Dear Mrs. Fisher,
I received a letter from Travis Crane, employee in the Community Development
department. Travis advised you were upset with the neighbors of 4695 Wadsworth Blvd.
on the evening of August 4t' and had called the police because they were disruptive and
may have been drinking.
I looked up the report for the incident on August 4, 2005, 11:15 p.m. Officer Gonzales's
report indicates he responded to a disturbance at 4695 Wadsworth Blvd. He contacted an
intoxicated male and determined he was a danger to himself or others, so he took him
into custody and transported him to Detox. The male Officer Gonzales contacted was 35
years of age and there was no other indication of criminal activity found at this location.
The report also indicated the male was living there with his wife.
I would encourage you to continue to call whenever you observe a disturbance or wimess
what appeazs to be criminal activity going on at this location. The Police Department
would rather respond and investigate when the suspicious/criminal activity is occurring,
than to have information come in later that we cannot really do much about.

TERMS AND CONDITIONS
As applicant for a building permit in the City of Wheat Ridge, I do hereby agree to the terms and
conditions set forth below for the issuance of a Certificate of Occupancy in connection with this
building permit. The issuance of a Certificate of Occupancy requires:
1) The completion of all required landscaping and related site improvements. inspections
are performed by the Planning and Zoning Division.
2) The compietion of site drainage/grading requirements per the approved site grading
plan and/or final drainage report and plan, i( such report and plan is applicable. For all
residential and nonresidential projects with an approved final drainage report and plan, a
letter of certification is required from the civil engineer of record. Inspection are performed
by the Public Works Department.
3) The completion and acceptance by the City of Wheat Ridge of all required public
improvements, or a Development Covenant or cash escrow may be required in lieu of
construction, as determined by the Public Works Department. The Public Works
Department performs public improvements inspections.
4) The completion and approval of a Certificate of Occupancy Application form and final
inspections. Inspections are performed by the Building Division.
All the above items must be completed and approved by Planning and Zoning, Building and
Public Works before a Certificate of Occupancy is issued. Finai Inspection by the Building
Division does not constitute authorization of a Certificate of Occupancy nor permission for
occupancy. Occupancy of the structure is not permitted untii the Certificate of Occupancy
is issued. (Uniform Building Code, Section 109)
The City is not responsible for any real estate ciosings or other agreements concerning the
property which may be affected by failure to complete the above items and obtain a Certificate of
Occupancy.

Dear Mr. Petty:
I have completed my second review of the building permit for the property located at 4695
Wadsworth Boulevard, and I have the following comments:
1. The paved driveway as shown on the site plan is acceptable. You should be aware that
the proposed driveway should extend to the edge of existing pavement.
2. The parking area must be contained in some fashion. The site plan does not indicate
what materials will be used to accomplish this.
3. You should be aware that when the landscaping is installed, a maacimum of twenty
percent of the landscaped area may be non-living landscaping, such as bark or rock. The
area adjacent to Wadsworth Boulevard labeled as "Xeriscape" on the site plan is
somewhat ambiguous. Please be aware that if rock is placed in this enYire azea, the
maximum standard for non-living landscaping will be exceeded.
4. The proposed fence (as described in number 4 of the building permit) is acceptable.
Please be aware that any fence located within the front yard setback azea may not exceed
six feet in height. A thirty-six inch high fence is acceptable in the front yard setback
area.
Prior to issuance of a certificate of occupancy, Darin Morgan will need to walk through the
structure to ensure that all work performed is accurate. If needed, a building permit application
for the interior work that was initiated/completed in 2002 must be submitted and reviewed.
After this inspection, assuming all improvements have been constructed according to the
submitted and approved plans, a certificate of occupancy will be issued. It would be in yow best
interest to contact Walt Petit of the Wheat Ridge Water District to discuss any issues with water
service.
The building permit for the garage door conversion and associated landscaping and parking
improvements is approved provided the above issues are resolved. A site inspection will be
required upon completion of the construction/installation. Please be aware that if any of these
items are not addressed, a certificate of occupancy may not issued. I have attached my letter
dated 13 January 2004 that details the conditions of approval, as specified by the Boazd of

