Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. AAC may order excess materials. Excess materials will not be charged above the Contract price. All excess materials belong to AAC. If materials need to be restocked or reordered due to a cancellation by the Customer, Customer will be responsible for an additional RESTOCKING FEE of $500.00. 2. All materials are guaranteed as specified. All work to be completed in a workmanlike manner according to industry standards. AAC warrants its workmanship for 5 years for any roof replacement and gutter installation and 1 year on all repairs. Materials are warranted by the manufacturer pursuant to manufacturer's written warranty. AAC will supply a Completion Certificate and manufacturer warranty information upon receipt of payment in full. 3. Alterations or deviations from approved specifications resulting in additional labor or materials costs will be executed only upon written Change Order. Customer is responsible for the cost of all Change Orders above the estimate and Customer's obligation will not be limited to the amount of insurance deductible. All agreements and service dates contingent upon strikes, accidents, or delays in obtaining materials, inclement weather or other causes beyond AAC's reasonable control. 4. The Customer shall carry general public liability insurance and property damage insurance (including contents and other personal property), for all-risks, including fire, smoke, tornado, hail, wind and rain, and all other insurance appropriate for the Customer. ROOF REPAIRS OR REPLACEMENTS REQUIRE THE INTERIOR OF THE STRUCTURE BE EXPOSED TO THE ELEMENTS DURING THE PROGRESS OF THE WORK. AAC WILL USE COMMERCIALLY REASONABLE EFFORTS TO IDENTIFY THE POTENTIAL FOR INCLEMENT WEATHER EVENTS AND TO PROTECT THE ROOF AND STRUCTURE DURING THE PROGRESS OF THE WORK BUT SI TALL HAVE NO LIABILITY FOR ANY DAMAGES CAUSED BY WEATHER OR OTHER CAUSES. AAC shall have no responsibility for damages from rain, tornado, windstorm, hail, ice, ice dams, or other perils, nor for any damage from nail pops, driveway cracking or below the roof or to the interior of the premises or any contents or personal property located therein and the Customer shall be responsible for properly safeguarding (and removing, if necessary) its property from the jobsite. 5. Customer agrees that AAC will not be liable for any structural movement, settling, cracks in dry wall, or driveway due to the performance of the work or the unloading and loading of materials or equipment. 6. The Customer shall designate an area for AAC to place trailers, dumpsters, or stored materials. 7. The dollar amount of the Contract is the amount approved by the Customer's insurance company ("RCV") for the scope of loss, plus overhead and profit (if applicable), and any agreed upgrades or extras. ANY replacement of damaged or deteriorated decking, flashing, roof jackets, fascia boards, vents or other materials or components, unless otherwise stated in this Contract and approved by the Property Owner's Insurance Company are EXCLUDED and if such work is requested will be charged to and paid by Customer as extra materials and labor, which amounts are in excess of insurance deductible. 8. Supplemental amounts paid by the Insurance Company for additional labor or materials above the original scope of repairs shall be paid directly to AAC. 9. AAC is not responsible for pre-existing conditions or previous design, construction, or maintenance conditions or problems with the premises, whether known or unknown at time of acceptance. AAC may alert and inform the Customer on correcting any problems it may observe, but AAC has no such obligation or responsibility. 10. Final payment to AAC is due upon substantial completion of the work, without delay for any inspections by city or other governmental authorities or others. Any amounts not paid within fifteen (15) days shall accrue interest at the rate of eighteen percent (18%) per annum from the due date, until paid. Customer shall be responsible for all attorneys' fees, costs, and legal filing fees incurred by AAC to collect any amounts due or otherwise enforce the terms of this Contract. In the event of a legal proceeding arising out of this Contract, the prevailing party shall be awarded their attorneys' fees, and costs. 11. The Contract is binding on the Customer for all purposes upon execution on the reverse side of this Contract, so long as the Property Owner's Insurance Company approves the work. Customer is not entitled to cancel this Agreement for any other reason except if mandated by and in strict compliance with C.R.S. § 6-22-101 et seq., if applicable. 12. By signing this Contract, Customer represents that s/he is the owner of the property on which the work is being performed and authorizes AAC to perform the work as approved and specified by the Property Owner's Insurance Company, and the Customer agrees to deliver to AAC all Insurance Company payments on account of the work, properly endorsed to the Company, immediately upon receipt, and to otherwise pay to AAC all other amounts, including the deductible portion, if applicable, or for extra work, immediately upon receipt of invoice. 13. The provisions limiting out of pocket expenses to the amount of Property Owner's insurance deductible applies only to the work as approved and specified by the Property Owners Insurance Company identified on the reverse side of this Contract, and not to any extra work or upgrades, and not to any costs, expenses or legal fees. 14. This Contract contains the entire agreement between the parties and may be changed only by a written instrument signed by all parties. All prior negotiations, statements or representations shall be deemed merged herein and shall not be relied on and do not survive the execution of this Contract. If any provision of this Contract should be held to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected thereby. 15. Customer agrees to provide a copy of Insurance Claim Report to AAC promptly upon receipt. 16. To the extent any term or condition of this Contract is void, illegal, or unenforceable under any state or federal law or statute, such void, illegal or unenforceable provision shall be deemed stricken, but the balance of this Contract shall remain in effect. 17. If Property Owner's mortgage lender requires that all or any portion of the payments issued by Property Owner's Insurance Company be paid to or retained by the mortgage lender, Property Owner shall remain liable for payment of such amount directly to AAC. 18. Property Owner represents that Property Owner is current on all mortgage payments owing on all mortgages on the Property. MANDATORY COLORADO DISCLOSURES In Compliance with C.RS. §16-22-101, elieq. 1. AAC shall hold in trust any payment received from Customer until roofing materials are onsite and work has begun. 2. AAC carries general liability insurance. General liability insurance is produced by Signature Select LLC., 1705 17th St., Suite 100, Denver, CO 80202 (303) 534-4567. Policy # CGL0052701-22. 3. RESCISSION. Customer may cancel this contract and receive a full refund of any amounts paid at Customer's sole discretion within 72 hours of execution of this contract. In witness whereof putchaser(s) each acknowledge receipt of a completed copy of this contract, and all disclosures on the day and year written below. If you plan to use the proceeds of a property and casualty insurance policy to pay for the roofing work, you may rescind this contract within 72 hours after you receive written notice from the property and casualty insurer that your claim has been denied in whole or part. In the event of rescission, AAC is entitled to retain payments or deposits to compensate AAC for roofing work actually performed in a workmanlike manner consistent with standard roofing industry practices. 4. DEDUCTIBLE. Your deductible is the portion of your claim that is not covered by your insurance company. You, the insured, are responsible for paying your deductible amount to AAC. Example: Your claim equals $10,000. If your deductible is $500, the insurance provider will pay $9,500 in total. Leaving you, the insured, to pay the difference, $500 to AAC. In compliance with Colorado law, AAC cannot pay, waive, rebate, or promise to pay, waive, or rebate all or part of any insurance deductible applicable to the insurance claim for payment of roofing work on your property.
