We received a building permit to construct a barbed wire fence around an office/warehouse
building at 10700 west SOth avenue.
The reason I'm forwarding this to you is because evidently they will be having gates put
up which may limit access into the site as I see it.
The gates, as shown, would be at the north and south entryways into the parking lot. I
have attached a scanned copy of the plans submitted, the area in yellow indicates the area
of barbed.wire.
Please let me know if you have any concerns, and I will gladly forward them to the
applicant.
The person constructing the fence is Steelock Fence Co., 303.295.1915, Adam Lassanske.
Hopefully you can open the document up, if not let me know. The barbed wire is allowed
with their zoning, just not sure about the restricted access that may result.

I have received your request for zoning information for the property located at 10700 W. 50`h
Avenue. The property is currently zoned Planned Industrial Development (PID), and is a part of the
L&K Industrial Park. Your specific request was in relation to the nature of your business, and
whether or not the zone district would allow the intended use. I would like to discuss the zoning
designation, allowed uses and your intended use below.
The L&K Industrial Park was rezoned to PID in 1974. The development plan did not list a set of
allowed uses, rather, the plan referred to a specific section of a historic version of the Code of Laws.
The development plan lists the allowed uses as "all uses allowed in Section 21-B including any
warehousing as allowed under the original L&K Industrial Park plat recorded December 27, 1974
in plan book 46 page 32."
Your letter dated 12 April 2006 specified that Peterson Company engaged in the distribution of
metal products and the processing of inetal products. After reviewing Section 21-B of the Code of
Laws `custom fabrication' and `retail sales of any commodity that is manufactured, processed, or
fabricated only on the premises' are listed as allowed uses. However, you should be aware that at
no time can any metal smelting or extraction occur.
Based on this information, the use as you have described is an allowed use for the property located
at 10700 W. SO' Avenue. As we discussed previously, any alteration to the building footprint
layout or addition of storage areas will require an amendment to the development plan.

regard to the 10700 W. SDth property. The lettar can be made addressed, "To
Whom it may concern". The nature of the Peterson Company's steel busfness is
primarily the dlatribution of bar greUng, plank grating, perforated sheet,deck,wire
and expanded metal products. The "processing" that ia done to existing
manufactured products include: cutting,welding,shearing,forming and custom
fabricatfon of these materials into indusVlal products. At no Nme will Psterson
Company ever smelt or extract steel. Nor will Peterson Company use the property
for anything Iisted under uses prohibited listed In section 21 page 111.

This uaemo is in response to a request for a Cectificate of Occupancy for the Hatcher Constructiou
building located at 10700 West 50`h Avenue. Public Woxks can not approve the Ceraficate of Occupancy
at this time due to a drainage problem that currently exists at rhe southwesterly portzon of this site.
I was contacted on A,ugust 31, 2005 by the Tim Porter, the property owner at 4950 Oak Street (just west
af the Hatcher development) to report tbe ponding o£water onto his praperry as a zesult of the Hatcher
developnaent. The dminage problem is caused by fill placed along the westerly side of the Hatcher
detentioz► pond. F'tll was bzought onto the site duzing the consixuctivn of the detention faci►ity, and 'as
showiu to be excessive (by about a foot arid a hal fl on the as-built plans tbat were submitted with the
Drainage Certification received back in May of 2005. The excess filt iucxterrupts the historical flow
pattem and has pzoduced a damming effect onto the 4950 Oak SUreet propetty.
Mr. Hatcher was contacted by 1Zuss Higgins, Pield Services Supervisox on August 31, 2005 to discuss
the opt,ions. NUr. Iiauhe,r was informed at that time that he will nced to re-grade the area in question to
restore the historical flow pattem. ltuss spoke to Mr. Porter back ou,August 31, 2005 as well, and he
stated he was willing to meet with Mr. Hatcher to try and work out a solution. PW doesn't know if this
meeting ever occurred becween Mr. Hatchex and Mr. porter, but at sounded as if the neighbor was wzllixAg
to work with Mr. tiatcher to resolve ttxe drainage issue..
So after I received the C.O. request today, Russ visited the site to verify the grading work kxad beeu
completed prior to PVJ approval of che C.O„ and discovered tbat in fact the gading work k►as not even
started. Until NIz. Hatcher completes the site grading to restore the historical drainage pattern, Public
VJorics has po alternative but tp withhold the Certificata o£Occupancy.

