Detective R. Rowlett, Officer T. Wardell and Detective C. Gallegos responded to the scene and found that the Wheat Ridge Fire Department was on scene. They met with Arson Investigator Dan Hrouda of the fire department. The fire department had responded to the area on a report of the smell of natural gas on January 5, 2005. They also had been to the area earlier in the week on other calls of odors of natural gas. On January 5, 2005 they checked the area more thoroughly and discovered that the smell appeared to be coming from the apartment complex at 7750 to 7766 West 39th Ave. There are nine units in the complex but only one of the units (7760) is occupied. Excel Gas was called and a technician, Larry McDonald responded to the scene. He checked the gas meters for the individual apartments and found that one of the meters was running out of control. He was able to isolate the area of the leak as beim in the rear laundry room area of the apartment complex. The fire department found that the doorway to the laundry room had been secured by someone railing a lame piece of panted plywood over the door and window. They pried the plywood off the door and found that there was a major gas leak in the room. The following notations had been made by Detective Reporting Officer P WACKER ReportDatet Supervisorw1/7/2005 •. ++ MrA 707-77:a 7 r; r. a Rowlett and Investigator Hrouda: The room contained a gas hot water heater that was not in operatio4l An active gas line led to the hot water heater and then continued outward. it appeared that the above gas line at one time also serviced other appliances in the room but that it had been capped off just past the inoperative hot water heater. The end cap of the gas line had been removed and was no longer present. Natural gas was coming out of the line at a high rate. An attic access trap door leading to a common attic for the entire apartment complex had been removed opening up an area where the natural gas could rise. (Note: This is the only entry into the attic.) The entire attic area of the apartment building had been filled with natural gas but ventilation thru the roof space had prevented the natural gas from backing down into the individual apartments. Investigator Hrouda informed me that at the point of discovery of the major leak the gas company turned off the gas to all of the units in the apartment complex. Firemen then forced entry into all of the locked apartments to check and see if anyone had been rendered incapacitated by the fumes. They found no one in the building. They did find that one of the apartments, 7760 West 39th Ave., was occupied by a resident. The rest of the apartments were vacant. A look at the apartments revealed the following suspicious activity: The domestic oven in 7758 West 39th Ave had been turned on and was still hot. The door to the oven was found open by firemen and the electric igniter was clicking and attempting to re -light the oven from when the gas had been turned off. This particular apartment shares a common wall with the above utility room where the gas leak was found. A hole had recently been cut in the floor of the apartment at 7750 West 39th Ave. The hole was rectangular in shape and was large enough to allow a person to crawl down under the flooring of the apartments. A circular saw blade was still on the kitchen counter of the apartment. Another hole had been cut in the floor of the apartment at 7766 West 39th Ave. This hole was also rectangular in shape and also was large enough to allow a person to crawl down under the flooring of the apartments. Detective Rowlett processed the apartment complex as a crime scene and took pictures. Hrouda and the Excel representative, Larry McDonald attempted to notify an owner for the building. McDonald was able to determine that bills from the power company had been sent to L and L Coin in Mountainview Colorado. He contacted the store and talked with a man who refused to identify himself or take responsibility for the property. The person contacted on the phone gave McDonald the telephone number for the owner as "303-638-585811. This number was called but no contact could be made with the flowner". Hrouda arranged for the doors to the various apartments to be secured by Colorado Fire and Flood and for measures to be taken to protect water lines since the individual gas heating units in the crawl space to all of the unoccupied units were turned off. The key for the lock placed on the occupied apartment at 7760 West 39th Ave was secured at the police department and a message was left for the occupant to contact Hrouda. On the afternoon of January 6, 2004 1 contacted Dan Hrouda by telephone. He informed me that he had conducted more work on the investigation but that he was still unable to get in contact with the owner of the apartments. He advised that further investigations indicated the following facts The apartment complex was owned by a man named "Roger Loker". "Roger Loker" was also the owner of L and L Coins in Mountainview Colorado. Another arson had been reported in September of 2004 at a residence located at a site behind L and L Coins. This fire involved a "set fire" of a gas grill. A check with Jefferson County showed the property taxes for the above apartment complex were in a non payment status. on the evening of January 5, 2005 the resident (name unknown) at 7760 West 39th Ave made arrangements to get back into their secured apartment by picking up the key. Investigator Hrouda asked me to attempt to contact someone at L and L Coins. I called the above cellular phone number at 1630 hours. I left a message for "Roger" to call me. By 1635 hours I was advised that a person named Roger Loecher was waiting for me in the police lobby. I greeted Mr. Loecher and took him to an interview room. Loecher informed me that he was in the city complex attending a City sponsored business association meeting. He decided to just drop by rather then call me on the phone. I asked him if he knew what was happening at his above apartment complex. He told me that he had talked to his