This is to inform you the above referenced address has not been issued a certificate of occupancy
due to a fencing issue at the northwest corner of the property. Mrs. Cavness has been made aware
of this issue and has indicated the property to the west of your address will be pulling a permit for
the portion of the fence that is in violation.
As of today's date the permit for this fence has not been issued and the certificate of occupancy for
the address referenced above has not been issued. "
This letter is to inform you the above referenced address cannot be occupied until the certificate of

The followine items must be completed before a Certificate of Occunancv will be issued
PLANNING DEPARTMENT REOUII2EMENTS
1. Compliance with all relevant ordinances, resolutions, vaziances, approved site plan, etc.
2. Completion of all landscaping per plan and/or Zoning Code.
3. Completion of all pazking improvements and driveway connections per p]an and/or zoning code.
4. Completion of handicapped pazking spaces and signage.
5. Removal of all construcrion work trailers, materials and debris.
6. Removat of construclion debris from neighboring and/or surrounding sites.
7. Removal of all construction signs, banners, etc.
8. Sepazate permits must be obtained for permanent signs with the permit being approved prior to installation of signs.
9. Sepazate permits shal] be obtained for fences and/or retaining walls exceeding 48" in height, if not indicated on
approved plans.
PUBLIC WORKS DEPARTMENT•
1. Compliance with all relevant ordinances, resolutions, vaziances, special exceptions, etc.
2. Site grading to be completed for positive drainage away from building and if applicable, in compliance with the
overall gading plan(s).
3. A Drainage Certificarion Letter is to be furnished from the engineer of record stating that the paving and drainage
improvements have been installed per approved plans and specification.
4. If the proper[y is affected by S#reetscape requirements, any required Maintenance Agreement needs to be signed prior
to requesting a certificate of occupancy and any required escrow in lieu of flie conshvction of such items needs to be

6. If applicable, all City of Wheat Ridge approved surveying documents, such as the Final Plat and/or required sepazate
easement instrvments must be recorded at the Jefferson County Clerk and Recorders Office.

I have completed my inspection for completion of construction, and I have the following
comments:
1. The west side of the properiy adjacent to the driveway must be landscaped. Pursuant to
Section 26-502 of the Wheat Ridge Code of Laws, one hundred percent (100%) of the

2. A fence has been erected on the western property line and the southern properiy line of
this property and 6380 West 39~h Avenue. This fence was constructed without a valid
permit. The fence exceeds the maximum allowable height far a fence in the front yard.

2. 51-500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 cubic yards may
be ailowed wiih a perrnit approved by fhe Ciiy tngineer. Aii appiicaiions are io be sunmitted on the
appropriate completed application form and shali be accompanied by the appropriate fee.and sketch
plan indicating the following information before the permit will be issued.

G. Erosion control plan showing placement of control devices such as hay bales, etc..

3. 501-20,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic
yards but does not exceed 20,000 cubic yards may be allowed by a permit issued by the City Engineer
after review of an application and supporting information. The following information shali be submitted
with the required application form:
A. A site plan, prepared and signed by a Colorado registered professional engineer, at a scale
of no less than1 inch to twenty feet (1:20) which illustra4es the foliowing:
1. Location an dimensions of all property boundaries and structures on the site.
2. Location and extent of areas to be filled and/or excavated.
3. Location of existing waterways and drainage courses indicating any chenges. (for a
site containing an established irrigation ditch, a letter of approvai from the
appropriate ditch company shall be required).
4. Location of existing and proposed points of ingress.
5. Location and extent of existing vegetation, proposed changes in such vegetation and
methods of rehabilitation on site vegetation after earthwork operations are complete.
6. Erosion control plan.
7. Grading plan with existing (dashed lines) and proposed (solid lines) ground contours
with contour intervalsof 2 feet and spot elevations.
8. At Jeast two cross sections (east to west and north to south) through the site
showing depth of fill and/or excavation.
9. A drainage report may be required if site runoff characteristics are changed.
10. Relative elevations of adjacent properties and structures.
11. Statement of purpose of intended fiil and/or excavation.
4. Performance Standards: The following provisions shall apply to all Minor Excavation and Fill
Fermits:
A. Rehabilitation: Within thirty(30) days after cessation of filling and/or excavation,
rehabilitation for the site shall have been completed in accordance with the approved plans.
Rehabilitation shail consist of leveling, grading, landscaping or any combination thereof to
minimize potential erosion ancl be acceptable to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City
Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the terms
"garbage, trash orjunk" as defined in the Wheat Ridge Code of Laws, Section 15-4."
in no case shall debris or contaminates identified or classified as hazardous waste by local,
state or federai agencies be used as fill in any fill areas within the City of Wheat Ridge.
C. Excavation and/or fill areas shall be graded to facilitate weed control until final grades are
set and site rehabilitation and use occur (must be leveled with side slopes not to exceed 3
to 1).

