Lack of adequate gazbage and rubbish storage and removal facilities as detemrined by the health officer. 1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they aze or contain structural hazazds. Structural hazards shall include, but not be limited to, the following: 1. Deteriorated or inadequate foundations. 2. Defective or deteriorated flooring or floor supports. . 3. Flooring or floor supports of insufficient size to carry imposed loads with safety. 4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective material or deteriora[ions. 5. Members of walls, partitions or other vertical supports that aze of insufficient size [o carry imposed loads with safety. 6. Members of ceilings, rooFs, ceiling and roof supports, or other horizontal members that sag, split or buckle due to defective material or deteriorarion. 7. Fireplaces or chinmeys that list, bulge o settle due to defecrive material or deterioration. 9. Fireplaces or chimneys that aze of insufficient size or strength to carry imposed loads with safety. 1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code are deemed substandard buildings. 1001.5 Hazardous Elechical Wiring. Electrical wiring that was installed in violarion of code requiremenu in effect at the time of installarion or electrical wiring not installed in accordance with generally accepted construcrion pracrices in azeas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be consideied substandazd. 1001.6 Hazazdous Plumbing. Plumbing that was installed in violarion of code requirements in effect at the fime of installation or plumbing not installed in accordance with generally accepted conshuction pracrices in azeas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.7 Hazazdous Mechanical. Mechanical equipment that was installed in violarion of code requ'uements in effect at the time of installafion or mechanical equipment not installed in accordance with generally accepted construction pracrices in areas where no codes were in effect or that has not been mainbined in good condirion or that is not being used in a safe manner shall be considered substandazd. 1001.8 Faulty Weather Protections. Buildings or portions thereoi shall be considered substandard when they have faulty weather protections, which shall include, but not be limited to, the tollowing: 1. Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or iloors, including broken windows or doors. 3. Defective or lack of weather protection for exteriar wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, split or buckled exterior wall coverings or roof coverings. 1001.9 Fire Hazazd. Any building or portion thereof, device, appazatus, equipment, combusrible waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condirion as to cause a Fire or explosion or provide a ready fuel to augment the spread and intensiry of fue or explosion arising from any cause shall be considered substandard. 1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are specii'ically allowed or approved by this code and the Building Code, and that have been adequately maintained in good and safe conditio¢s, shall cause a building to be substandard. 1001.11 Hazardous or Insanitary Premises. The accumulalion of weeds, vegetation, junk, dead organic matter, debris, gazbage, offal, cat hazborages, stagnant watec, combusrible materials, and sitnilar materials ox condirions on a premises constitutes fire, health or safety hazards that shall be abated in accordance with the procedures specified in Chapter 11 of this code. 1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with adequate exit facilities confonning to the provisions of this code, buildings or portions thereof whose exit facffiries were installed in violarion of code requirements in effect at the rime of their construction or whose exit facilities have not been increased in number or width in relarions to any incLease in occupant load due to alterarions, addirions or change in use or occupancy subsequent to the time of construction shall be considered substandard. Notwithstanding compliance with code requirements in effect at the time of their construction, buildings or portions thereof shall be considered substandazd when the building official finds that an unsafe condirion exists through an improper location of exits, a lack of an adequate number oi width of exits, or when other condirions exist that aze dangerous to human life. 1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall be considered substandazd when they are not provided with the Fire-resistive construcrion or fue- extinguishing systems or equipment required by this code, excep[ those buildings or portions thereof that conformed with all applicable laws at the rime of their construcrion and whose fue-resisrive integrity and fire-extinguishing systems or equipment has been adequately maintained and improved 'ul relarion to any increase in occupant load, alteration or addirion, or any change in occupancy. 1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or dining purposes that were not designed or intended to be used for such occupancies shall be considered substandard. The following is a list of items that shall be fixed to meet code: 1. The old siding shall be removed and replaced. 2. No permit for addition of house onto concrete slab in back yazd. This structure shall be brought up to code. 3. Any broken windows shall be fixed. 4. The roof needs new shingles. 5. All faulty weather protection shall be fixed 6. All exposed wood shall be painted over. 7. Stairs/steps shall meet code. 8. Note the single family residence needs to be inspected inside and these may not be the only issues. ORDER 1. The City of Wheat Ridge Building Official has determined the building referenced above to be a Substandard Building. The Building Department will post the building as a Substandard Building due to the amount of life safety issues. Pursuant to Code there shall be an inspection of the entire property to determine if this is more than a substandazd building. An inspection shall be scheduled with Chad Root 303-235-2853 before September 13, 2006. If the property is not inspected by September 13, 2006 the City will consider the building a Dangerous Building per Section 30213 and then all occupants shall vacate the property with 30 days of September 13, 2006. This is therefore required in order to protect life, health and safety of the public. U. The owners are ordered to pull a building permit to fix the deficient items. The Building Deparhnent will post the building as a Dangerous Building due to the amount of life safety issues. Pursuant to Code ail occupants shall be required to vacate the property. Secrion 801 in the Uniform Code far the Abatement of Dangerous Buildings states, "801.1 Procedure. When any work of repair or demolition is to be done pursuant Section 701.3, Item 3, of this code, the building official shall issue an order thereof to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director. Plans and specifications therefore may be prepared by said director, or the director may employ such architectural and engineering assistance on a contract basis as deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standard public works contractual procedures shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall be paid from the repair and demolition fund, and may be made a special assessment against the property involved, or may be made a personal obligation of the property owner, whichever the legislative body of this jurisdicrion shall detennine is appropriate." On August 2, 2006, Officer Laura Backus, Community Services Officer for the Wheat Ridge Police Department, observed the following repairs and clean-up needed at the single multi-family structure located at 10609 West 48th Avenue and 10605 West 48th Avenue: ► the front porch and the front door needed repairs and paint ► the current paint on the structure was peeling ► the particle board on the enclosed porch located on the north side of the structure was swollen and falling apart a broken window in the enclosed back porch ► a deteriorating fence ► a large pile of grass clippings, branches and dirt located on the east side of the structure During her visit at the property, Officer Backus contacted Frances Lund, tenant at 10605 West 48th Avenue. Ms. Lund advised Officer Backus she has rented the duplex,for several years. Ms. Lund advised Officer Backus she had contacted her landlord to request repairs be made to the structure. Ms. Lund advised Officer Backus the landlord would not return her telephone calls. Ms. Lund provided her landlord's name, Harry Stewart, and contact information to Officer Backus. Officer Backus responded to the property on August 14, 2006, to conduct a compliance check for repairs to the property. Upon her arrival, Officer Backus found no improvement to the property or the condition of the structure. Officer Backus left a telephone message for Mr. Stewart to contact her. Officer Backus had tried to contact Mr. Stewart on several occasions. Officer Backus had responded to Mr. Stewart's residence in Arvada in an attempt to contact him. Mr. Stewart had not returned any of Officer Backus' telephone calls, nor had Mr. Stewart responded to the warning notices from Officer Backus. On August 14, 2006, Officer Backus contacted Your Affiant regarding the Building Code violations at the property. I advised Officer Backus I would check the property for any life and safety issues. On August 28, 2006, 1 responded to the property. I conducted a detailed inspection of the outside of the structure and discovered the addition to the residential structure had rotted through the wall and framing. I observed that the roof had collapsed in on a portion of the building and had the possibility of additional collapse. I could see a hole through the roof from the inside to the outside. I observed water damage throughout the exterior of the structure. I observed the following violations needing to be brought to up current building code standards: • the roof had rotted through • the walls had rotted through • the siding had fallen off • there were several broken windows After conducting an initial inspection of the property, I responded to my office to write a Notice and Order As Sub-Standard Housing to the tenants, property owner and property manager. On August 29, 2006, 1 contacted Harry Stewart and advised him of the violations. Ms. Lund advised Officer Backus she has rented the duplex for several years._ Ms. Lund advised Officer Backus she had contacted her landlord to request repairs be made to the structure. Ms. Lund advised Officer Backus the landlord would not return her telephone calls. Ms. Lund provided her landlord's name, Harry Stewart, and contact information to Officer Backus. On August 28, 2006, 1 responded to the property. I conducted a detailed inspection of the outside of the structure and discovered the addition to the residential structure had rotted through the wall and framing. I observed that the roof had collapsed in on a portion of the building and had the possibility of additional collapse. I could see a hole through the roof from the inside to the outside. I observed water damage throughout the exterior of the structure. Whenever any portion of a building, or any member, appurtenance or ornamentation on the exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the building Code for new buildings of similar structure, purpose or location without exceeding the working stressed permitted in the Building Code for such buildings. 