employee, Fred Wilkins, at L and L Coin. I asked Roger when he had last been to the apartments. He told me that he had been to the apartments on Monday, January 3, 2005. He said that a water pipe had broken in the crawl space on the left wing of the open end of the u -shaped units. (Note: This particular day was very cold and the break in the pipes was probably due to frozen pipes.) His handyman, Johnny Ducey, had been there to find the break. They arranged for the water company to turn off the water at the street around 10:00 AM. They then went down into the crawl space and turned off the water inside the building. I asked Roger how they got down into the crawl space. He informed me that the entrance to the crawl space was on the opposite end of the apartments and the dirt under the floors was soaked in water. Instead of using this entrance they decided to cut a hole in the floor of the nearest unit to the water valve to shut off the water. I asked Roger if any other holes had been cut in the floors of the apartments. He advised me that another hole had been cut in a floor of an apartment on the right wing of the complex about a year ago for the same purpose under the same circumstances. Roger did not know when repairs would be made to the water system for the apartments. He said that Johnny Ducey did the existing work to get the water shut off. He asked me what the problem was with his apartments. I told him that the fire department had been to the apartments due to a major gas leak. I also advised him that the fire department had considered the gas leak to be suspicious in nature. He asked me where the leak had been found. I advised him that the leak was located at the end of a gas line in the laundry room area. He told me that this particular room had been boarded up two or three years ago because of problems. The room was no longer in use and juveniles in the area were getting into it and causing vandalism. Johnny Ducey boarded up the laundry room to stop the problem. I I asked Loecher the addresses of property that he owned in Colorado. He gave me the above information. I asked him if there had been any other recent fires at any of the above sites. He told me that there had been a grill fire at his rental property at 4368 Depew Street. He said that he did not know the details of the fire. Loecher told me that his apartment complex is insured and free of any leans. He said that he was an honest man and had no reason to destroy his property to make an insurance claim. He advised that his apartment complex was insured by Safeco Insurance. He provided me with the above insurance information. I asked him if his taxes were up to date on his property. He said that he did not keep up on those type of matters because he had so much property. I asked him if he had a business manager. He told me that he took care of his own business. Mr. Loecher did not appear to be upset when he learned of the incident or the fact that the fire department had to force entry into each individual apartment. He informed me that he could not give me information on Mr. Loecher's insurance until he had Loecher's permission to talk to me. He said that he has known Loecher for several years and insures several pieces of property for Loecher. McCarron said that as a courtresy he usually goes to L and L Coin to pick up insurance payments from Loecher every month so they are not late. He will talk to Loecher today. Included as property insured is a garage at 35th and Wadsworth Blvd where Loecher owned a business named "Rent a Vet". The business is now closed and the garage is vacant. McCarron also told me that Loecher also has in joint ownership other pieces of property with a man named George Graul. These pieces of property are also insured by his agency. Upon arrival., Inv. Hrouda briefed me on the scene as follows: o Wheat Ridge Fire responded on an odor investigation to a report of the smell of natural gas at a business complex at 7777 W. 38th Avenue, directly south of 7758 W, 39h Ave, This was their third response to this location in the last two days. They determined that the odor was coming from a laundry room in a small apartment complex directly west of 7758 W. 38 1h Avenue. Fire personnel removed a piece of plywood from a south facing exterior door to the laundry room to gain entry. The plywood had been placed over the regular door to prevent entry as the laundry room is no longer in use. There was no other access to the room. Upon gaining entry, fire personnel found a gas line in the full open position with the cap to the line removed. A large open access hole for the attic was located in the center of the room and natural gas had filled the attic space which was completely open and extended the entire length of the complex. Inv. Hrouda advised that natural gas levels were well beyond the explosive level. Fire personnel shut off the gas to the line, which supplied gas to a hot water heater. The valve for the hot water heater was in the off position and the heater was not on. An extension pipe from the hot water heater appeared to have been previously capped however the cap was missing. The valve for the extension was in the full open position allowing gas to vent into the laundry room, Fire personnel removed the galvanized pipe extension and it was turned over to me by Inv. Loecher owns several pieces of property in Wheat Ridge and perry has assisted him over matters. He also knows both men from an informal relationship. He was unaware who the second man in the pick up would be but did remember that the truck plate had a personalized plate "Cenos". He took for granted that the man was probably a plumber. Ducey told him that there was a water break in a section the apartments. They had tried to get to the water shut off in a certain area and were unable to get it to stop. He arranged to turn off the water for the men till they made repairs. He returned around noon to restore water service. He said that the men told him that they tried to turn the water off at one location but found out that the break was in a