The basement walls for the above referenced walls were designed and
reinforced to carry the lateral loads without the use of counterforts or
buttresses. The walls have the minimum reinforcing as required by ACI-318R.
This minimum reinforcing also exceeds the required reinforcing due to the
lateral loading. The spacing of the 1/2" anchor bolts @ 4'-0" o.c. that attach
the wood plate to the concrete wall should be decreased to 1/2" anchor
bolts @ 3'-0" o.c. maximum.

The submitted building plans have been approved by the Planning Department. You should
be aware of the following:
A. The front yard setback of 24.0 feet is permitted pursuant to Case number WA-02-08.
B. You should be aware that the driveway must be paued prior to issuance of certificate
of occupancy.
C. You should be aware that a minimum of twenty-five percent (25%) of this lot and a
minnnum of one hundred percent (100%) of the front yard shall be landscaped
pursuant to Secrion 26-502 (D) prior to issuance of certificate of occupancy. You
will also need to provide two (2) street trees of an acceptable species to be placed in
the front yard setback. You are not required to submit a landscaping plan, however, a
certificate of occupancy will not be issued prior to the completion of said
landscaping.

test, analyze, and report on the condition of the soils encountered only as these tests pertain to
the suitable design and construction of an appropriate foundarion for the proposed building
and/or residences to deternune the load bearing capacities of the soil.
THE PARTIES SPECIFICALLY AGREE THAT COLORADO ENGINEERING AND
GEOTECHNICAL GROUP. INC. HAS NOT BEEN RETAINED NOR WII_L THEY RENDER
AN OPINION CONCERNING ANY ENVIRONMENTAL ISSUES. HAZARDOUS WASTE.
HYDROGEOLOGIC. OR ANY OTHER KNOWN OR UNKNOWN CONDITIONS THAT
MAY BE PRESENT ON THIS SITE.
GENERAL:
This report presents the results of data obtained during the subsoil investigarion on
6390 WEST 39'HAVENUE, JEFFERSON COLTNTY, COLORADO.
CONCLUSION AND FOUNDATION RECOMMENDATIONS:
In general, test hole one consists of silt to the two foot depth, silty sand/sandy silt from
the two foot to the six foot depth, clayey sand from the six foot to the sixteen foot depth and
clayey silty sand below the sixteen foot depth. Free water was encountered at the sixteen foot
depth during the drilling operation. Test hole two consists of silt to the three foot depth, silty
sand/sandy silt from the three foot to the eight foot depth, clayey sand from the eight foot to the
eighteen foot depth and clayey silty sand below the eighteen foot depth. Free water was
encountered at the eighteen foot depth during the drilling operation. Both test holes were drilled
to a depth of twenty feet.
An open hole inspection is required atthis site. A satisfactory type of foundation system
will bear on the undisturbed natural soil (i.e. footings, wall on grade). The foundation shall be
designed for a maximum soil bearing pressure of 1,500 psf for all depths of the excavated area.
The active case equivalent fluid pressure is 35 pc£ All loose and disturbed soil shall be removed
before placing of the concrete for the foundation. The bottom of the foundation shall be a
minimum of three feet below finai grade for frost protection and below any organic material.
Settlement at ttus site may be up to one inch but will most likely be less than one-half inch. Soil

