Dear Mike:
This letter serves as drainage certification for Pet Cremation Services located on the
property at 12000 Weat 62nd Avenue. On February 22, 2003 a field review was
perFormed to verify that the proposed site improvements were constructed in
accvrdance with the approved drainage plan, The drainage pian and calculations for
the property were summarized in our letter dated June 27, 2002 and amended in our
letter dated July 23, 2002. The City approved the drainage plan that was included in
our July 23, 2002 letter.
7he new site improvements coneist of additional concrete surface for parking. Based
on our field review the site improvements are consistent with the approved dreinage
plan. It is our opinion that the addltion of the concrete surfaced parking to the existing
site improvements will not adversely impact the adjacent propercies.

I have completed my initial review of the above-mentioned project, and I have the following
comments:
Pazking:
A. The handicapped accessible pazking stall should have a minimum eight (8) foot
access aisle.
2. Signage:
A. If any changes to either wall signage or freestanding signage aze anticipated for this
address, a sign permit application must be completed and submitted to the City.
Landscaping:
A. The onsite landscaping does not meet the conditions ofthe code under which the
building was wnstructed. At the time of the original pernut, the code specified that
ten percent of the site must be landscaped. Included in this ten percent of site
landscaping, street trees should be provided every thirty (30) feet for the street
frontage adjacent to West 52'a Avenue. You should be awaze that non-living
materials, such as bazk or rock may be used, but may not exceed twenty (20) percent
of the overall landscaped area. You will need to indicate the landscaping azeas on the
site plan, complete with a detail ofthe amount and species ofthe items to be
installed. The City does recognize the implications of the current water shortage
situation, and is cognizaiit of the long-term effects of the drought. You aze not
required to install your landscaping at this time; however, escrow must be provided
to the City in the amount of 125% of the value of the installed landscaping. You will
be required to complete and sign an escrow agreement form, provide the City with a
copy of the landscaping bid, and submit a check or letter of credit to the City in the
amount of 125% of the bid price. All of these items will be required prior to issuance
of a certificate of completion.
4. General:
A. Prior to the pwchase of the property, it was indicated to you that the City would
need to see a copy of the certification from the state and Jefferson County for the
furnace in the southwest corner of the property. You will need to get a copy of both
certifications and provide them to the building department.
All requued changes should be made prior to resubmittal. You should be awaze that any comments

The charging rate shall not exceed 250 pounds pe, hour or 2,200 pounds per day based on batch
loading twice daily of animal remains (pithological waste rated at 1000 Btu's per pound). No other
types of wastes shall be burned in this umlt without prior approval from the Division.

4. Automatic controls shall not be overridden during operation. The charging door shall not be opened
during the firing cyde so as not to disturb the combustion cycle. -

8. The Division has the authority to require compliance tests when there is a reason to believe that the
unit is not in compliance with Air Poilution Control Regulations.
g, At all times, including periods of start-up, shutdovm, and malfunction, the facility and control
equipment shall, to the extent practicabie., be maintained and operated in a manner consistent wilh
good air pollution control practices for minimizing emissions. Determination of whether or not
acceptable operating and maintenance procedures are being used will be based on information
available to the Division, which may inc'ude, but is not limited to, monitoring results, opacity
observations, review of operating and rnzintenance procedures, and inspection of the source.

• May 8, 2000, a letter was sent to Mr. Delmain stating that the non-conforming use could
remain, but could not be expanded without bringing the property into compliance. A pre-
application meeting was recommended at the applicant's earliest convenience.
• May 26, 2000, a meeting was held with Mr. Delmain and CiTy staff to discuss the current
use of the property and how the proposed addition could be used.
• June 30, 2000, The City oF Wheat Ridge Public Works Department reviewed the first
submittal and issued comments.
• July 3, 2000, The Arvada Fire Disfict reviewed the first submittal and issued comments.
• July 5, 2000, The City of Wheat Ridge Building Division reviewed the first submittal and
issued comments.
• July 17, 2000, Morton Buildings picked up review comments and paid building plan
review fee.
• October 23, 2000, new construction plans were re-submitted for review.
• October 26, 2000, the planning division reviewed the re-submittal and issued comments.
• November 13, 2000, The City of Wheat Ridge Building Division reviewed the re-
submittal and issued comments.
• November 29, 2000, the City of Wheat Ridge Public Works Department and Planning
Department reviewed the re-submittal and issued commen[s.
• December 8, 2000, City staff had a meeting with Mr. Delmain to explain what
outstanding items still need to be resolved before a building permit can be issued.
As you can see by this chronological of events the ciry took approximately thirty-three (33) days
to review the first submittal and approximately (28) twenty-eight days to review the second
submittal. Although this project appears to have been in process with the City for seven (7)
months, the City has realistically only taken two of those seven months to complete our review
process and issue review comments.

