♦�4I City of "Wheatlge MMUNITY DEVELOPMENT Memorandum TO: Address file for 10400 W. 38th Avenue FROM: Scott Cutler, Senior Planner DATE: October 10, 2024 SUBJECT: Legally Nonconforming Structures The property at 10400 W. 38 h Avenue is zoned Commercial -One (C-1) and contains a house built in approximately 1872, and another building constructed in approximately 1911, according to the Jefferson County Assessor. Various additions were constructed over time. The Assessor states that these buildings are primarily used/assessed as single -unit homes, with some additional commercial/retail space. In the C-1 zone district, residential uses in existence on or before March 11, 1997, are considered a permitted use, and such residential uses may be extended, enlarged, and/or reconstructed so long as no additional dwelling units are created. The existing buildings likely do not comply with the required setbacks as required by the C-1 zone district and will not in the future if the property line shifts further north due to acquisition of the Lena Gulch easement. However, the buildings may remain as -is, and they are and will continue to be considered legally nonconforming under the current regulations. Section 26-120 of the City Code allows for legal nonconforming structures to be restored to their original size and scope if involuntarily damaged. Any legal nonconforming single -unit structure and accessory building can be renovated or expanded, so long as the expansion is built in line with the nonconforming setback and does not further encroach into the setback. Only in the case of total redevelopment or demolition of over 50% of its replacement cost will the entire development standards of the C-1 zone district apply. In that instance, new development is subject to the City's site plan review process and setbacks and site development can be assessed at that time.