different section of the apartment complex. He said that the water line branched into two different locations to the apartment once the line left the street. The men had to cut holes in the floor of the apartments to get to the turn off valves.. I asked Nickle if he was around the backside of the apartments. He told me that he was only at the street in front of the apartments to turn off the water. He said that once the water was turned on he thought that the repairs had been done to the water system. I asked Nickle what he knew about Johnny Ducey and Roger Loecher. He said that he had known them for several years. I asked him if they had ever been involved in any suspicious activity. He said that he did not think. that Roger would do anything unusual or illegal. We reviewed observations made by firemen that had responded to the scene and discovered the activated stove and the open gas Line. I also updated them on information that I had been told by Loecher about the water line break and the fact that the laundry / utility room had been boarded up for several years. Geno told him that he had been over to the apartments on January 1, 2005 and heard a noise as if a fan was running inside 7754 West 39th Ave. On the morning of January 3, 2005 Ducey went to the complex and realized what Geno had been hearing was running water from pipes that had broken during a cold spell. The broken pipes were in the east wing of the units where the furnaces were not in maintenance. Ducey said that he got the water department out to help him and he had to cut into one of the floors to get the water turned off for the east wing. After Deno left Ducey realized that the water pipes for 7758 were frozen up. He then saw that the floor furnace for this apartment was also not working. He said that to thaw out the lines and keep them open he decided to light the oven in the unit and leave the oven door open to keep the place warm. Ducey admitted that he left the oven on for three days. We asked him what steps he did to light the oven. He said that he first went to the meters and turned on the gas for the unit. we walked out to the meters and he pointed out the correct meter for 7758 West 39th Ave. However he said that the meter man had correctly labeled the meters since then. He added that he was not completely positive which meter he had turned on. He pointed to the second bank of meters and told us that they were for the west wing. He said that he turned on a meter on the end. He said that it really did not make much difference what meter he turned on because all the lines from the meters went to apartments with secured appliances on them. We asked him to count the meters and the apartments. He realized that there were ten meters and nine apartments. He asked where the extra meter went to. We told him that it went to the boarded up abandoned laundry room. He then said "It must be my fault, I am responsible." He concluded that he may have been mistaken what meter he had activated. We talked with Roger Loecher. Loecher said that he was unaware that the line to the laundry room was not capped and that the valve leading to the open end of the line was standing open. He said that it had been years since anyone had been in the room. (Note: The fact that no one had been in the room was a further indication of the amount of time that the men had spent at the property since the only way to the attic was thru the room.) Loecher said that he had made mistakes but that he had made no attempts to blow up his apartments. I told him that I would be in contact with him at a future time to talk about the possibilities of criminal violation. On the morning of January 11, 2005 before writing this report I discovered that a warrant had been issued for Mr. Ducey in Wheat Ridge in 2003 when he failed to appear on a traffic violation. I arranged for Ducey to turn himself into the police department and post bond. I also met with Chad Root of the Building Department and arranged for him to inspect the apartments for violations with Fire Marshall Saba of the Wheat Ridge Fire Department. They will make sure that the apartments are safe before gas utilities are returned to the apartments. Loecher was advised to contact Root for assistance. Detective Rowlett titled her report for this case as a criminal attempt arson. The floor is exposed concrete slab. All washers and dryers have been removed. There is a water heater on the North wall supplied with natural gas by galvanized steel pi e that T's off a few inches from the floor IP on the West side of the heater. A flexible gas connecting hose is coupled to one of the steel threaded connections. The valve controlling gas to the heater is in the off position. The temperature dial is turned to the lowest or off position. Labels on the heater read; Signature 700 Class Lined Automatic Flame Control High Recovery Where the steel pipe T's the other side leads to a piece of open end pipe, the valve controlling gas flowing through the unsealed pipe opening was found in the on position. Xcel Energy gas team turned this valve to the closed position, removed a short section of pipe and installed a cap to prevent gas from escaping. There is alligbt coating of soot on the water heater body and smoke staining on the ceiling of this room from a previous fire. Protected areas are visible on the ceiling showing the position of formerly existing walls. Upon completion of the investigation several attempts to reach a responsible party were unsuccessfid using the telephone number on a for rent sign (303) 231-9646. Xcel contacted the billing office to reach a responsible partyl, Larry McDonald called the number given to him by billing and got through to L&L Coins, Larry was told, "if he wanted to contact the owner he would have to contact the ownee' and was given a cell phone number and told "I'll give you the owners cell phone number but you did not get it from me"'. No contact was made to an R.P. Evening was approaching and the temperature was below freezing. Colorado Fire and Flood were called to secure the property.