Deaz Mr. Petty:
Pursuant to Case Number WA-03-21, the City of Wheat Ridge Board of Adjustment approved your
request (with conditions) for a two-family dwelling unit for property located at 4695 Wadsworth
Blvd. The submitted building permit details the scope of work to be: permanently closing the
garage door facing Wadsworth Blvd., a new 12-foot by 25-foot asphalt driveway from West 47`"
Avenue and landscaping pursuant to city requirements.
After initial review of the submitted building permit, I have the following comments:
1. Please submit a legible site plan that details the location of the existing house in relation
to the property lines.
2. The site plan should detail the accurate location, size and species of all existing and
proposed trees. You should be aware that four street trees will be required prior to
issuance of a certificate of occupancy. These street trees must be at least 2.5 - 3 inches in
caliper, and must be located within the front yard setback area adjacent to the public
right-of-way.
3. After a cursory site visit, Yhe front yard appears to be deficient in respect to landscaped
azea and material. You should be aware that prior to issuance of a certificate of
occupancy, and as a condition of approval by the Board of Adjustment, 100% of the
front yard and not less than 25% of the entire lot shall be landscaped.
4. The proposed gravel parking area should be detailed more clearly on the site plan. As a
condition of approval by the Board of Adjustment, any pazking areas should be clearly
and permanently delineated. Additionally, all parking spaces shall conform to standazds
established in the Code of Laws. Each parking space shall be 8.5 feet wide and 18 feet
long. A gravel or road base surface is acceptable, however any gravel ar road base
should be contained on all sides in a permanent fashion with the use of a permanent
delineator.
5. A right-of-way permit must be completed and approved prior to commencement of work
on 47"' Avenue. The driveway connection on W. 47`h Avenue must extend to the edge of
existing asphalt. The first 25 feet of driveway (measured from the property line south)
must be paved.
6. A right-of-way permit must be obtained by the Colorado Department of Transportation
for any work in the Wadsworth Boulevard right-of-way. The Board of Adjustment
granted the variance with the condition that the curb cut on VJadsworth Boulevazd be
permanently sealed, and the garage door facing Wadsworth be permanently sealed.
7. If a fence is proposed on this property, a fence permit must be completed and submined
to the Building Department for review.

Please be advised that at its meeting of December 3, 2003, the Board of Adjustment APPROVED
your request for a 24.9 square foot variance from the 12,500 square foot minimum lot area
requirement to allow a two-family dwelling unit on property zoned Residential-Two and located at
4695 Wadsworth Boulevazd for the following reasons:
1. The Board feels this variance will not substantially alter the character of the locality.
The vast majority of the neighborhood is zoned R-2, including R-3, RC and NC
directly to the south along Wadsworth.
2. The granting of this vaziance will not be detrimental, in itself, to the public welfare or
injurious to other properties or improvements in the azea.
3. The additional units will not impair the adequate supply of light or air to adjacent
properties nor should it significantly increase congestion in the public streets.
4. This request entails approximately a.2% variance.
5. The applicant iias madc signiiicant el7'ort to minunize dhis vuriance request b}'
acquiring 602 square feet along the Wadsworth Boulevazd frontage from the Colorado
Department of Transportation. Applicant further testified that CDOT has declined to
sell further frontage to acquire the shortage of 24.9 square feet.
6. The footprint of the current structure will not be increased in dimension as a result of
the variance.
The city traffic engineer has reviewed and approved the street access from this
property to West 47' Avenue.
With the following conditions:
The curb cut from Wadsworth Boulevard must be closed and access to the property
shall be limited to West 47`h Avenue.

2. The current garage door facing Wadsworth must be abandoned and permanenUy
sealed. A new gazage door accessing from the west will be allowed.
3. No parking of any kind may occur along the Wadsworth Boulevard frontage.

