Councilmember Terry Womble was absent. Also present: Deputy City Clerk, Christa Jones; Deputy City Manager, Patrick Goff; City Attorney, Gerald Dahl; Director of Community Development, Alan White; Director of Public Works, Tim Paranto; Director of Parks and Recreation, Joyce Manwaring; staff; and interested citizens. APPROVAL OF MINUTES OF November 27, 2006 Motion by Mrs. Sang for approval of the Minutes of November 27, 2006; seconded by Mr. Schulz; carried 7-0. Mayor DiTullio asked for Moment of Silence for slain Officer Ken Jordan from the Colorado Springs Police Department. CITIZENS' RIGHT TO SPEAK There was no one present to speak. Item 1. CONSENT AGENDA: A. Right of Way Dedication for Carr Street. B. Approve Award of the Phase III (E-Citation) implementation of Logisys Field Reporting (LFR) to Logistic Systems Inc., for the not to exceed amount of $43,680.00. C. Motion by Mr. Stites for approval of the Consent Agenda; seconded by Mrs. Sang. Mr. Gokey asked to pull Item D. Ms. Berry asked to pull Item E. Motion on all other items carried 7-0. D. Motion by Mr. Gokey to approve Resolution 57-2006; seconded by Mr. Stites. Mr. Gokey asked that Parks Director Joyce Manwaring give background on this property. Joyce Manwaring stated that the purpose for this purchase was to give pedestrian access to the Greenbelt from that location and a small parking area. It has historically been used as a greenhouse site and there is still a greenhouse located on it. There are some pesticides still present in the soil, but they are negligible to human health. To mitigate this, they are proposing to re-vegetate the area and put in either a gravel or asphalt parking lot. Motion carried 6-1 with Mrs. Sang voting no. E. Resolution 58-2006 was introduced by Ms. Berry, who also read the executive summary. Motion by Ms. Berry to deny Resolution 58-2006 for the following reasons: She believes that the Resolution as proposed does not fully meet the intent of Amendment 41 because it does not have an independent Ethics Commission; seconded by Mrs. Adams. Rights-of-entry were obtained from property owners to replace the sidewalks at their existing locations. During the lot line adjustment required of the property owned by Habitat for Humanity at 4690 and 4700 Carr Street, Habitat for Humanity agreed to dedicate five feet (5') along Carr Street for street right-of-way to accommodate the existing condition. Staff recommends that the attached quit claim deed be accepted by the City Council to complete this action. COMMISSION/BOARD RECOMMENDATION: N/A STATEMENT OF THE ISSUES: The sidewalk along 4690 and 4700 Carr Street lies outside of the existing street right-of-way. The property owner, Habitat for Humanity, is dedicating sufficient land along their frontage to provide that the sidewalk will be in the street. ALTERNATIVES CONSIDERED: Continue existing irregularity concerning the sidewalk along 4690 and 4700 Carr Street. FINANCIAL IMPACT: Acceptance of this Right-of-Way will have no costs to the City. These properties were the subject of a lot line adjustment plat in August of 2005. During the platting stages, the project was referred to the Public Works Department for review. One of the referral comments was that the applicant should reserve a 5 foot tract of land adjacent to Carr Street for eventual dedication to the City. I have included a copy of the plat which details this reservation. The property owner wishes to dedicate this reserved area to the City. The Code of Laws requires City Council action for any dedication of land. Please let me know if you need additional information regarding the lot line adjustment plat or case history. A note on the plat calls for a two foot section of property to be `dedicated' to the owner of lot 180 Clearvale Subdivision. A land transfer of this type would require a public hearing, and would in turn require the completion of the mineral rights certification form. The Community Development Department can only review and approve a lot line adjustment plat between two lots. As it was submitted, the proposed lot line adjustment plat is shifting lot lines between three lots. This is considered a minor subdivision. Additionally, the five feet of right-of-way should be noted as a reservation for future dedication to the City. The next step in the process will be the official submittal. For detached garages, carports and sheds: 30 foot front yard, and either 5 or 10 feet for the side and rear yard, depending on height or structure. There is a potential that either the primary structure or an accessory structure might be located within the 100 year floodplain limit; the site design will be dictated by the applicant. I