1. This permit was issued based on the information provided in the permit application and accompanying plans and
specifications and is subject to the compliance with those documents, and all applicable statutes, ordinances,
regulations, policies and procedures.
2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must
be made in writing and received prior to the date of expiration. An extension of no more than 180 days made be granted
at the discretion of the Chief Building Official and may be subject to a fee equal to one- half of the original permit fee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to
the standard requirements, fees and procedures for approval of any new permit. Re- issuance or extension of expired
permits is at the sole discretion of the Chief Building Official and is not guaranteed.
4. No work of any manner shall be performed that shall results in a change of the natural flow of water without prior
and specific approval.
5. The permit holder shall notify the Building and Inspection Services Division in accordance with established policy
of all required inspections and shall not proceed or conceal work without written approval of such work from the
Building and Inspection Services Division.
6. The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of
any provision of any applicable code or any ordinance or regulation of this jurisdiction. Approval of work is subject
to field inspection.

As directed by the Council at its July 15 Study 5ession, 1 have revised
Sec2ion 5.45, as it appears on pa9es 19 through 21 of Item No. 4 in Yhe Council's
July 22 mesting packet. Because of the rtumder of changes to be made, and the
awkward length of the original paragraphs, t have reorganized the material as a
"repealed and I'eenacted" Sectfon 5.45. !n comparing the attached d1'aft to that
appearing in youe Council packet, you will observe that all af fhe languago iniended
to be included in the Section has 6een included samewhere in my draft. In addition,
I have made the following changes, as directed by the Council_
7. Existing single family hames are exempted from the curb, gutter
and sidewslk requirement.
2. Yhe former lseperatel provisions cancerning the 1 QO°h esaYOw
requirement and the limit on escrow to 10° of total building
permit value have been combined in a single subsection.
3. The list of circumstanees under which it is permitted to create an
escraw fund for the fiuture constructian of the public
imprvvements, rather than requiring that they be constructed
currently, has been streamlined and made into a complete
santence.
q. The appeal process has peen restored to the origlnal language,
which requires that appeals go to the City Council, rather than to
. the Board af Adjustment.
5. In ligtit af the escrow requirements in new subsection (e) and
Caunoil's comments, the requirement of a development agreement

5ec. 5.45 Public improvements required. Repeaf and reenact entire section to read

(a) General requirement
Applioations for building permits shaA be reviewed by the
Department of Public Works to determine whether the proposed construction will
require the installation or constructian of public improvements, including, but not
limited to, paving, curbs, gutters, sidewalks, drainage facilities, or other public
improvements as may be required by ordinance or by the subdivision regulations.
(b) Exemptions
Gurbs, gutters and/or sidewalks shalt not be required in association
with any of the following developments:
(1) Remodeling of an existing building;
(2) Construction of addition to an existing single family
residence; or
(3) Construction.upon any street designated as an exempt local
street in the City's comprehensive plan.
(C) Procedure
The Department of Publlc Works shall determine whether pubfic
improvements, as described at subsection,(a) of this section 6.46 are necessitated by
Yhe proposed canstruction based upon the specific adverse effects created by that
construation, including but not limited tv drainage, Yraffic, street continuity, subdivi-
sion regulation raquirements, relocation ar undergrounding of u#ilities, street widening,
andlor roadway construction. Upan making a determination that puhlia improvemen#s
are required, the Departmeht of Public Works shall so inform the Chief Building
Ui'ficial, and a condition shall he inserted in the building permit which shall require the
constructian of such public improvements !ay ths property owner and the dedicatiun
thareof to the City. All suoh public improvements shall be constructed in full
complianae with the City's Enginearing Division regulatidns, design standards and
construction specifications. At the time of issuance of a building pormit in association
with which public impCOVements are or will be required under this section 5.45, the
applicant for such building .permit shal{ be provided a copy of this section 5.45 at no
charga. , •
(d) Cost
The cost of any puqlic improvements required to be construCted
under this section shall be borne by the property owner, and the construction thereaf
shall be at the sole Gost, risk and expense of the property owner, subject to the
provisions of applioabfa Ci#y ordinanaes, regulations or policies. Suhject to the
requirements of subsection (e) of this sectian, failure ta construct any such reGuired

"fhe Department of PubGc Works may determine, after
consideration of the factors set forth in this subsection Sel, that public improvements
required by this section 5.45 may be constructed subsequent to the issuance of a
certifiaate of occupancy for tha property for which the building permit was issued, if
either of the following two conditions are met:
i11 Less than one-half of the praperties on both sides of the
frnnting strset, for a distance of 500 feet on either sida of
the (extended) lot lines of the property in question, have in
existenae, curbs, gutters and sidewalks, ar
(2) The installation of curhs, gutters and sidewalks would, in
the vpinion of the Department of Public Works, be
impractical, ecanomically unfeasible or not in the best
interest of the City prior to issuance of the certificate of
occupancy.
In the avent the pepartment of Public Works determines that the public improvements
may be constructed subsequent to the issuance of a certificate of occupancy based
upon the satisfaction of one of the canditions listed above, the property owner shall
be required to post in an escrow account with the City an amount equal to 900% of
the estimated cost of the required public improvements. The cost estimate shall be
prepared by the Pubiic Works Engineering Division, based upon current constructions
costs p(or to lssuance of a building permit. Notwithstanding the 1000/0 requirement,
the amount of the required escrow shall not exceed ten (10) percent of the value of
the proposed eanstruction or determined by the building permit.
(f) ADOea1
Any owner, cantractor or developer who is aggrieved by decisian
of the Department of Public Works requiring installatian of public improvements or the
escrow af funds as required bY this seation 5.45 shall have the right to appeal the
Department's determination to the City Council by filing a written request far a pubtic
hearing befare tha City Council, which written request must be raoeived by the City
Clerk no (ater than thirty (30) days after the Pepartment of Public Works'
determination. The appeal shall be decided by the City Council following public
haaring after notice ta all interested paCties by posting, and shall be conducted
pursuant to the procgdurss for public hearings as specified in the subdivision
regulations.
