Midroof & Final Roof inspections for ROOFS 6/12 PITCH & OVER: 3rd party inspection will be
required for both the midroof and final inspections. The 3rd party inspection report AND
THE ORIGINAL PERMIT CARD needs to be dropped off to the Permit Desk at the City of Wheat
Ridge. The report MUST BE SIGNED by the Homeowner.
REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec.
R806. The installation of ridge venting requires the installation or existence of soffit
venting. For calculation purposes, one hat or turtle vent equal to one-half of one square,
foot of opening.
Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name) roof
covering" is required to be on site at the time of final inspection.

1. This permit was issued based on the information provided in the permit application and accompanying plans and specifications and is
subject to the compliance with those documents, and all applicable statutes, ordinances, regulations, policies and procedures.
2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Building
Official and may be subject to a fee equal to one-half of the originalpermit fee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to the standard
requirements, fees androcedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief Building Official and is not guaranteed.

Residential Roofing Permit Application
This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received and due to the volume of requests, time to process
varies and is subject to change. YOU WILL BE CONTACTED WHEN YOUR
PERMIT IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE
AND TIME WINDOW TO COMPLETE THE TRANSACTION. You will be notified if

your contractor's license or insurance has expired, and you may update those
documents at the time you are issued your permit.
For all other requests:
Homeowners wishing to obtain a roofing permit must apply for the permit in person
at City Hall. Revisions to existing permits (for example, to add redecking) must be
completed in person at City Hall. All other non -roofing permits must be completed in
person at City Hall. The Building Division will be open from 7:30-10:30 a.m.,
Monday through Friday to process these types of requests.