This case was presented by Travis Crane. He advised the Boazd there was jurisdiction to
heaz the case. He entered all pertinent documents into the record and reviewed the staff
report and digital presentation. Staff recommended approval of the application for
reasons outlined in the staff report. Mc Crane distributed the following to Boazd

Mr. Petty, the applicant, was swom in by Chair DRDA. He stated that, in addition to
information contained in the staff report, it should be noted that there is an existing R-3
property directly adjacent to his property to the south and is being used as a 3-family
dwelling; and the building does have ground level access which would make it
handicapped accessible. He stated that when he purchased the property three years ago,
he was not awaze that CDOT had purchased part of the property as right-of-way. Based
upon the city's estimate that the property was 11,900 square feet in size, he purchased
602 square feet back from CDOT which he ihought would bring the size of the lot to over
the required 12,500 feet. However, he learned the 11,900 squaze feet was an estimate and
an actual survey revealed that there is still 24.9 square feet (or three inches of the entire
length of the eastern propeRy line) short of the required squaze footage. He approached
CDOT to purchase additional propercy but was informed they would not sell additional
property at this time. He stated that he coald have purchased additional propefty from
CDOT if he had realized that the 11,900 figure was inconect.
In response to a question from Board Member HOWARD, Mr. Petty explained that the
first floor has two entrances (one entrance to a one-bedroom unit and the other to a two-
bedroom unit which has access to the basement). One unit has an entrance from
Wadsworth and the other has an entrance from the driveway (47`h). There is a second-
story unit that is inaccessible from the inside of the house and contains two bedrooms,
bathroom, living room and kitchen. He stated he has never added kitchens or bathrooms
to the structure. He plans to have a single-family unit on the entire first floor and a
single-family unit, which has a separate outside entrance, on the second floor.
Chair DRDA asked to heu from members of the public who wished to address the
matter.

Ms. Fisher was sworn in by Chair DRDA. She expressed opposition to the application.
She expressed concern that more than two uniis would be rented out if the variance is
approved. She stated there was moce than syuare iootage at issue in thut the propeny
doesn't meet setback, landscape or pazking requirements. She expressed concern about
decreased property values in the azea if the property is rented out as a duplex. She
submitted a copy of the city's traffic study, dated July 29, 2002, into the record.
Board Member ABBOTT commented that the only issue the Boazd can address is
whether the property can accommodate a duplex and asked staff to address the issues of
parking, number of people living in the dwelling, etc.
Travis Crane replied that Board Member ABBOTT was coaect that the Boazd's decision
should be based upon the square footage issue and whether or not the property could

support a duplex. The other issues, such as cars parking on the lawn, should not be a part
of that consideration. If pazking or other infractions occur, code enforcement would
address those issues. He also noted that the Board has the flexibility to require certain
conditions of approval such as delineating parking areas from landscaped areas.

Mr. Barrett was swom in by Chair DRDA. He lives across the street from the subject
property and expressed his opposition to the application. He stated the only driveway on
the property w'as from Wadsworth and another driveway was created by cars driving and
parking on the ]awn. He stated that it is dangerous for drivers to back out of this property
onto 47`h.
In response to a question from Board Member ABBOTT, Travis Crane stated that he did
not know how many neighborhood complaints have been made to code enforcement
regarding this property.
Joann Fisher PRAFT

Ms. Fisher was sworn in by Chair DRDA. She spoke in opposition to the application.
She asked the Board to consider the impact on the neighborhood if a duplex is alloWed.
She stated that she has reported the tenants of this property several times regazding
tenants' cars racing down the street and the parking situation. She expressed concern
about increased traffic if a duplex is allowed.
In response to a question from Board Member BLAIR, Ms. Fisher stated that prior to Mr.
Yetty's purchase, the house had always been used as a single-family residence.
Ms. Fisher entered into the record a letter of opposition from John J. Reczek, 7775 West
47`h Avenue.
Jeff Petty retumed to the podium to state that there is no additional unit in the basement
nor dees he plan to build an additional living unit in the basement. He stated that he
evicted tenants after code enlurcemen[ informed him that [he building could iwt be rented
as a duplex. Cazs were also removed from the property as a result of code enforcement
action. He stated there is presently parking room for four cazs. He is also planning to
add an additional pazking azea next to the driveway on the west He stated that there is a
gentleman presently living in the house to do repairs and keep the house from being
vandalized. He also commented that there are many other duplexes in the immediate
❑eighborhood. He also stated that it was his understviding that the previous owner had
many family members living in the house.
Board Member HOVLAND commented that the issue at hand basically concems square
footage and he would like to see parking addressed as a condition of approval.