expansion at this site may be as much as one inch in some areas but will probably be less than
half of this amount. No foundation wall shall exceed twenty-five feet in length without utilizing
counterforts or buttresses unless otherwise designed by the foundation engineer.
SITE CONDITIONS:
At the present time this site is vacant. It is our understanding that a single fanuly
residence with a basement and garage is planned far conshuction.
FIELD AND LABORATORY INVESTIGATION:
Two exploratory test holes were drilled on September 24, 2002 at the site location shown
in Figure 1. These test holes were drilled with a four inch diameter power auger.
At specific intervals, the drilling tools were removed from the test holes and soil samples
were obtained with a two inch inside diameter spoon sampling tube. The depths at which soil
samples were talcen are shown on the Test Hole Log, Figure 2.
All soil sampies were carefully inspected and classified in the field and laboratory. The
samples were subjected to visual inspection and laboratory testing in order to evaluate the
physical and mechanical properties of the materials encountered. The natural moisture content
and the natural dry density was obtained from relatively undisturbed drive samples of typical
materialsencountered. Swell-Consolidation tests were also performed on typical samples of soil,
see Figure 3. These tests indicate the behavior of the soil upon various loading and wetted
conditions.
DESIGN AND CONSTRUC'TION DETAILS SLAB ON GRADE CONSTRUCTION:
The natural soils are suitable for the support of exterior concrete slabs, garage slabs, and
Uasement slabs. However, when these soils have a change in the moisture content, they may
consolidate in volume and shrink, thus lowering and cracking the concrete slabs, or they may
expand, thus heaving and cracking concrete slabs. The builder and future owners should be
aware of and understand that there is a definite risk of future damage with any slab-on-grade
construchon.
If the builder and future owners are willing to accept the definite risk of some damage due
to concrete floor slab movement, the following recommended details should be carefully
followed during conshucrion of the interior floor slabs. Experience with sunilar soil conditions

has shown that these details will help prevent wetting of the soils under the slabs and will
m;n;mize damage when wetting of the soil does occur.
1. Do not place a gravel layer beneath the concrete slab, unless specified by the foundation
engineer. The slab should be placed directly on the undisturbed natural soils, or well
compacted fill soil.
2. Separate the slab from all load bearing members and utility lines of at least one-half inch
to allow for independent movement of the slab. Provide a positive control or slip joint at
the construcrion joint between the slab and foundation walls.
3. Provide frequent scoring of the slabs to provide control joints for possible cracking of the
slab. Control joints should be placed to provide approximate slab areas of 150 square
feet, with a maximum dimension between joints of twelve feet.
4. A minimum void or clear space of one and one-half inches should be provided at the
bottom of all non-bearing partitions and furring strips placed over the concrete slabs, see
Figure 4. In finished room areas, all drywall and paneling should be stopped
approximately one and one-half inches above the top surface of the slab. This will allow
some space for upward movement of the slab before pressures are applied to the wall and
the upper levels of the structure. One should provide a one-half inch space at the bottom
of all door jambs to allow far limited movement of the floor slab. The owner is hereby
notified that it is their responsibility to maintain these void spaces:
5. In the event a hot water heating system is used, the piping should not be placed beneath
the concrete floor slab. In the event a forced air furnace is used, a two inch collapsible
connection should be provided Uetween the furnace and the heat ducts.
6. The soils that will suppurt :the concrete slabs should be keptmoist during conshuction
by occasional sprinkling of water and especially a day or so prior to pouring of the slab.
This procedure will help maintain the moisture content of the underlying soil.
7. In the event the builder or future owner desires to provide decorative graeel or bark
around the house, we have attached Figure 5 to illustrate one acceptable method of
installation. The method will prevent ponding of water near the foundation and provide
for proper drainage away from the house.

