REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. Remove enitre walls between existing dining room and addition and existing bedroom and addition and support existing roof (final design by engineer) Install custom provided door into sewing room through existing exterior wall. Install new french door and doggie door in dining roor addition. Remove window and extend opening to install door in rear of existing garage. Create opening and install existing front door from existing laundry closet to garage. Extend hose bibb to back yard. Remove existing furnace and asbestos ducting and install new furnace with A/C and extend new ducting to addition. Install electrical per specifications including new sub panel. Drywall addition. Move sink to new location and install new ice maker line for refridgerator. Patch concrete around driveway. Remove existing front porch deck and rail. Pour new concrete porch and reinstall existing posts. Paint kitchen and porch posts. Siding: Remove existing siding from house and install new vinyl siding on entire existing house and addition, but not existing garage. Wrap all existing and new fasica with aluminum and install vinyl soffit on existing and new. SPECIFICATIONS: We hereby propose to furnish all materials, except as noted, and perform all labor necessary for completion of the project as described in the attached Project Specifications details, and drawings. Contractor may substitute materials without notice to the Owner in order to allow work to proceed, provided that the substituted materials are of no lesser quality than those listed in the specifications. EXCLUSIONS: Building permit fees, Engineering fees, Costs associated with design changes from engineer, Containment of lead based paint if necessary Page 2 PAYMENTS: The Owner agrees to pay any and all payments according to the payment schedule detailed below. Should said payment(s) not be made, or if satisfactory arrangements for payment have not been made, the Contractor reserves the right to stop all work until such time as payment is rendered or satisfactory payment arrangements have been made. Contractor is not responsible for delays due to back order materials or circumstances beyond our control. We propose to furnish and install the above complete in accordance with the above specifications for the sum of $8,880-47 dollars. Payment to be made as follows: $8,000.0 upon final building inspection, and $880.47 balance upon substantial completion, plus any agreed upon extras as they are completed. The foregoing terms, specifications and conditions are satisfactory and are hereby agreed to. Contractor is authorized to do the work as specified and payment will be as outlined above. The Owner upon signing this agreement represents and warrants that he/she is the owner of the premises, and that he/she has read this agreement and agrees also to pay, after thirty (30) days of completion, a 1-1/2% service charge per month on any unpaid balance. FINANCE CHARGES: Any contract payment or invoice amount not paid by the due date shall be considered delinquent and shall bear interest at the rate of one and one-half percent (11/2%) per month on the outstanding balance. If steps shall be taken, whether by suit or otherwise, to collect any sum including interest which has become delinquent, the Owner agrees to pay all costs thereby incurred, including any reasonable collector's fees, attorney fees, and court costs. CHANGE ORDERS: The Owner may, from time to time during the progress of work, request changes in the work specified above. No additional work shall be performed by the Contractor unless written authorization to proceed with such work including the price for such work shall be issued by Owner. If the Owner agrees to an appropriate increase or decrease in the contract amount because of the requested change(s), the work shall be performed. Any alteration or deviation from above specifications involving extra labor and/or material costs will become an extra charge over the agreed amount. Additions are billed at $75 per hour plus materials plus 30%. 50% of all change orders will be paid upon signing and balance at completion unless agreed upon otherwise in writing. Additional charges for the changes are due and payable prior to the work being performed, with payment to be received no later than the next scheduled contract payment. The completion date stated in this Agreement shall be adjusted according to the change(s) mentioned above, and the original completion date shall become null and void. All work that the customer has agreed to perform, but that has not been performed by the customer according to the agreement shall be performed by Contractor. Page 3 GUARANTEE/WARRANTY: The Contractor hereby guarantees that the work shall be free from defects in labor for one (1) year from the date of Completion of the project. Materials are warranted as specified by individual manufacturers and not by the Contractor. Conditions that VOID Warranty Damage due to "Acts of God" (excessive wind, rain, snow. Hail, ice and lightening; Improper use of chemicals; Vandalism or animals; Damage due to new construction activities; Damage due to fire; Work performed by an outside contractor or homeowner. Conditions of guarantee do not apply if Contractor is not paid in full for all work completed, or if work is presently subject to arbitration or litigation. Noncompliance with the basic maintenance requirements may be cause for termination of warranty. Materials provided by owner and installed by Contractor are not covered under guarantee/warranty. SCHEDULING: All work scheduling shall be at the discretion of the Contractor as to time, day, month, etc. Contracted items will be given priority over time and material, or extra work in order to remain on established schedules. The Contractor shall not be held liable for delays in completion of contracted items, due to, but not limited to: Acts of God; acts of Owner; weather conditions; material shortage; acts of public utilities; or any other unforeseen items beyond the reasonable control of the Contractor. USE OF SITE: The Contractor shall be allowed reasonable access and use of site and confine all operations within the limit of the site to all applicable codes, ordinance and law without encumbrance of equipment or materials. The site shall remain reasonably accessible and usable by Owner at all times. Owner to enter work site at his/her own risk, this includes all persons and pets. Contractor not to be held responsible or liable for injury caused by construction operations, equipment and/or materials on-site. BUILDING CODES/HOA/GOV: All work performed under this agreement shall comply with applicable building codes. Any additional work required by the Building Department beyond the agreement of this contract is not the