7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls or other structural portions have materially less resistance to winds or earthquakes than is required in the case of similar new construction. 8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of any portion of the ground necessary for the purpose of supporting such buildings; (iv) the deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or completely collapse. 9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for purpose of which it is being used. 10. Whenever the exterior walls or other vertical structural members list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle on third of the base. 11. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent damage or deterioration of its non-supporting members, enclosing or outside walls or coverings. 12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts. 13. Whenever any building or structure has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Building Code or Rousing Code, or of any law or ordinance of this state or jurisdiction relating to the condition, location or structure of buildings. 14. Whenever any building or structure which, whether or not erected' in accordance with a all applicable laws and ordinances, has in any non-supporting part, member or portion less than 50 percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (ii) fire-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics required by law in the case of a newly constructed building of like area, height and occupancy in the same location. 15. Whenever a building or structure, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be unsanitary, unfit for human habitation or in such a condition that is likely to cause sickness or disease. 16. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage, inadequate exists, lack of sufficient fire-resistive construction, faulty electric wiring, gas connections or heating apparatus, or other cause, is determined by the fire marshal to be a fire hazard. 17. Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence. 18. Whenever any portion or a building or structure remains on a site after the demolition or destruction of the building or structure or whenever any building or structure is abandoned for a period in excess of six months so as to constitute such building or portion thereof an attractive nuisance or hazard to the public. The 1997 Uniform Housing Codes states: SECTION 1001- 1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit, guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the conditions referenced in this section to an extent that endangers the life, limb, health, property, safety or welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard buildings. 1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are when they are in sanitary. Inadequate sanitation shall include, but not be limited to, the following: 1. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house. 2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a hotel. 3. Lack of or improper kitchen sink in a dwelling unit. 4. Lack of hot or cold running water to plumbing fixtures in a hotel 5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house. 6. Lack of adequate heating facilities. 7. Lack of or improper operation or required ventilating equipment. 8. Lack of minimum amounts of natural light and ventilation require by this code. 9. Room and space dimensions less than required by this code. 10. Lack of required electrical lighting. 11. Dampness of habitable rooms. 12. Infestation of insects, vermin or rodents as determined by the health officer. 13. General dilapidation or improper maintenance. 14. Lack of connection to required sewage disposal system. 15. Lack of adequate garbage and rubbish storage and removal facilities as determined by the health officer. 1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or contain structural hazards. Structural hazards shall include, but not be limited to, the following: 1. Deteriorated or inadequate foundations. 2. Defective or deteriorated flooring or floor supports. 3. Flooring or floor supports of insufficient size to carry imposed loads with safety. 4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective material or deteriorations. 5. Members of walls, partitions or other vertical supports that are of insufficient size to carry imposed loads with safety. 6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split or buckle due to defective material or deterioration. 7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of insufficient size to carry imposed lads with safety. 8. Fireplaces or chimneys that list, bulge o settle due to defective material or deterioration. 9. Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with safety. 1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code are deemed substandard buildings. 1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed in violation of code requirements in effect at the time of installation or electrical wiring not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect at the time of installation or plumbing not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code requirements in effect at the time of installation or mechanical equipment not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard when they have faulty weather protections, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weather protection for exterior wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, split or buckled exterior wall coverings or roof coverings. 1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or vegetation that, in the opinion of the chief of the fire department, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause shall be considered substandard. 