The list of outstanding items needed to complete the review process is as follows:
• Corrected site plan showing entrance in correct Incation
• Copy of previously approved development covenant that has been conveyed to the
current owner of the property. Please be aware that if this document cannot be
produced, a new Development Covenant will be processed and will require an
escrow be submitted and held in perpetuity by the City of Wheat Ridge.
• Drainage letter from the engineer oF record amending the existing approved
drainage report of the subdivision and stating the proposed improvements to [he
site meet the designed and approved criteria of the subdivision.
• The new incinerator that has been installed on the west side of the building should
have received a building permit to be installed. Provide speciScations and
installation information From the manufacturer for review as pazt of the current
improvements.
• A copy of approval information far the installation of the incinerator from the
county health department and state air quality organization.
Once all of these items have been submitted and approved by the appropriate departments, a
building permit can be issued.
I, as the Codes Administrator am the person responsible for ensuring that all approvals from the
appropriate departments have been received prior to signing off on a building permit and issuing
said permit. Mr. Garcia reviewed the first submittal on June 30, 2000; his comments were given
to myself and passed on to your contractor the same time all other correction items were passed
along. Any additional comments or requirements Mr. Garcia expressed in his November 29, 2000
review comments were as a result of the changes that had been made to the site plan since our
first review in July 2000.
I have outlined the information needing to be submitted and approved in order for your building
permit to be issued. If all outstanding issues are addressed correctly and the correct information is
submitted in a timely manner, then and only then will the City be able to issue your building
permit.

• A copy of approval information for the installation of the incinerator from the county
health department and state air quality organization.
Once all of these items have been submitted and approved by the appropriate departmenu, a
building permit can be issued.
I, as the Codes Administrator am the person responsible for ensuring that all approvals from the
appropriate deparhnents have been received prior to signing off on a building permit and issuing
said permit. Mr. Garcia reviewed the first submittal on June 30, 2000; his comments were given
to myself and passed on to your contractor the same time all other correction items were passed
along. Any additional comments or requirements Mr. Garcia expressed in his November 29, 2000
review comments were as a result of the changes that had been made to the site plan since our
first review in July 2000.
I have outlined the information needing to be submitted and approved in order for your building
permit to be issued. If all outstanding issues are addressed correctly and the conect informarion is
submitted in a timely manner, then and only then will the City be able to issue your building
permit.

I am sorry that I will not be able to attend the planning
commission meeting on Thursday March 20, 1997. I would
like this letter to be read during the meeting, if
possible. I operate a pet cremation business at 12000 W.
52nd avenue, Wheat Ridge, C0. Pro-Vet provides both private
and communal animal cremations for our customers in the
west metro area. We are the only service in this area.
The alternatives for animal disposal are the landfill or
the rendering plants. We believe our company provides a
valuable service to the residents of the west metro area.
Our customers are the public and the veterinary clinics in
our geographical area. We began our service in 1996 after
completion of our new building and equipment dedicated to
providing this service.
Before I purchased this property, 3 1/2 years ago, I met
with Meredith Reckert and John Eckert to confirm that the
zo:iing was proper for our pet crematicn busines-. I was
told by both parties that this was the correct zoning and
was given copies of the zoning requirements. In the
beginning of 1996, we demolished the rental building on our
property and began construction of our new 2 story building
for the pet cremation service. Before we obtained our
building permit, I met again with John and Meredith to
confirm that the zoning was proper.
we began construction on our building, obtained the
necessary permits and began to use the facility in the

summer of 1996. We built the building specifically to
house our cremation equipment, nothing is outside or in
the view of the public. The cremation units are state of
the art, fully permitted by the State of Colorado. They
operate cleanly with no odor, smoke, or visible emission.
Each unit fully complies with State and Federal EPA
regulations. Similar units are installed at Table Mountain
Animal Control Facility in Jefferson County. The process
is the same that is used for human crematories such as the
unit at Crown Hill.
At present, we have an investment of over $ 300,000 in
building and equipment that cannot be written off in a 5
year amortization schedule. Our business is such that we
cannot pick-up our equipment and move it to a new location.
This would be a great cost. If the new amendments would

