If Owner plans to use the proceeds of a property and casualty insurance policy to pay for the roofing work, Owner may rescind this wntract within 72 hours after you receive written notice from the property, and casualty insurer that Owner's claim has been denied in whole or part. THE OWNERS RIGHT OF RESCISION DOES NOT APPLY WHEN THE PROPERTY AND CASUALTY INSURER DENIES, IN WHOLE OR IN PART, A CLAIM RELATED TO A REQUEST FOR SUPPLEMENTAL ROOFING SERVICE AT THE TIME OF THE INITIAL ROOFING INSPECTION OR THE EXECUTION OF THE INITIAL ROOFING CONTRACT. However, the Company is entitled to retain payments or deposits to compensate it for roofing work actually performed in a workmanlike manner consistent with standard roofing practices. Upon timely rescission, the Company shall refund all unused money within ten days. 9) FOR NON -INSURANCE CLAIMS: When the Company is performing work that is not the subject of an insurance claim, the Owner shall pay the Company one-half of the total contract estimate upon delivery of material, and the remaining unpaid balance shall be due and payable to the Company within 72 hours from the approval date by the local building inspector. 10) If this contract is cancelled by the Owner later than (3) days from execution, the Owner shall pay to The Company twenty percent (20%) of the contract price as liquidated damages, not as a penalty, and The Company agrees to accept such as a reasonable and just compensation for cancellation. In addition, if material has to be reordered or restocked because of a cancellation by the Owner, there will be a restocking fee equal to fifteen percent (15%) of the contract price. 11) Replacement of deteriorated decking, pipe jacks, ventilators, flashing and other materials necessary to bring the new roof to city and county code, unless otherwise stated in this contract, are not included and will be charged as an extra on a time and material basis. 12) The Company's Limited Warranty does not cover damages to roofs caused by lightning, gale (50 mph) winds, hurricane, tornado, hailstorm, impact of foreign object or other violent storm casualty, or damage to roofs due to settlement, distortion, failure or cracking of the roof deck, wall or foundation of a building. 13) The Company will not be held liable for any structural movement, settling, cracks in drywall, cracking or breaking of driveway (unless due to negligence) during the roofing or loading process, the minor scratching or denting of rain gutters. 14) All pictures, wall hangings, lights, collectibles, etc., both indoors and out MUST be secured by Owner. Any damage to personal items during installation will not be the responsibility of the Company. The Company will also not be responsible for nail damage to tires, pets, etc. Pets should not be left unattended during installation. 15) Any alteration or deviation from specifications involving extra cost will be executed only upon written orders, and will become an extra charge over and above the estimate. 16) The Owner is to carry fire, tornado and other necessary insurance.
