DECLARATION OF COVENANT AND RESTRICTION

_ THIS DECLARATION OF COVENANT AND RESTRICTION is made this 112 day of
JC.A A)Y by Rex P. Winters and Janet E. Gunn ("Declarant").
1. Burdened Property. Declarant is the owner of the real property located within the
City of Wheat Ridge, Jefferson County, Colorado described in the attached Exhibit A ("Burdened
Property") also known as 12310 W. 42"d Avenue . A primary dwelling and an accessory
dwelling (the "ADU") presently exist on the Burdened Property, or are proposed to exist on the
Burdened Property, pending the issuance of a City of Wheat Ridge building permit(s) if necessary
and subsequent issuance of a Certificate(s) of Occupancy.
2. Burdened Property Subject to Wheat Ridge Code. Accessory dwelling units in the
City are subject to certain regulations under the Wheat Ridge Code of Laws (the "Code"), and in
particular, Code Section 26-646, or its successor section(s) as amended from time to time. That
Code Section requires that either the dwelling unit or the ADU on a property must be occupied
by the property owner. The Declarant intends by this Covenant and Restriction to ensure
continued compliance of the Burdened Property with the Code.
3. Imposition of Restriction. Declarant, for itself, its heirs, successors and assigns,
hereby covenants and agrees that:
A. No portion of the Burdened Property, either the primary dwelling or the ADU
on the Burdened Property may be conveyed separately from the other,
respectively; and
B. The Burdened Property shall not be subdivided unless such subdivision can be
accomplished in accordance with the provisions of the Code; and
C. The owner of the Burdened Property must occupy either the primary dwelling
unit or the ADU on the Burdened Property.
4. Burdens Run With the Land. Declarant hereby declares that this Restriction shall
pass with and burden each and every tract, lot, and parcel of land within and which is a part of
the Burdened Property and shall apply to and be binding upon the heirs, successors in interest
and assigns of the Declarant and any owner hereafter of said tracts, lots and parcels, shall run
with the land at law and in equity. Any person acquiring any interest in the Burdened Property
shall be deemed for all purposes to have assented and agreed, as an essential condition of any
such conveyance, to the provisions of this Covenant and Restriction, to have agreed to comply
with this Covenant and Restriction and to have waived any right to challenge or contest the
provisions hereof except as permitted herein.
Relationship to Land. Declarant acknowledges and agrees that the restrictions
imposed by this Covenant and Restriction are related to and touch and concern the Burdened
Property.

6. Enforcement. The City is an express third -party beneficiary of this Covenant and {-1
Restriction and is authorized and empowered to enforce the obligations established hereunder.
The rights, duties and obligations contained in this Covenant and Restriction may be enforced by
the filing of an appropriate action in law or in equity in the District Court for Jefferson County,
Colorado whose jurisdiction over this Covenant and Restriction is hereby acknowledged.
7. Recording. This Declaration of Covenant and Restriction shall be filed for record
with the office of the Jefferson County Clerk and Recorder by the City concurrent with issuance
of the Building Permit for the ADU, or issuance of Certificate of ADU Approval for existing ADUs
determined to be legally nonconforming.
8. Removal of Declaration.
A. In the event the ADU is demolished or modified such that it no longer functions as
an ADU as defined in the Code, upon application of the then -property owner and
approval by the City pursuant to the Code, the City shall record a release of this
Declaration in appropriate form.
B. In the event the imposition of this Declaration is no longer permissible under
federal, state, or local law, upon approval_by the City, the City shall record a
release of this Declaration in appropriate form.
9. Severability. If any provision of this Declaration of Covenant and Restriction is held
to be invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect
the validity of the remaining provisions.

to be signed by it duly and authorized agents the day and year first above set forth.

1. This permit was issued based on the information provided in the permit application and accompanying plans and specifications and is

2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and

The following design describes a residential Solar PV system with a peak STC DC size of 8.0 kW �
+ and an estimated electrical generation of 11,240 kWh per year.
+ The modules form an array on the south facing roof oriented at 20 degrees of tilt. The array
consists of 2 strings of 13 BP 20OW modules connecting to a Xantrex GT 5.0, and 1 string of 14
+ on Xantrex GT 3.3 inverter. ,

+ The DC wire is enclosed in conduit, which connects to the inverter and the PV disconnect,
followed by the service panel and utility meter located on the east wall of the house. The inverter

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection
prior to installation of ANY roof coverings and is require on the entire roof when spaced
or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are
required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and
water shield is required. Eave and rake metal is required. A ladder extending 3 feet above
the roof eave and secured in place is required to be provided for all roof inspections.
Roof ventilation is required to comply with applicable codes and/or manufacturer
installation instructions, whichever is more stringent. In order to pass a final inspection
of elastomeric or similar type roof coverings, a letter of inspection and approval from the
manufacturer technical representative stating that "the application of the roof at (project
address) has been applied in accordance with the installation instruction for (roof
material brand name) roof covering" is required to be on site at the time of final
inspection.
Roof inspections for ROOFS OVER 6/12 PITCH: 3rd party inspection will be required, the 3rd
party inspection report will be collected at final roof inspection performed by City of
Wheat Ridge. If report is not available the final inspection will not be completed.

excessive wind, ice or hail during the period of the warranty.
Endeavor Exteriors shall refund any deposit if this contract is cancelled within 72 hours (3 days).
If this contract is cancelled by the client, after three (3) or more days of execution, the client agree
pay Endeavor Exteriors twenty percent (20%) of the contract price, set by the insurance company

At your request, we visited the residence referenced above to evaluate the capacity of the existing roof
strucmre to support an added roof mounted photovoltaic (PV) solar array. The proposed solar panels
are to be flush mounted and weigh no more than 3 pounds per square foot (psf). It is our
undecstanding that the PV installer will be utilizing an installation method prescribed by a proprietary
racking system manufacturer as a means to a[tach the panels to the roof, and that this installation
method has been designed and sealed by a licensed engineer in the State of Colorado.
The 2006 Colorado Front Range Gust Map places this residence in a location that has a design wind
speed of 120 mph, three second gust. The exposure is C. Following the analytical design procedures
of ASCE 7-05 the maximum design wind uplift components and cladding pressure is 63 psf.
The existing roof framing is part pre-engineered trusses and part stick framing with 2x6 roof rafrers,
2x6 ceiling joists and 2x4 internal bracing struts.
The PV panels are to attach to the existing roof with support rails and attachments. The attachments
shall be spaced at a maximum of 3'-0" along the rails.
Each attachmen[ shall be connected to the roof framing with a 5/16" diameter by 4" long lag screw
with a minimum of 2 1/2" embedment in pre-drilled holes (3/16" diameter for the threaded portion of
the screw and 5/16" diameter for the unthreaded shank) into the existing roof framing. The screws
shall be located within the center one-third (1/2") of the framing member width. Another option for
the roof connection (if acceptable by the track and attachment manufacturer) is using (2) 1/4" diameter
by 3 1/2" long "Simpsod" SDS screws per connection, with a minimum of 2 I/4" embedment in 1/8"
diameter pre-drilled holes.
Based on these criteria it is our professional opinion that the added dead load of the proposed solar
array does not overstress the existing stmcture, provided there is only one layer of shingles on the
roof. The Flush mount system does not add additional wind loading to the roof Framing.