In addition, our business does not encourage or increase
traffic flow in our area. we have one truck that we use
for pick-ups from the veterinary clinics. Our facilities
are clean and animals are stored in freezers until they are
cremated. There is no open or visible storage. The
cremation systems operate quietly, completely within our
building.
I am a person of limited funds. I cannot afford to move
our business in 5 years time. That would impose a severe
economical hardship on me and our employees. If someonecall
interested in seeing our facility in operation, plea
and I would be glad to conduct a tour.

This letter is in regard to your application for building permit for propeRy located at 12000 West
52nd Avenue within the City of Wheat Ridge.
You have demolished an existing structure on the property and have applied for a building permit
to construct an approximate 2000 squaze foot building addition to the existing 2400 square foot
building already on the property.
Your existing building which is used as an animal crematorium was constructed in 1996 as an
allowed use in the Industrial zone district. Subsequent to the permit being issued, the City of
Wheat Ridge amended the Code of Laws to require a special use permit for crematoriums. Since
your building was already in existence at the time of passage of this legislation, it is considered a
non-conforming use. Pursuant to Section 26-7. Nonconforming Lots, Uses and Structures., of
the Wheat Ridge Code of Laws, a non-conforming use can remain "as is" in perpetuity but
cannot be expanded without bringing the property into conformance. Therefore, a special use
permit process is required prior to issuance of a permit for the property. The special use permit
process is a two step process requiring public hearings in front of both Planning Commission
and City Council and a pre-application neighborhood meeting. A Type II site plan must be
submitted as part of the application package. See attached Special Use Permit process ~uide.
I would recommend scheduling a pre-application meeting with staff at your eazliest convenience

mentioned property. The property is zoned as Industrial, and currently exists as a mortuary and
crematory. The Wheat Ridge Code of Laws states that any mortuary or crematory in the Indusirial
district may only be allowed with a Special Use Permit granted by City Council. The crematory was
built on the property prior to the requirement for a Special Use Permit, and therefore is a legal non-
conforming use. This non-conforming use may continue provided that the nature of the business does
not change, expand or cease for a period of sixty (60) days. Should the use cease for sixty days, or if
any expansion or changes aze planned, the property owner must apply for and receive a Special Use

The timetable for moving the trailer is not workable for us. If the city retires (2) weeks
or more to review our application, and we received your letter on Apri19 , that would
only leave us about a week or so to accomplish all the requirements of Mike's Apri140'

strange in that you will never pave over an inigation ditch. I need to have a definitive
answer on this requirement. It adds a significant cost to our building project.
Other parts of the permit application have been addressed. We have a new drawing that
details our cure-in pad. We have the landscaping plan revised - although the driveway
could change that.
We aze going to see that the permit moves forward as fast as possible. We do not want to
be in this trailer any longer than is absolutely necessary. But, there is absolutely no way
that we can have all these items addressed in that time frame.

To respond to your letter of March 26`h, we will need to be in our trailer for a while
longer. It serves as our office for both Pet Cremation Services and FM Systems. I have
the application for our building permit ready to resubmit. There aze (2) items remaining
at issue:
One is the requirement for the previously approved development covenant on this
property by Mike Lucas. I could not find anything in our closing documents on this
property other than the standazd language of the title policy. (I do have the title policy).
The requirement for the escrow amount is the hold up for us.
The sewnd issue is the requirement to have the drain study redone. When we first
obtained this property, our intent was to have the old house demolished and (2) new
buildings expected. The new building proposed will not have any effect on the drainage
on this property. The building is at the same elevation as the existing building. Drainage
will be around both sides of the buildings as originally engineered. I ask that this
requirement be waived.
The last item in the requested information regarding the incinerator equipment. Part of
FM Systems work is building new animal cremation systems. We also repair and modify
(recondition) older incineration systems to meet new regulations. We also will build and
test new equipment for sale to the pet cremation industry. The concrete pad on the west
side of the property line will be used to test new equipment and to cure-in the systems
before shipment. I will need to add a gas hookup for this test pad. I will resubmit that
information with the permit application. I will furnish a sepazate detail for this addition.
Please review my request for the first (2) items. If we can resolve these (2) issues, I will
resubmit the plans for approval.