This memo is in response to a request for a Certificate of Occupancy for the Hatcher Construction
building located at 10700 West 50`h Avenue. Public Works can not approve the Certificate of Occupancy
at this time due to a drainage problem that currently exists at the southwesterly por[ion of this site.
I was contacted on August 31, 2005 by the Tim Porter, the property owner at 4950 Oak Street (just west
of the Hatcher development) to report the ponding of water onto his property as a result of the Hatcher
development. The drainage problem is caused bv fill !sterly side of the Hatcher

All permits shall be applied for through the Public Works Department. An approved pernut is effutive for a
period of one (i) year from date of issue and may be renewed. All fees shall be in accordance with those fees
established by the Uniform Building Code or other applicable City adopted Resolutions or Ordinances.
Note: AU public improvements, when constructed, shal[ be maintained (by the respective individual(s) and/or
company responsible for the construction oj that pub/ic and/or private improvement in lhe respective
deve[opment) on a daily basis, or as needed, such that Ihey are free of mud and other construction debris
tracking from the sUe. Failure to comply wuh this requirement wiu result in the enforcement of Article III,
Specified Nuisances, Section 15-I6 (4) of the Ci1y of Wheat Ridge Code oJLaws.
MINOR EXCAVATION AND FILL PERMITS
1. 1-50 Cubic Yards: No permit is required for dumping or excavation of earth materials, which do not exceed
50 cubic yazds, provided, however, that any fill deposited is on namral terrain of less than three (3) horizontal
to one (I) vertical slope, or such fill is less than three (3) feet in depth and is not intended to support permanent
struc[ures, and in addition, such fill or excavation dces not obstruct or otherwise adversely affect any
drainageways. Should any of the above standards be exceeded, or a drainage way be affected, a permit shall be
required under the guidelines for No. 2.
2. 51'-500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 cubic yazds may be
allowed with a permit approved by the City Engineer. All applications aze to be submitted on the appropriate
completed applica[ion form and shall be accompanied by the appropria[e fee and sketch plan indicating the
fo]lowing infwmation before the permit will be issued.
A. I,ocation and dimensions of all property boundaries and strucmres on the site.
B. I,ocation and extent of azeas to be filled and/or excavated.
C. I,ocation of existing and proposed drainageways, irrigation ditches, etc., and indication of how and where
his[oric run-off wi11 be maintained on and through the site.
D. Cross-section azea to be £lled and/or excavated indicating original slope, new slope and depth of fill.
E. Statement that indicates the proposed use or purpose for said fill or excavation.
F. Relative elevation of adjacent properties.
G. Erosion conVOl plan showing placement of control devices such as hay bales, etc.
3. 501-20,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic yazds, but
dces not exceed 20,000 cubic yards, may be allowed by a pettnit issued by [he City Engineer after review of
an application and supporting information. The following information shall be submitted with Ihe required
application form:
A. A site plan, prepared and signed by a Colorado registered professional engineer, at a scale of no less than
1 inch to twenty feet (1:20) which illusvates the following:
B. L.ocation and dimensions of all property boundaries and swcmres on the site.
C. I,ocation and extent of areas to be filled and/or excavated.
D. Location of existing waterways and drainage courses indica[ing any changes. (for a site containing an
established irrigation ditch, a letter of approval from the appropriate ditch company shall be required).
E. I.oca[ion of existing and proposed points of ingress.
F. Location and extent of existing vegetation, proposed changes in such vegetation and methods of
rehabilitation on site vegetation after earthwork opera[ions aze complete.
G. Erosion conVO] plan.
H. Grading plan with existing (dashed lines) and proposed (solid lines) ground contours with contour
intervals of 2 feet and spot elevations.
1. At least two cross sections (east to west and north to south) through the site showing depth of fill and/or
excavation.
J. A drainage report may be required if site runoff characteristics are changed.
K. Relative elevations of adjacent properties and swctures.
L. Statement of purpose of intended fill and/or excavation.
4. Performance Standards: The following provisions shall apply to all Minor Excavation and Fill Permits:
A. Rehabilitation: VJithin thirty (30) days after cessation of filling and/or excavation, rehabilitation for the
site shall have been comple[ed in accordance with the approved plans. Rehabili[a[ion shall consist of
leveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable
to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with [he approval of the City Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the terms "garbage, vash
or junk" as defined in the Wheat Ridge Code of Laws, Section 15-4."
In no case shall debris or contaminates identified or classified as hazardous waste by local, state or federal
agencies be used as fill in any fill areas within the City of Wheat Ridge.
C. Excavation and/or fill areas shall be gaded to facilitate weed con[rol until final grades are set and site
rehabilitation and use occur (must be leveled with side slopes not to exceed 3 to 1).