Boazd Member ABBOTT commented that he was sympathetic to the neighbors' concerns
about parking and landscaping and would address those issues in a motion. He pointed
out that these same problems could occur with a single-family house.

published, it was discovered that the landscape buffer requirement did not apply.
Therefore, the fence height variance is the only matter to be considered at this meeting.
She advised the Boazd there was jurisdiction to heaz the case. She entered all pertinent
documents into the record and reviewed the staff report and digital presentation. Staff
recommended approval of the application for reasons outlined in the staff report.

property 4695 Wadsworth Boulevard. I have included the sections of the Code regazding
landscaping, parking and fencing. I have also included three building permit applications. I spoke
with Darin Morgan, Chief Building Official far the City of Wheat Ridge, and he indicated that a
separate permit must be submitted for the window replacement and for the landscaping/pazking
improvements. I have included a third building permit application for the interior work that was
initiated/completed in 2002. Darin Morgan will need to walk through the structure to ensure that all
work performed is accurate. After this inspection, assuming all improvements have been
constructed according to the submitted and approved plans, a certificate of occupancy will be
issued. You will not need to submit a building permit application for general maintenance repair to
the roo£ If any work beyond general maintenance repair is performed, a building peanit application

Cannen Berry, of the city attorney's office, advised that the legal documents entered into
the record had no bearing on this hearing. This hearing involves public zoning issues
while these documents relate to covenants which aze private restrictions and should not
be considered by the Board.
In reply to a question from Board Member ECHELMEYER, Mike Pesicka explained that
the owner of the property, Morton Silverman, gave power attorney to Jeff Petty to
represent him at this hearing. He also explained that, in 1959, owners of the property
conveyed 2100 square feet of the lot to be used for highway right-of-way.

Jeff Petty, the applicant, was sworn in by Chair MONTOYA. He stated the property was
purchased as a duplex and possibly a triplex. The realtor. Jim Urba_tLOf i Trhan -
ompantes, presente3 the property as a duplex with the potential to be used as a triplex.
He also stated that he is aware that the property may only be used as a duplex since it is
zoned R-2. He submitted a letter he received from Michael C. Buttes, conservator of the
estate for the wife of the builder. He read the letter into the record as follows:
Please accept this letter as confirmation of our telephone conversation regarding the
above property. As 1 indicated to you, as the Jefferson County Public Administrator, I
am the court-appointed conservator for Cornelia D. Co[den who may also have been
previously known as Alma Dodson Colden as well as Alma Dodson. As part of my
assistance to Cornelia, I marketed and sold her home at 4695 Wadsworth, Wheat Ridge,
Colorado, to Ronald W. Rice on October 31, 2000. At the time of sale, the configuration
of the home was as follows: The southern portion of the main floor consisted of two
bedrooms, a bath, a kitchen and a living area. The northern portion of the main floor
consisted of what I would call a studio area including kitchen facilities and bath area.
The upper floor consisted of a third studio area consisting of a living area, kitchen
facilities, bedroom area and I do not recall ifa bathroom area is included. (Mi• Petty
stated that there is an existing bathroom in the area.) I recall the basement of the
property being an unfinished open space area. Mr. Pe[ty inquired of ine as to the length
of time the Colden's owned the property and, although I cannot give you a complete
answer, I do have a deed from Ms. Colden's husband dated May 11, 1972 to Cornelia
Colden. It is my belief that the Colden's built the current structure on the property many
years prior to that and that the 1972 deed was merely an intra family conveyance. I hope
you f:nd this information helpful.
Mr. Petty stated that the main floor studio area is handicapped accessible. He stated that
fifteen years ago, two different families lived there and as recently as three years ago.
Presently, there is only one address. In the past two years, there has been a renter in the
downstairs apartment and Ron Rice and his partner were living in the other side of the