responsibility of the Contractor. Owner is responsible for obtaining approvals from HOA, City, State and other governing parties for all items related to construction. If elected, the contractor will provide these administrative services on behalf of the homeowner for a fee. PETS: Care and protection of pets during construction period is the responsibility of the homeowner. Page 4 INDEPENDENT CONTRACTORS: The relationship of Owner and Contractor created by this agreement shall be that of independent contractors and not one of joint venture, partnership, or employment. SUBCONTRACTORS/SUPPLIERS: The Contractor shall provide the names of all individual subcontractors and entities proposed to provide services or materials as a part of work completion upon request by Owner. The Owner shall be prohibited from contracting with any of the Contractors subcontractors and/or Suppliers during the course of work or during any dispute period. ASBESTOS AND OTHER HAZARDOUS MATERIALS It is the obligation of the Owner to determine if the structure covered by this contract contains asbestos and/or other hazardous materials. This proposal and contract does not include any provision (neither monetary provisions nor time schedule provisions) to cover the unforeseen hazards or additional work necessitated by removal of asbestos and/or other hazardous materials. If asbestos and/or other hazardous materials are discovered after work is already in progress, and if the asbestos and/or other hazardous materials represent a changed condition from those described in the plans and specifications, then the Contractor shall be entitled to additional compensation and an increase in time for completion of the project. If not listed in the proposal this will be an additional charge to the Owner. LEAD BASED PAINT (LBP): Renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be certified and must follow specific work practices to prevent LBP contamination. If the above scope applies the Contractor will test each potential area affected for LBP presence. If not listed in the proposal this will be an additional charge to the Owner. EXISTING CONDITIONS: We make no representation of existing conditions and assume no responsibility of condition for any of the Owner's equipment that may or may not be relocated or affected by our work, unless such conditions are caused by an act of negligence on our part. HIDDEN DEFECTS: It is acknowledged that hidden structural defects, or other defective components of the existing sidewalk, pavers, walkways and streets that replaced in order to properly complete the above -quoted work, and further acknowledge that the expense, if any, will be the responsibility of the property Owner. Page 5 DESTRUCTIVE INSPECTIONS: We have made thorough visual inspections of the existing structure and have made our analysis of the building methods and locations of covered systems. We have not made destructive inspections (that is, removing floors, walls, sidings, or other coverings) to reveal possible unknowns. In the event of a discovery of an unknown element (not an oversight on our part), any additional costs involved shall be cost incurred by the property Owner. UNDERGROUND INSPECTIONS: It is unknown by all parties, if any underground obstructions other than those stated in the text of this contract exist. If any such obstructions are found and must be removed from the site work area, the movement of which obstructions caused an increase in the cost of the contract, then those costs shall be incurred by the property Owner. This provision shall not apply to anticipated roots of trees. It is acknowledged that there has been no soil stabilization test done on the subject site. If a test is requested by the Owner, or by local authorities (for example, the Building Department), the Contractor shall have such a test performed by a licensed engineer. All costs involved in this testing shall be the responsibility of the property owner. DELIVERIES: It is acknowledged that the Contractor shall need to have heavy trucks picking up and delivering materials for the above described work including roll -offs. The property Owner acknowledges this fact and releases the Contractor from liability for possible damage to landscape; sprinklers; driveways (e.g. cracking or sinking); or sidewalks, where applicable. Unless specified in proposal, all site damage caused by construction activities will be repaired at homeowners expense. ADVERTISING: It is acknowledged that the Contractor shall install a yard sign to facilitate delivery of materials, as well as advertise. The Contractor shall have the right to photograph its work and use the photographs for promotional purposes in brochures and other advertising media. The Contractor shall not advertise client names unless prior approval has been obtained from the client. We shall add client names to the current Past Clients List, to be provided to potential clients, on request, as references. UTILITIES: The Contractor has not included costs for electrical, water, sewage, gas or telephone. It is understood that the Contractor shall have full use of the Owner's utilities during the process of construction and that the Owner shall bear the costs of those utilities above and beyond the contract price agreed upon in this contract. If elected by homeowner, Porta Potties/wash-station can be provided at an additional cost. MATERIALS SELECTIONS: We ask that selections of specialty and/or all other materials be provided within thirty (30) days of signing this contract. Providing selections after thirty days may extend the life of the project and may increase the Owner's contract price. We assume no responsibility for any delays caused by selection of materials that are not locally and immediately available. Page 6 OWNER RESPONSIBILITIES: As a homeowner, you can help to ensure that your project goes smoothly by doing the following: A) Designate one person to be the Owner's point of contact. This person shall be kept informed of the job's progress and shall be provided answers to questions as they arise. B) Direct all questions to the Contractor's Leadman and avoid trying to resolve questions or problems with workers, subcontractors, vendors, or other individuals on or off the job site. C) Make any and all changes to the original contract in writing and ensure that an "Additional Work Request" form is completed and signed before those changes are made. Owner is responsible for the protection, securing and relocation of personal effects that may be subject to damage or loss during construction period. Additional cost may be imposed if Contractor is required to move or protect items impeding ability to perform work. OWNER SUPPLIED ITEMS: All materials supplied by the Owner are to be on site by the specified date in the contract and provided schedule.
