First I will address the elevated deck in the back of the house. Shortly after signing our second lease in 2005 my husband, Brian, brought to the attention of Robert the terrible condition of the deck. Brian offered to rebuild the deck for free if the Heald's would but the material. Robert declined stating that he did not think the deck was bad enough to need repair. At that time we decided that we were no longer going to use the deck aside for grilling, and that our children would no longer be able to play on the deck. It was clearly rotted and many sections of the surface would sink in when walked on and the guard rails were so far apart that my 5yar old at the time almost fell through them. Brian offered to rebuild the deck another time before it got cold, again the Heald's declined his offer. On July 221' of 2006 Robert came over to place a "For Rent 'sign in front of our house for the property next door. He and I had a confrontation about the condition of the yard at that time and I had told him to talk to my husband when he got home. When my husband arrived home later that day he and Mr. Heald had a confrontation out front. At that time Brian took Mr. Heald around to the back and showed him the condition of the deck and told him that we thought it was a danger to us and our children. Mr. Heald agreed to rebuild the deck and left. Soon after he left Mr. Heald came back with some scraps of wood and some tools and proceeded to take down the deck. He took down half of the deck and realized the whole deck would need to taken down and totally rebuilt. For this he knew he would need a permit and said he would be back when he got the permit. At that time he tore down the stairs and put a railing up on one side. Mr. Heald has been to the property next door many times and has never taken steps to fix the hazard that he left in the back. This has cut off the second fire exit from the upper level of the bi-level house and with 4 young children in the house we are very concerned for our safety. Last I would like to address the concern of the possible mold growing in our inf arcs room in the lower level on the house. Last summer after watering the lawn I went down stairs to find the wall and floor of one of the bedrooms soaked. At that time I removed the hose and call Mr, and Mrs. Heald to tell them about the situation. Mr. Heal told me what he thought bad happened and left it at that. Now a year later nothing has been done to fix the leak of the drywall and carpet inside. Brian has brought it to Mr. Heald's attention since then and he does not have any concerns. We see evidence that there is mold growing on the wall and carpet in the bedroom. Brian showed Mr. Heald this and he didn't think there was mold but he would patch the drywall. This was several weeks ago and nothing has been done- l am truly concerned for my family's safety and well being as long as these problems are not addressed. 1 would appreciate any help you could offer.