In the event that landscaping required by Wheat Ridge Code of Laws, Section 26-502
and/or as shown on an approved landscape plan is not installed

or do other such work to accomplish that purpose as may be necessary, provided that the
City of VJheat Ridge shall first give notice in writing to the contractor, developer or
owner of its intent to do so.
If the City of Wheat Ridge exercises its right to perform work of any nature, including
labor, materials and use of equipment either by force account or contract, the City shall
have the absolute right to withdraw the escrow funds to complete said landscape
improvements. The only precondition to the City's right to withdraw the escrow funds
for this purpose shall be a letter from the Planning and Development Director, stating that
the landscape improvemen s have not been completed or provided and that the

TERMS AND CONDITIONS
As applicant for a building permit in the City of Wheat Ridge, I do hereby agree to the terms and
conditions set forth below for the issuance of a Certificate of Occupancy in connection with this
building permit. The issuance of a Certificate of Occupancy requires:
1) The completion of all required landscaping and related site improvements. Inspections
are performed by the Planning and Zoning Division.
" 2) The compleGp of site drainage/grading requirements per the approved site grading
plan and/or fina(rainage report and plan, if such report and plan is applicable. For all
residential and nonresidential projects with an approved final drainage report and plan, a
letter of certification is required from the civil engineer of record. Inspection are performed
by the Public Works Departrpent
3) The completion and acceptance by the City of Wheat Ridge of all required public
improvements, or a Development Covenant or cash escrow may be required in lieu of
construction, as determined by the Public Works Department. The Public Works
Department performs public improvements inspections.
4) The completion and approval of a Certificate of Occupancy Application form and final
inspections. Inspections are performed by the Building Division.
All the above items must be completed and approved by Planning and Zoning, Building and
Public Works before a Certificate of Occupancy is issued. Final Inspection by the Building
Division does not constitute authorization of a Certificate of Occupancy nor permission for
occupancy. Occupancy of the structure is not permitted until the Certificate of Occupancy
is issued. (Uniform Building Code, Section 109)
The City is not responsible for any real estate closings or other agreements concerning the
property which may be affected by failure to complete the above items and obtain a Certificate of
Occupancy.