SURFACE DRAINAGE:
The backfill soil around the house should be moistened and well compacted to prevent
future settling. The backf`ill material should be free of trash, frozen soil and large rocks. The
future owner must be advised to fill in any settled area to eliminate ponding of water near the
house and to provide adequate slope for proper drainage away from the house and off the site
at all times.
The finished grade or ground surface near the foundation walls should have adequate
slope to provide proper drainage away from the house and off of the site. A xninimum slope of
ten percent far at least the first five feet out from the house is recommended.
Roof downspouts and sill cocks should discharge onto long concrete splashblocks,
minimum of five feet long, or into metal gutter extensions to deposit runoff water further out
from the house and beyond the limits of backfill soil near the foundation wa11s.
The future owners should be cautioned and advised against the installation of a lawn
sprinkler system within five feet of the foundation walls. If a sprinkler system is installed, the
sprinkler heads should be placed so that water spray from the heads under full pressure does not
fall within five feet of the foundation walls. Lawn irrigation should be controlled to prevent
excess wetting of the subsurface soils. Lawn, flowers, shrubs, and other plantings within five
feet of the foundation walls should be hand watered and this watering should be minimized. If
a drip irrigation system is used, one should limit the amount of water to sustain the plantings.
One is also advised that any irrigation lines can leak and/or break and release excessive amounts
of water near foundations and can cause damage to slabs and foundation walls.
SUBSURFACE DRAINAGE AND BASEMENT CONSTRUCTION:
Free water was encountered during the drilling of the test holes: The requirement for
subsurface (perimeter) foundation drains will be detercnined at the time of the open hole
observation. See Figure 6 for a suggested method of installingthe foundation drainage system.
Ground water should not affect construction or be a deterrent to the construction of the house
with a basement.
REINFORCING:
The concrete foundarion walls should be well reinfarced at the top and bottom of the
walls to clear span at least a distance of ten feet. This will give the walls beam strength to span

or bridge over any soft or loose pockets of soil not found in our exploratory holes or that may
develop during construction. This will also help prevent. differential movements of the
foundation system. Refer to the foundation plan for specific details of reinforcement. The
foundation plan is not a part of this soils report, and the exact requirements are a function of the
design of the shucture.
TOPOGRAPHY:
The topography of the site at which the test holes were drilled is relarively flat.
W EATHER:
The weather at the time of the soil examination consisted of cloudy skies with wann
temperatures.
CONSTRUCTION DETAILS:
In any soil investigation, it is necessary to assume that the subsurface soil conditions do
not vary greatly from the conditions encountered in our field and laboratory tesring. Our
experience has been that at times soil conditions do change and variations do occur and may
become apparent to the tune of excavation for the foundation system. If soil conditions are
encountered which appear differentfrom the test borings as presented in this report, it is required
that this office or a qualified soils engineer be called to inspect the open excavation. This
inspection is not a part of this report and is not included as any part thereof.
OPEN HOLE OBSERVATION:
The owner, or a representative of the construction firm, shall contact Colorado
Engineering and Geotechnical Group, Inc. a minimum of twenty-four hours prior to the
completion ofthe foundation excavation to schedule an open hole observarion. This observation
must be performed befare the placement of concrete, and preferably prior to the setting of the
forms. This observation will insure that soft spots, anomalies, etc., are not present in locations
which will affect the foundation.
At the time of the observation, the requirement for suUsurface drainage will be
established. Additionally, the maximum allowable bearing pressure of the soil may be revised
according to the soil conditions exposed.

FOR THE FOLLOWING REASONS:
l. The general intent of setbacks is to provide sepazation between adjacent structures and
streets within the neighborhood. This is to provide an open view perspective within the
neighborhood among other things. The proposed structure actually sits well beyond the
recognized 30-foot setback from West 39`h Avenue, therefore this structure will appear to
the neighborhood as well set back from average. Lamaz Street extending only some 30
feet south from its intersection with West 39th creates an anomalous and technical basis
for setback measurement.
2. The average front yazd setback in the neighborhood is approximately 24 feet. If this 6-
foot vaziance from the standard is applied there will be no tangible visual difference from
the requested 6 feet, therefore it would seem to be a practical and non-detrimental plan
and variance.

September 26, 2002. A set of these minutes is retained both in the office of the City Clerk and
in the Department of Planning and Development of the City of Wheat Ridge.