in It represents only the known cost of this contract at the time it is signed. 'Estimate' amount is an initial estimate of the cost of the scope of work and has no bearing on the total
amount or the final total amount to be paid
2. Customer is to provide all insurance paperwork related to this claim to Company including but not limited to the Property Owners/Homeowners Insurance Loss Sheet Failure of
Customer to provide this information in a timely manner and/or allow Company access to this information does not affect the Total Amount to be paid by customer as specified on
the front of this contract and in section 1. Refusal of customer to provide this information is a default of this contract on their part,
3. If Customer is intending to make payment on this contract from the proceeds of a property and casualty insurance policy Customer may cancel any scope of work that is denied by
their insurance company without penalty. Customer must notify Company within 72 hours of receipt from their insurance company denying the claim related to this contract Any
part of the claim allowed by insurance company remains a part of this contract. Customer agrees to allow Company to pursue this claim with their insurance company until final
negotiations are completed. Final negotiations are considered to be complete when Company agrees to no longer pursue the claim.
4. Customer by their signature on this agreement extend this agreement with its terms and conditions to their insurance company regarding any claim related to this contract and requests
their insurance company la pay contractors overhead and profit and to provide any and all information regarding such claimis to Company..
5. Customer agrees to furnish contact information and account numbers for insurance and loans on the subject property for collection purposes, and hereby requests insurance arid
lenders to assign disbursements for this project to Company and make payments jointly to Company and the property owner, By following these requirements Customer is allowed
to make payment on this contract as paid by Insurance and/or their Bank or Mortgage Company,
6. Customer shall allow Company to proceed with the work as outlined in this contract or the insurance loss sheet within 60 days from signing this contract or upon receipt of initial
payment or settlement. from Property Owners insurance company or tie considered in default of this contract. Company may start work after the 60 day period due to delays negotiating
with insurance, scheduling conflicts. weather, material availability or other reasons not stated here. Completion of work by company is contingent upon delays due to weather, strikes,
accidents or other delays beyond Company s control.
7. Customer will provide required access to their property during daylight hours in order for Company to perform the work slated in this contract. Customer will be in default of this
contract if access is either denied or unobtainable and arrangements have not previously been made with Company. Customer will allow company to use driveways for access to
load & off-load materials unless other arrangements have been agreed to in writing by both parties on the front on this contract.
B. All material is guaranteed to be as specified. Company has the right to order excess material. Any material left over after completion of work is excess and is not part of this agreement,
This excess material belongs to Company.
9. All work will be completed in a workmanlike manner according to standard practices. Company agrees to meet or exceed all municipal inspection requirements Company shalt not
be held liable by Customer for any and all work that passes final inspection by the municipality and/or the applicable manufacture no mater the circumstance.
10. Company warrants it's workmanship to be frco of major defects for the period staled on the front of this contract next to Company Warranty as stated herein. Company warranty
covers only the specific work completed by Company and will be void if any subsequent alterations are made to the roof, exterior. or any item in this contract by others without prior
written consent from Company. Company Warranty written on this contact is for new roofs only, all other scopes of work performed by Company come with a 1 year workmanship
warranty unless otherwise specified on the actual written Company warranty Card. Partial repairs made by Company do not come with a warranty unless otherwise stated on the
front of this contract. Company Warranty is effective only during the Company Warranty period written on this contact and/or the Company Warranty Card. Company is not liable for
any installation defects after the warranty period and is not liable for consequential damage at any time regardless of circumstance. Company is not responsible for damage to
the roof and exterior, nor any consequential damage, due to roof teaks and/or exterior damage caused by: severe weather, excessive wind over 50 m.p.h., hall, wind
driven rain, Ice dams, preexisting or future construction defects, lack of maintenance during the warranty period, alterations made after the roof was Installed, and/or
failure to notify Company of any leaks right away. Company must be notified of leaks in time to mitigate any subsequent damage. Company is not responsible for any darnage
to concrete driveways, except as a result of carelessness on behalf of Company.
11. The execution date of this contract will be the earliest date written on this contract once this agreement is signed by Customer.
12. This contract shall be considered as cancelled by Customer upon receipt of written notice of cancellation by Company in writing as signed for in person, via facsimile or through
U.S. Mail or 10 days after company sends notice to Customer of failure to perform on this contract.lf this contract is cancelled by the Customer prior to the commencermill of work
more than 72 hours after the date this agreement was signed. Customer shall pay to Company twenty percent (20%) of the contract pi ice plus any and all job related expenses or a
minimum of $500.00, whichever is greater. for Company's services. It this contract is cancelled by the customer after commencement of work, customer will pay. in addition to the
cancellation fee the cost of materials, tabor and associated profit for work completed up to and including the date the cancellation Customer. Work commences with Company's
negotiation with insurance company. and continues with the subsequent paperwork. follow-up and scheduling until the job is installed and complete. Payment should be made to
Company and delivered or mailer! to Company's address listed on front of this contract.
13 Payment is to be made for each portion of work as it is completed. Customer shall be in default of this contract if payment is not made to Company as staled herein or later
than 10 days from completion of each portion of work unless payment is to be made from proceeds of an insurance claim from Customer s Insurance Company in which case Customer
shall be in default of this contract if payment is not made to Company within 10 days from receipt of these proceeds from their insurance company. unless otherwise authorized in
writing by Company. Customer is not to withhold funds from Company greater than the value of any work or portion thereof that has not been completed Final paynrerit in full shall
not be held while waiting for the city local or other inspectors to inspect the work. Customer is not to withhold payment of the balance owed upon completion of work for any
reason unless stated herein. Company will make a reasonable attempt to satisfy any Customer concerns upon completion of work if payment has hero made in full.
Company will be allowed ample time to complete warranty work.
14. Should default be made in payment of this contract. Customer shall pay a $100 00 fare fee plus interest charges added from the original due date at a rate of eighteen percent per
annum (18`/o PER ANNUM) with a minimum reasonable charge of $15.00 per month. If placed with a collection agency and'or in the hands of an attorney for collection, all collection
fees, at orney fees, court costs. legal and filing fees shall be paid by Customer accepting said contract. Additionally, Customer shall pay 530.00 if a lien notice is issued and $250.00
Plus all filing fees if a lien is filed. If customer is in default of this contract, any and all discounts or credits given by Company to Customer will be null r3 void and the full
amount due.
15if there is any dispute arising under this conhact. Customer will be responsible for Company's reasonable attorney s fees and costs including but not limilod to all filing fees and
court costs. Customer agrees to a venue for any litigation or court proceedings in Jefferson County. Colorado as governed by Colorado State law.
16. Prior to litigating any dispute arising out of this agreement, customer agrees to mediate and/or arbitrate said dispute through the dispute resolution program offered by the 888 Serving
Denver/Boulder (8 8). By agreeing to submit any dispute arising out of this agreement customer agrees that no dispute shall be submitted to arbitration prior to the exhaustion of
informal grievance procedures traditionally used by the 888. Customer further understands that the arbitration decision is legally binding on all parties involved in the dispute.
17. This Agreement consfitutes the entire agreement between both parties. It may be changed only by a new contract or written instrument, initialed or signed by both parties. This
does not preclude additional work performed by Company as verbally agreed to by both parties, change orders, addendurns, etc. Any alterations or deviation from above specifications
involving extra costs as requeslod by the Customer verbalfy or in :voting will become an extra charge over and above the amount due and payable by the Customer.
18. Any representation. statements or other conunumcations not written in this contract are agreed to be immaterial. and not relied on by either party, and do not survive ttie exeCUtlan
of this contract with the exception of a verbal authorization by customer to perform additional v✓ork.
19 If any provision of this agreement should he helo to be invalid or unenforceable the validity and enforceability of the remaining provisions of this agreement shall not be affected
and shall remain fully enforceable.