50 cubic yards, provided, however, that any filt deposited is on natural terrain of less than three (3) horizontal
to one (1) vertical slope, or such fill is less than tlvee (3) feet in depth and is not intended to support permanent
swctures, and in addition, such fill or excavation dces not obswct or otherwise adversely affect any
drainageways. Should any of the above standards be exceeded, or a drainage way be affected, a permit shall be
required under the guidelines for No. 2.
2. 51-500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 cubic yazds may be
allowed with a permit approved by the City Engineer. All applications are to be submitted on the appropriate
completed application form and shall be accompanied by the appropriate fee and sketch plan indicating the
following infonnation before the permit will lx issucd.
A. Location and dimensions of all property boundaries and strvctures on the site.
B. I,ocation and extent of areas to be filled ancUor excavated.
C. Location of existing and proposed drainageways, irrigation ditches, etc., and indication of how and where
historic run-off will be main[ained on and through the site.
D. Cross-section area to be filled and/or excavated indicaling original slope, new slope and depth of fill.
E. Statement that indicates the proposed use or purpose for said fill or excavation.
F. Relative elevation of adjacent properties.
G. Erosion control plan showing placement of contro► devices such as hay bales, etc.
3. 501-20,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic yazds, but
dces not exceed 20,000 cubic yards, may Ue allowed by a permit issued by the City Engineer after review of
an application and supporting information. The following information shall be submitted with the required
application form:
A. A site plan, prepazed and signed by a Colorado registered professional engineer, at a scale of no less than
1 inch to twenty feet (120) which illustrates the following:
B. Location and dimensions of all property boundaries and swcmres on the site.
C. Location and extent of areas to be filled and/or excavated.
D. Location of existing waterways and drainage courses indicating any changes. (for a site containing an
established irrigation ditch, a letter of approva] from the appropriate ditch company shall be required).
E. Location of existing and proposed points of ingress.
F. I,ocation and extent of existing vegetation, proposed changes in such vegetation and methods of
rehabilitation on site vegetation afrer earthwork operations are complete.
G. Erosion conVOl plan.
H. Grading plan with existing (dashed lines) and proposed (solid lines) ground contours with contour
intervals of 2 feet and spot elevations.
1. At least two cross sections (east to west and north to south) through the site showing depth of fill and/or
excavation.
J. A drainage report may be required if site runoff characteristics aze changed.
K. Relative elevations of adjacent properties and swcmres.
L. Statement of purpose of intended fill and/or excavation.
4. Per[ormance Standards: The following provisions shall apply to all Minor Excavation and Fill Permics:
A. Rehabilitation: Within thirry (30) days after cessation of filling and/or excavation, rehabilitation for the
site shall have been completed in accordance with the approved plans. Rehabilitation shall consist of
leveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable
to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the terms "gazbage, trash
or junk" as defined in the Wheat Ridge Code of Laws, Section 15-4."
In no case shall debris or contaminates identified or classified as hazardous waste by local, state or federal
agencies be used as fill in any fill areas within the City of Wheat Ridge.

K. Relative elevations of adjacent properties and structures.
L. Statement of purpose of intended fill and/or excavation.
4. Pertormance Standards: The following provisions shall apply to all Minor Excavation and Fill Permits:
A. Rehabilitation: Within thirty (30) days after cessation of filling and/or excavation, rehabilitation for the
site shall have been completed in accordance with [he approved plans. Rehabilitation shall consist of
leveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable
to Ihe City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the terms "gazbage, vash
orjunk" as defined in the Wheat Ridge Code of I,aws, Section 15-4."
In no case shall debris or contaminates identified or classified as hazardous waste by local, state or federal
agencies be used as fill in any fill areas within [he City of Wheat Ridge.
C. Excavation and/or fill azeas shall be graded to facilitate weed control until final grades are set and site

1) The building address numbers shall be posted on a temporary basis and shall be
permanently affixed to the building in a minimum of 4 inch numbers on a contrasting
background. UFC 97 901.4.4 Amended.
2) All-weather fire departrnent access roadways, minimum of 24 feet of unobstructed width,
capable of supporting the imposed loads of 52,000 lb. Fire apparatus are to be installed
prior to above grade construction. UFC 97 9013 Amended., 8704.2 Amended.
3) "No Pazking Fire Lane" signs may be required to be installed identifying such roads.