A. Case No. WA-02-08: An application filed by The Buckeye Group for approval
i~. of (A) a 15-foot front yazd setback vaziance from the required 30-foot front yazd
setback from dedicated right-of-way resulting in a 15-foot front yard setback.
This would inciude (B) a request for additional setback encroachment of up to 6
feet from the required 30 foot setback from the intersection of two right-of-way
lines of Lamaz Street for property zoned Residential-One C(R-1 C) and located at
6390 West 39"' Avenue.
Tlus case was introduced by Travis Crane. He entered all pertinent documents into the
record and advised the Boazd there was jurisdiction to hear the case. He reviewed the
staff report and presented photos and site layout pertaining to the application. Variance

criteria for both requests (A and B) were reviewed. Staff recommended denial of the
application as oudined in the staff report.
In response to questions about whether or not Lamaz would be extended or vacated,
Travis Crane replied it would probably remain a dead-end street but the present right-of-
way for Lamar remains. Sidewaik will be required along 39th Avenue and Mr. Crane
indicated it was not clear at this time whether or not it would be required to go azound the
corner down Lamar Street.
John Burch
Conifer, CO
Mr. Burch, builder for the applicant was sworn in by Chair MONTOYA. He stated it
was the applicanYs intent that the location of the house fit in with the house planned for
the adjacent lot as well as the rest of the neighborhood. Without the variance, the house
would be set further back than other houses in the neighborhood and would also result in
a ten-foot back yazd. The variance would a11ow a 25-foot back yard.
Chair MONTOYA asked to hear from those wishing to address this matter.
Sam Wells
3895 Lamar Street
Mr. Wells was sworn in by Chair MONTOYA. He stated his opposition to the
application. He expressed concem about lack of pazking if the variance were granted.
He didn't believe the location of the house would fit in with the existing neighborhood if
the vatiance were granted.
Kay Wells
3895 Lamar Street
Ms. Wells was sworn in by Chair MONTOYA. She spoke in opposition to the
application for the same reasons stated by Mr. Wells.

Mr. Johnson was sworn in by Chair MONTOYA. He spoke in opposirion to the
application based on the lack of parking due to inadequate driveway depth if the variance
were granted. Further, the requested setbacks would not fit in with the rest of the

3855 Kendall Street
Mr. Maske was swom in by Chair MONTOYA. He spoke in opposition to the
application. FIe expressed concern about parldng and traffic congestion, especially
because 39th Avenue is very nazrow and Lamaz carries a lot of traffic. He expressed
concern about the safety of children in the azea.

Ms. Shell was swom in by Chair MONTOYA. She spoke in opposition to the application
and expressed concem about parking and traffic congestion.
Vince DiManna
3920 Lamar Street
Mr. DiManna was sworn in by Chair MONTOYA. He spoke in opposition to the
application. He stated that he was advised by staff not to pursue a 5-foot variau.ce for a
freestanding gazage request last spring and didn't feel it was fair to grant a 15-foot
variance to the applicant. He also expressed concern about parking, traffic congesrion
and consistency in the appearance of the neighborhood.
Josie Larson
3900 Lamar
Ms. Larson was sworn in by Chair MONTOYA. She spoke in opposifion to the
application. She expressed concern about pazking, traffic congestion and consistency in
the neighborhood.
Boazd Member YOLTNG suggested redesigning the house to push the gazage back to be
even with the front of the house. This would result in a 6-foot variance rather than a 15-
foot vaziance and would be the same as the variance in request B. This configuration
would also provide for a larger back yard.
Board Member ABBOTT expressed concern about the proposed 15-foot driveway and its
conflict with the driveway on Lamaz. He asked the builder if it would be possible to
design the house to put the garage on the other side of the house.
Mr. Burch returned to the podium and stated that he didn't believe it would work well to
move the garage to the other side of the house.
The suggestion made by Board Member YOUNG to move the gazage back to be in line
with the house was discussed with the builder and the Board. Mr. Burch agreed that such
a compromise would be satisFactory to him. Chair MONTOYA asked the neighbors how
they felt about the compromise. No opposition to the compromise was voiced by the
neighbors. There was indication they were a11 in favor of the revised configuration.
Upon a motion by Board Member ABBOTT and second by Board Member BLAIR,
the following resolution was stated:
