SUBJECT: ADU on Property
The purpose of this memo is to confirm the legitimacy of an Accessory Dwelling Unit
(ADU) on this property, which received a Certificate of ADU Approval on February 22,
2024, and to provide an updated history of events for this property.
Prior to August 15, 2022, ADUs were not permitted by Wheat Ridge City Code. The ADU
ordinance allowed owners of property currently containing structures or portions of structures
which may fall within the definition of ADU are granted the right to apply to the City for
approval of an ADU.
BACKGROUND
An application was filed by John and Susan McMillin on December 10, 2023, seeking to legalize
an existing ADU on property at 9801 W 38th Avenue.
• The property is zoned Residential -Two (R-2).
• The property contains a single -unit home, which according to the Jefferson County
Assessor, was constructed in 1919.
• Per the Jefferson County Assessor, the site is approximately 48,352 square feet in size,
though Improvement Location Certificates (ILCs) show less land area due to ROW
dedications and exceptions over time.
HISTORY AND PRIOR FINDINGS
As part of the ADU legalization process, the applicant provided information and staff reviewed
City and County files to understand the history of the property and of the ADU:
• The applicant described the ADU structure as a two-story converted barn with
approximately 1,500 square feet of floor area, located behind the house on the property.
• The ADU is currently the applicant's place of residence and the primary house on the
property is rented out. The existing house on the property is approximately 1,100 square
feet.
• Jefferson County recognizes the property as containing two detached single -unit homes,
per the Assessor's website from December 2023, one being the primary house and one
being the bam/ADU.
• The applicant stated that the barn had been converted into a dwelling unit before their
purchase in 2000, and a sales brochure states the same, that the barn had been "tastefully
converted into a loft -like spacious two -bedroom apartment... plus a studio apartment on
the main floor."
0 There is no permit history or documentation for the conversion of the barn into a
dwelling unit. The applicant stated that the conversion was likely completed slowly over
time, with tax records showing that the barn had running water in the 1950s. Multiple
previous owners allegedly added upgrades over time.
0 The structure was "discovered" as a dwelling unit by the City during a roof inspection in
2017. At the time, the City began an enforcement process since ADUs were not allowed
and provided a compliance pathway for the applicant. The barn could either be
decommissioned as a dwelling unit, or a subdivision pursued to place each dwelling unit
on its own lot, after an inspection was performed to confirm the structure met building
code requirements for a residential dwelling unit.
• A building inspection of the barn was performed on December 17, 2017. The applicant
stated that no written inspection results were provided. A staff email showed the list of
the findings and possible corrections:
o Electricity was wired to codes of the time (late 1990s) and one outlet in the upper
bedroom was not grounded.
o Furnace B-vent was not secured at a joint in the basement that is venting carbon
monoxide gas into the basement. Inspector verbally advised owner to repair
immediately.
o No clear areas in front of wall furnaces.
o Other items not related to life safety.
o Email states that the barn was generally code compliant except for the B-vent
which needs to be repaired.
• There is no evidence that the City approved two dwelling units (either as two primary
units or a primary unit with accessory unit), but the 2022 code amendment allowing
ADUs created more flexibility allowing the barn unit to be legalized as an ADU.
• Based on the above findings, in 2023, Renee Meriaux (Chief Building Official) requested
that a new life safety inspection be performed as part of the ADU approval process since
it is unclear whether the B-vent was repaired.
2024 UPDATE AND INSPECTION RESULTS
A life safety inspection was performed on January 16, 2024 under Permit #202302458. The
inspector noted that a smoke/carbon monoxide detector was required and a cap placed on the
abandoned section of a flue pipe. The property owner performed the corrections, confirmed by
the Building Division on February 1, 2024. The ADU inspection was marked as completed on
February 1, 2024.
The Certificate of ADU Approval, address change notification for the ADU (creating a B
address), and a signed deed restriction are included in the address file.

DECLARATION OF COVENANT AND RESTRICTION
THIS DECLARATION OF COVENANT AND RESTRICTION is made this la"day of

1. Burdened Property. Declarant is the owner of the real property located within the
City of Wheat Ridge, Jefferson County, Colorado described in the attached Exhibit A ("Burdened
Property') also known as 9801 W. 381h Avenue A primary dwelling and an accessory dwelling
(the "ADU") presently exist on the Burdened Property, or are proposed to exist on the Burdened
Property, pending the issuance of a City of Wheat Ridge building permit(s) if necessary and
subsequent issuance of a Certificate(s) of Occupancy.
2. Burdened Property Subject to Wheat Ridge Code. Accessory dwelling units in the
City are subject to certain regulations under the Wheat Ridge Code of Laws (the "Code"), and in
particular, Code Section 26-646, or its successor section(s) as amended from time to time. That
Code Section requires that either the dwelling unit or the ADU on a property must be occupied
by the property owner. The Declarant intends by this Covenant and Restriction to ensure
continued compliance of the Burdened Property with the Code.
3. Imposition of Restriction. Declarant, for itself, its heirs, successors and assigns,
hereby covenants and agrees that:
A. No portion of the Burdened Property, either the primary dwelling or the ADU
on the Burdened Property may be conveyed separately from the other,
respectively; and
B. The Burdened Property shall not be subdivided unless such subdivision can be
accomplished in accordance with the provisions of the Code; and
C. The owner of the Burdened Property must occupy either the primary dwelling
unit or the ADU on the Burdened Property.
4. Burdens Run With the Land. Declarant hereby declares that this Restriction shall
pass with and burden each and every tract, lot, and parcel of land within and which is a part of
the Burdened Property and shall apply to and be binding upon the heirs, successors in interest
and assigns of the Declarant and any owner hereafter of said tracts, lots and parcels, shall run
with the land at law and in equity. Any person acquiring any interest in the Burdened Property
shall be deemed for all purposes to have assented and agreed, as an essential condition of any
such conveyance, to the provisions of this Covenant and Restriction, to have agreed to comply
with this Covenant and Restriction and to have waived any right to challenge or contest the
provisions hereof except as permitted herein.
5. Relationship to Land. Declarant acknowledges and agrees that the restrictions
imposed by this Covenant and Restriction are related to and touch and concern the Burdened
Property.
6. Enforcement. The City is an express third -party beneficiary of this Covenant and
Restriction and is authorized and empowered to enforce the obligations established hereunder.
The rights, duties and obligations contained in this Covenant and Restriction may be enforced by
the filing of an appropriate action in law or in equity in the District Court for Jefferson County,
Colorado whose jurisdiction over this Covenant and Restriction is hereby acknowledged.
7. Recording. This Declaration of Covenant and Restriction shall be filed for record
with the office of the Jefferson County Clerk and Recorder by the City concurrent with issuance
of the Building Permit for the ADU, or issuance of Certificate of ADU Approval for existing ADUs
determined to be legally nonconforming.
8. Removal of Declaration.
A. In the event the ADU is demolished or modified such that it no longer functions as
an ADU as defined in the Code, upon application of the then -property owner and
approval by the City pursuant to the Code, the City shall record a release of this
Declaration in appropriate form.
B. In the event the imposition of this Declaration is no longer permissible under
federal, state, or local law, upon approval by the City, the City shall record a
release of this Declaration in appropriate form.
9. Severability. If any provision of this Declaration of Covenant and Restriction is held
to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect
the validity of the remaining provisions.

Effective December if 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name)
roof covering" is required to be on site at the time of final inspection.
Roof inspections for ROOFS OVER 6/12 PITCH: 3rd party inspection will be required, the 3rd
party inspection report will be collected at final roof inspection performed by City of
Wheat Ridge. If report is not available the final inspection will not be completed.

