All changes and deviations in the work ordered by the customer must be in writing. The contract sum being increased or decreased accordingly by the Company. Any claims for increases in the cost of the work must be presented by the "Company" to the Customer in writing, and written approval of the "Customer" shall be obtained by the "Company" before proceeding with the ordered change or revision. 8. The agreement cannot be cancelled once material has been delivered to your job site, without mutual agreement of both parties. 9. The "Company" will not be responsible for slight scratching or denting of gutters, damaged flowers, minor broken branches on plants and shrubbery. 10. The "Company" agrees to re -execute any work which does not conform to local codes and specifications, warrants the work performed, and agrees to remedy any defects resulting, from faulty workmanship which shall become evident during a period of five years after completion of the work All material defects shall be handled by the Manufacturers' warranties. 11. The "Company" is not responsible for damage below the roof due to leaks caused by excessive Wind greater than 60mph, ice damming, hail, at any time during the construction process, or the "Company's" warranty period. 12. In the event the "Company" is delayed in the prosecution of the work by acts of God, fire, flood or any other casualties; or by labor strikes, late delivery of materials, or by neglect of the "Customer"; the time for completion of the work shall be extended the same period as the delay occasioned by any of the aforementioned causes. 13. The "Company" carries workers' compensation, automobile and commercial general liability (bodily injury and property damage) insurance. A Certificate of Insurance identifying our insurance carrier and the types and amounts of coverage and our insurance contract information and can/will be provided to the "Customer" and is incorporated herein by reference and should be considered as part of this contract 14. Neither the "Customer' nor "Company" shall have the right to assign any rights or interest occurring under this agreement without the written consent of the other, nor shall the "Company" assign any sums due, or become due, to him under the provisions of this agreement 15. The "Company" and the "Customer" agree to settle all disputes in accordance With the laws of Colorado and the county in which the agreement is executed. 16.