Dear Mr. Moore,
This letter is to inform you that the Final Drainage Report, Grading & Erosion Control Plan, and Civil
Conshuction Plans for the above referenced project have been reviewed and approved for construction.
please be aware of the following items regarding the construction of the project:
1. Erosion control for the project shall be placed in conformance with the NPDESBMP requirements
as set forth by the State, the Drainage & Erosion Control Plan as approved by the City of Wheat
Ridge, and shall be maintained as needed during the course of construction.
2. All drainage improvements shall be conskucted in conformance with the approved Final Drainage
Report and Plan.
3. Upon campletion of the drainage improvements the Engineer-of-Record, Mr. Dauid E. Moore, P.E.,
shall provide to the City of Wheat Ridge a Drainage Certification letter stating that the grading and
the drainage shall function as defined in the Final Drainage RepoR and Plan, and the site has been
accurately surveyed to confirm the construction was completed in accordance with the approved
documents. The Certification Letter shall be written and stamped by the Engineer-of-Record who
preparec( the Fina1 Drainage Report, and shall be submitted for review and approval by the City prior
to issuance of the Certificate of Oceupancy.
4. It will be the responsibility of the of the contractor for the project to repair any damage to the
existing public improvements on West 50~' Avenue as a result of related construction traffic in the
azea. Also, the contractor will be responsible for maintaining West 50`h Avenue on a regulaz basis
such that it is free of construcrion debris and tracking from construction traffic accessing the site.
5. It will be the responsibility of the developer/owner, to provide the necessary testing, as applicable
for the scope of this project, for subgrade compaction and other related material tests for those
unprovements to be constructed within the public Right-of-W ay.
(SEE ATTACHED MATERIAL SAMPLING & TESTING REQUIItEMENTS)
6. Prior to any construction of the public improvements, the necessary Right-of-Way Construction
Permit(s) and respective licensing will need to be submitted for processing by the City. A detailed
descriprion of the work to be completed within the Right-of-Way and a Traffic Conrtol Plan shall be
submitted for review and approval prior to the issuance of the ROW Construction Permit(s).
7. A copy of the NPDES Permit Application has been previously submitted and acknowledged by the
City of Wheat Ridge. A copy of the NPDES Permit shall be submitted to the City prior to issuance
of the GradinglLandfill Permit.

MATERIALS AND TESTING REQUIREMENTS
FOR
CONSTRUCTION OF PUBLIC IMPROVEMENTS
DESCRIPTION
Materials sampling and testing for public improvements shall be performed by an independent materials
testing company at the expense of the developer, and/or utility district. Unless otherwise designated, all
referenced specifications, standazds or policies shall be the latest edition as revised or updated by
approved supplements published and issued prior to the date of the building permit.
REQUIREMENTS
All materials sampling and testing shall be performed by certified, experienced and qualified materials
testing technicians who work under the supervision of a registered professional engineer in the State of
Colorado. All materials sampling and testing equipment shall be serviceable and have current calibrated
certifications.
Soil classifications and moisture-density curves shall be provided to the Department of Public Works
inspector prior to in-place density testing. Materials testing technicians shall furnish copies of failed test
results to the inspector as promptly as the results become available. On a weekly basis when testing is
being performed, the developer shall fumish the inspector with copies of all test results taken during the
prior week and a cover letter, signed by the supervising registered professional engineer, which
summarizes the results and discusses any failed tests or inconsistencies.
The City materials testing requirements are provided in Table 720-1. All testing procedures of
verification and central lab requirements shall be as specified in the Frequency Guide Schedule of the
Colorado Department of Transportation Field Materials Manual. One test is required for any fraction of
the specified frequency. The reference to Section 203.07 in the table is from the Colorado Deparhnent
of Transportation Standard Specifications for Road and Bridge Conshuction.

Please make the following corrections and/or revisions to this submittal:
1. The total number of spaces on your site plan comes to 76. Pursuant to Section 26-501D.9. The
required number of handicapped parking spaces for your project is 4. One in every 8 handicap
accessible spaces must be designated "van-accessible" and shall be served by an access aisle a
minimum of 8 feet in width. Each handicap space shall be marked with a freestanding sign using
the standard uniform words and/or symbols that signify the space as parking for the handicapped
only. The handicapped symbol shall also be painted on the pavement.
2. On Lot 4 and Lot 5, the "future proposed buildings" will require an amendment to the L&K
Planned Industrial Development when development of those buildings begins. The future area
for the proposed building will need to be planted with sod or seed to minimize soil erosion until
the buildings are completed. Native seeding is okay, but weeds are not allowed. If you decide to
seed you will need to escrow for the cost of seeding. This will need to be done prior to issuance
of a Certificate of Occupancy.
3. Please label the individual lots as Lot 4, Lot 5, and LoC 6 respectively.
4. If you are planning on constructing any signs please show the placement of the signs on the site
plan, with proposed setbacks from property lines. Also include a detail of the sign showing size
and height.
5. No Certifica:es of Occupancy will be issued until landscaping is installed along W. SOth Avenue.
6. The final approved landscaping plan for this development requires 1 tree or shrub per every
1,000 square feet of lot area. The total area of this development is 148,102 square feet. The
required r.umber of trees and shrubs is 149. Your table totals 65 trees and shrubs, but your site
plan totals 60. Please revise to meet the minimum requirement. If there are existing trees on the
property that you are going to retain, please show them on the landscape plan.
7. All outside storage must be screened by a 6 foot view obscuring fence. Please ]abel on the site
plan where any proposed fences will be placed, along with a description of the type of fencing to
be used.