Please allow this letter to serve as a response to our meeting last week, with input from a follow up
conversation with the Community Development Director. The following fact pattern was established by Staff
and utilized in discussion regarding your property located at 9801 W. 38a' Avenue:
• The property measures approximately 48,000 square feet and is zoned Residential -Two (R-2). The R-2
zone district requires 9,000 square feet of land for a single family home and 12,500 square feet of land
for a duplex.
• Two detached dwelling units exist on the property. City records only indicate one dwelling unit and all
documentation states the rear `unit' as a barn, with no documentation or references indicating the
structure was converted to a dwelling unit.
As you stated, when purchasing the property the previous owner said there were no permits for the
barn conversion, then subsequently dropped the price of the home, providing evidence that the barn
conversion into a dwelling unit was not permitted or approved by the City.
The Kentwood City Properties sales brochure from 2000 states (and was confirmed by you) that the
property had three units at the time of your purchase of the property ("One house, one rental unit, one
mother-in-law quarters"). This is another clear indication that the conversion was done without proper
building permits, as Staff would not approve three dwelling units in the R-2 zone district, let alone two
detached dwelling units.
Given this information, there are two options for your property moving forward: 1) decommission the barn as a
dwelling unit, or 2) subdivide the property so each unit exists on its own lot. Given your zoning and lot size,
Staff is supportive of a subdivision with a setback variance to allow the barn to continue as it currently exists, 5
feet from the rear property (current zoning standards require a minimum of 10 feet). The property is actually
large enough to be subdivided into three lots — one lot for each existing unit and a third (which could be large
enough for a duplex) for future sale or development.
Next steps for a subdivision would be a pre -application meeting.

It has come to the attention of the City of Wheat Ridge that there are two structures on your property
being utilized as individual dwelling units. This information was verified through a rental listing online for
the property which states: "You'll share the yard with the owners, who live in the renovated bum on the
property." Building permit records indicate the rear structure on the property as a bum in both a 1992
Improvement Location Certificate and a 1996 building permit (see attached). There are no permit records
showing the City approved conversion of the bum into a residential dwelling unit.
The property is zoned Residential -Two (R-2), which is the City's single-family and duplex zone district.
While your property has adequate lot size and frontage to allow for a duplex structure, you are not
permitted to have the two units in separate structure. Dwelling units are not permitted in accessory
structures (Section 26-625) and no more than one primary structure is permitted on the property (Section
26-610).
If you have any additional information regarding the conversion of the barn into an accessory residential
structure, we welcome you to bring that forward.

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been

1. This permit was issued in accordance with the provisions set Eorth in your application and is subject to the laws of the
State of Colorado and to the Zoning Aegulations and Building Codes of Wheat Ridge, Colorado or any other applicable
ordinances of the City.
2. This permit shall expire 180 days from the issue date. Requests for an extension must be received prior to expiration
date. An extension may be granted at the discretion of the Huilding Official. 3. If this permit expires, a new permit may be acquired for a fee of one-half the amount normally required, provided no
changes have been or will be made in the original plans and specifications and any suspension or abandonment has not
exceeded one (1) year. If changes have been or if suspension or abandonment exceeds one (1) year, full fees shall
be paid for a new permit.
4.. No work of any manner shall be done that will change the natural flow of water causing a drainage problem.
5. Contractor shall notify the Huilding Inspector twenty-four (24) hours in advance for all inspections and shall receive
written approval on inspection card before proceeding with successive phases of the job.
6. The issuance of a pexmit or the approval of drawings and specifications shall not be construed to be a permit for, nor
an approval of, an violation of the provisions of the building codes or any oCher ordinance, law, rule or regulation.

Laying out
the installation area
The installaaon can be laid out with raiLs
pazallel ro the ia&ers (high-profile mode)
or perpendicular to the raRers (low-profile
mode). Note chat SolazMount raiLs make ex-
cellent straight edges for doing layouts. Cen[er
the installation area ovec the rafrers as much
as possihle.
Leave enough room to safely move around the
azray during installauon
The width of the installation azea is equal ro
the length of one module.
The length of the installation azea is equaI to:
• the toral width of the modules,
• plus 1 inch for each space benveen
modules (for mid-clamp),
• plvs 3 inches (1~/s inches for each set
of end clamps).