The following is a history of the property located at 12050 West 52"d Avenue.
The owners, Eileen and Emanual Valentino, purchased the property in 1992 with the intent of
relocating their concrete contracting business, Cirywide Enterprises; Inc., onto it. At the time of
purchase, they checked with the City who informed them the property was zoned Industrial. Neither
the owners nor the city have written verification of this occurring.
A miscellaneous building permit was issued on October 28, 1992 for installation of a concrete
driveway and parking lot. Included as a note was "Landscape buffer must be 10' wide"
(Attachment 1, approved permit application). Attached to the permit is a site plan, which illustrates
the proposed commercial improvements (Attachment 2, site plan).
Another building permit was issued on November 12, 1992 for construction of a freestanding garage.
In the section of the permit for planning sign-off was a note indicating that the property is zoned
Industrial. There was also a note indicating that prior to an issuance of a certificate of occupancy
that "landscaping and parking standards for commercial uses" must be met (Attachment 3, approved
permit application). It is indicated on the permit to "see attached". There is no attachment in the
file.
According to the property owner, the structure was converted from a house to a commercial office
when the garage and site improvements were completed. This included removal of the kitchen and
conversion of the bathroom to be handicapped accessible. A concrete ramp was poured to allow
handicapped access into thc- onlv door into the buildinR A field visit conducted on Ocfiher?2
2003, verified that these improvements occuned and are still in place. There are no copies of
certificates of occupancy for the structure conversion or garage construction.
In 1999, the owners relocated their concrete contracting business to the 44`h Avenue Industrial Park,
at 12951 W. 43`d Drive. The property on W. 52"d Avenue was leased to Rocky Mt. Tree Care, Inc.
In 2002, the tree company applied for a business license. It was approved with a zoning designation
of A-2. The approved license also indicates that the use is in a commercial structure and that there
aze seven employees (Attachment 4, business license).
The City's zoning map designates the property as being zoned Agriculture-Two (Attachment 5,
existing zoning map).
A copy of the zoning map in place in 1992 designates adjacent land on all sides, except to the west,
as being zoned Industrial. The written "A-2" designation covers the property to the west and
extends slightly on to the subject site (Attachment 6, previous zoning map).
The existing tenant on the property is moving to a new location so they can expand their business.
The property owner, Eileen Valentino, is desirous of renting the property. She contacted the
Community Development Department in mid-October to verify allowed uses. It was at that point
that we became aware of the zoning discrepancy. The owner has been very cooperative but is getting
impatient, as she needs to lease the property to generate income.
Issues for consideration:
Is there liability on the part of the city for issuing permits with inaccurate information? The
owner has spent considerable amounts of money based on the city issuing permits for
construction, which the owners believed to be legal.
Should the property be considered a non-conforming use? If so, what would allowed uses
be? The original use acknowledged by the city as being allowed was for a concrete
contracting company.
How do we correct the problem with the zoning map? Would an administrative correction be
appropriate? Or, should the owner rezone? Per the Zoning and Development Code, if the
property is less than one acre it can be rezoned to industrial. The property in question is
roughly 12,000 square feet in size; therefore a zone change to I would be possible. Would
the city be willing to waive fees?
In the interim, how should the owner advertise allowed uses on the property? As A-2 or I?