property. The appraisal stated that the property was zoned R-2 and therefore, the third
kitchen should be removed. Mr. Petty submitted the MLS information which stated the
property was a two-family and possibly three-family income property as well as a copy of
the purchase contract. He stated that he has invested approximately $60,000 in the
property including $30,000 to renovate the inside ofthe house and he has plans to clean
up the outside of the property. He further stated that a hardship exists if this property
must be used as a single-family residence. He plans to use the main floor and the upstairs

the Boazd to deny the request for variance and require the owners to clean up the
property. She stated that she has lived in the area for 37 yeazs and was never awaze of
apartments being rented in the subject structure.
Chair MONTOYA reminded Ms. Fisher that Carmen Berry had eazlier informed the
Board that the lawsuit Ms. Fisher referred to could not be considered in this case. He
also informed Ms. Fisher that she should contact the city's code enforcement office in
regard to the condition of the property.

variance. She expressed concem about cars parked on the property as well as a dumpster

property in 1999 at which time the subject house was used as a single-fanuly residence.
She expressed concem about a lack of pazking on the property if used as a multi-family
unit. She objected to the lack of maintenance of the property. She further stated that she
came before the Boazd of Adjustment for a variance to buiid a gazage on a half-acre piece
of property she purchased adjacent to her home and was told by the Boazd at that time

this was a condition placed by the Boazd of Adjusiment at the time the vaziance was
granted.

Ms. Fisher was sworn in by Chair MONTOYA. She expressed opposition to the granting
of the variance. She stated that the previous owner never rented to anyone. She felt it
would be too dangerous for a handicapped person to use the entrance referred to eazlier
by Mr. Petty because of its proximity to Wadsworth. Chair MONTOYA clarified that the
possible handicapped accessible entrance was not included in staff's evaluation of the
request.

appiication because it would have a negative effect on surrounding properties.
Jeff Petty returned to the podium for rebuttal. He stated that a lot of the traffic azound
the house has been due to ongoing construction. He also commented that traffic from his
property is rather insigruficant when compared to traffic generated by the 300 homes in
the azea. The back portion of the property as weil as the driveway can be used for
pazking and he clarified that the entrance he refened to as a possible handicapped
entrance is not located next to Wadsworth. He stated that he was willing to comply with
the conditions set forth in the staff report. He stated there is a multi-family use next door
which sets a precedent for multi-family use in the azea. His plan is to use the property as
a duplex, beautify the property and be a good neighbor.

Type of Variance: Request for approval of a 600 square foot variance from the
12,500 square foot minimum lot area requirement to allow an additional dwelling

1. No evidence was submitted that government entities of city, county, state or local
utility providers have ever recognized this structure as a legal or nonconforming
two-family use.
2. There was evidence that a previous owner conveyed for value a portion of the
originally platted lot to the State of Colorado thereby creating an R-2 lot
undersized for duplex use.
3. Numerous neighbors testified in opposition to the grantiug of this variance.
4. Neighbors testified that they had no memory of the structure being used as a
multi-family use prior to the year 2000.
5. Reasona6le testimony was provided by neighbors as to potential parking
problems likely to be exacerbated by multi-family use.
6. It would appear that approval of this variance request would provide no tangible
benefit to the surrounding neighborhood or to the city.

on the right-of-way dedication noted on our pazcel maps. The 1959 deed provided by Jefferson
County states that the dedication was for the "East 15 feet of Lot 29, Block 1, Hillcrest
Heights..... a pazcel containing (approximately) 2100 square feet." According to the original 1958
plat for Hillcrest Heights, the dimensions of Lot 29 were 140' x 100' (or 14,000 squaze feet).
From these findings, I would conclude the following:
1. The above-referenced property is approximately 11,900 square feet
2. Under existing conditions, only a one-family dwelling is permitted