Remove the tile or shake undemeath each standoff locarion, exposing
the roofing undedayment. Ensure that the standoff base lies flat on
the underlayment, but remove no more material than required for the
flashings m be installed properky.
Use the standoff base as a template to mazk lag bolt hole locarions oa
undedayment above the center of the rafrers (Fig. 9 or Fig.10).
In low-proEle layouts, stagger standoffs on rafters (Fig. 9) to disqil>
ure the load.
4Vhen determining the distance benveen the raiLs in high-profile
mode, keep in mind that the center of each rail will be offset from rhe
standoff lag bole holes by'/6 of an inch.

Installing Splices. If your installation uses
SolarMoimt splice bars, attacU the rails mgether
(Fig. ll) before mounting the raiLs to the foot-
ings. Use splice bazs only with ftush ins[allarions
or those that use low-profile dlt legs.

Mounting Rails on Footiags. Rails may be
attached to eirher of two mtiuncing holes in the
footings (Fig.12). Mount in the lower hole for a
low profite, more aesthetically pleasing instal-
lation. Mount in the upper hole for a lvgher
profile, wtuch will maximize airRow under the
modules. This will cool them mare and may
enhance perfocmance in hotter climates.
Slide the/Wnch mounting bolts into the footing
bolt slou. Loosely attach the rails to the footings
with the flange nucs.
Ensure that the raiLs are oriented to the footings
as shown in Figure 6, 7, 9, or 10, whichever is
appiopriare.

Installing the modules
Prewiring Modules. If modules aze the Plug and Play type, no prewiring is
required, and you can proceed direcdy to "tnsralling the First Module" below.
If modules have srandazd J-boaes, each module should be prewired with one
end of the intecmodule cable for ease of uvs[allaaon. For safery reasons, module
prewiring should not be performed on the roof.
Leave covers off J-boxes. Theywill be installed when the modules aze installed
on the raiLs.
Installna the First Module In high-profile installaaons, the safery bolt and
tlange nut mus[ be fastened to the module bolt slot at the aligned (lower) end of
each rail. It will prevent the lower end clamps and clamping boltc from sliding
ouc of the raIl slo[ during ins[allaaon.
If [here is a retum cable to the inverter, connec[ it m the first module. Close the
S-boa cover. Secure the first module with T-bolrs and end clamps ac the aligned
end of each rail. Allow tialf an inch between the ral ends and the end clamps
(Fig. 15). Finger tighten Range nuts, center and a7ign che module as needed, and
secviely tlghten the 8ange nurs (15 fr lbs).
Iastalling the Other Modules. Lay the semnd module face down (glass m
glass) on the first module. Connect inreimodule cable ro the second module and
close the J-box cover. Ttun the second module face up (Fig.16). With T-bolts,
mid clamps, and tlange nuts, secure the adjacen[ sides of the fust and second
modules. Align the second module and securely bghten the flange nucs (Fig. 17).
For a neat installaaon, fasten cable clamps m rails with self-tapping screws.
Repeat the procedure undi all modules aze installed. Attach the outside edge of
the last module to the rail with end clamps.
Trun off any excess raii, being careful not to cut into the roo£ Allow kialf an inch
between the end clamp and the end of the rail (Fig.15).
Check chat all flange nuts on T-holts aze smuelyfasrened.

DESCRIBE REQiTEST/VIOLATION: Multiple zoning and code violations. Need
history of property including when and if a building permit was issued, if not, why has
building not been taken down.
ACTION TAKEN: The structure was built in 1919. The only permits in the file are
for new electrical service and reroofing in 1992 and for constsruction of a gazebo in
1996.
The structure was slightly damaged by a fire started by the tenant a few days before
Christmas, 2002. There was no structural damage and very little other damage;
mostly smoke damage. The structure has been boarded up temporarily and does
not constitute a hazardous situation or dangerous building. A notice and order to
demolish will not be issued.
The tenant has been evicted and the owner is attempting to settle with the insurance
company. The owner is also investigating whether the structure could be remodeled
to add a second story. No permit has been requested to date.