1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are specifically allowed or approved by this code and the Building Code, and that have been adequately maintained in good and safe conditions, shall cause a building to be substandard. 1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be abated in accordance with the procedures specified in Chapter 11 of this code. 1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with adequate exit facilities conforming to the provisions of this code, buildings or portions thereof whose exit facilities were installed in violation of code requirements in effect at the time of their construction or whose exit facilities have not been increased in number or width in relations to any increase in occupant load due to alterations, additions or change in use or occupancy subsequent to the time of construction shall be considered substandard. Notwithstanding compliance with code requirements in effect at the time of their construction, buildings or portions thereof shall be considered substandard when the building official finds that an unsafe condition exists through an improper location of exits, a lack of an adequate number or width of exits, or when other conditions exist that are dangerous to human life. 1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall be considered substandard when they are not provided with the fire-resistive construction or fire- extinguishing systems or equipment required by this code, except those buildings or portions thereof that conformed with all applicable laws at the time of their construction and whose fire-resistive integrity and fire-extinguishing systems or equipment has been adequately maintained and improved in relation to any increase in occupant load, alteration or addition, or any change in occupancy. 1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or dining purposes that were not designed or intended to be used for such occupancies shall be considered substandard. The following is a list of items that shall be fixed to meet code: 1. The old siding shall be removed and replaced. 2. No permit for addition of house onto concrete slab in back yard. This structure shall be brought up to code. 3. Any broken windows shall be fixed. 4. The roof needs new shingles. 5. All faulty weather protection shall be fixed 6. All exposed wood shall be painted over. 7. Stairs/steps shall meet code. 8. Note the single family residence needs to be inspected inside and these may not be the only issues. ORDER 1. The City of Wheat Ridge Building Official has determined the building referenced above to be a Substandard Building. The Building Department will post the building as a Substandard Building due to the amount of life safety issues. Pursuant to Code there shall be an inspection of the entire property to determine if this is more than a substandard building. An inspection shall be scheduled with Chad Root 303-235-2853 before September 13, 2006. If the property is not inspected by September 13, 2006 the City will consider the building a Dangerous Building per Section 302.13 and then all occupants shall vacate the property with 30 days of September 13, 2006.. This is therefore required in order to protect life, health and safety of the public. H. The owners are ordered to pull a building permit to fix the deficient items. The Building Department will post the building as a Dangerous Building due to the amount of life safety issues. Pursuant to Code all occupants shall be required to vacate the property. This is therefore required in order to protect life, health and safety of the public. Ill. If the structure has not been brought to code or demolished by January 1, 2007. Section 801 in the Uniform Code for the Abatement of Dangerous Buildings states, "801.1 Procedure. When any work of repair or demolition is to be done pursuant Section 701.3, Item 3, of this code, the building official shall issue an order thereof to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director. Plans and specifications therefore may be prepared by said director, or the director may employ such architectural and engineering assistance on a contract basis as deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standard public works contractual procedures shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall be paid from the repair and demolition fund, and may be made a special assessment against the property involved, or may be made a personal obligation of the property owner, whichever the legislative body of this jurisdiction shall determine is appropriate." The property owner and all occupants are hereby ORDERED TO CEASE AND DESIST occupancy and use of the above described building. The Building Official shall cause the property to be posted with the attached Notice and shall take action to remove all future occupants from the building until the building is brought up to code. REMEDIAL ACTION The property owner must apply for and obtain a City of Wheat Ridge building permit to correct any deficiencies. IV. All deficiencies shall be fixed but are not limited to the items on this list. APPEAL OF THIS NOTICE AND ORDER Any person having record title or other legal interest in the above described premises may appeal this Notice and Order or any action of the Building Official to the Building Code Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code, provided that the appeal is made in writing as provided in the Code and filed with the Building Official within ten (10) days from the date of service of this Notice and Order. Failure to appeal will constitute a waiver of all rights to an administrative hearing and determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE EFFECTIVENESS OF THIS NOTICE AND ORDER.