feel the site is large enough that the 100-year floodplain limit will not be an issue. Given the large parcel size, coupled with the typical size of housing constructed by Habitat, it should be fairly easy to avoid the southern 15 or 20 feet of the parcel. Should the primary or accessory structure be located within the 100-year floodplain limit, a floodplain permit must be processed and approved by the City of Wheat Ridge. Plan: SF (6) Single Family not to exceed 6 dwelling units per acre Applicant/Owner Preliminary Proposal: Move lot line between two lots located east of 46th Avenue and Carr Street to create two lots of equal size for the purposes of constructing two single family homes, one on each lot. Will a neighborhood meeting need to be held prior to application submittal? NO Planning comments: The process to be followed depends on the status of the two lots as lots of record or unplatted lots. The information submitted shows the northern lot as Lot 11, and the southern lot as "unplatted". The City's subdivision records conflict with this assessment. In the Williams Subdivision, the northern lot is shown as Lot 10, and the southern lot as Lot 11, making each a platted lot. If the southern lot is unplatted, the request will be a minor subdivision. Lot line adjustments can be reviewed administratively. The minor subdivision in this case will require hearings before the Planning Commission and City Council. This process is discussed in further detail later. If the two lots are platted as lots of record, then a lot line adjustment plat can be reviewed administratively, meaning no public hearing is required. As there is a contradiction with the plat submitted and records regarding the status of these two lots, further information will be required at the time of submittal. Title work on the property, a deed, or any information that definitively states that these lots are either lots 10 and 11, or lot 11 and "unplatted" will be necessary to proceed. Please be aware that there is anticipated street reconstruction in this area, expected to be phased in over the course of the next two years. It would be preferable for the City to be informed of where the curb cuts are existing and proposed for the two single family homes. This information would be beneficial in coordinating the street reconstruction for this street frontage. There is a well of some kind shown on the south lot on the plat. Written acknowledgment from the appropriate state department will be required to alter or remove the well. It is recommended that you contact the Colorado Division of Water Resources at 303-866- 3587. A small portion of the southern lot lies within the floodplain. It needs to be clear where the structure or structures lie within this floodplain boundary. If there are to be any type of structures within this boundary, a floodplain exception permit may be required. Five feet of right-of-way dedication will be required along the frontage of both lots. If a plat is processed, the right-of-way dedication will be noted on the plat. If a lot line adjustment plat is processed, the right-of-way dedication will be an easement. Should you choose to proceed, the next step would be to submit 18 full size (24X36) sets of the plat. Staff will refer the plat to outside agencies for comment. Depending on the type of plat (lot line adjustment or minor subdivision), the process will vary. A minor subdivision will require a public hearing before Planning Commission, who will make a recommendation to City Council. If the plat is approved either administratively or by City Council, a mylar copy must be recorded with Jefferson County. Final Plat: 2 - 24"X36" Final Plat hardcopies, plus a CD-ROM containing the Final Plat in an AutoCAD® DWG format. City-based bearings/coordinates shall be used per Section 26-407-D-6 of the, Municipal Code of Laws (please see Note 2 below). We anticipate the resolution and sale to be complete by the end of September. We intend to build one single family structure on each of the lots. We are working with the National Renewable Energy Lab, based in Golden, to develop a `zero-energy' house plan for the house on the north lot. The north lot is currently 64' wide, while the south one is 91.5' wide. We would like to move the lot line to the south 13.75', making both lots 77.75' wide. This will allow greater flexibility in placing the `zero-energy house' in optimal position on the north lot, as well as preserve the root systems of the trees on the north edge of the property. I have included both a stamped improvement survey of the property as well as a site plan showing the reconfigured lot line and possible building locations.
