Installation of roof sheathing (new or overlay) requires an approved inspection prior to installation of ANY roof coverings and is require on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. In order to pass a final inspection of elastomeric or similar type roof coverings, a letter of inspection and approval from the manufacturer technical representative stating that "the application of the roof at (project address) has been applied in accordance with the installation instruction for (roof material brand name) roof covering" is required to be on site at the time of final inspection. The individual submitting the application indicated that an extensive remodel was under way at this address. No application for permit had been received prior to this application. (Exhibit #1) On March 7, 2011, an application for a Contractor's License for Evolution Development, LLC and an application for Building Permit for work at 7345 W. 28 Avenue was presented to the Building Division by Mr. Craig Pepper on behalf of Evolution Development. (Exhibit #2) The signed Contractor's License application (Exhibit #3) lists Craig Pepper as individual authorized to pull permits for Evolution Development. The building permit application was accepted for review, but a permit was not issued. Mr. Pepper inquired as to whether he was able to perform demolition work prior to permit issuance and was told that he could not. On March 11, 2011, a dumpster containing construction debris at 7345 W. 28 Avenue was observed by Building Division staff from the Municipal Building during a meeting. On March 14, 2011, the permit application submitted for review on March 7 th was completed, a permit created (Exhibit #4), and Evolution Development was contacted and informed that the permit was available for purchase. Also on March 14, 2011, an investigative site visit was conducted by Building Division staff and it was found that extensive remodeling work, of which electrical wiring and structural alterations was verifiable from the exterior, was underway or complete without a permit. A notice requesting that the owner /contractor contact the Building Division immediately was left on the front door of the residence. No contact was made by the end of the business day on March 14, so a Stop Work notice was posted on the property on March 15, 2011. On March 16, 2011, Mrs. Cynthia Dorroh, co -owner of Evolution Development, contacted the City Manager's office to file a complaint concerning the posting of a Stop Work notice and the assessment of an investigative fee on the permit. At this time, the required permit had not been purchased by Evolution Development. Mrs. Dorroh argued to the City Manager that the failure to obtain a permit was a simple clerical error and that Evolution Development does not perfonn work without obtaining the required permits. Jefferson County Assessor's records (Exhibit #5) indicate that Evolution Development purchased and re -sold a home in Wheat Ridge in September and December 2010 respectively, at 3005 Upham Court, prior to the purchase of the property in question at 7345 W. 28 Avenue. MLS listings for the property at 3005 Uphain Court (Exhibit #6) state that the residence had a "top to bottom remodel" including a "spacious new eat -in kitchen" and the addition of finished square footage in the basement. No permits were ever obtained for work performed at this location. On March 18, 2011, an on -site meeting was held at 7345 W. 28 Avenue. Present at that meeting were Craig Pepper, Cynthia Dorroh, City of Wheat Ridge Combination Inspector Kirk Cadotte, and Chief Building Official John Schumacher. Mr. Pepper was introduced by Mrs. Dorroh as the Project Manager. A walk - through of the property was conducted at this meeting and an extensive amount of complete or partially complete remodeling work was observed. At the time of this meeting, the building permit for this project had not yet been purchased by Evolution Development. The scope of work observed by Building Division staff that had been performed without permit included a new furnace and ducting system; structural alterations of interior bearing walls; installation of a basement egress window, including alteration of the foundation; installation of framing, plumbing and mechanical systems throughout the basement; installation of new electrical wiring throughout the structure; and additional miscellaneous remodeling tasks throughout the structure. Mr. Pepper acknowledged during this on -site meeting that he oversaw the work and was the responsible party on the project when the work occurred. He also acknowledged his personal performance of portions of the work. A list of items performed without work and requiring inspection or correction (Exhibit #7) was made during the March 18 meeting. Mr. Pepper, on behalf of Evolution Development, arrived at the Building Division on the afternoon of March 18, 2011, to pay for and obtain the required building permit for the project. Inspections of the work were subsequently performed and the work has since been completed and approved by the Building Division. Mr. Pepper was the responsible party with whom Building Division staff met at the project during subsequent inspections, and Mr. Pepper's phone number provided on Evolution Development's Contractor License application is the phone number provided for responsible party contact on at least four (4) of the inspections performed on the project. (Exhibit #8) Additionally, documents provided with the building pen application listing materials purchased at Home Depot for this project indicate Mr. Pepper as the party responsible for the order (Exhibit 49) and Mr. Pepper is listed as an individual able to pull pen under the Contractor's License (Exhibit #10) issued to Evolution Development. Mr. Pepper, on behalf of Evolution Development, knowingly performed work without the required permits and inspections. Mr. Pepper is listed as a person of authority on licensing documents for Evolution Development. Mr. Pepper was, with the exception of one meeting, the sole point of contact with the Building Division on behalf of Evolution Development. Mr. Pepper was the Project Manager and by documents provided the individual responsible for the coordination of the project and Mr. Pepper was the individual who submitted the permit and licensing documents on behalf of Evolution Development.
