitted until the Certificate of Occupancy
is issued. (Uniform Building Code, Section 109)
The Ciry is not responsible for any real estate closings or other agreements concerning the
property which may be af(ected by failure to complete the above items and obtain a Certificate of
Occupancy.

Please make the following corrections and/or revisions to this submittal:
1. Please submit a site plan with a scale. You did submit a to-scale survey, but the site plan must
also have a scale. For purposes of establishing the setback line, the survey plat will be used
unless a scaled site plan is submitted.
2. You were granted a 1` variance to thz 30' front yard setback requirement to allow you to build
29' from the front lot iine. The submitted survey shows a setback of 31.2' to the main wall of
the existing house, but your site plan shows 29'. Your can build in line with the main wall at
31.2', or build to the 29' setback line.
3. If you intend to erect a fence on your property, you can submit a fence permit from the City.
Fences must meet all setback, height and sight triangle requirements.
4. Just a reminder. The maximum number of units (your existing residence plus one more unit)
allowed on your property without a variance is two. Your setback from the eastern property line
is shown as 5-feet. A multi-unit development (3 or more dwelling units) would require a
minimum side yard setback of 15-feet.

In response to a question from the Boazd, Mr. Crane stated that it was acceptable to deny
both portions of the variance request under one motion.
The motion passed 8-0.
Chair MONTOYA advised the applicant that the request for a variance had been denied.
The applicant inquired about an appeal process. Chair MONTOYA advised the applicant
that an appeai may be made through district court within 30 days. Travis Crane advised
the applicant that he would send a letter to the applicant explaining the appeal process.

This case was introduced by Mike Pesicka. He entered all pertinent documents into the
record and advised the Boazd there was jurisdiction to heaz the case. He reviewed the
staff report and presented photos and site layout pertaining to the application. Variance
criteria for both requests were reviewed. Staff recommended denial of the application as
outlined in the staff report. He entered a letter of opposition into the record which was
received the morning of the hearing from a resident at 2885 Gray Street.
Boazd Member DRDA expressed concern that ingress/egress for two additional dwelling
units could add to traffic congestion on 29t'.

Mr. Daus, the applicant, was sworn in by Chair MONTOYA. He referred to the staff
report that said the reaz easement was granted to him by the Denver Water Boazd. He
explained that he ganted the easement to the Denver Water Boazd. This ten-foot
easement is actually a hill and is unusable and he asked that this be taken into
consideration. He questioned the request for four (instead of two) pazking spaces for the
existing home. He understood that there would only be a necessity for six pazking spaces
and four required spaces for the house would bring the total to eight. He noted that there
aze other multi-family units in the neighborhood and there is only one home that was
built in 1909. He stated that his plans aze in keeping with the chazacter of the
neighborhood. He is requesting the additional ten feet on the side yazd to build a third
garage so there would be a garage for each unit.

A copy of the letter of opposition which was eazlier entered into the record was given to
Mr. Daus for his review. Mr. Daus disagreed with the statement in the letter that there
was not enough room for his proposed additions.
Boazd Member HOVLAND expressed concern about ingress/egress from the gazages
proposed to face 29h Avenue.
Boazd Member YOiJNG asked if Mr. Daus had considered changing the plan to build the
gazages to face the east. Mr. Daus explained that he wanted to keep the side yazd for
landscaping.
Chair MONTOYA asked if there were anyone present who wished to address this matter.
There was no response.
Upon a motion by Board Member DRDA and second by Board Member ABBOTT,
the following resolution was stated:

property, other negative criteria do apply in this case.

applicant's project. She plans to live in the main structure and maintain a guest house for
missionaries in the other structure. The grounds will also be available to use for group
meetings, retreats, etc.