THE FIELDS ON THE SOUTH AND NORTH SIDES OF EVERETT MIDDLE
SCHOOL ARE BEING FLOODED OUT, ALLEGEDLY FROM THE
IRRIGATION SYSTEM AT 9801 WEST 38TH AVENUE, WHICH IS A
PRIVATE RESIDENCE. THE PHOTOS THAT I JUST TOOK ARE BEING
DEVELOPED; PLL SHOW THEM TO YOU LATER TODAY.
THIS PROBLEM CROPPED UP EIGHT MONTHS AGO. PD OFFICER
TERRY JACKSON AND IAN SCARLIFF, THE ASSISTANT PRINCIPAL,
MET WITH ME AT THE SCHOOL. AT THE TIME, THE ABOVE AREAS
WERE AFFECTED BY WHAT APPEARED TO BE FLOODING FROM 9801
WEST 38THAVENUE. I HAD CONTACTED THE OWNER OF THE
PROPERTY, MICK FRIEND( (303)994-9760), WHO DOES NOT LIVE IN
WHEAT RIDGE, AS WELL AS THE TENANT, WHO HAD JUST MOVED
INTO THE HOUSE. MICK FRIEND SAID THAT THE TENANT DID NOT
KNOW HOW TO WORK THE IRRIGATION SYSTEM, AND THAT HE
WOULD TEACH HER HOW TO WORK IT CORRECTLY. I MET WITH IAN
SCARCLIFF AGAIN THAT DAY, AND ASKED HIM TO CONTACT ME IF
THE PROBLEM CAME UP AGA1N.
AFTER RECEIVING THE COMPLAINT FROM YOU THIS MORNING, I
WENT TO 9801 WEST 38T'` AVENUE, AND MET WITH ANNETTE
LEONARD ((303)422-7825), THE NEW TENANT. SHE SAID THAT SHE
HAD JUST MOVED IN AND KNEW NOTHING ABOUT THE IRRIGATION
SYSTEM. IT APPEARED TO ME THAT THE IRRIGATION WATER WAS
NOT TURNED ON. I PHONED PROPERTY OWNER MICK FRIEND, AND
LEFT HIM A MESSAGE AT WORK TO CALL ME ASAP.
I THEN MET WITH THE SCHOOL CHIEF BUILDING ENGINEER, MARY
BRUYER. SHE SAID THAT FOR THE SEVEN YEARS THAT SHE HAS
WORKED FOR THE SCHOOL, THE FLOODING HAS ALWAYS BEEN A
PROBLEM IN THE SUMMER, AND THE FLOODED AREA ON THE
NORTH SIDE OF THE SCHOOL, WHICH IS A SMALL LAKE, FREEZES
OVER IN THE WINTER.
I NEXT MET WITH SCHOOL PRINCIPAL KATHY NORTON ((303)982-
1580). SHE TOLD ME THAT SHE HAS HAD TO REPLACE PART OF THE
GYMNASIUM FLOOR, DUE TO THE WARPED BOA.RDS THAT RESULT
FROM THE WATER THAT ALLEGEDLY FLOWS FROM 9801 WEST 38T"
AVENUE, UNDER THE SCHOOL, AND ON TO THE NORTH SIDE OF THE
SCHOOL. I TOLD HER THAT I WOULD CALL HER LATER TODAY,
AFTER I SPOKE WITH MICK FRIEND.
FRIEND RETURNED MY PHONE CALL AT 11:00 AM TODAY. HE SAID
THAT HE HAS NOT HAD THE IRRIGATION WATER TURNED ON FOR
THE PAST FOUR DAYS. I AM MEETING HIM ON THE PROPERTY
TODAY AT 2:00 PM.
OUR CODE DOES NOT ADDRESS THIS ISSUE, SINCE IT IS A CIVIL
MATTER. WE MAY NOT HAVE A LOT OF GROUND (SO TO SPEAK) TO
STAND ON, IN TERMS OF OUR INVOLVEMENT.