Dear Michael:
In response to your comments on Hatcher Construction dated August 28"' 2003 we have the following
comments.
1. We have added three H.C. spaces totaling four, one being van-accessible with an &foot
access aisle. There shall be a sign in front of each designatin m as H.C. parking.
There shall be a painted symbol on the pavement of each space ~G~? cr}}ae-~ A "^~^"i6
2. We are not planning to include future construction bullding at this time so an amendment
to the L&K Planned Industrial Development is not necessary at this time. Native seeding
will be planted and maintained until buildings are proposed some time in the future.

NOTES
1. The test holes were drilled on Aprii 7, 2003, using a 4 inch diameter, continuous flight, solid
stem auger.
2. (41 /1 2) Indicates location of penetration test as performed in this area. (41 /1 2) means that 41
blows with a 140 pound hammer, falling 30 inches, were required to drive a two inch inside
diameter sampler 12 inches.
3. The stratification lines represent the approximate boundary between soil types; the transition
may be gradual.
4. The locations of the test holes are approximate and were determined by pacing from known
building corners staked by representatives of Alliance Development Services and using site plans
made available to this firm. The elevations of the test holes are approximate and were
determined using site plans made availabte to this firm. The locations and efevations of the
hoies should be considered accurate only to the degree implied by the methods used.
5. Water level readings were made in the test holes at times and under conditions stated. This
data has been reviewed and interpretations made in the text of this report. It must be noted,
however, that fluctuations of the ground water depth may occur because of seasonal variations
in rainfall, temperaicre, and c:her fac.ors v~hich may differ from those a: .he time ,he
measurements were made.

Building Plan Review Comments
Dear Darin:
In response to your comments on Hatcher Construction dated August 26, 2003 we have the following
comments.
1. This comment does not apply to the civil plans; the electrical engineer will address this
comment.
2. We have added H.C. parking as requested.
3. Soils and Materials addressed the ground water in the soils report. See page 5 of the report
concerning Ground Water and Soft Soils, the site has been raised as high as possible. The
recommendations shall be followed and SMC shall be on site to give any reeommendations at
the time of construction. See page 10 for Below-Grade Construction recommendations.
4. The water elevations in the test holes are located in the building area. A pothole was dug in
the area of the retention pond and a water surface elevation was surveyed to be 5368.75, this
was the elevation used in the design of the pond. The drainage engineer will address this in
the report as requested.
5. Floor and roof plans will be submitted with the next submittal.
6. A one-hour, non-combustible construction shall be installed at this location.
7. We shall include all redlines with resubmitted.

1. Change NEC on title page to 2002 ediGon and ad' t plans accordingly.
2. Due to the number of parking stalls proposed, handicap parking spaces are required minimum
with one being van-accessible with 96-inch access aisle.
3. Provide letter from soils and structural engineer stating minimum separation required between ground
water and bottom of footings.
4. According to the soils report there is ground water at elevations 5370 to 5373, high point of detention
area is 5370. Have drainage engineer verify detention area and submit findings.
5. Floor and roof structural plans are not part of submittal.
6. Due to the distance between the proposed and future structure, the east wall of this building will be
required to be constructed as one-hour, non-combustible construction.
7. Correct redline plan and resubmit redlines with resublittal.
